himself in. brandon hudson has that story. brandon? >> reporter: this man was almost hit at this intersection over the summer and knew that something bad would happen because drivers speed through here unfortunately. it was his own uncle who was hit as he crossed the street. down the street from where a driver hit and killed 57-year-old richard brennan, his nephew remembered the man neighbors called pops. >> he really kept to himself. he was a good guy. he's family oriented. >> reporter: philadelphia police tried to cross south 57th street around 10:00 last night. a speeding driver hit richard going north and didn't stop. investigators are looking for a gray van with a broken front windshield. >> i'm upset that they kept going. >> i heard it was pops. >> reporter: neighbors say pops was walking home. he walked everywhere.

ideal location in new jersey. the garden state is offering $7 billion in potential tax credits. meantime, amazon may be looking to get into a new business. we'll tell you what it could soon be designing. that's at 4:45. a local advocacy group is calling for eagles fans to boycott next sunday's game. the group called the 1022 protest committee is urging fans to protest outside nfl stadiums this sunday. organizers say they are doing this because the nfl is trying to silence players. they are supporting colin kaepernick who has filed a grievance. kaepernick, of course, drew national attention last season when he knelt during the national anthem before games to protest social injustices and this year he hasn't been signed to any nfl team. his lawyers issued a statement

saying, "athletes should not be denied employment based on partisan political provocation by the executive branch of our government." the nfl says it has no comment on kaepernick's filing. students return to school tomorrow after the district has been closed for a week because of mold. teachers returned to the monrow district today. holly glen elementary students will be starting again tomorrow. and a philadelphia school also closed because of mold say they are still cleaning up. we're still waiting to hear if john b. kelly will be opened tomorrow. the school has been closed since last thursday. the school says the traces of mold was caused by issues with the heating and air conditioning

system. out west, hundreds of people have been allowed to return to their homes from the devastating california wildfires. some people are returning to untouched homes while others are returning to total destruction. calmer winds and cooler temperatures are helping firefighters get a handle on the frames now. the toll on first responders has been brutal. >> how long are the shifts that you guys are working here? >> we're 24-hour shifts. >> meantime, the death toll rose today. a contractor driving a water truck was killed when it rolled over. 41 people have now died in those fires. one woman at home is recovering after a home in feltonville. crews had to be called to rescue a roof on the building. they came right in and helped that frightened dog down from the roof. a man accused of setting off bombs along the jersey shore and in new york city could spend the

rest of his life in prison. jurors convicted this man of putting two pressure cooker bombs on the streets in new york. this is video from one of the bombs here that went off. you can see that shrapnel flying. 30 people were hurt in this explosion. sentencing in this case is scheduled for next year. >> this is the wrong place to try and carry out an act of terrorism. witnesses will come forward, evidence will be developed, arrests will be made, prosecution will be brought forth and they will be successful. >> rahimi still faces charges in new jersey for blowing up a trash can in seaside heights last year. a u.s. soldier who walked away from his post in afghanistan pleaded guilty today to endangering his colleagues. you'll remember, beau bergdahl was in custody for five years

before he was freed as part of a prisoner exchange. he faces a maximum of life in prison. harvey weinstein has been accused of sexual assault by several women and meantime, the weinstein company has been seeing fallout but now a private equity firm says they are negotiating with the company. it could buy the company or just a portion of it. and al michaels quickly apologized after making a joke about weinstein during sunday night football. >> let's face it, the giants are coming off a worst week than harvey weinstein. >> michaels apologized in the next quarter for being a little flip and says it was not meant in that manner. the social media movement in the wake of the harvey weinstein scandal is giving victims of

sexual violence a voice. still ahead, nbc 10 head to a college campus. remembering the life of a student shot and killed by police earlier this month. miami beach officers shot and killed carrie ann after she drove her car into officers. she tried to drive away from a crash before hitting an officer. her death follows the death earlier this year of temple student jenna burley. one man is facing charges in that case. students are invited to gather at 5:00 tonight to comfort one another. right now a new survey asked hundreds of business owners about the soda tax and shows that half of the businesses lost money because of it. the city controller says more than 60% of businesses like grocery stores, restaurants and bars blame the tax for losing money. 650 businesses were surveyed.

more than 400 say they've lost 10% of their value. business owners are struggling to keep their employees with that revenue lost. but the city not buying the survey results. they say the reality is that wage tax revenue interest the beverage industry are actually up from last year which means the repeated claims about mass job loss are false and, of course, the controller leaves out the tax's many positive economic impacts through funding pre-k and community schools. an update on puerto rico. nearly 70% of the island now has running water but those who don't are getting increasingly desperate. several people have died from back tearier infections. the army is delivering clean water to worried residents. the governor detailed the plan to get people back on their feet. >> sustaining and maintaining hospitals, meaning that the medicine, equipment, generators

macy's will open again on black friday shopping. they will open thanksgiving evening. tj m t.j. maxx and home depot are promising to stay closed. amazon may be taking on nike, underarmour and they have not signed any long-term contracts and has only started ordering small batches of product for a trial run. this afternoon, the halloween party that makes hospitals less scary for young patients. shrine n shriner's hospital hosted halloween fun. it's part of the spirit of children campaign that raises money for hospitals around the u.s. and last year raised nearly $50,000 for shriner's.
