consensual encounter. cosby told the judge he would not testify in his own defense. deanna durante was in the room for closing arguments and she has the latest. >> reporter: andrea constand sat just feet away from camille cosby, the wife of bill cosby. defense lawyers told the juror that cosby had a secret fling with constand and he didn't want his wife to know about it, they also laid out a story in which constand was lying. they were lovers and bill cosby didn't want his wife to know. that's what his lawyer spent two hours trying to stress to the jury. a number of times saying cosby was investigated and cleared in 2005 because the district attorney then found constand was lying, giving inconsistent stories and changing the dates of when the assault allegedly happened. the closing argument was

powerful. he's begging them to end this case. he says constand is lying and so is another accuser who testified about a 1996 assault and they say the only reason the case was carried out is because cosby's 2005 deposition where he admitted to getting quaaludes in 1970 was unsealed. it had nothing to do with party drugs and there's no proof that's what he gave constand. camille cosby sat on one side of the courtroom, constand on the other. perhaps the first time the two were together in the same room. up next in late afternoon is the z-rigt attorney for his closing argument. he was kevin field who in his election bid to become d.a. promised to get bill cosby in a campaign ad. he's going to spend the rest of the afternoon trying to convince them to convict him. deanna durante, nbc10 news. >> we'll hear from deanna live in a few minutes.

but first, again today cosby brought his wife camille to the courthouse for this last day of her husband's testimony in this trial. we spoke to bill cosby's spokesperson about the significance of that. here's what he had to say. >> she came in holding his hand. you got to see her. it wasn't a show. it was real. it was real love. 53 years that they have been together and she was here to show that i'm not going to stand for this -- i'll stand by my husband no matter what they try to paint him, i'm sticking by him. >> coming up at 4:30 our nbc10 news legal analyst is going to be joining me live here from the courthouse to talk about cosby's wife camille showing up to the trial today. what her appearance could mean for his defense? right now i want to get right to

deanna durante. you were in the courtroom. you just came out. where do we stand at this point? does the jury have the case? >> reporter: not yet. right now is a very critical time for the jury. this is when they're instructed on the law. everything they've heard, the evidence the opinions of the lawyers, they will take that but they have to apply it as the way the law is written when it comes to these three counts. >> they haven't gotten those instructions yet. >> the three counts are indecent aggravated sexual assault and they all apply differently whether or not andrea constand was conscious, whether she was given this drug that he described in his previous sworn testimony and whether or not she was able to consent and one thing that kevin field the d.a. hammered, he spoke for almost two hours telling them that the words of each of them should come into play here. bill cosby who never took the stand but his deposition when she sued him in 2005 as well as his police reports in 2005. she never said yes but he just

went for permission physically, touching her in different areas. she never said yes. andrea constand's own words on the stand, she never consented to any kind of sexual activity with bill cosby. kevin field wanting to make sure that the jury really got that even putting up the transcripts already of what andrea constand said last week, that she never said yes to any kind of sexual activity with bill cosby. >> talk to me about that moment when bill cosby confirmed for the judge that he would not testify in his own defense. >> typically that happens outside the presence of the jury but cosby's a comedian. he waved can you see me now, judge. can you see me over here? this was all outside the presence of the jury and it's what they call colloquy. it's just very quickly a couple of questions. have you talked to your attorney, are you confident with your legal advice, do you want to take the stand in your own defense? no. is this your own choice? yes. i do your honor, very quick and

then they move on. >> camille cosby in court today. she walked into that courtroom. we haven't seen him with any of his family members at this trial until today. >> it was very significant. this has been a very controlled trial. this is not your typical trial. once the doors are closed, people cannot come in. those doors were closed and bill cosby walks in, then camille walks in. walks in front of the gallery and sits down the defense side of the courtroom there, but she did not return after the lunch break. >> she did not. so she was there for the morning session but not this afternoon, but again the first time we've seen her with her husband of 53 years during this trial. the defense team trying to say that the family didn't show until now because they wanted to shield them from the media circus and everything that's going on here -- >> that's what his spokeman said on friday. >> you go back in. you'll listen as the jury is instructed, correct? >> at this point i think it's too late for me to get back in

