the train derailed. speeds showed reached 106 miles an hour when it was in the frankfurt curve. the place where the speed limit is 50 miles an hour. eight people died and more than 200 were on board the train, many seriously injured. only one victim in court for part of the hearing today. she say sheen couldn't walk after the crash. when she woke up, she saw bostian didn't know where they were. he refused to let her use the cell phone. try to show a judge he was aware of hissen surroundings after the crash. the defense held on to the ntsb findings that a septa train that had been hit caused him to lose his sense of awareness and accelerated the train at the wrong spot of the curve. lawyers argued he e had no intent or disradar for human life and what occurred here was an accident and not a crime.

but he'sen innocent of any criminal charges. >> now the scene of the derailment was a massive scene in which you had firefighters, crime scene technicians and bomb technicians thatten went to examine parts and pieces of the train. at one point today an officer with the police department testified he's with the bomb squad and went into the compartment and he says he saw bostian's knapsack anden went through it and found a tablet like an ipad or some or device there. when he was done examining that, he put it back in the bag and then left. later pictures were shown of that bag being ransacked and to this day the tablet has yet to have been found. that's the latest on this. the judge ruling this an accident, not a crime. deanna durante, nbc 10 news. we'll keep updating you on

the storm. and it shows. from the air you can see widespread devastation of some communities. marinas near ri unrecognizable, scores of homes damaged. and on the ground, a look at more of the same for those who didn't evacuate, they are grateful to be alive. >> we're all good. it's just going to be a big time rebuild. we have poles everywhere. >> reporter: leaders say it may be awhile before people can return. across the state, resources are limited and millions remain without power. >> it may take multiple days in some areas. >> reporter:. but reenforcements are beginning to arrive as airports resume service today. the recovery from ir pa ma could cause tens of billions of dollars across several states and years before things are back to normal. >> unaccounted people.

a team of medical respond ers were flown into the keys to help. >> so much work to be done. what's left will bring rain to our area start iing tomorrow ux but we won't see anything like florida experienced. meteorologist glenn "hurricane" schwartz is tracking just how long that rain will stick around for us. >> it's just a matter of scattered showers. we have some clouds in as a result of irma, but also some peeks of sunshine in the philadelphia area. as you go further south, the clouds are thicker. that's closer to where the remnants of irma are. you can see the thicker clouds in delaware and south jersey with a little bit more sunshine to the north. the showers of north carolina again fairly light for the most part and kind of scattered. so as we lock through the future here, we're starting to see some winds coming in from the south. that will allow some low level moisture and here comes some showers again. perhaps gi the morning by.

the morning rush. a little better chance later on during the day. but wednesday again, it is scattered and generally light. it's 78 degrees in philadelphia now. 82 in northeast philly. but most of the area is in the 70s. cooler in dover because the clouds have been so thick there. as we go through the night. tonight, a fair amount of cloud cover. we're not expecting showers for most of the area. it is possible that parts of delaware could see a couple showers by 6:00 a.m. more on the timing of when the greatest amount of rain is going to occur coming up in a few minutes. >> to track the rain and any storm that hits our region with the nbc 10 app. you can use our live radar and get alerts when a weather threat is 30 minutes out from your exact location. developing now, police are investigating the death of a lacrosse recruit at will have yet college in easton. authorities say the 19-year-old died at lehigh valley hospital

yesterday. public safety officers say they respond ed ed to a medical emery sunday afternoon. right now investigators are working to determine what led to the medical emergency and if alcohol played any role. the school sent out a letter to students reading losing a member of the class of 2021 is a heartbreaking start to the year for our newest students n particular i hope the support of the community will be helpful to all at this very sad time. >> a tale of love and lost following a deadly house fire. that started just before midnight last night in wilmington. hen couldn't find his wife, so he went back into the burning home to try to find her. >> he ran around the side of the house to get a hose. came back in to try to find her, but she's outside yelling his name the whole time. he didn't know so he did what any husband should do with a wife.

requests at the philadelphia i.c.e. field office in the wake of rumors of massive national raids set to begin this weekend. >> we're telling them they don't have the right to maintain a wall of secrecy around their actions. they need to give us the information we need to protect our communities. >> officials confirmed to nbc news the raids are meant to target undocumented meempeople across the country. texas senator ted cruz is trending. his account liked a tweet containing a pornographic video. the whole thing e spread across social media. cruz says a staffer liked the tweet and was still discussing whether they would lose access to the twitter account. today north korea threatened that the u.s. will pay a price over sanctions imposed by the united nations security council. they target north korea's revenue from other countries.

