>> reporter: the victim has bite marks and scratches all over his body. now the question is where did the bear go here in this wooded conservation officers say they've set up traps. they are trying to catch it, and they say the bear hasn't been spotted since the attack. >> a sunday afternoon hike by the split rock reservoir in the rockaway township nearly turned deadly for 50-year-old boy scout master chris petronino >> i was very upset and concerned for him and the boys. >> ann shannon a family friend support. he has been treated at the hospital for bite marks and scratch marks across his body. >> he had good intentions to take them out there and show them some things that he knew when he was a kid that were fun and adventurous. >> the problems started when petronino showed those scouts a cave. as he walked in, a black bear grabbed his foot, pulled him

biting him. he tried fighting it off. he struck the bear with a hammer but the animal wouldn't let up. emergency radio calls went out shortly thereafter. >> we have a gentleman in the cave with a bear. >> the three children ages 10 to 12 stayed calm outside the cage and called 9-1-1. they location. they put their skills to use. >> they have started a fire possibly for a smoke signal. >> the scouts put food near the cave to lure the bear out, but that didn't work. the bear stayed in the cave for a substantial amount of time and eventually ran off. emergency crews finally reached the group an hour and a half after that 9-1-1 call went out because of the rocky and steep terrain. they airlifted him to morristown medical center. his injuries are not significant. >> thank goodness, especially this time of the year you don't want anything bad to happen. >> reporter: such a scary situation. investigators say the bear was trying to protect his hibernation spot.

was right by that cave just two bear. we're live this afternoon ilona gold cbs2 news. thank you. new this noon, a bronx father is under arrest after month-old son. mark morgan is in morris park with more for us this noon. >> reporter: the investigation is ongoing here in the bronx. here is the latest information that we have. police have arrested 51-year- old jose feliciano of the bronx shown here in this surveillance video. feliciano is accused of smothering and smoking his 2- month-old son 11 days ago in the bronx apartment he shares with the child's mother danielle white. the child's body is believed to be in the duffel bag that feliciano is carrying in the surveillance video. the woman confessed she and foe lease owe buried the child's body. i spoke with kimberly rodriguez

>> every time i get on a train i'm praying. >> riders can travel with more assurance. over the weekend the railroad activated its positive control system on its route between new york city and philadelphia. the system is designed to automatically apply brakes on a train when it goes over the speed limit. >> you have 60 seconds to, you know, make some kind of move, start slowing down, apply the brakes, and if you don't the computer system will recognize that, and it will sit on the train to stop itself. >> lance today is traveling on amtrak as a passenger but he knows the system well, installing it in parts of virginia as a foreman. >> we're out there and our heads down and our back's something protecting us, you know, while we're out there working, and we get to go home to our families too. >> moments before the derailment in philadelphia the train was traveling 106 miles per hour more than double the speed limit, soon after congress mandated that all railroads have the positive system in place by the end of

they ended up extending the deadline after commuter railroads complained that the complicated technology would make it difficult to implement the controls so quickly. >> feel safer knowing that something is happens, the train is going to stop and that >> major freight and commuter rails now have until the end of 2018 to get their systems in place. reporting from penn station, janelle burrell cbs2 news. >> the safety system had been installed on the southern stretch of rail between new york and philadelphia at the time of the derailment but not on the northbound tracks where that accident happened. arraignment for a long island man charged if an apartment rental scam, 26-year- old joseph hernandez of sayville posted internet ads promising a room for rental. prosecutors say he then stole the rent, security deposit, money and personal property. fernandez is charged with grand larceny. he was originally arrested in september but was rearrested when investigators say he

campaign 2016 has one less cob tender. senator lindsey graham posted a video this morning officially ending his campaign for the white house. >> today i'm suspending my campaign for president. i want to thank everyone who's taken this journey with me. >> the republican hopeful said he had suspended his campaign country. he did not participate in last week's republican debate. the nypd is looking for two suspected thieves accused of brooklyn apartment building. police want to question the two men about several packages that were dropped off by fedex and then taken from the lobby of the bed sty building last month. stolen packages are a big problem across the country, especially during the holiday season. police in arcadia are plants fake packages to bait and track thieves. >> once the package is stolen by a suspect an alert occurs at the police department, and usually within a few minutes

>> one person was killed, dozens injured. cbs2's john blackstone has more. >> in a moment of horror the driver over this car barreled through a las vegas sidewalk. witnesses say she had a toddler >> people were punching the window trying to get the child out of the backseat. she accelerated again and kept mowing everyone down. >> emergency responders were forced to set up a triage center to attend to nearly 40 victims, the normally bustling vegas strip was partially shut down. >> she went up off the street on to the sidewalk two or possibly three times, and based on the evidence and information from our fatal investigators, at this point we are treating this as an intentional act. >> police say the violent rampage started near the planet hollywood resort. the suspect drove on and off the sidewalk reaching the paris hotel and casino. >> it literally looked like she wasn't even trying to stop the car. she was just sitting there like just looking straightforward, not even moving. >> police say the suspect attempted to drive away but was tracked down in a parking lot.

trip in, remember, tuesday it's a little wet. wednesday we could see a soaker. we'll look at a futurecast in just a second. over my shoulder, some clouds right now, mostly cloudy and 49. it's a west wind waiting for that southwest wind to fill in. we've had gusts 20 to 25 miles an hour. warmer numbers to the east, hanging on north and west. 37 in monticello, but across the board it's 3 to 13 degrees warmer than it was this time yesterday, so we're shooting for 55. we're already above normal, but well above normal this afternoon. we'll likely hit that late in the day as well. not a record today. sunsets at 4:31. we set our sights on winter at about 10 minutes to midnight tonight. clouds and some sun, some wet weather off to the west. a lot of that will miss us, but an area of low pressure develops along it. so wednesday is the busy day. don't forget, you've got a few showers tomorrow morning, on

showers tuesday afternoon could slow you down. it's wednesday where i think we see better coverage and heavier rain into the afternoon. so if that's your get away time, be mindful of the fact that you're dealing with rain and fog in the morning, heavier rain in the afternoon on wednesday, and then there you go, 70 smashes the old record at 63 for christmas eve. still mild on your christmas day friday. >> does not seem right. >> no, shorts for christmas. i can't believe it. >> palm springs,. >> thanks john. let's go to fresh grocer tony tantillo. noon. >> the taste of today is going to be purple asparagus. i love doing tips of asparagus this time of the year. for some reason in the winter time asparagus is great. in the spring it becomes locally grown. right now it's being imported in, very minimal, very few are locally grown. when you see purple asparagus that's important, fairly expensive, select and store it right and you will enjoy it. what to know, when you overcook it it turns green.

matter of fact the color's beautiful, quick selection, purple from top to bottom, a lot of times you're going to find purple asparagus with the white trunk. that's how it is. you don't have to get rid of that white trunk. just shave it down a little bit. what i do, i take the asparagus and i shave with a peeler halfway, all the way down. you got purple and green after you shave it. maybe a little white at the end. then i just steam it, that's all. not too long, all the colors are vibrant, add a little bit of lemon juice in the water, in the steam, and the colors are nice and vibrant and delicious looking. you will love it. mix it with the white and green, asparagus salad, hot or cold, and i'm tony tantillo your fresh grocer. always remember to eat fresh and stay healthy. it's a sure sign of the christmas season. >> we'll check out the