because the doors will be closed. i came out here to give you an update. the judge is assuming it'll take about 45 minutes to an hour to charge the jury. this judge does choose his words carefully. the jury's ordering dinner right now and we're expected to be here until 10, 11:00 tonight. >> thanks for that insight and coming out here to know the latest. at 4:30 we'll be talking to our legal analyst at about the significance of today's events including camille cosby coming here to court with her husband but for now let's send it back to our nbc10 news shud yoe and erin coleman with other news of the day. >> we got breaking traffic news to get to. this along the northeast extension of the pennsylvania turnpike. the northbound lanes still closed. still shut down because of this crash in montgomery county. a truck and a tractor-trailer, you can see there collided. this is in green lane. it happened around 12:30 this afternoon. a driver was trapped in all of

this. and he is in there. you can see him in there in the red shirt, in the cab. he was not seriously hurt but again the northbound lane still closed at this hour. we'll continue to monitor this breaking traffic news and we will of course let you know as soon as they reopen. the heat is on. nbc10 news in drexel park as these people soaked up some raise today, the baking sun even force issing some four legged friends to conserve as much energy as possible. take a look at our camera off the marquis de lafayette hotel. many folks trying to beat the heat, we just learned in the last hour that philadelphia schools will close early tomorrow because of the excessive heat. students will be dismissed at noon. our first alert team coverage begins with krystal klei who is live outside the studios with more on this record breaking heat, krystal. >> reporter: we're on day two of

the 90s. tomorrow will mark the third day of the 90s. the official heat wave. in the shade is not as bad in the direct sunshine. it is toasty outside across all our neighborhoods. take a look at the records on the left side of the numbers and on the right side the highs so far seen today. i wouldn't be surprised if one of these or two bump up another degree. we've made it to 94 degrees, one degree short of tying a record. atlantic city tying the record already, 93, allentown tying the record at 92 and you see very close calls in areas like reading, trenton and wilmington. across the board all of us in the 90s except for pottstown, wildwood. areas like dover 93 and trenton 92 degrees right now. hot across the board. let's talk future temperatures here so if we go throughout the evening hours, it stays hot.

into russian meddling in the 2016 election. sessions will face questions about his contacts with russia's ambassador to the u.s. during the presidential campaign. the white house today declined to say whether the president agrees with sessions' decision to testify. >> he believes that the sooner we can get this addressed and dealt with that there's been no collusion, he wants this to get investigated as soon as possible and been done with it so he can continue with the business of the american people. >> attorney general sessions recused himself when he admitted to having two meetings with the russian ambassador during the campaign. president trump met with his cabinet today at the white house. it was his first meeting with his entire cabinet present. during the meeting, trump criticized senate democrats for delaying the confirmations of his cabinet members. meantime first lady melania trump and son barron are now living at their new home the

white house. this is video of them arriving with the president last night. mrs. trump and barron were living at trump tower in new york until he finished the school year. the first lady tweet aid new picture of the view. looking forward to the memories we'll make in our new home. from the white house to wedding crashers, still ahead on "nbc10 news at 4:00," the surprise appearance from president trump at a new jersey couple's reception. right now 18 penn state fraternity brothers are fissing charges after a pledge died from a hazing ritual. keith jones is live in the breaking news center with more. >> reporter: police detective who saw that video says 19-year-old timothy piazza looked dead. he looked like a corpse. today the fraternity brothers accused of the case arrived in court for a preliminary hearing. the hearing will decide if there's enough evidence to send the case to trial. the detective talked about the

surveillance video on the night of the pledge event at the fraternity house. that's where timothy fell several sometimes and fell unconscious at one point. the video also showed the frat brothers carrying him upstairs the morning after. the officer also said the video showed piazza was clearly hurt after his first serious fall which happened at 11:00 that night. by 3:00 a.m. he was left alone on the couch but he tried to get up again and walk again before falling several times. prosecutors say they didn't call for help after 12 hours. piazza later died from brain and stomach injuries. eight of the brothers charged, other charges included aggravated and simple assault. penn state permanently banned the frat back in march and announced last month changes to the entire greek system at the school. live in the breaking news center, keith jones, nbc10 news. >> new details on the investigation into a crash that killed a philadelphia woman who was trying to protect her

children. this afternoon we are getting our first look at a driver charged in that crash. police today released a mug shot. his suv jumped the curb along ar mingo avenue hitting and killing linda rojas. she shielded her son and pushed her daughter out of the way. he faces dui and manslaughter charges. orlando, florida is pausing to remember the victims of the deadliest mass shooting in u.s. history. 49 people were murdered at a gay nightclub in the heart of the city's downtown, among them a teenager from our area. ♪ >> the orlando gay corrus sang at this memorial service on the grounds of the nightclub this morning. this service just one of several being held in orlando today. the owner of the pulse was on hand. >> we are here to honor our

