let's take you through a time line. 10:00 last night, her 14-year-old son and-year-old daughter were in bed. her 18-year-old son was on his phone. the mother goes to sleep. by 1:00 in the morning, police say he burst into his mother's room demanding car keys. he takes her purse, gets the keys and leaves with the car. the mom calls police to report the stolen car. while inside the house to get the registration, the 14-year-old realizes that his 7-year-old sister is not in her room. the mother finds the 7-year-old in the basement unconscious with a bag on her face. the mother rushes the child to officers who perform cpr and take her to the hospital. the stolen car was found blocks away after it crashed. the son was gone but show issed up at the police district at 11:20 a.m. >> he locked himself in the back of the police car there. when officers found him, he did something stupid. >> he is facing multiple charges

including attempted murder. his sister is on life support at st. christopher's hospital. she's believed to have been strangled and suffocated. reporting live, nbc 10 news. more breaking news this out of burlington county. police arrested a teacher for allegedly take iing pictures an video up girls skirts. eric howell concealed a camera in a coconut water box and put it in his briefcase. he walked up next to girl and carried his suitcase so the camera could see up the skirts or shorts. what a difference a day makes. we were stuck in the 60s now as

we take a live lock at university city. 79 degrees and sunny. over in camden, more clear skies and sunshine. let's check in with meteorologist glenn schwartz with more with a lock at what we can expect in our neighborhood. >> about time we can see the whole skyline of philadelphia. it's been awhile since we have been able to say that. a lot of sunshine during the day today. great visibility after that morning fog. not much on the radar. there are some storms down by washington. and also in central and western pennsylvania and our area. we have this one little shower going into the poconos right now. that is about it. the activity in western pennsylvania continues to weaken as the sun starts going down. and the remnants of the washington storm may graze southern delaware, but computer models show it continue to weaken. there's that action east of allentown and so we're in pretty good shape for the rest of the night. 79 degrees, we did hit 80

degrees today. allentown hit 80. not quite as warm at the beaches. 18 degrees warmer than it was this time yesterday. in allentown and trenton, 17 degrees in philadelphia. that is pretty impressive. and we're to stay near that 80 degree mark for awhile. as you can see into tomorrow morning, no fog issues. some real nice weather until a part of the weekend. we'll tell you more about that coming up. just one day before this little boy would have turned 5 years old, a jury could not decide whether or not his father killed him. tonight dj creato remains held on $750,000 bail in his son's death after a jury could not reach a decision in the murder case. the body was found a mile away from his home in 2015. creato killed his son because he

was scared his girlfriend would leave him, but brendan wandered away and suggested a stranger was responsible. zillion cydney long has been fo the story. she joins us live. the jury left the courthouse today under tight supervision. >> reporter: that's right. jurors slipped out of a side door without saying a word to anyone. they were being chaperoned by sheriffs deputies. e we did talk to those attorneys and loved ones close to the case and willing to comment along with the heartbroken residents of nearby haden township. after being stoic for six weeks, he let out a deep breath he looked up as if in prayer and looked to his parents for their reaction to dead locked jury of his peers. >> d.j. is upset. he wanted to go home today and be with his family. it's a tough case. they gave it their all.

>> not the boy's mother, nor prosecutors nor the parents. >> any relief? sdwl no comment right now. >> reporter: could put their emotions into words. we asked the defense attorney why he thinks the jury asked repeatedly to see the police interrogation and then got stuck unable to reach a verdict. >> these are such sense ty facts. i understand. >> reporter: a quick ten minutes from the courthouse blue ribbons still hang on homes along cooper street and people here mourn again. >> it's just a shame really. just for justice for brendan. i went to school with sam. >> reporter: one woman learned the outcome when she saw something beside the bench. >> there's a decision made and i'm scared to know what it is. >> reporter: she returned texting us balloons she placed

in honor of brendan who would have turned 5 tomorrow. >> seeing something like this happen, you have heard of anything like this. just to have answers would be nice. >> reporter: and d creato's bail remains at $750,000. but the defense attorney does plan to ask for a bail reduction. the prosecution has also said it has every intention to retry this father on these charges connected to his son's death. they will return here to the krours on july 5th. cydney long, nbc 10 news. now the question what is next in this case? first, lawyers will have to select a new jury. this will also give both sides a chance to retool their argument and figure out why jurors weren't convinced the first time. we asked the criminal defense attorney who is also a former prosecutor what might change next time. >> i think the prosecution may try to focus more on aspects of