they were imposed in reaction to its nuclear program. the country denounced what it calls w's evil intentions. today president trump called the sanctions a very small step. >> the sanctions are nothing compared to what ultimately will have to happen. >> mr. trump met with the president of malaysia today and said it was important malaysia had stopped doing business with north korea. in the meantime, the international olympic committee says there's no hint of a security threat when it comes to the winter olympics in south korea. the president of the ioc said he's. hoping for a diplomatic solution before the games begin in february. today another key witness testified in the trial of senator bob menendez. this is video of him arrive iint the courthouse. a dominican woman testified that the senator helped her with a visa. she said her original application was denied in 2008 but then spoke to her alleged boyfriend who said he was going

to fix it by talking to menendez. her visa was e eventually approved. he's charged with accepting bribes for political influence. cory booker called the rails vulnerable to terrorists and asked why there isn't tighter security on amtrak and other rail systems. booker asked officials to visit the garden state to discuss what security measures the agency is taking to protect al qaeda against-style attacks such as training programs and background checks for employees. senator bob menendez also signed the letter. a spokesperson responded that the agency works to keep the rails safe on a daily basis. a new poll finds most support a proposed bill aimed at stopping abusers from getting a gun. supporters urged lawmakers to pass that legislation. it bars anyone convicted of domestic violence or who has a

protection order against them from buying a gun. and it requires them to turn in any guns they already have. >> the rally says educators met today toigting a bill that allows guns in the classroom. >> is that a gun? >> yeah, it is. >> this is one of three videos released today at the rally. it was hosted by the pennsylvania secretary of education and cease-fire. the videos highlight what they believe are the dangers that come from arming school employees. >> we want people to know what's being considered. we want poem to think about the ramifications and think about what if this were your school. >> the bill allows teachers, cafeteria workers and custodians to carry guns in public schools including elementary schools. in philadelphia the push is on to get more kids in the classroom. the sixers dunk squad wowed fourth graders at the school.

affairs office says the tech giant has agreed to provide pricing wedges in new jersey stores. this will make it easier to find the price of the item you're looking at. this settles the claim from the state that apple's in-store digital pricing violated state laws. the decision comes the same day apple unveils the new iphones. we'll e show you those in our next half hour. john dorenbos announced on instagram that his open heart surgery is happening today. >> he thanked his fans for standing with him. he learned he had an aortic aneurysm after being traded to the saints last month. the condition was discovered during a team physical. the eagle became a fan favorite around the country bh he performed his magic tricks on "america's got talent." today the eagles made the support known tweeting all of eagles nation is thinking of you today, john. >> get well soon, john. go birds. >> on his instagram feed, he

thanked his wife, family and friends and said the video from fans seen here brought some tears adding i feel the love and support. stay with nbc 10 for updates on his recovery. back to irma's devastation and take a look at this. hurricane irma just left a trail of destruction in its wake all across florida and beyond. getting a first look at the damage along jacksonville beach. you can see a lot of rooftops peeled off buildings and splintered and debris scattered. >> what's leftover from irma will bring rain to our area starting tomorrow. >> let's bring in meteorologist glenn "hurricane" schwartz. time out these rain chances for us if you will. >> the rain chances go up a

little bit during the day tomorrow and a lot more during the day on thursday. and as we head through the weekend, things start drying out again. it's 78 degrees. we have some of the clouds from irma in the philadelphia area. less of it farther to the north than the suburbs and lehigh valley and poconos. everybody is in the upper 70s to 80s. let's take a look at some of the suburbs. chester, bucks. montgomery county specifically. but they tend to read aç littl high. these are about average. you can see the white areas. those are the high, thin clouds. not really capable of producing rain. the clouds down in southern virginia and that's a different

story. as you can see, it's not a solid area, it's not especially heavy. but that moisture will be gradually increasing around here. you can see the moisture is thickest down in louisiana of all places. so it's kind of spun around and going back to the gulf of mexico. at least part of the moisture is. let's see what happens as we go through the hour and into tomorrow, there's tomorrow morning. it would be one or two during the a.m. rush. through the day we get a little bit of the heating and we see more showers. they are generally on the lighter side. a different story on thursday. the bulk of the moisture from irma comes in. especially during the afternoon. you can see pretty good coverage on that. maybe even some thunderstorms. thursday afternoon and into

