nbc10 news starts now. a student walking to cheer practice ends up in the hospital in instead. tonight police say her phone may have caused a dangerous distraction. good evening i'm jacqueline london. >> i'm jim rosenfield. with us the montgomery student was face timing with a car crashed into her. >> drew smith is live. how is the girl doing tonight? >> she was badly hurt. knocked unconscious during the crash. we have since learned doctors decided to send her to children's hospital of philadelphia. across the street dlkts are working inside the police station talking to witnesses who say this girl was on her phone. using the face time app. distracted while crossing the street. >> reporter: the damage to the front of car shows the point of impact. a 14 year-old girl hit while crossing high land avenue.

her cheer leading teammates later found out why she never made it to practice. >> the trainer told us and the coaches that a girl got hit. >>. >> reporter: friends ran down to the accident scene. right in front of the high school. >> her bag is sitting down there. it's really bad. it's emotional. >> reporter: both of girls sneakers laying quite a distance from the car. >> i feel terrible for her. >> reporter: investigators spent hours taking measurements and photographs. they say witnesses saw the teen video chatting on her phone as she crossed the street. >> the fact that that could happen to you and in ten seconds is very scary. >> reporter: research shows that these types of accidents are happening more often. 12 pedestrians killed while using mobile devices in 2015. we leeked deeper into the national numbers and found 1,500 er visits for distracted pedestrians in 2012. that doubled over seven years. >> police towed away the car

involved in the crash. the driver stayed on scene, and rushed to help. he is not facing charges. friends of the 14 year-old say she's a happy and fun teammate. they're thinking of her tonight. >> our first game is friday. she's really excited to be there. just really hoping she's okay. >> this happened right in the school zone. right next to a crosswalk. there were signs just like in warning drivering to yield to pedestrians. police say in a case like this, it shows drivers and pedestrians need to be alert and focussed. a plea deal for a south jersey father today. pleaded guilty to first degree aggravated manslaughter charges in the death of his young song. told the judge he deprived 3 year-old of oxygen. he faces up to ten years in prison now. comes after a jury was deadlocked on the case back in may. residents are once again feeling shock and sadness. >> this guy is getting away with

murder. it's disappointing. the fact that only ten years will be served. it's crazy in my mind. >> the body was found in a field near his home. prosecutors said dj killed him because his girlfriend didn't like children. he will be sentenced september 29. less than 48 hours after a train crash in upper dar by, a passenger has filed the first lawsuit. claims the train he was on blew passed a previous station before crashing into another train at the 69th street station. more than 30 riders were hurt. the ntsb is investigating what caused the crash. they with working the trains video recorder and plan to interview the operator soon. all right. now the numbers we have all been waiting for. the drawing happened minutes ago. >> because of the jackpot is up to $758 million. the second largest in u.s.

the suspect now facing burglary, child endangerment and other charges. paying for parkt is going mobile again. the meter up service could return by the end of the year. the mobile app allows drivers to pay meters with their smart phone. and add more time remotely. the city had the service for several years, but had to shut it down. after the vendor went out of business. there's mixed news for the nations oldest historically back college tonight. today the state agreed to forgive $30 million in loans in delaware county. but that means big budget cuts. because the state is requiring balance its budget over four years. >> i heard about that. i feel weird. i already have my stuff all done. where else am i going to go this late in the game. >> they have until september 1 to submit a plan that addresses the financial issues or it could lose its accreditation. >> the school district is asking

students to weigh in on its bathrooms. the school board voted last night to create a survey on student privacy in bathrooms and locker rooms. this all comes after a lawsuit over the districts transgender policy. the lawsuit claims allowing students of the opposite sex in those rooms amounts to sexual harassment sfwl legal trouble forced organizers of the to cancel the delaware tradition. the event was scheduled for november 3. the landowners backed out. the part of a lawsuit filed by a woman who was injured at the event lags year. >> also tonight. thrills and thunder. high above the jersey shore. >> the air show drew big crowds to the beach and board walk today. estimated 425,000 spectators focussed on the sky for the 15th year. a slight increase compared to 2016. organizers say the air show

new tonight more messages of hate for the second time this week neighbors discovered racist vandalism. some of it turned up in wilmington and chester county earlier this week. police made an arrest in that case. the suspect george claims he has been associated with white supremacy groups.

tonight people are looking for the ways to say hate is not welcome in their community. >> brandon hudson shows us how. >> reporter: a message of hate spray painted oen a van. on the hood and some words we can't show on tv. >> it disturbed my mom. my mom is 77 years old. >> reporter: his nephew owns the van. jackson said they covered it up so it wouldn't draw attention. but news of the crime traveled fast. it got the attention of u.s. congresswoman. >> she comes and want to make sure we're okay. >> reporter: police say someone vandalized the van over night. >> it's over a parking space. all they need is god. >> reporter: police consider what happened to be a hate crime. and one person who lived here his entire life said he's always felt comfortable walking around the neighborhood. there's children here and parents here and oftentimes they play at the playground down the street. hate crimes in nine cities jumped 23% in 2016.

following lt lebs of president trump. but hate is on display in smaller towns too. like coats ville. where just this week vandals tagged a store front. and garage with racist words and symbols. >> it's terrifying. this can happen in our country. >> a chapter leader for the hate has no home. the violent events led to more demand. they sold 50 two nights ago. a record for them. >> we're not going to stand for white supremacy and nazis coming out. we're going to stand up against them. elsewhere a statue of robert e lee is causing controversy tonight. new video shows a man trying to cut a tarp off the monument. he called it a desecration. it was placed over the statue this morning. they also covered a monument to stone wall jackson.

heather hire was killed when a car droefr into a crowd. city says it placed the tarps over the statues as a memorial to her death. dozens of protestors gather outside nfl headquarters in new york tonight in support of colin kaepernick. supporters chanted to give him a job. he made headlines last year for refusing to stand up during the playing of the national anthem as a protest against police brutality and racial oppression. eagles has done his own protest during the national anthem. he began holding his fist in the air last season. and has continued again this season. during last weeks game, chris long put his around him as a sign of support. >> official business in nevada today. president signed a new bill into law aimed at helping veterans.

down so much. so yesterday at the feels like temperature of philadelphia got to 101. even higher in delaware. today's feels like only 84. tomorrow's only 80. that's a 20 plus degree drop from what we saw yesterday. tomorrow the temperatures 82 degrees. 78. 78 redding. and allen town look at the low temperatures in the 50s. turn off the air conditioner for a number of days. 82. that's one of the warm spots. at the jersey shore near 80. dover at 81 degrees. beautiful weather everywhere. great weather for the eagles tomorrow night. doesn't get much bet e than this. it was too warm and humid last week. and now over the next several days we head into the weekend, we have nothing but sunshine here. and it actually gets a little bit cooler over the next couple
