>> it's been a busy morning. look at the numbers, minute owe la, 1.75 inches of rain, and leavitttown not far behind. and an inch in the city and using some of the computers to extrapolate the numbers we saw this morning. many communities right in the one to 2-inch range and some closer to 3 inches. and we're not done with it yet. we have light rain continuing for parts of long island. we want to show you a radar perspective. there's heavy rain off the jersey shore. you're going to see another round. and notice the thunderstorms to the west are strengthening. they're going to push into really a moisture rich environment and there's added lift with a little bit of heat this afternoon. the national weather service wants to remind you there is a slight risk of some severe weather. and then we could be dealing with gusty winds as well. so watch out the rest of the afternoon. good news is some better weather is coming and we'll

have the rest of the forecast in a bit. now back to mary. new information on the new jersey crash that seriously injured actor tracy morgan and killed his friend. the ntsb pointing at blatant mistakes made by the truck driver. we have details live from the newsroom. >> reporter: the ntsb blames fatigue for the deadly crash. investigators say the driver didn't sleep for almost 30 hours straight before the accident. it was june of 2014 on the new jersey turnpike. a walmart truck slammed into a vehicle in cranberry, leaving the comedian with brain trauma and broken bones and killing james mcnair. a year later he talked about the incident. >> he was a good man. it's hard for me to see he's gone.

>> we knew each other a long time. >> reporter: investigators spoke off camera saying this could have been prevented and point the finger at the walmart driver, kevin roper. >> an examination of his work records showing he had four hours of sleep opportunity and had been awake in excess of 28 hours at the time of the crash. >> roper refused to be interviewed and they examined his work and phone records. he missed a night of sleep and was off the clock when he chose to drive to delaware to start his walmart truck route. and the deadly crash happened when he was on the clock hours later. >> this demonstrates the potential consequences of one poor decision regarding fatigue. >> reporter: the ntsb provided a simulation of the crash. they say roper was going 65 miles per hour when the speed limit had been reduced to 45

because of construction. and now walmart must adopt a fatigue safety program and considered aing technological the fleet to keep drivers away. walmart has agreed to do that. >> reporter: the truck driver has pled not guilty to several criminal charges, including death by auto. his case has not gone to trial. alawn in a gold -- the legionnaires' outbreak is under control. city council is moving forward with new legislation. janelle burrell has a report from city hall. >> reporter: amid speculation that mayor de blasio and governor cuomo are at odds, the city is moving forward with ma the mayor says is early detection. >> this is treatable with antibiotics as long as we know. >> reporter: a councilmember

remembers one of the areas most affected. she's among the councilmembers considering the law that could be among the first of its kind in the country regulating all city cooling towers, the source of the bacteria. >> a database and we have to know where cooling towers are. >> reporter: twelve people have died from the legionnaires' disease of the 113 cases diagnosed so far. most patients are in the south bronx. all cooling towers would have to be registered with the city and regular testing and cleaning would be required. and quarterly inspections and annual certifications would be required. >> a new set of realities we have never crowned before in the city. >> and governor cuomo has his teams scouring the bronx, testing for the bacteria as they try to pinpoint the source.

action against building owners who don't maintain their towers. >> i urge every building owner for ethics and legal reasons to attend to the cooling towers immediately. >> two cases of the disease have been diagnosed in rockland county. the town hall meeting will be in the bronx. an autopsy is set for today to determine if a body found in the hudson river is that of a manhattan photographer. the sheriff's office believes the body found is 32-year-old ann jones. jones was kayaking saturday morning with his girlfriend. the daughter of singer annie 11 knocks. the kayak overturned. police arrested more than a dozen people on the fourth straight night of protests in ferguson, missouri. marking the one-year

anniversary of the death of michael brown. some threw frozen water bottles and other objects at police. gunfire erupted sunday and police shot and critically wounded an 18-year-old who they say fired at their unmarked suv. senator charles schumer has outlined a plan but how much will it cost and how long will it take? >> in a matter of years, not decades, the only two rail tunnels running under the hudson river into manhattan will become inoperable. >> reporter: it's never been more necessary to move forward with amtrak's gateway project. the idea is to dig two new tunnels to double train capacity. the first step is already underway with foundation for the tunnels already in place under the hudson yards development project.

