since 6:00 this morning. live with this story this morning. >> reporter: all of that unfolding just about 15 minutes ago first we heard rapid gunfire filed by those loud booms coming from right here down the street on staten island where you can see it is still very much an active scene this afternoon. all of this began about 6 hours ago with u.s. martials trying to execute an arrest warrant but it quickly turned into a dangerous and chaotic scene. >> armored vehicles surrounded the court on staten island this afternoon where inside police say 38-year-old garland, a career criminal, and accused gang member is barricaded inside, armed and refusing to surrender. >> we believe him to be armed of course, with at least an assault rifle. investigators say the stand off began shortly before 6:00 this morning when u.s. martials came to the home where his

girlfriend lives, to execute a federal probation warrant but he had his own plans. >> upon making entry into the apartment, we had a smoke- filled situation. saying he was in the basement and allegedly started a fire inside. when firefighters got to the scene, police say he pulled out a gun and began shooting firing about 12 rounds. two of the bullets striking a 50-year-old lieutenant. maria is his neighbor, one of several residents police have evacuated. >> she heard the fire department, heard the shots, which was two shots then she approaching. less than two hours after those initial shots this post on the facebook page were in through his account quote today i die. afraid of that. >> concerned friends now at the scene including this woman who

relatives identify as his girlfriend, inconsolable. earlier seen leaving with investigators, investigators lieutenant is in stable condition. >> it is our hope that this can be resolved you know, peacefly. they are looking to try to convince the young man to come out peacefly. >> began just a short time ago a series of shots and loud explosions coming from the home here where he has been barricaded inside since 6:00 this morning, at this point it is not clear whether he was shot or whether he has surrendered to police, we are still waiting for an update afternoon. cbs 2 news. thank you. we continue with more breaking news this time a tractor trailer over turned on interstate 80 spilling debris on the new jersey transit tracks, jim smith is in chopper

2 with the details, jim. >> what's amazing you can see the bucket portion of that truck came off the truck and it is now sitting across those supports for the over pass, this happened on the eastbound side of route 80 near exit 28, happened around 10:30 this morning, there was a second vehicle that was involved, what's amazing is that both the drivers sustained what is being described as minor injuries crews are on the scene trying to get the truck as well as that bucket removed from the roadway and the over pass, what is underneath there is the new jersey transit tracks, they have been stopped the transit is planning on doing bus service as an alternate as far as the traffic goes you can see the delays about a four to five mile delay on the eastbound side of route 80 again getting into the area of exit 28 where there is only one lane open, also about athree-mile delay on the westbound side passing by the scene. jim smith, cbs 2 news.

all right jim thank you. a small earthquake hit new jersey early this morning the center located in the central new jersey down, shook people in neighboring summerset counties, andrea grimes has this report. in the middle of the night we both looked at each other like what the heck was that? >> they had no idea at first an earthquake woke them up hitting their town in new jersey. >> we thought the bed was going to go through the house, that's what we thought actually. the geological survey reports a quake struck two miles north around 3:30 a.m. >> kind of like a thunder clap more of a rumble, i woke up because the windows. i thought i felt something, she slept through it. >> i didn't realize. i woke up and i felt like the house had cracked and then you know, sitting there like that felt like an earthquake. authorities here in summerset county and in neighboring morris county

saying several residents called police to report rumbles. officials say no one was injured. there was no reports of damage, however about an hour later we did have a transformer fire but we don't know if that was related or not. jersey central power and lights say the issue knocked out power to 40 customers. as for the earthquake, he is glad it wasn't worse. >> i went around, checked my house, i went downstairs, woke fine. >> all though rare earthquakes are not uncommon a few small one happened here back in 2010. reporting in new jersey, andrea grimes, cbs 2 news. the last earthquake much smaller than this oneregistering 1.9 southeast of trenton in december of 2014. the nypd continues a search for a gunman who killed one man and wounded two others in brownsville, police responded to a report of gunfire just

after 8:00 last night on saratoga. one was pronounced dead later at the hospital, we spoke to the mother of one of the other wounded men she did not want to be identified. >> do you know why anybody would come up to them and do in? >> i'm not sure that's what i hope the police can find out, i really just hope that's what they can find out, i don't know what happened. i live around the corner just someone came and told me, my son was one of the victims. the gunfire was reported to police by the new shot spotter detection system. a school bus driverred said the brakes failed, it slammed into a building yesterday morning 11 children, the driver and two other adults were hurt, their injuries nonlife threatening, video shows the bus running a red light hitting the suv and smashing in the corner of a liqueur store. they are investigating the claims that the brakes failed.

all right john. >> thank you very much. we're continuing to follow breaking news out on staten island the fire commissioner at richmond university hospital where a firefighter was taken after he was shot during a stand-off on staten island. let's listen in. >> somewhat stunnedded by the fact that a firefighter would be shot in the performance of duty. >> can you provide information about the last time this happened years ago? >> that was quite a bit different was that members were forcing a door and somebody performing security mistook that for a crime and fired their weapon and hit a firefighter in the foot so a little different circumstances. >> so this lieutenant was crawling on the ground under the smoke? >> he had -- he had left his members at the door with the hose line and said i'll call you when i find the victim or the fire, crouched down below the smoke and that's how it occurred. that routine for a

lieutenant to go ahead like that? >> yes it is. our officers are known to lead from the front and that's what he was doing. >> what can you tell us about the fire itself? >> well the fire, whatever, we still don't know what was on fire, he did not, he was not able to find it and the fire self extinguish. whatever that perpetrator set on fire it did not spread throughout the building. >> what number of fire department after the ambush in webster new york put in place for protocols when situations like this happen, did you guys put that in place today? >> we have protocols, we have active shooter protocols, this instance was, until the lieutenant was shot not a known active shooter event. once it occurred certainly our members backed off and law enforcement was on the scene.
