erupted. >> reporter: the crime scene tape marks the area where investigators are looking for shell casings following a gun battle overnight in ferguson, missouri. the gunfire erupted between two small groups as interim police chief an dre anderson was being interviewed down the street. panicked bystanders took cover behind cars and buildings. fired. >> it was a remarkable night of gunfire. >> reporter: plain clothes police officers caught up with one suspect in a restaurant. he started shooting into an returned fire. they ran and more shots were >> there were four officers in that van. all four fired at the suspect and the suspect fell there. >> reporter: this video shows the suspect injured face down on the ground in a parking lot. >> he bleeding. get him some help, man. >> reporter: the incident

happened hours after more than a thousand people marched from the spot where unarmed michael brown, jr., was fatally shot by a white police officer last year. his death sparked the black lives matter movement. some community leaders are criticizing the police department for using plain- clothed officers during the protest. >> organizers also say they were concerned because police were not wearing body cameras. the officers involved have been placed on administrative leave. an amtrak executive just faced lawmakers and testified about major problems on the new jersey transit. delays have stalled thousands of passengers. here's the details. >> i'd like to begin by offering my apologies for the recent series of northeast corridor delays. >> reporter: steven gardner, the president for the northeast transit corridor faced the oversight committee. he stressed the vintage equipment that led to chaos last month and showed a piece

of obsolete cable. >> recent disruptions are likely to not be entirely preventible, in fact, may increase over time until the tunnel can be renewed and modernized. >> reporter: he said the problems stemd from old supply cable and repairs needed that caused delays on new jersey transit trains. during the week of july 13, thousands dealt with the mess on five days going in and out of new york city. today, lawmakers focused on getting answers. >> to what extent are these problems. >> reporter: the commuters are still aggravate snood if it rains it's delayed, if it's sunny it's delayed, windy it's delayed, it doesn't matter. >> it's unbearable at this point, and their answer is nothing. >> reporter: the concrete walls in the train tunnel haven't been replaced. >> such extensive demolition and reconstruction of the tunnel can only occur during a tube.

>> reporter: this senate committee, also discussing a long term solution and possibly speeding up financing for a proposed gateway tunnel under the hudson. the estimated cost, $14 billion. the federal government has offered loans, but local governors say we need grants to afford it. lawmakers also want to hear from the head of the new jersey transit as well as the new jersey transportation commissioner. they're expected to testify in september. at penn station, elonna gold. >> the senate committee also wants to hear from all the transportation experts. to a developing story. the search for a missing kayaker in duchess county. they are searching for i an jones, the 32-year-old whose kayak capsized. he was with his girlfriend, the daughter of singer annie len ox. jones is still missing. witnesses say neither were wearing life vests. the cause of a deadly truck accident in queens is under

investigation. chopper 2 was over the accident in auburndale this morning as police and firefighters tried to determine what went wrong. a box truck careened across the median of francis lewis boulevard and slammed into two parked cars. the driver the truck was killed. investigators believe he may have suffered a medical emergency while behind the wheel. the nypd is searching for a burglar accused of stealing cash and jewelry. this surveillance is from an apartment bedroom. they say the man entered the bedroom on saturday night. he stole 10 high-end watches in addition to bracelets, earrings and wedding rings. the suspect was last seen wearing white sneakers, black jeans and a light hooded colored shoot. the health department has upped the number of diagnosed cases of legionaires disease to 109. 76 people have been treated and discharged. the mayor and council speaker are set to introduce legislation today aimed at

fighting the outbreak. governor coumo says he's doing everything he can to identify the outbreak. >> it's a combination of testing and treating the towers. we feel like we're making good progress. i don't care if it's the south bronx or sudden place, new yorkers are new yorkers, and i'm going to make sure their government is there for them. >> the disease is spread through bacteria which tends to flourish in cooling towers when it's hot outside. the faa investigates more drone scares in the air near newark airport. pilots from four flights reported seeing drones as they approached the airport yesterday. cbs 2's genel is live. >> reporter: investigators were trying to figure out who was responsible for these most recent cases. drones aren't allowd to flight within five miles of an airport and more than 400 feet off the ground. whoever was operating the drones yesterday, clearly breaking the law and putting thousands of lives at risk.

imagine the pilot of your flight looking out the cockpit to see one of these, a drone hovering just feet away as they're flying thousands of feet in the air. >> it would be quite unsettling because, you know, you see a bird outside, that could bring down the plane too, right, but this is much more serious than that. >> reporter: it happened to four different flight crews sunday as they approached newark airport preparing to land. >> compass 5837, we just saw the drone at 3,000, 16 and-a- half dme. >> you saw the drone. >> 3,000 feet, it was probably about 400 off our left wing. >> about how far. >> about a quarter of a mile at the right drill. >> reporter: that's a pilot from one of the four commercial flights, all of them between 8 and 13 miles from the airport at an altitude of 2,000-3,000 feet when the drones came into view leading to this warning to all newark pilots from air traffic control. >> attention all aircraft, use caution. drone reported. >> reporter: these are just the latest of several recent

