at any moment, the jury could return a verdict in bill cosby's trial. will they find america's dad guilty of sexual assault? right now at 6:00, last-minute appeals to the public. >> what andrea constand has done is not been truthful. >> we don't think the courthouse dor should be shut in the face. >> what the second day of deliberations could mean for cosby's future. nbc 10 is bringing you live coverage from decisions just as soon as it comes down. good evening, i'm jim rosenfield live once again . back in 2004, here's the latest today. the jurors asked the judge three questions one was about cosby's dependence testimony. they also. wanted a definition of the language used in the third

felony charge, but the judge could define that for them. they requested to hear the testimony of a police officer who took a report from andrea constand at her home in 200 5. a spokesman for bill cosby addressed the media. the defense hoped to call a potential witness to the stand yesterday. but you may recall the judge did not allow that calling her statement hearsay. deanna durante was inside the courtroom today. she's bricking us all of the late breaking developments. tell us about it. >> reporter: cosby's spokesperson came to the steps a few moments ago giving another statement saying his wife will not be in the courtroom when the verdict is reached. and again, this case boils down to what cosby says and what his accuse sor has said as well. they remain confident the comedian is upbeat and happy with the questions the jury is

asking. they had page asks pages of his 2005 deposition read back to them. the graphic explanation of what he says are consensual sexual encounters with andrea constand. she sat in court listening to the judge. she was stone faced and stared straight ahead and offered no reaction when he talked about sexual encounters he had with her. cosby's lawyers have not commented publicly on the case, but a spokesman has taken to publicly attacking the judge in the case accusing them of blocking a a witness the defense wanted to call in part to discredit the testimony of andrea constand. about those questions the jury is asking, they asked about one term in the criminal charges without her consent. they wanted that defined. the judge said he couldn't. two jurors in the back very expressive shaking their head saying they didn't want the charge reread to them. late today they had the entire testimony of a police officer

read to them. the very first police officer to take andrea constand's report of sexual assault. that's the latest, deanna durante, nbc 10 news. >> they are still deliberating behind you now. >> reporter: they are, normally we get an update when they are eatinger. we have not gotten that update yet. we are expected to be here late into the evening. >> yes, we are. thank you. this afternoon bill cosby's spokesman spoke to the media outside the courthouse. he says the defense hoped to call that witness to the stand yesterday, but the judge denied that request, as we have been telling you, calling it hearsay. wyatt read a statement to reporters and handed out a hard copy. it was from a woman from temple university. jackson alleges andrea constand told her she intended to set up

cosby. listen to wyatt read a portion of that statement. >> i did ask andrea constand if what she said really happened. her response was that it had not happened, but she could say it happened and file charges. file a civil suit. get the money. go to school and open up a business. >> again, the jury heard of that statement. they know nothing about it. andrea constand testified she did not know ms. jackson. coming up later in the thaft, we'll speak with a retired judge about today's events and what they could mean for the outcome of this trial. in the meantime, back to my co-anchor in the nbc 10 studios with other news of the day. >> a lot of anticipation out there. jim rosenfield, we'll see you shortly. sky force 1 is live over breaking news. medics are responding to south high school for people who are overcome by the heat at

tonight's graduation ceremony. several is are being evaluated for heatstroke. no one has been taken to the hospital at this point. we'll continue to monitor that situation and let you know it we learn anything new. across our today, it was too hot for school. thousands of philly students can thank mother nature for an early dismissal. students among others in the deval lee were released at or before lunchtime today due to extreme temperatures and older school buildings that just get too hot. city pools are not open yet and for families with  air-conditioning, it's a tough task without air-conditioning, it's a tough task when temperatures skyrocket. >> you can't keep trap ped in te house because they get agitated. you have to find something to do. it's very hard in the city with the pools not being open. >> very few dined outdors and the temperatures peaked around lunchtime for those exercising or toor you aring the city,

temperature ever recorded for. so we got a little bit of relief at the shore with an afternoon sea breeze. and the winds, that is going to be changing dramatically. so certain that things are going to cool down. i'll tell you how long the cooldown will last and when the rain comes back in just a few minutes. appalling lie, the words jeff sessions used to describe allegations that e he or anybody in the trump campaign colluded d with russians. lauren mayk attended the senate intelligence committee hearing ask joins us live from capitol hill. >> this was jeff sessions opportunity to separate facts from fiction, but it was also chance to clear his name today.

