just moments ago for allegedly beating a prisoner, violating his civil rights and according to the fbi lying and asking cofer it up. -- to cover it up. >> no one is above the law. >> reporter: the man once sworn to uphold the law finding himself in handcuffs today. former chief james burke in fbi i did accused of using his power to assault a prisoner and then cover up the crime. >> burke repeatedly met with members of the police department who witnessed the assault to agree on ways to get their story straight. >> reporter: the indictment dates back to 2012 when christopher lobe was arrested for breaking into the ex- chief's unmarked police suv, admitting to stealing the police's duffel bag. inside the bag were the chief's police belt and ammunition but lobe insisted that he found pornography and other disturbing items. lobe and his attorneys say that

torturing him. he says chief burke and other officers beat him with burke being the main attacker. >> the defendant burke entered the interrogation room and is alleged to have repeatedly slapped and hit him about the face. >> reporter: they say the investigation proves burke tried to hide what he allegedly did. the 51-year-old abruptly stepped down from his position in october, just weeks before the arrest today. >> when caught at a cross roads between right and and wrong, burke took a short cut on the path to justice. >> reporter: and we just heard from burke's attorney who is denying the charges against his client. again, he is expected to go before a judge this afternoon. we're told by the u.s. attorney, if he is found guilty on the charge, he faces up to 5.5 years in federal prison. reporting live from central islip, long island, janelle burrell, cbs 2 news. >> thank you. a suspect is under arrest in the murder of a brooklyn rabbi in florida last year.

as he walked the to his daughter's home. natalia zea is live from miami gardens in florida with more. >> reporter: well, chris, early this morning, police raided this home here in miami gardens. they arrested the teenager who lives here for the murder of that rabbi. the rabbi's family is grateful for the arrest but the suspect's family says this young man is innocent. >> not yet but on the way. it's a step towards justice. >> reporter: he got the call from the state attorney's office this morning that after 16 months, they made an arrest for the murder of his father-in- law, a beloved rabbi. the suspect was just 14 at time he was shot to death as he walked to synagogue on the day of the sabbath. the crime put the jewish community in north miami beach on edge. >> sad that a kid not even 18

i don't know what his story is, the background, but there's no excuse for an act like that. >> reporter: charles' loved ones see this arrest differently. >> this is being pinned on a young teenager that has a little issues, who doesn't? and this is just ridiculous. >> reporter: the mother says police raided her home in morning which is about a mile if the murder scene. she says the officers waited until after she went to work to arrest her son for a murder she says he didn't commit. >> i'm going to fight this. to the death. to i go in my grave. >> 100% certain he didn't do this. the whole family was home with him when this occurred. >> reporter: a grand jury has already indicted the suspect. he will be tried as an adult. and the state attorney's office is holding a news conference this afternoon to give more details on this big arrest.

natalia zea, cbs 2 news. >> thank you. the nypd is search for a hit-and-run driver who slammed into a teenager and left him to die in the road. diane macedo spoke to the familiar family. >> reporter: the nypd combed this busy intersection looking for any clue that might lead them to the driver that hit and killed a 17-year-old. say the black toyota camry was traveling westbound as he was crossing this intersection with junction boulevard around 11:00 last night. they say after the car hit him, it continued in the same direction. >> [ speaking spanish ] >> reporter: i loved him very much, he was my only grandson, his grandmother told me in spanish. she says he lived with her and his parents just a few blocks away from the crash scene. she says he was walking home from a funeral when he was hit. >> how can you just two by, hit somebody and then drive off. like don't you feel guilty or anything? >> reporter: neighbors are part

reported the green laser pointed at the pilots around 1:00 a.m. this morning when the plane was airport. the aircraft did land safely. no injuries were reported. laser light shows have become a trend this holiday season but the lights could be hitting planes overhead. just last week, an american airlines pilot in texas reported seeing a blinding flash that was later traced display. pilots say the decorations could have a similar effect to getting hit by a hand held laser. the faa says consumers should make sure the lights are hitting their house, not shining off into the sky. dog thes left alone in a kennel on the sidewalk. is it a genius idea or a nightmare? the kennel controversy ahead. but first, sharon oz born from the talk is here.