drone incidents. last week, there were three separate reports of drones spotted by pilots near jfk airport. the federal aviation administration says drones can be just as dangerous as large birds during an air strike because of their ability to potentially bring a plane down. the plane sunday landed safely as scheduled at newark, but many passengers now calling for stricter restrictions for drone operators who they say put their lives at risk. >> that's crazy form of fun. you know, especially when you're dealing with airliners that are coming in with hundreds of passengers a day. . >> reporter: now, some drones are built with software that prevents them from working once they get too close to an airport and a lot of people are now calling for that software to be installed in all drones that are made. as for this case, whoever is responsible for flying those drones yesterday, they face up to a $25,000 fine and possible federal charges as well. reporting live this afternoon

from newark airport, janelle durrell, cbs 2 news. a violent dead across instanbull, turkey after two deadly attacks. two women opened fire at the u.s. consulate. one of the attackers was shot and arrested. police are searching for the second woman. a gunman also exploded a car bomb at a police station and inspecting the scene. that led to another shoot out. the world has lost a giant of a man. frank gifford passed away at the age of 84. >> he once shared a locker with mickey mantel and like mantel, he was an athlete that was larger than life and worshipped by millions. >> an impossible catch by frank gifford. >> fancy footwork and toughness define frank gifford. he spent his entire career with the new york giants and played three different positions on both offense and defense and made the pro bowl playing each. in 1956, he'd led the team to an nfl championship and was

craig boswell has the latest from washington. >> reporter: donald trump says he was not suggesting megyn kelly had blood coming out of her wherever last week. trump defended himself on nbc's today show. >> it's all fueled by you and the press. it's ridiculous. who would say such a thing. if i would have said that, it would have been inappropriate. >> reporter: since then, roger stone trumps long time political advisor resigned over the fire storm of criticism saying provocative media fights have are overwhelmed your core message. i no longer can remain involved in your campaign. and trump's opponents, who are all trailing him in the polls, attacked. >> do we want to win? do we want to insult 53% of all voters? mr. trump should apologize. >> the kind of rhetoric we've heard of late from mr. trump is election. >> reporter: some are concerned trump's comments could hurt the rest of the g.o.p. field with women voters, but that's something presidential historian peggy newman says is overblown.

>> i actually don't think people experience donald trump as the -- a republican. they experience donald trump as donald trump. he is his own brand. >> reporter: reliable polls have not yet been released since the debate so it's uncertain whether trump's comments have hurt him. craig boswell, cbs news. >> trump has more than 1.1 million mentions on twitter. that is from friday morning through midnight sunday and since the end of the debate, 58% of the mentions have been negative. cnn will host the first democratic presidential debate of the 2016 campaign. the debate will happen on october 13 in nevada. a more specific location will be announced in the coming weeks. hillary clinton, bernie sanders, martin o'maly are among those expected to participate. verizon wireless customers are in for some big changes this week. beginning thursday, customers will no longer be able to purchase discounted phones by signing up for a two year contract. phones will be full priced

reality tv stunt man is arrested for pulling a dangerous prank in hollywood. stevo climbed a crane to protest seaworld after killing a large whale. an ambulance and fire department responded. he was booked on several commit trespassing. let's get to the forecast and see what's coming. it's been nice the past few days but uh-oh. >> and we need the rain. my concern is some thunderstorms too. happy monday afternoon to you. let's see what our weather watchers are watching and waiting and hoping for heading down to the shore. good old marine deblasio in neptune city. her request is, come on, when is the rain coming? soon, i hope. she has some thirsty flowers there. so many waiting for the rain.

some reports of dark clouds to the west. this is interesting. this is adam heder in middletown and he also shares the same kind of feeling, looking forward to some rain so the grass will go from hay to yay. and i love this picture. he says, kids don't try this without adult supervision, but beautiful picture there. all right. now, the weather picture is changing. we see some pretty skies in the city right now. to the west though, we do have some clouds rolling in. 81 in the city. so we already hit 81 so we bumped the number up a bit, closer to the normal high of 83 afternoon. low to upper 70s north and west. 80 in great neck, 70 in river head. 81 in tom's river. 83 is the normal. i think we can do that. plenty of sun out there right now, not the record of 98. sun sets at 8:01 and speaking up, even with the clouds filling in, the uv forecast is an 8. burn time 15-25 minutes. if you'll be out this afternoon, do remember a moderate rip current risk still

for the south facing beaches of long island. these threatening clouds growing nfilling in and rolling in from the west. warren county, you'll see some showers. we've had some report of a nice soaking rain. the area low pressure is still leaving the lakes. it is going to be met by some moisture to the south so it looks like we could see 1-2 to possibly 3" rain out of this through the day tomorrow. timing it out for you, relatively quiet into the afternoon, early morning commuters though, you're dealing with the risk of some imbedded thunderstorms, could even see a little bit of hail, some gusty winds with some of these storms, and then another round in the afternoon. see what i mean in then another round tuesday night and then we see those left-over showers you usually see after a storm exits the afternoon of the next day. the concern is, we could see an isolated severe thunderstorm, so not only the potential for some localized flooding, but could see some wind damage as well. but then after wednesday, it shapes up and it's relatively quiet and warmer week. but do exercise caution, plan on it wet tomorrow.
