septa train slams into a parked rail car. more than three dozen passengers injured. the second crash at the same location in a matter of months. >> february we had another incident behind here on the curve. >> leaving commuters with plenty of concern. >> look deeply in what is going on. >> we need to find out what is going on. >> this afternoon the mayor of upper darby township is raising a red flag about safety for these trains. >> the rail cars moved in and out of the busiest transportation hubs in the philadelphia area. >> e we want to update you with what we know about the crash. 42 people were hurt when a a high speed line train crashed into an up occupied parked train at the 69th street terminal. the national transportation board is on that scene investigating. among those things they are investigating if speed was a

factor. this is the second crash at that location in the last six months. the mangled mess of metal was unfortunately all too familiar for commuters at the 69th street transportationen center overnight. >> we have a team of reporters dedicated to this major story this afternoon. cydney long is working to learn more about the passengers injured. let's begin with steven fisher live in upper darby where the ntsb is now investigating. >> reporter: the crash behind me habit changed much behind me. you can see what's going op. but the ntsb is out here investigating trying to figure out how this happened. until the train with the caution tape can be removed, the line will continue to experience some delays. this was the scene just after midnight at the transportation center in upper darby. emergency crews raced to the station after an occupied train from the high speed line crashed into a parked train.

>> there was a a train coming out of norristown, which is coming east into the terminal and it struck a parked train that was sitting there for the morning. >> for a a short time, the transportation hub came to a halt. 42 people were injured and had to be taken to various hospitals. >> when you're going a certain speed and you can't control it's scary. >> my daughters picked me up and drive me. i'm not going to ride it. as the ntsb investigated, we spoke to officials that said the norristown line was running every 20 minutes. a little slower than usual due to the crash. >> it takes a little longer. >> we caught up with bill at the 69th street station.

the crash is concerning, but he doesn't have a choice. >> there's been no information about how fast that train was moving when it crashed. we do expect to learn more at the ntsb. >> some of the 42 injured are still being treated a at the hospital while others were lucky enough to go right home. you spoke with doctors about the injured passengers and how medical crews prepare for events like this. >> that's right. in the attending trauma surgeon told me the train accident injuries could have been far worse. no concussions here. still they simulate or train on these emergency or disaster drills here every other week to be prepared.

the driver is all banged up and there was this one girl bleeding out of her face pretty bad. most passengers are improving and dozens have been released. >> most ly numbness to the limb, which at the end had no cause that was found from brain injury or spinal injury or nerve injury. so things that were just consistent with bumps and scrapes. >> in a a statement today, the councilman is sending his thoughts and prayers to all of the 42 injured septa passengers saying safety must be top priority for all transportation riders within our transportation network. we're live in university city, i'm cydney long, nbc 10 news. >> this is the second train accident at 69th street in six months. a market line train hit two out of service trains in february. four people on board the trains were hurt.

we check ed with the ntsb. the report on that crash has not yet been e relowested. and how that could have happened. turning to our weather, tracking a steamy and stormy night. >> the radar shows the threat for thunderstorms that will move in from the west. some could be severe. let's take a live look outside. the phillies are taking on the marlins in a doubleheader. the weather is feeling more like miami tonight. they enjoyed cooler temperatures today. the heat is what's helping fuel the threats.

>> 24 hours ago we put out this first alert for these severe storms. we're keeping it for the same areas. the lehigh valley, suburbs ask and philadelphia. as the storms go toward new jersey and delaware. they are likely to weaken because of the time of day. as they weaken later tonight damaging winds and small hail possible in parts of the area. the storms are a lock way away but they are pretty powerful. especially ones in new york state. it's a long way from here. 170 miles to the lead iing edgef those storms. these are severe thunderstorm warnings. there has been damage in western pennsylvania so it's something we're going to have to watch. here we are at 8:00.

