and sunshine coming up we'll talk your beach and mountain forecast if you plan to hit the beach, it is going to be i think a very busy day along the coast. andrea and diane back to you. to the legionnaires outbreak in the bronx, the health department traced the deadlybacteria to cooling towers now the disease is found in the suburbs. joining us from lincoln hospital with more. >> reporter: the issue has since been resolved. but the state isn't taking any chances today teams from the health department are going to be here in the south bronx, they are going to go to a number of locations testing cooling towers just to find out how widespread this issue could be because there is now another scare. this time in rockland county. >> reporter: the facility in orangeburg shut down abruptly

on friday morning after an employee was diagnosed with legionnaires' disease, expert showed up with face masks to investigate. and destroyed the bacteria that caused the potentially deadly pneumonia. people have some serious concerns. >> definitely. it's scary. this neighborhood, it is all little kids. so it is scary. >> because only sparse details surround this case in rockland county it is unclear how or where the worker was exposed. >> do you want more answers definitely. >> it is the first case outside of the south bronx, the victims, older adults. but the disease affected 101 people. health officials say five cooling towers that supply air- conditioning within 10 blocks of each other tested positive for the bacteria. he believes he contracted

legionnaires from the lincoln hospital. he plans to sue new york city for $10 million. >> we think we think the hospital breached its duty to adequately check the environmental systems for legionella. the state is taking action hoping to stop this outbreak. >> we're starting a massive testing effort in that immediate vicinity where we will actually have a coordinated testing program where we will send people out to test these cooling towers to determine if they are a source of the bacteria or not. >> the health department says you cannot get legionnaires from person to person contact. people have gotten it in cooling towers. thank you.

we're following developing news in mali where 12 people killed and four hostages freed after a stand off. this happened in central mali over night. saying five malian soldiers a u.n. contractor and three hotel members are among the dead. three jihadis were also killed, saying the hotel was a popular location for staff. and james holmes will spend the rest of his days behind bars, 12 jurors failed to unanimously agree for the death penalty, a prove that surprised the courtroom. he left 12 people dead, 70 others wounded in a theater three years ago, the life sentence is not sitting well with families of the victims. >> that's not justice. he is living, he is breathing and our loved ones are gone. >> prosecutors argued that the former neuro science graduate planning the masker.

new this morning, police say two young girls were abandon in a casino parking lot while their parents were inside gamble. happened before midnight at the resort casino in queens. they noticed the girls without their parents. the girls ages 6 and 8 were taken to the hospital for observation, the parents two counts of endangering the welfare of a child. the search is underway in the bronx after this robbery at a rite aide store. investigators say he cut a security guard with a box cutter on tuesday after the guard tried to stop him from leaving the store. the guard says the suspect made off with nearly 2 dozen boxes of condons. the guard is expected to be okay. this one in a bronx laundromat. an employee says she was

cleaning the washing machines when the masked man demanded cash. she says he took off with $250, police say he left in a gray jeep liberty. in our next half hour, we speak to the terrified woman behind that counter. police are investigating the death of a newborn in queens. sources say the child was thrown from a bathroom window cbs 2 tracy has more. >> oh my god, that's horrible. that's just terrible. >> reporter: b residents of this apartment building at 115th street and myrtle avenue, horrified by the gruesome discovery. police say the 3 week old infant boy was found dead in a courtyard. >> i saw blood everywhere. >> the neighbor says she heard a noise and saw the infant's lifeless body. >> they told me to go back in there and do cpr. >> police say the infant was

thrown from the bathroom window on the fourth floor even more awful sources say the baby was alive when he fell to his death. >> sources say the infant's father and mother and two other adults were in the apartment, the police question is on the parents. >> sends a chill up my spine, that's awful. >> police still haven't charged anyone in the incident sources also tell us the infant was taken to the hospital 10 days ago but it is still unclear why. police are also questioning those doctors. to a commute this morning the subway tunnel that carries the a and c lines between manhattan and brooklyn under the east river is now shut down in both directions. for superstorm sandy repairs a and c rains will run on the f line between west forth street in manhattan in brooklyn. anc trains will not make stops at high, fulton chambers and canal streets.

