frankfurt. good evening, i'm jacqueline london. >> i'm jim rosenfield. before the fight the two women were locked inside the store after employees suspected them of shop lifting. >> why experts on both sides of the law say the whole incident could have been avoided. >> reporter: the view is from the outside of the seven 11 on frankfurt avenue. the women inside are suspected of shop lifting the night before. employees locked them in and called police. >> what started it is, suspected shop lifters being locked in a store, caged. it flies in the face of commonsense. i don't think what shopkeeper's privilege may exist. to come upon a situation where people are already out of their minds, risks harm to the public and to the police. >> reporter: defense attorney william brennan says the door lock, though legal was a mistake. because when police arrived -- >> don't swing on the cop! >> reporter: the officer was punched some say before he knew what he was locking into.

a safety director says the problem is the reaction to police. >> police are there to do a job. it's when some of these knuckleheads decide to push back on the authority. that's when things go down to tubes. >> reporter: both women have been charged with multiple crimes, including assault. one woman remains in jail the other was released. brennan was in court as lawyers argued for reduced bell for the women. >> taking the police on is usually not a smart move. it's great for my business. but it's just not a smart move. >> reporter: neither have connection to this case, but both of these men have spent years in a criminal justice system and both say the fault is here lies in the store employees for locking the women in in the first place. >> you suck it up on the packet of juicy fruit and you make a police report. >> reporter: an attorney for one of the women says none of this would have happened had those doors not been locked. we did reach out to seven 11 to get comments, they did not return the request. philadelphia police say they're not talking about the case now because it's in the hands of internal affairs.

outside police headquarters deanta durante, nbc 10 news. a bucks county superintendent is sounding the alarm about racism in his district. >> the latest incident racial remarks made at a high school football game. so the superintendent took to a blog to write about it. in that blog, he writes, we do have a problem. we need to recognize it. own it. and do our very best to fix it. nbc 10's steven fisher spoke to school official and students who say they will not stay silent on this issue. >> reporter: an investigation revealed it was two middle school students from quakertown who was using those racial slurs. the district admits they have a problem but they're work ing with parents and students to make sure it stop. >> he wants to fix the problem. he admits it's a problem. it's not just the school district it's the community. >> reporter: the quakertown school district is not making bones about it. they say a culture change is needed. >> we didn't get where we are, all of a sudden. this has been going around for a

long time. >> reporter: the school says there have been racial issues involving students in the past, but just last week, two middle school students slohouted racia slurs. >> quakertown, we care about cheltenham and what happened. what those kids do don't represent the rest of us. >> reporter: it's not just the adults asking for change, the students themselves are demanding it. >> definitely felt disgusted. >> a situation like this is very serious. something needs to be happening. there has to be a solution. we have to look deep into it. >> reporter: students who had nothing to do with the incidents have apologized to cheltenham for the actions of those middle schoolers. >> we have to make a difference. you know, as people. because, you know, incidents like these shouldn't happen. they shouldn't have hate towards, you know, someone just because of the pigment of their skin. >> reporter: what's done may be done. but now it's where they go from here. >> saying something that's been a problem and, you know, to have a proactive approach to solve

it. >> reporter: and the actions they put forth. >> and to make it better. something like this won't happen in the future. >> reporter: reporting in quakertown, nbc 10 news. in chester county, a silent show of unity by students at coatesville area high schools. students linked armed as a show of strength. they were responding to photos of several teenagers posing with pumpkins that featured the letters kkk. some of the teenagers are from the coatesville school district. it's the second racially charged incident involving students there in the last several weeks. new at 6:00, we've learned former montgomery county district attorney bruce caster is suing bill cosby accuser andrea constand. he is seeking $50,000 and a personal injury claim filed against constand and her

attorneys. the winner kevin steele had criticized caster's handling of the cosby case. bill cosby will be retried next spring. new details on a story we brought you as breaking news yesterday at 5:00. camd camden police say they've arrested a man who stabbed a landry mat employee in camden employee. they say he robbed the employee and took the entire cash register. we spoke with a woman who works at the landry mat. she said she felt uneasy coming into work. >> i was uncomfortable and if i was asked if i could cover this morning, i was very nervous. >> best faces multiple charges, including armed robbery and aggravated assault. new at 6:00, the philadelphia district attorney's office nabbed nine people in an illegally street gambling operation. investigators say the ring was family affair that operated in

about 40 locations throughout the city. gamblers could bet on the numbers with a chance to win more money. authorities say the operation generated millions of dollars of illicit profits. we're learning about the moments leading up to a multistate shooting rampage, which ended in delaware. a witness saying he saw the gunman gather his co-workers together for a meeting before opening fire at a business in maryland. according to that witness he told them he had something to say and then started shooting. after that shooting in maryland, police say he drove to delaware where he shot and wounded the owner of a used car dealership in wilmington. they captured him later that night in newark. he's been held on more than $2 million bail. right now on the nbc 10 app, learn more about the victims who were killed. you'll find a timeline of how the shootings unfolded.

