feltonville. today the department's commissioner said an independent witness tried to intervene and stopped the man from pulling his weapon on the officer only seconds earlier. >> he said he himself looked the guy in the face and said, don't do it, man. don't do it. and as if to say, don't pull that gun out. >> reporter: but the commissioner also admits today unanswered questions linger. investigator say shortly before 7:00 last night the officer saw the man riding recklessly on this red dirt bike and felt a m gun in the man's waistband during a search. that's when both the officer and witness told the man, don't do it, don't grab the gun. police say he did, anyway, and a violent struggle ensued. after clearing a jam in his own weapon, the officer fired as the man ran south on whitaker away from the scene. >> [ bleep ] -- he's -- >> reporter: last night outraged family members were overcome

with emotion. >> he was a good boy. >> reporter: police tell us the gun in that man's waistband was loaded. the question, whether or not the officer was justified on firing on a fleeing suspect. >> he is running ahead of the officer and he discharged from behind. so that's a piece that we want to look at very closely. >> reporter: the commissioner says video from a different vantage point of the moments before the man fell might provide that critical context. >> we should note the officer involved in this shooting was driving people who were part of an unrelated case where all of this unfolded. it was one of those passengers sitting in the officer's patrol car who was the witness quoted by the police commissioner. a witness who had a very close-up persecutive on how all of this happened. >> george spencer. a man who got into a violent confrontation with a tow truck driver trying to repossess hi girlfriend's van is dead this evening. it happened in point breeze at 18th and dickinson just before

take a look here. this deer left behind a trail of destruction in a pennsylvania paint store. surveillance video captured it all showing the young buck leaping right over a displayened then running around the mount pocono's store. caused a few thousand dollars' worth of damage. apparently made it out of the store anded animal seemed to only have a small cut on its head after all that. wow. helping those who need it most. that's exactly why two texas police officers are being called heroes this evening. they bought an air conditioning unit for a 95-year-old man. the officers responded to a call

will be willing to testify under oath about james comey. what's the likelihood that we'll ever see that happen, do you think? >> reporter: well, it's certainly a possibility. you have democrats who are calling to that, jim, thanks for having me on today. we'll see if that actually happens, but i think one of the biggest takeaways from the day is that yesterday you saw a president trump who was very disciplined in his messaging. he didn't go on twitter. he didn't comment on comey's testimony at all throughout the day. in fact, he outsources that, left that to his outside counselor, marc kasowitz, and today a very different tone from this president. went back into campaign mode, took messaging into his own hands. woke up to that tweet effectively saying he was vindicated, and that james comey was a leaker, and disputed a number of allegations from yesterday. of course, the question is, how can heish vindicated if james

comey is, in fact, lying about some of their interactions? we saw him very defiant today. not only saying he's willing to testify, but really pushing back forcefully against some of what james comey said yesterday. particularly that he's asked for a loimty pledge from james comey and called on comey to drop the mike flynn investigation. a preview what we can expect to see from this president and his top surrogates, and you pointed out, he dangles the possibility that maybe tapes exist. potentially trying to put pressure on james comey. i think that the pressurer going to build for him to give a real answer about that. you have calls from congress for him to actually say whether or not those tapes exist. some here within the administration concerned be a the president taking such an important, grave matter, into his own hands and, of course, are urging that everything and all of the messaging goes through his outside counsel. he's going to spend the weekend