celebrating the anniversary of her death. the memorial basketball game features some of the top girls players in the region. doors open to the public at 6:30. new jersey governor chris christie says sports betting could begin very quickly in the garden state if the u.s. supreme court allows it. the governor wants to legalize sports betting at racetrack but a federal law bans sports betting in every state except delaware, montana, nevada and oregon. the high court could hear arguments on the issue before the ends of the month. betting could start within a week if the ban is lifted. pension reform is center stage in harrisburg. while reducing its pension debt. the state is $75 billion in debt when it comes to paying retirement for state workers and teach. under the new law workers will

have three different retirement options by 2019. two new jersey state troopers rescued a child and a dog from a hot car. the two were called to hammonton township after a woman accidently locked her grandson and this 2-year-old puppy inside her car. the trooper's had to break the car window to get them both out. the child and dog are fine. speaking of the heat, the heat is on across our area as we take a live look from our camera. meteorologist tammie souzza with us now. it is hot and the heat's sticking around for a bit. >> it's sticking around. it looks like it's going to stick around another couple days before we get a break in the heat. you can see the moisture in the air. we do have a haze that's out there. you can feel it too. maybe you want to go to the beach. look at all these people out there looking for relief. 88 right now in cape may. it was actually 91 last hour. the winds out of the south at 14

miles an hour. the ocean water is 63 to 65 degrees depending on where you are. that's what knocked the temperatures down just a little bit. the air temperature right along the shoreline. in philadelphia it's 94 right now with west/southwest winds to 13 miles an hour and if you want real relief go to mt. pocono where it's 83 and a west wind to 17 miles an hour. we have issued a first alert and it's because we have a heat advisory tomorrow from noon to 7:00 in the evening. we also have an air quality alert. the feels like temperature tomorrow will be between 95 and 100 so you need to take it easy. never, ever, ever leave pets or kids in a car and drink plenty of nonalcoholic fluids. pace yourself tomorrow. the air quality we have high ozone levels out there. it's a code orange so it's unhealthy for sensitive groups including the elderly and maybe small children. limit that outdoor activity if you are somebody that has sensitivity to all of the air quality. right now it is 92 in allentown,

welcome back. i'm jim rosenfield live at the montgomery county courthouse in norristown waiting for the jury to get the case. bill cosby's wife camille made her first appearance at her husband's trial today. jurors are getting jury instructions from the judge. cosby's lawyers rested today after calling just one witness to the stand, that lone witness, a detective who reminded jurors that cosby's accusers had visited him out of state. cosby then told a judge he would not testify in his own defense. we're joined right now by our legal analyst, thanks for being here this afternoon. let's talk first of all about optics, camille cosby coming to court with her husband for the first time since this trial began. how does that play with the jury? >> it was definitely planned. she was there. not only was she there but the defense pointed her out and said she deserved better. their whole point was to show

the court, she's here and standing by her man. even though she's standing by her man, he's innocent and didn't do anything and when he can stand by him there must be something there that he's innocent. >> 53 years married. no other family member appeared here with cosby until today. we did see some of his costars last week and other celebrities if you will. let's talk about the defense strategy today butting one witness on the stand and it's not bill cosby. what do you think about how that strategy played out? >> i definitely think in a place like this, they made a very conscious decision to say the prosecution has not made out their case. defense attorneys have done it before. they haven't met any of the elements of their case. let's get this over with and get to the closing. there's no way whatever they met any of the elements here. this is what the defense believes in this case, that it

was a he said/she said case. they believe it came down to credibility. they believe in the cross-examination of the prosecution's case that they had done enough and there was nothing more to do here. with we're not going to wait any more of your time. >> the jury gets their instructions from the judge. he'll instruct them on what the burden is to meet a guilty decision and do they begin deliberating immediately? >> right now this is the most boring part of the case. sitting there while the judge goes over the charging and all the elements and details of the crime. very boring for the jury and all the parties involved. the judge may say, depending on what time it is, i'll go ahead and allow you guys to retire for the night and come back tomorrow and start with deliberation or he may let them get right into it. a lot of time judge's will ask the jury what do you want to do. >> we know from deanna durante they've already ordered dinner

some parents of prematurely born babies worry about their