by a couple degrees from what you saw this morning. 47 in philly. 48 in vineland. 46 in west chester. burlington 45 and avalon 54. tomorrow we'll warm up into the mid 70s again. everywhere but out along the jersey shore because of east winds coming in off the cooler atlantic waters. we'll talk about the second half of the weekend and the rain that moves in whien i come back. in south jersey a fireball streaks across the sky. >> nearly 200 people reported seeing the bright object in the sky. the american meteor society says that flash of light was a very bright meteor. the sighting comes ahead of tonight's meteor shower. you can read more about it on the nbc 10 app. one month after hurricane maria devastated puerto rico, there are hurricane victims now in philadelphia in need of help. >> philadelphia's office of emergency management has now set

a man running from police was found hiding in an unusual place in wilmington.

a trash can. this all started when employees at enterprise car rental called state police. they say devontae williams tried using a fake id to rent a car at two different locations on wednesday. police say he ran when he saw them but officers found him hiding in the trash. new at 6:00, a train that could get you from new york to washington, d.c. in 29 minutes running through philadelphia is getting more support tonight. maryland's governor is throwing his support behind elon musk's hyperloop. officials issued a conditional utility permit to allow crews to build a ten mile tunnel beneath a portion of the freeway. people would board levitating pods. musk is best known for his electric car company tesla and space x. very high tech. atlantic city officials are threatening to demolish a hotel. >> the property got a lot of attention when an alligator was

found in the pool over the summer. months later the problems continue to mount. nbc 10 jersey shore bureau reporter ted geenberireenburg h details. that's all new at 6:00. >> reporter: it is seen by thousands coming into atlantic city every day, but few would consider the closed bayview inn and suites a welcoming sight. >> it's an eye sore now. should be torn down. >> reporter: the motel on busy route 40 was shut down for code violations in midaugust, when an alligator turned up in the pool following a drug raid. since then, it's been the scene of two suspicious fires. doors to some of the rooms still open. >> it is really unfortunate because of that fire. >> i don't see any security over there. it's very easy for people to get in. >> reporter: city officials say in the past week, the problems here have only gotten worse.

with piles of tires being illegally dumped on the property. >> it has to be resolved. >> reporter: the director of the city's licensing and inspections department says after a lack of progress by the motel's operator and owner, he's given them a november 12th deadline to secure the property and come up with a concrete plan on its future. >> it's not going to sit. it's going to be cleaned up by them immediately or demolished by us. >> reporter: a lawyer for the company tells me they're weighing options. but says his client is looking to redevelop the property. and hopes to come up with a mutually agreed upon plan with the city before the deadline. >> we're not going to let this thing linger for months. >> reporter: time running out for a place open to trouble and a city losing patience. ted greenburg, nbc 10 news. look at this beautiful shot.

cape may as the sun is setting at the shore. that's awesome. >> the sun going down earlier and earlier these days. this weekend, above average temperatures. going to be really gorgeous. whether you're at the beach or if you want to decorate the house in a halloween theme. >> you can do whatever you want. if you're outside it's going to be perfect. cooler at the beach this weekend. the winds will be coming off the ocean. you'll need to have maybe your fleece or sweatshirt if you're at the beach. still pretty weather. let's take a look at philadelphia. sunset took place at 6:14, it's already down. and now we're looking at a beautiful, beautiful sort of colored sky out there. all those beautiful oranges, right now the temperature at 72. the winds out of the northwest to nine miles per hour. we have ten miles' visibility. there just isn't anything out there in the way of cloud cover. where is the cold? it's building into the northern rockies and the pacific northwest. there's a storm system settling in there. look at this, rapid city, 81. look at all the 70s across the

ohio valley, the midwest, tennessee valley. this is abnormally warm weather for everybody. not just us. 71 in trenton. 67 in wilmington and vineland. allentown coming in at 68 and coatesville you're at 63. tonight, we'll drop down to a couple of degrees cooler than we were this morning. we have northwest winds that will be coming through, bringing slightly cooler air mass in. it will be 48 in philadelphia. 50 in coatesville. 47 in vineland and trenton. 51 in stone harbor. we don't have anything on the doppler. it hasn't had much of a workout this week. not too far away we're starting to see clouds making their way through the upper midwest. we have high pressure in place, which has done a fine job keeping the storm systems out of the area. it's going to start to break down by the time we get to the second half of the weekend and start moving eastward and it will open up the flood gates for rain to move in monday night.

the warm air sticks around for the weekend. here's the storm system out west. you can see it curving and digging in. there's that snow starting to move out of the northern rockies and into parts of montana. we are not getting snow. we are fougnot going to be cold enough for snow but we will go back to the 60s. we're going to be waking up tomorrow morning into the mid and upper 40s with winds out of the north. then throughout the day those winds will swing around and they'll be out of the east and southeast. keeping it cooler out there along the jersey shore. 67 in atlantic city. while we'll enjoy the mid 70s in philadelphia. on sunday, similar conditions. we'll have the winds out of the southeast, we'll be in the mid 70s, see more cloud cover in delaware and then on monday, everybody gets the cloud cover. an isolated sprinkle or shower is possible, especially in the lehigh valley, berks county and the poconos early on. as we move flthrough the evenin temperatures will go up and then we have chance of rain later in the evening.

you're danny? i'm steve. joseph, i'm steve. how are you? nice to meet you sir. no different from everyone else. they just want a job. they want respect and they want dignity. steve called fairly frantic. you know, he had a premature baby and i think he had just been given the diagnosis that she had down syndrome. lauren brought out the best in me. she made me a different person. lauren's the spark that started the fire. the goal is keep places like this open so all people, regardless of disability, have an opportunity for employment.