but it was the questions that he did not answer today that led to some testy exchanges with some of his former colleagues here on the senate. this hearing happened in the same room where former fbi director jim comey testified last week. the attorney general addressed the plans that at one point the president cleared the room for a one-on-one conversation. and that comey told the attorney general not to let that happen again. jeff sessions said today that that in itself, that conversation was not problematic. but there are rules about communication with the white house. on russian interference in the election, jeff sessions that had he had no knowledge of collusion with the trump campaign. >> the suggestion that i participated in any collusion that i was aware of any collusion with the russian government to hurt this country which i have served with honor for 35 years or to undermine

thety of our democratic process is appalling lie. >> now there were points when the attorney general would not answer questions about his conversations with the president. here's one of those exchanges and how marco rubio responded to them when i asked him after the hearing. >> senator kain -- >> i understand that, but the president hasn't asserted it. you said you don't have the power to assert exec privilege. what's the legal basis for your refusal to answer the questions. >> i'm protecting the right of the president to exert it it he chooses. >> i think that's understandable for an attorney general. obviously, he's recused from the russia investigation. and so the likelihood it was involved in russia as well and unless he violated the law in which case i have no evidence of that.

no unelse does either. >> now that is senator rubio's take on things. a republican, but i just caught up with democratic senator cory booker from new jersey. he was disturbed by jeff sessions not answering the questions. he's going to look into whether or not he has a right to not do that and it e he doesn't, she should be held in contempt of congress. >> we'll see what happens with that. >> police say a local doctor pulled a gun on them while they served a a search warrant at his office this morning. nbc 10 shot this video in egg harbor township after a negotiator talked dr. coughman into surrendering. today's search is not related to the unsolved homicide case but would not elaborate. >> in connection with the search warrant, i can say it was not related to the death of april

welcome back. i'm jim rosenfield live outside the montgomery county courthouse. still awaiting a decision from this jury. the bill cosby sexual assault trial. but just moments ago, we heard from bill cosby's spokesman about how he's feeling as he waits on this jury. >> he's being bill cosby. just taking it in the moment, believing that these jurors are looking through the facts, seeing the truth. >> and for more perspective, we want to bring in court judge one last time. thank you tr being here.

e we know the jury has asked three questions today. they have been deliberating all day. walk us through what the judge might be thinking as it seems this case is moving toward a conclusion. >> you have to remember that the judge started bonding with this jury over a week ago when this trial started. the judge has repeatedly probably e reminded this jury how they are and how he wanted to work with them. you tell the jury in your preliminary instructions and final instructions this they are the judges of the facts. you are the judge of the law. and that you put those two things together to arrive at a verdict. you want them to know as hard as you're work ong the case that you appreciate all the effort that they are putting into the case. if you're a judge now you're waiting to see if they are giving you any insight or thoughts they want to wrap it up tr the day. it's been a a long day. they have been deliberating since 9:00 this morning. you want to hear from them on that. last time they were in and e he

answered a question, you reminded them of that. if not and if you don't hear from them for awhile, you might have your sheriff bring become a note and tell them when you want to wrap up for a day, let me know. ut to make them known you are appreciative and there's nothing wrong with the fact they have gone this long without a verdict. you have them to have a bond with you so they know they are working with you, and you don't want to lose them or let them see you get frustrated in any way because you don't want them to get frustrated. this is a process. it takes time. there's discussion. there's conflict of testimony and you have to talk until they come to an agreement. so you want them to know there's nothing wrong with that and you want them to e know how much you appreciate the effort they are putting in the case. whenever they want to knock off for the night, that's fine for you as the judge.

taking a live look outside at university city. we are in the final stretch of this heat wave. we are expecting cooler temperatures tomorrow. but it is still steamy out there. >> yeah, it's going to a pretty steamy night too. by the time you get up tomorrow morning, the humidity will be down and tomorrow afternoon, it will be so much different. 95 degrees in philadelphia. we have lots of out there. the humidity is not especially high for this time of the year. we have a nice sea breeze. 80 in ocean city. . it got up to 90 at the beaches here. the wind shifts and it went down. it was a west wind earlier. ask they were up close to 90. now that sea breeze has gone inland. much cooler weather for the rest of the week. this isn't just a one-day thing.

we have a wet period on friday. covering the weekend although it will not be a washout. it's going to be warm to hot. and then it will be humid. speaking of thunderstorms, we got some near the border. but that's pretty far away. the showers are the closest ask still north ask west of the poconos. i don't think we'll have to worry about them. these are the low temperatures tonight. not very low. tomorrow the high of only 79 in chestnut hill. compared to the mid-90s. 70 in long port. over the next few days, we're seeing the temperatures below normal and here comes the rain on friday. for just about the entire, look how much cooler it gets at the jersey shore.

i'm john clark. the eagles started their mandatory minicamp. they lost power at the complex. take a look. the body guard is back. he skipped the voluntary workouts and says it's partly because of his contract. he has two years left. he wants the birds to rework his deal and retire as an eagle. he also says he was resting his body. >> i was just resting my body.