thursday night, and then we start drying things out on friday. as we head toward the weekend, tammie will tell you about the improving conditions. >> it does improve a little bit. there's always an outside sprinkle or shower into saturday, but for the most part, that would be very early in the morning. the numbers is a chance of isolated shower on friday with 80s across the board. saturday, temperatures about the same. a little cooler along the jersey shore. it's going to be a beautiful day that's going to be seasonal. we talked about jose. this is basically a weak hurricane about to be a tropical storm in the atlantic. and we were talking about the mod ills els thing to bring it into the u.s. or up the east coast. so right now, we are look iing

a hurricane. category one, but it's expected to weaken a a bit more. let's take a look at the track. because it's kind of interesting. there's nothing to stare steer it right now until high pressure builds in north of it. then it will curve around the high pressure and at this point it will weaken to a tropical storm and then it's expected to reintensify to a hurricane. not sure what status, but not a strong hurricane. at least not by the time we get into monday and go up the east coast. here are all of the forecast models. the uk models want to bring it right into florida. the rest of them at this point kieping it off the coast. here's your ten day on 10. a a chance of showers wednesday, thursday friday clearing out for sunday. >> another local bid to score amazon's new headquarters. >> who is jumping in the race now.

on life in our area. >> it's all thanks to the philadelphia department of prisons. and the organization called new leash on life. cosmo will be paired with inmate trainers who will socialize the animals for rehabilitation program. at the end of the program, the animals will be available for adoption. hurricane irma wasn't about to ruin the birthday party of a young cancer patient in florida. with that storm bearing down, the 3-year-old's mother wasn't able to get ready for the big day. the girl was in the hospital after being diagnosed with leukemia on friday. so the staff stepped in. somehow they came up with a cake and decorations. she begins her chemo tomorrow. that brought a smile to her face. >> she was so happy and licked the cake. coming up next at 4:00, surviving hurricane irma. >> let's go to aaron. >> we are live at philadelphia international airport. we have been watching the big board all day as these flights start to roll in from florida after irma. we'll have your travel stories

we continue to follow this break nauz. charges dropped in the amtrak derailment. a judge decided to toss the case. the 2015 crash killed eight people and hurt 200 others. the judge decided at a hearing this afternoon that this derailment was an accident, not criminal. coming up in our next half hour, our legal exert weighs in on

what happens next in this case. also today a closer look at the devastation hurricane irma left behind in florida. >> millions are still without power and water, food and fuel are scarce in some of the hardest hit areas. in the hardest hit areas, it could be ten days or more before power is restored. one of the worst areas where fema says 90% of homes are damaged or destroyed. 7 deaths in florida. 35 were killed in the caribbean. >> they are starting to reopen today, but none of them expect to be full by back on schedule before tomorrow. the first flight carrying passengers home took off from tampa this morning. >> travelers are thankful to be home safe today. aaron has been at philadelphia international all day long and joins us there live with more. >> all day long, we have been here since 9:30 waiting for these flights to roll in. in the beginning

most of them were cancelled. looking at the big board, some things are changing. you can see fort lauderdale, some good news. they are coming in so also down here orlando, frontier and hopefully the southwest floiigh come in. so many waiting for loved ones to come home. the very first flight from tampa arrived at 1:00 this afternoon. safe to say everyone is happy to be home. a good sign of bags rolling off the carousel from florida. it's the first flight to land at philadelphia international from any of the cities there ravaged by irma. she rode out the storm in a hotel and one of many travelers cheering when they took off. we clapped and were so tlild. we did good coming back. >> he lives in one of the

mandatory evacuation zones. he tells nbc 1011 of his family members huddled in one house for safety. he shared photos of some of the damage in his area with flight. s too hard to come by right now he's meeting with friends at the airport and driving home with help. >> whoever needs it. water mostly. power is still out. >> fliers are feeling the aftermath of loads of cancellations. she was scheduled to fly through fort lauderdale today but reroute the through boston. >> so the best thing for folks looking at the big board is you do not see any red really. the past couple days, you could see cancelled everywhere. but it looks like hopefully the flights are going to come in.