killed a man they say stabbed 6 people last night. one of the stabbing victims was treated and released the other five rushed to near by hospital in conditions ranging from nonserious to critical. it is not clear what led to the stabbings. back to new york police are on the search for a robbed a bronx laundromat at knife point. >> wearing a mask straight from a horror movie, this armed robber paralyzed the clerk with fear. >> i was afraid to death, scared to death like he was going to kill if i don't give money. >> you thought he was going to kill you. >> the 51-year-old said she was cleaning the washington machines thursday night, when a masked man grabbed her at gunpoint pulled her behind the counter and demanded cash. she opened the register and the man dumped the drawer into his

bag. he took off with $250. scared. >> the customers were hiding. >> yeah they were scared. she called 911 and police arrived within minutes. when we showed video of the crime to customers, they told us they weren't surprised. >> in the bronx stories aren't really knew, it is something that happens every day. >> on the streets, so scared, we want police here on the street to protect us. >> more of a police presence. >> yeah, presence. police say the suspect fled the scene in a gray jeep liberty suv. ironicically they are only a quarter of a mile away from the police precinct. reporting from the bronx. cbs 2 news. a police officer suffered a head injury and two other officers were hurt while responding to a home invasion

call also in the bronx. police got in a scuffle with two of the suspects who they say were leaving the apartment yesterday, they arrested one of them but the other got away. police also arrested the owner of the apartment on drug charges. new jersey officials are warning beach goers about rib currents after a man drowned in sandy hook. officials blamed his death on rip currents. he had disappeared wednesday night, life guards say an increased number of swimmers are getting caught in these kinds of currents, advise swimmers to look out from the shore, the water will look dirty or muddy at the surface while the water looks calm. >> you can feel it even if you're just standing in one you'll feel the water being pushed behind you and feel yourself being sucked backwards. if you do get pushed out by rib current move parallel to the shore until moved out of it. and a dolphin stuck since sunday, authorities say the

dolphin has moved into another area and will hopefully find its way out to the ocean seen. the mammal center is asking the public to view the animal from a distance. tracy has more on why it ended up in the river in the first place. >> they spent hours huddled up on this bridge, cell phones in hand hoping to catch a glimpse who has made this area home. >> if you'll watch. >> i've never seen a dolphin up close unless you count sea world in florida. this is pretty cool. >> this portion of the south river is connected to the rareriton river. >> came to visit us. a volunteer with the marine mammal stranded center believes it came here to eat. >> more than likely this has

followed some bait fish. >> saying the dolphin has been here in the fresh water since sunday, getting pretty comfortable despite being stuck in this 10 to 12-foot deep pool of water. >> a lot of bait fish are also confined to the pool, basically sitting a dolphin restaurant. >> police have cleared the bridge to secure the area, in any distress. they are hoping it swims out on its own before they have to take any further action. reporting from new jersey, cbs 2 news. happening today, dragons the festival. it kicks off at 9:00 at the park in queens, watch over 120 teams compete both today and tomorrow, also enjoy the parade, live performances and crafts and food. 6:38 no parent wants to see their child in pain.

parental leave for employees. cbs reports on how the new policy could be a game changer in the corporate world. >> this teacher says she was only allowed eight weeks off after the birth of both of her children. she and many parents were stunned to find out netflix is offering their employees paid parental leave for an entire year. >> they say it is a way they feel they can maintain good employees then you want to go back to work you feel good working at a place that actually cares about you. >> most moms we spoke with took about three months off of work to be at home with their newborn, dads didn't take anytime off at all. >> when my wife gave birth i only got two days. >> the company is allowing both new moms and dads to take off as much time as they want for the first year after their child's birth or adoption. >> that's great. >> are they hiring? >> they would be good if both parents get that time. >> expert says the reality is