it could be farther to the east. it's showing quite a bit of weakening. the clouds come through. but the threat of severe storms diminishes later on tonight. the biggest threat is north and west. more on the timing of these storms and what comes after that just a few minutes. >> we'll see you then. >> 20 minutes of nonstop news continues with local ties to a missing sailor aboard the u.s.s. john mccain. >> one of the members is from cherry hill. the naval destroyer collided with an oil tanker. a a total of ten sailors went missing. today the commander of the fleet says bodies were discovered in a compartment of the warship. lauren mayk is in cherry hill where the missing saylor went to high school. >> a lot of people are holding out. hope tonight.

it's philadelphia's soda tax driving customers out of the city. a new study shows that appears to be the case. the marketing from catalina look ed at sales. that firm found that sugary drink sales fell by 55% while sales at storesen wept up about 38%. the tax is raising $39 million so far. below the $42 million projection. we reached out about the l study and they tell us they are not gbuying it. they said while we think catalina is dramatically overstating the drop, we did expect e retail sales would be down in the first few months because initially people are upset, but they do the math and realize the cost of gas or the pure inconvenience doesn't make it worth it. pennsylvania governor tom wolf was republicans to return to harrisburg and balance the budget. he made the comment during a radio show in pittsburgh.

they support a plan that passed the senate last month. that plan relies on borrowing taxing consumers, utility bills and expanding gambling. house republicans say they are trying to come up with a revenue package that doesn't increase boar e rowing or taxes. students and teachers at an elementary school in mansfield will get a fresh start when the school year begins. >> 200 volunteers are sprucing up morton mcmichael elementary school. it's part of the school improvement project. they will renovate the teachers lounge into a recess room. in center city the boys and girls club stuffed this van with donated school supplies. the back to school vans was parked outside the center for three hours today. volunteers collected notebooks, pens and backpacks from flows and other contributors.

storms. number one threat, secondary threat in philadelphia then delaware and south jersey is much lower threats. that's why they are not in the first alert. 7:00 p.m. to 2:00 a.m., locally damaging winds, lightning and small hail. the storms quite a bit away even west of williams port. but there's some nasty thunderstorms. the worst of it going up into new york state. the orange areas, those are severe thunderstorm warnings that are in effect right now. that it leading edge is going 50 miles an hour. but even at that speed, it doesn't get to reading until 7:10 p.m. so it's got to hold together for quite awhile. even the western portions of the area. we do have more clouds and showers back behind that. but that's a cold front that's

bringing relief from the heat. there's 6:00 and it's still far away. 7:30, 8:30 showing you hour by hour with these computer models. and storms coming into this portion of the state but this is one of the cases where the timing helps us and overnight tonight there could be a few more showers. but there's no guarantee there's going to be any rain in parts of delaware and south enginejersey the way this is setting up. there is a guarantee that there's going to be relief from the heat. and krystal klei will tell you about that. >> thank goodness. we're look iing at the storms breaking the hot spell we have been under today. take a look at what it feels like across the region. most of us feel like we're around 100 degrees. all the way down to the jersey shore, 99 is what it feels like right now.

northwes northwest. the closest one is 150 miles away. here's the hour by hour. that's north of harrisburg. that's several is hours away and it weakens toward us. so we are seeing it weaken closer to philadelphia. that's why philadelphia is not in the watch right now. it has the threat for the thunderstorms later on this evening. and jersey shore is going to keep with the clouds. maybe a couple showers in the morning. everybody is going to be seeing relief from the extreme heat and we'll show you an incredible forecast. coming up in a few minutes.