the case that make the jury more comfortable to convict a father of killing his child other than we ruled out anybody else who could have done it so it must be this guy. >> the judge set july 5th to discuss the next step. the mother of six girls allegedly sexually abused by a man testified at his trial today. the mother told a jury she knew lee caplin was having sex with many of her daughters after she and her husband gift ed the girs to him. caplin fathered two children with one of the girls. caplin's lawyers say the girl's parents took advantage of the man's generosity and forced the to lie about the abuse to keep themselves out of trouble. this started as a special sendoff with a lot of hype, but the first direct flight ended with a detour. a technical issue prompted them to divert the flight to boston.

icelandair says mechanics couldn't find anything wrong today, but the pilots want to do a test flight any way. a reporter on board spoke to us by phone about yesterday's ordeal. >> everybody was cool and calm and collected thanks to the staff. they definitely kept them happy and gave us lots of wine. >> philadelphia mayor who is also on the flight tweeted this afternoon still best in-flight meal i ever had. thanks for handling with excellent customer service. in new jersey three airports are getting more than $5 million to enhance safety. atlantic city international, cape may county airport will receive is the funding tr the federal aviation administration. atlantic city international will see the largest piece of the pie. it will go towards new fencing

it's a growing problem that puts you at risk every time you get on the road. the nbc 10 investigators show you the the dangers of drugged driving last week. now nbc 10's tim furlong shows us the issue is now getting much-needed national attention all because of tiger woods.

>> for possibly the best athlete to ever play his sport to asleep behind the wheel on the side of the road, tiger woods was quick to point out he was not driving drunk over the weekend. he was overtaken by prescribed medication including vicodin. dr. oz. says any one med could be trouble. makes mixes could make it worse. >> you didn't think it was going to be an issue and you're asleep on the side of the road. >> reporter: tiger's is the highest profile bust, but not the only one. the governor's highway safety association says a recent study they found more than people had drugs in their system than those who had alcohol. it gets tricky because there's a difference between prescription medication and illegal drugs. >> this is a new issue for us. >> reporter: the delaware office of highway safety drunk aggressive and distracted driving is a huge, but drugged driving is a major problem.

you can see the state is running a drugged driving campaign reminding them they are still impaired driving. they can tell if you're impaired by drugs or prescription meds. >> reporter: if you're allowed to take what taking, you're responsible for what you do on the roads. >> impaired driving law is comprehensive. it's for alcohol and drug impairment as well. >> reporter: maybe tiger's story will be the beginning of a conversation that will update laws and save lives. tim furlong, nbc 10 news. under age drinking is on the rise among 10-year-old kids right here in pennsylvania. the state liquor control board released a report on underaged drinking today. that report says while the preteen group's numbers are troubling, binge drinking was down overall. pennsylvania now ranks below the national among 10th through 12th

graders. need medical care? this new health center at temple university hospital will provide services for patients who don't need to be admitted. the center is located right next to the emergency department and will offer primary and behavioral health care as well as family planning. a makeover for the health system as it plans to change its name and buy five local hospitals including pups. ed. looking for something to do tonight? why not go to the outdoor movies. it returns to fringe arts. tonight's movie is the 1980s classic "caddieshack." catch a different movie every night through the end of august. a live.

even those might miss allentown. 9 at the airport in philadelphia. it's going to be pretty close to these temperatures at this time tomorrow afternoon and friday afternoon and a great night for the movies outdoor. not only tonight but the next c couple nights as well. it was only 62 for the high yesterday. and not much in the way of rainfall. that's for sure. not around here. one shower up by the poconos. we had one in chester county. one is in pennsylvania. look at all the sunshine here. not only that, 76 in chest hill. lan hong at 77. easton, 77. allentown, 77.

a west wind is going to allow the jersey shore to stay warmer. 76 in long port. 78 in avalon. 0 at the beach. that is quite a change. through the weekend, everything is getting pushed back a bit. that allows for a better weekend. saturday is looking dry. philadelphia at the jersey shore, 74 and a land broez before the sea breeze kicks in. sunday not as warm at the shore, but it looks like the showers may hold off until very late sunday or sunday night. now there will be differences at the shore. but the next three days, look at that. temperatures in the 70s. so we have some really good news
