>> even on some of the coldest nights he said he'd rather this spot than the unknown of a city shelter. >> there is criminals in there, people that came out of jail put them in there, mentally ill people in there, you wouldn't let your dog. >> he calls their home refusing to accept governor cuomo's state executive order that would mandate people on the streets be forced into shelters when the temperature drops below 32 degrees. also refusing to accept the order, mayor deblasio. >> if someone is in danger, we will bring them in period. >> the mayor says it is a practice that has essentially already been if place. >> look. i want to be very, very clear. for years the nypd and our outreach workers if they believe someone is in real danger they have a right to bring them in and they have been bringing them in. >> some speculate the order is politically motivated bullying who has been add odds with the

mayor deblasio has been facing the homeless. there is a question whether the legal. >> it is a violation of constitutional rights. donna is executive director union. >> rounding people up because they are homeless is is bothillegal and bad policy. if people want to go. a band-aid. now, the head of the civil liberties union says that you can only legally force the homeless off the street if they are committing a crime or hurting themselves or others, they say that they will closely be following this mandate to see how it is enforced. reporting live this afternoon from the upper west side. janelle burrell, cbs news. a rough start to 2016 for

market plunged 7% on the first day of trading for the year taking a look the dow nasdaq down 432 points. what's going on here. >> reporter: the dow having its years. at one point it was down 467 points that's the worst since 1932. of course all of this as you mentioned coming from the 7% drop in china, china has new rules in place so that if they have a big drop, they have what's called a circuit breaker they stop trading, take a breather so people can get their thoughts together and go back in hopefully with a level head. that happened at a 5% drop. took a 15% break and the market continues to fall further. after it fell 7% they closed the stock market in china that

just have to move on. >> he did say at that players meeting he did tell the players if it is the last time they are meeting he enjoyed their time. he'll learn his fate at 1:00 today, all indications are that the two sides will go in different directions. the hunt is on for a man who stabbed a mcdonalds employee to death outside a restaurant in the bronx. that restaurant just across the street from the 50th police precinct station house. meg baker joins us in the kings bridge section, meg. >> reporter: chris and mary, chilling start to this monday, police are still searching for that suspect said to be a homeless man that stabbed a mcdonalds employee to death right here in this parking lot on 236th street and broadway. we spoke to family and friends of the man that died.

former over night manager was stabbed to death outside the fast food restaurant. >> the suspect was in the bathroom for an extended period of time when he ordered him out and went into the parking lot. that's when he stabbed garcia in the neck and chest. left behind, a shoe and cell phone. they say homeless people use the mcdonalds daily to use restroom or sit inside. >> if a homeless person show up we say you can't be here, if they start getting aggressive we would just tell them to leave before we just call the cops. garcia's father answered the door at his riverdale apartment. >> i'm sorry but my mom is devastated.

>> he was just coming out of work, an honest earning man, a family man and he was just a great person and the fact that this happened was just, there is no words. after the attack the homeless man left the scene. garcia went back inside the mcdonald's and collapsed taken to new york presbyterian where he passed away. >> garcia's former team said he never felt unsafe at this location at mcdonalds where he worked because there is literally a police precinct just around the corner. behind me you can see still very much an active scene as police search for that suspect. we're live in the bronx, meg baker, cbs 2 news. the new year brings extra tax break for commuters who take mass transit the combination will allow half a million city workers to shave up to $1,000 off their annual

how it will affect their employees, diane has more on the new commuter tax benefit. >> mayor deblasio and senator schumer started their morning offhanding out fliers to subway riders hoping to spread the word about a new commuter tax benefit. >> it is brand new, all you have to do is get your employer to fill out a form and you get it off your taxes. were you aware before you saw them? >> no, no. >> i think it is a good opportunity for all of us, that take the trains every day. the benefit allows all commuters across america to deduct $255 to pay for mass transit costs way up from last year when congress cut the benefit to $130. >> you could always do this if you drove to work, but if you were a mass transit user, you could only take only half of that deductionnd for awhile you couldn't take any of that deduction. >> unlike previous increases which had to be renewed, the

>> from this point on, that number will continue to grow with inflation. >> still new york city took things one step further with a new local law. >> it requires businesses with 20 or more full time employees to allow workers to use pre-tax income to pay for their commuting costs before this was voluntary. >> the mandate covers roughly 22,000 city businesses who have until yal july first, after that they have 90 days to fix the violations or face a fine up to $250. some want more. >> deblasio and schumer say they bush for it to be include, in brooklyn, cbs 2 news. there is much more ahead at noon, schools shut down for the day after the entire school bus

vandellized at some point over the holiday weekend. officials tell us when the school bus drivers arrive for work this morning at about 6 a.m., they discovered things like smashed windows, slashed tires and more extensive damage. >> the damage ranged from punctured tires broken windshields to fire extinguishers that were discharged within the bus or missing from the bus. >> any idea who would have done this? >> no idea, the matter is being investigated by the state police. the state police tell us that they are looking into whether this could have been students or someone else, they are calling it a very serious case of criminal mischief. the school district officials tell us they are doing emergency repairs and hoping to have everything back to normal so they can get the students to school tomorrow, they are having an emergency meeting this afternoon to make a decision but right now, they are scrambling to make repairs