today bill cosby returned to the montgomery county courthouse where a judge declared a mistrial in his sexual assault case. that happened two months ago. >> the comedian had a new legal team who has made a major change in how this case will play out when it's retried in march. deanna durante explains. >> unlike the case ended in a hung jury, it's bill cosby and his staff. the comedian sat quietly in court as lawyers met in chambers talking about the time line and the new defense would want to go five hours away to pittsburgh to select a jury. they defended michael jackson of his child molestation charges. now the civil rights attorney legal experts expect they are the ones to cross examine the accuser in the case who says he

drugged her and sexually assaulted her in 2004. constand is expected to take the stand at the retrial. because both lawyers are out of state, both will need to be sponsored by sam silver. he defended u.s. representative and graham spaniard. the district judge says a local jury may not react well to out of town litigators saying cosby should have a lawyer from the area at his tiable. but the new defense lawyers have a record of everything prosecutors did the first time around. >> they can examine what they said and if there's anything inconsistent, they are going to point that out. hoping to challenge their credibility. >> and that's why he says the defense has the upper hand when it comes to a retrial. some speculate it could be to buy more time or perhaps the lawyers for the defense just

there's a a push in new jersey to encourage grape growing because wine from the gartden state is apparently in high demand. lawmakers are considering incentives to get farmers to grow more grapes. they include low interest loans from the economic development authority and tax credits. camden county freeholder was also a lobbyist for wine growers says vineyards are struggling to keep up with demand.

center. it's a good thing that concert is inside because there's a a chance of rain tonight. even thunderstorms in parts of the area. >> let's get the latest from glenn "hurricane" schwartz. >> sometimes we have bad timing and the storms are on top of us right at this time of day when it's the hottest and most humid. they hold together. today we may have an advantage with the timing. because it's coming later. but the area is getting it first. lehigh valley and seuburbs especially, that's from 7:00 p.m. to 2:00 a.m. we put the first alert out for those areas 24 hours ago. and now there's a severe thunderstorm watch for pretty much that area until midnight tonight. it does not include philadelphia or delaware counties. includes every other county in pennsylvania. and as you can see, the leading edge of the showers are way west of harrisburg. and even though the showers are moving east fast, this first line is weakening.

that's in the middle of the night. these areas in the orange are severe thunderstorm warnings. if you take this leading edge, it's moving east. it's still enough to get to reading until after 7:00 tonight. so that's why there isn't much of a threat for a couple hours at least. so there are some tornado warnings right now and some showers back towards cincinnati. we're not totally out of it until we get through tomorrow morning. but here's the latest futurecast. these update regularly. it does show some rain and thunderstorms coming through this evening. but weakening as they get closer to the philadelphia area. this latest run does keep some of it together and so we do see some rain overnight.

expect it to be around tomorrow morning. sol showers toward the shore in southern delaware tomorrow morning to start off the day. but that's just the begin. ing of the changes coming in and krystal klei will tell you about how the temperature and humidity are going to change. >> roigt now, we are still feeling the hot and humid conditions. take a look at the feels like conditions. a a lot of us feel like we are at or above 100. 103 in vineland. it was at 104 just a bit ago. 97 in philadelphia. and coatesville at 93. atlantic city at 99 e degrees. we have seen e into the neighborhood temperatures some spots feeling at 105 and above. really uncomfortable conditions now. the storms will break the hot spell. look at the three-day outlook. 81 thursday. and 79 by friday. best yet, we are looking at the

humid itty just dropping day by day. we're looking dry conditions out there and sunny as well across our neighborhoods. and look at the lehigh valley. low 80s to upper 70s consistently. we'll have clouds in new jersey. and we'll be at 86 in delaware. look at that. that drop to around 9 to 80 degrees. plenty of sunshine and low humidity. temperatures are going to be nice. as we move along into your weekend, we stay dry. we have sunshine saturday and sunday. and 78 both days. so you got to get outdoors this weekend. >> that weekend looks perfect. >> really not a typical august at all. >> that was not a mistake. that may be the longest stretch we have seen all summer.

midnight. four people are in critical condition. it's unclear just how fast the train was going when it slammed into the parked train. one man on board explained the chaos. >> mitch blacher is live in center city the ntsb news conference will begin any moment now. >> what kinds of questions will investigators ask as they try to figure out what happened? >> reporter: this marriott has become the command center as we await that news conference. the question we anticipate them trying to answer is how that collision could have taken place when the train itself was equipped with train safety and slowing technology.
