kilpatrick, one of 12 inmates who escaped the lockup by using peanut but thor to trick a guard. he was found in st. maarten, florida, through a coordination between florida and alabama. his 18-year-old sister was also arrested along with her fiance and another family friend. authorities say the couple helped transport kilpatrick from alabama to florida and now facing criminal charges in both states. >> the head of the dea is making a startling rebuke of the president today following mr. trump's controversial comments last week seemingly condoning police violence. take a listen. >> when you see these thugs being thrown into the back of a paddy wagon, you see them thrown in rough, i said please don't be too nice. like when you guys put somebody in the car and you're protecting their head, you know, you put your hand over. like don't hit their head and

"new york times" and other outlets reported president trump is expected to direct his

department of justice to take on affirmative action in college admissions. the paper reports the administration will redirect resources in from the civil rights department to investigate and ultimately sue universities. it is a dramatic and unforeseen move and we're joined by tracie potts to get a sense of it all. tell us what's behind this announcement and what led up to it. >> here's what we know. "the new york times" published what they said they got their hands on an internal memo that seeks lawyers for a new project in the civil rights division that project focusing on investigating and suing colleges and universities whose admissions policies are demand to discriminate against white applicants. this would be and this is notable, this would be run by a division of the justice department that's full of political appointees of president trump and not the civil servants who normally deal with that issue. according to the "times," according to that memo, it targets intentional race-based

we'll adapt to it. >> reporter: rumors tillerson might quit over disagreements with the president. >> he calls me late at night on the weekends when something comes into his head and he wants to talk. i think if we're not having those differences i'm not sure i'm serving him. i would tell you the relationship between the president and myself is good. >> reporter: as for white house leaks blaming tillerson for widespread vacancies here at the state department, he said the diplomats he speaks to say help us fix all of this. that said, today he'll be meeting with republican congressional leaders about a range of issues including his proposed budget cuts which had he say are way too drastic. >> all right, thank you very much. we've been talking about the extreme temperatures especially in the northwest. look at the extreme measures they had to take at the oregon zoo. the animals doing whatever they could to stay cool. today and thursday the zoo will close early when temperatures are expected to top 105 degrees. that's helpful to the people

staffer. >> nbc's ron allen has more on how the suit goes all the way to the white house. >> reporter: good morning. how are you? as you mentioned, some of the lawsuit, makes pretty dramatic claims. some of its allegations go all the way to the white house. the man suing fox news is named rod wheeler, former washington, d.c. detective who is now a private investigator. wheeler was looking into the murder of a young man named seth rich, a 27-year-old staffer at democratic national committee shot and killed in july of 2016 during the height of the campaign. and a couple of weeks before those damaging e-mails about hillary clinton hacked from the dnc began pouring into the public. his lawsuit claims a fox news reporter made up quotes from him for a story that essentially said that seth rich not russia, was responsible for releasing those controversial dnc e-mails. and that somehow his murder was connected to all of that. according to the suit, it was a fake news story conjured up to "help put to bed speculation

that president trump colluded with russia in an attempt to influence the outcome of the presidential election." here's where the white house and president trump allegedly get involved. wheeler was being paid by a trump supporter and fellow fox news contributor named ed butowsky to investigate the murder. ed said he wan odd help the young man's parents solve the case. wheeler's lawsuit claims bu 2000cy told him the president knew all about the fox news article and butowsky urged wheeler to go on air and talk up the theory that the not the rushes was behind the leak. butowsky said the president just read the article. he wants it out immediately. it's now up to you but don't feel pressure. >> another fox news alert. a huge bombshell in the murder of this dnc staffer. >> an investigator now says seth rich was in contact with wikileaks before he was

murdered. >> butowsky has not returned a call for comment but denied sharing the fox news article with the white house. here's reaction from rod wheeler the man suing fox news. >> first of all, i'm thinking why would the president have to review a sorry pertaining to the murder of a guy in dc. why would the president be involved in this. at that point, it was rather obvious to me that they actually lured me into this investigation. they meaning this fox news reporter and ed butowsky to substantiate this russian narrative thing or debunk that when in fact they told me he was really getting involved just to solve a murder. >> fox news retracted the story a week later after it ran. a statement from fox news president jay wallace says in part the accusation fox news published the story to help detract from the coverage of the russia collusion issue is erroneous. the retraction of the story is still being investigated internally. the white house claims the president was not involved.