the elmmy for her portrayal of spicer on "saturday night live." in an interview, spicer says he thinks mccarthy should share the award with him. spicer also didn't rule out hosting "snl" if he were to be asked. beyonce is one of several big names scheduled to take part in a benefit concert tonight for hurricane harvey victims. the telethon will benefit several organization who is are providing relief for victims. that event is set for 8:00 tonight and air from los angeles, but there will also be stages in new york and nashville. >> the one-hour show will be simulcast on all the major networks and can be seen here ob nbc 10. and beyonce not the only big name set to take the stage. justin timberlake signed on to perform. blake shelton also planning to

attend and be streamed live on facebook, youtube and twitter. an important event. now to a singer who might not have the voice of justin timberlake, but he may have an even bigger heart. ♪ >> so this week that woman right there in florida was staying in a shelter and she was really stressed about the storm. so that sheriffs deputy asked how he could help cheer her up. the woman asked for a dance. so he did the honors. he sang and dance with her for a short time and gave him a kiss. >> she did. i'm sure that calmed her down and helped alleviate the stress. >> a lot of stress out there in florida and beyond. let's talk about the rain that maybe will stress you out a little bit. >> compared to what they have had down south, it's just tip in the bucket.

. we'll tell you more in a minute. the moisture from irma right now is in the form of clouds helping to keep the temperatures down in the 70s to near 80 degrees. in delaware where the clouds are thicker, it's a little cooler. but watch as we go. farther to the south. places that are normally warmer felt it. only 69. bethany beach all 71. it's not just the wind off the ocean. it's the cloud cover. it's a little thicker, as you can see on the satellite and radar. these not really reaching the ground, it's giving you an idea of a bit of an increase in moisture that. there's more moisture in west virginia and north carolina. some of that is moving up to the

north. this is just on the edge of that moisture from irma. i have to get out away to show you the extent of this thing. it goes from out in the atlantic ojean all the way into texas. good thing it's not that well organized. it's a lot of area to cover with moisture. as we go through the night tonight and into tomorrow morning. we could see enough moisture to see a few showers. especially for the morning rush and delaware. as we go into the afternoon, the chances increase and there will be some scattered showers on the lighter side than that goes down as the night comes. and then on thursday as we start to heat up and thursday may get into the 80s, we'll see more and more showers and maybe even some thunderstorms. look at that coverage on thursday. that's a good bit of rain. that's the peak of the rain for

irma. and now we'll tell you more about the rest of the moisture that comes after that. >> we're going to sail through what looks like a quiet saturday and sunday. so the last of the moisture is out of here. it's probably out of here earlier than the afternoon. look at your sunday. sunday is going to be a pretty day. we'll be a mostly sunny day and seasonal temperatures. we get into sunday. there could be a few sprinkles trying to make their way past the lehigh valley. and then we go into monday. there's a trough that's coming out of the central portion of the country and that may bring us a few sprinkles on monday. at this point we're going to it leave it dry. we're going to have clouds and sun. we'll have to update that with the next model runs that come in. we get into tuesday. so things pretty quiet out there. let's take a look at what's going on that we want to talk

about. jose has 75 mile an hour winds. it's basically moving just to the east very slowly. it's about 480 miles northeast of the islands. there's nothing to steer it so it's meandering around in a circle, which is what it's expected to do until high pressure forms knot of it and gives it a bend. now how close it comes to the u.s. mainland is still a question that everybody is asking. we're still a week away. we'll keep a close eye on jose. but we say no way, jose, leave us alone for awhile. 9 for tomorrow. it could be an ugly shoe and umbrella day out there. 83 on thursday with a chance of showers. especially for the temple game. on saturday we're looking at a chance of rain in the morning and then it looks like we clear out to a mix of sun and clouds for the days beyond that. a $1,000 new iphone.

[ both smooch ] ciao bella. breaking news, case dismissed against the amtrak engineer involved in a deadly train derailment. a judge made the ruling late this afternoon. the crash happened back in 2015 and left eight people dead. >> jim rosenfield joins us now. why did the judge toss out the charges? >> a lack of evidence based on what he heard in court, it was more of an accident than criminal negligence. the judge told lawyer on both sides of the case the charges should never have been filed. after four hours of testimony, the judge made his ruling and when he d you can hear the family of the train engineer gasp. prosecutors say bostian
