>> reporter: at lexington avenue this morning nypd officers walked down the street clearing people seemingly passed out on benches. residents say that is not the only problem here in harlem. >> this is every day they're out here smoking k2, looking like zombies. >> reporter: the huge issue here, people high on synthetic marijuana, k2. lisa gonzalez murphy said she'd rather take the train than walk past the people. >> i feel like i'm in a movie, zombieland. >> reporter: ilana gold found men openly smoking it. >> you're speaking k2? >> yes. >> reporter: it is popular with the city's homeless population. in this video from the nypd department a naked homeless man said to be high on synthetic marijuana blocks a school safety vehicle. the commissioner spoke about the problem earlier this week. >> these individuals, many of

them under the influence of this drug totally crazy. super-human strength, impervious to pain. some of the normal takedowns we would use are not going to work. >> some say this is a problem for years. but it has gotten worse over the last 12 months in harlem. >> do you think the city and authorities are doing enough? >> yes, police are in and out of here all the time. but as quick as they run them off they come back. >> absolutely not. this wouldn't happen if they were doing enough. >> reporter: it is illegal to sell k2 but legal to smoke it. they have been raiding the stores selling the drug and promising a crackdown. >> police say as fast as they're able to identify the chemicals in the k2 the producers change the recipe: the homeless

problem is worse according a poll. panhandlers are asking for money. a third of new yorkers say the quality of life is good or very good. investigators are trying to pig out how a manhole cover was found in the floor of a bus. it happened noon tuesday at 10 seventh street and inwood avenue in the bronx. according to the transit workers union the driver said he heard a screaming. the manhole belongs to the city department of environmental protection. according to the agency the driver likely rolled over the cover, dislodging it and shooting it right into the bus. now to a developing story in sandy hook, new jersey, yes where the search continues for a swimmer who disappeared in the sonia. >> that search has gone from a rescue to a recovery effort this

afternoon. officials searched for this missing swimmer for three hours last night. they have been searching four hours so far today and so far no sign of the missing young man who went swimming with his girlfriend in an area officials say they should have never been swimming. >> reporter: a state police helicopter is in the air and monmouth county divers are in the water. the 25-year-old man disappeared in the rough surf. officials say at this point it is looking grim. >> we're in a tough situation here. >> reporter: lifeguards went back on duty this morning and people are back on the beach but say this is a sad reminder. >> there is rip currents all over the jersey shore. lifeguards will might have v move you down to a different spot if the area is bad. >> i've seen them come out to get someone who wasn't listening to them to come in closer. >> the man was swimming in an unprotected area which is off

limits to swimming because of the endangered species here. the lifeguards in the nearest protected area were done for the day. rose russ said lately the rip currents were especially bad. >> the whole summer has been rough with the water. it is exhausting. you have to be a good swimmer. >> the national recreation area officials say you should only swim in a protected area. >> you always need someone to look out for what is going on. >> the rip currents made it an especially busy season for lifeguards both on and off duty along the jersey shore and long island. they have been making lots of rescues because of the dangerous rip currents. the search will continue for the swimmer who is missing. we know he is 25 years old and from monmouth county. the legionnaire's disease is getting worse.

the number of cases climbed to 97. all of the deceased individuals were older adults who had underlying health problems. they found it in five buildings. the man who attacked movie goers in a nashville theater had a history of mental illness. cbs 2 reports. >> reporter: nashville metro police said vincente montano entered the theater wednesday. >> he pulled out a hatch ket and a gun and we all ran out of the theater. >> reporter: he clouded the area with pepper spray before swinging the blade at this man and his daughter. >> all the citizens around us helped me and my daughter when we were pepper-sprayed. that gives me more faith in humanity again. >> reporter: when montano tried to leave, he was met by a s.w.a.t. team. >> there was a noise made by that gun.

it was then that the officer fired. >> reporter: a witness captured the loud gunshots heard during the s.w.a.t. team's takedown. >> the 29-year-old attacker died at the scene. two days before the attack, his mother filed a missing person's report with murfreesboro police. he was diagnosed with paranoid schizophrenia in 2006. his mother hasn't seen her son since 2013. >> the safety of our guests and employees is and always will be our industry's highest priority, said the national association of theater owners. three people were injured in the attack. one man was cut on the shoulder with the ax and the others were treated for pepper spray. robert sims was one of 10

men who pleaded guilty of pulling a driver from his suv and attacking him two years ago. he was tried with another. the 34-year-old former undercover officer was convicted in june of second degree assault but not guilty of gang assault. it shows him smashing the back window of the vehicle. morup dates in the malaysia missing plane mystery. a team found a plane window and more debris off of a french island. it will be sent to investigators in australia. the wreck age last week found is from the flight 370. the investigators leading the search are not going that far. they're saying it is only highly likely it is from that jet. despite an executive order from the president, jon stewart is signing off for the last time. >> today is the final taping of the daily show. scott rapaport outside of the studio where fans were camped out since 2:00 this morning.

there in north port. again, he's just enjoying hom hazy sun right now. thin clouds moving in. parts of the area seeing more in the way of cloud cover. mary ellen has 79. she's concerned about a storm this weekend. there is a better chance you'll see some showers, parts of monmouth, ocean county, than we will in the city or connecticut into the hudson valley or north and west. readings, though, still in the 70s. but as you look in the picture, more clouds are starting to fill in. mike sent in a picture of the dolphin as well. we're in all over the stories weather-watcher wise. in the city you see the clouds overhead, too. some breaks of blue here and there. not the cobalt blue we enjoyed yesterday. isn't that nice for lunchtime? winds variable at three. numbers around the aeshg the spread, it is about 10 degrees. 70 to 80 or 81 for the jersey shore. these numbers without exception

four to say nine degrees cooler than yesterday. we're below normal. after 19 consecutive days above, we'll turn that above. it will be below normal in the next few days. sun sets at 8:06. and even with the clouds, the time of the year, the uv forecast still an eight. if it is a long afternoon, round of golf, or cleaning up on the north shore, sun screen is a good idea. more clouds there on the state line north and west and there is our big mess to the south. this thing is going to push through. look what the models do with it, though. they keep the clouds in but the rain to the south, boy, only one model wants to even have it anywhere near us, so we'll leave the chance of a stray shower in the forecast overnight tonight and tomorrow south of the city and then we have a better chance for rain and thunderstorms monday into tuesday of next week. >> just doesn't look or feel like august. all right. johnny, thank you. voters putting their two