the rest of gateway comes with a hefty price tag. >> it will cost $20 billion. initial estimates for the tunnels have ranged from 10 to $14 billion. and additional work included but not limited to building a new portal bridge over the hackensack river in is a caucus is estimated at $10 billion. and these are just estimates. >> reporter: he's proposing amtrak, new york, new jersey, and the federal government team up to form the gateway development corporation. >> amtrak can't access mass transit funding. that's how congress works. >> port authority and regional transit agencies can't access federal railroad dollars the way amtrak can. we'll only get gateway done by adding up the pieces of financing. >> reporter: as for a timeline --

real life drama for kelly rutherford. she's in court after refusing to send her children to their father overseas. >> we have more on the international custody battle. jill-- >> reporter: yes, kelly rutherford was supposed to send her 8-year-old and 6-year-old back to their father in monaco

but refused to do so. a judge ordered the actress to appear in court this morning. and she has to face the consequences. >> kelly, how are the kids doing? >> great, thank you. >> reporter: she arrived at 10 a.m. to face the judge. instead of sending her children home, she released a statement over the weekend. i cannot send my children to live in a foreign country. the actress and now ex-husband custody battle. in 2012, a california judge sent the children to live with their father in france because his u.s. visa had been revoked and they would spend summers in new york with their mother. the actress has been trying to move her children back to the united states and both california and new york family courts ruled they no longer have jurisdiction over the case. she said no state in this

check out the dash cam video of the storm's devastating impact in taiwan. the mini tornado was whipped up after a typhoon over the weekend. you can see a car sucked into the funnel cloud and a person lying on the side of the road. 20 people are feared dead or missing. it was one of the strongest storms in the world so far this year. colorado and new mexico have declared stretches of the animas river and san juan river disaster areas. possible long-term effects and

rain so far. and in lafayette, new jersey she's had .8 inches of rain through this morning. right now just gloomy. dew points are way up there and we have low clouds and fog limiting visibility. and there's a lot of available moisture. so you could see an isolated thunderstorm this afternoon. 72 and winds in the city variable at six. and that's somewhat misleading. some of the weather watchers picking up on this as well. we've seen winds from the south and southwest gusting to 30 plus miles per hour. it's a blustery day. 72 in the hamptons, and 73 in monticello. 74 in sparta. temperatures are a little cooler. in some cases a lot cooler than this time yesterday. dew points are a lot higher so it's muggy. and that atmosphere ready for a few more storms. 79 if we work real hard and that's nowhere near the record of 102. sunsets at eight and there's

not a lot to see. heavy rain clearing the twin forks. a few more isolated pockets of rain through sufficient -- suffolk county. and look at the strengths gathering strength and the models are picking up as well. future cast shows isolated strong to potentially severe thunderstorms, not a lot of coverage and we'd see more rain around individual storms as late as 7:00 or 8:00 tonight. this is looking better for the mets and beach boys to the north. hopefully, nice perseid meteor shower viewing tomorrow morning. we hope. we'll try to get some sun in as the low leaves. and then thursday shapes up. that's a pretty nice day. and then it's going to warm up too. by saturday we're close to 90 and with just a little extra humidity we could see a pop-up shower or a storm in the

afternoon. be careful this afternoon. any individual storm could lead to localized flooding. >> once this is out of here, looks pretty good. >> download the weather app and get the forecast and check live radar and send us your weather pictures and video. in health watch, steroid therapy may be the key to treating pneumonia. it reduced the need for breathing tubes and lowered the risk of a life-threatening complications. patients with -- discharged a day sooner than normal when they received steroids. a 91-year-old retired surgeon is charged with importing cocaine hidden in soap. he was charged with importing drugs from india. police found 27 packages of soap which tested positive for cocaine. he could get life in prison if convicted.
