good afternoon, i'm mary. we begin with breaking news. heart break on long island, a 12-year-old struck and killed as she walked to friends. we are live with the details. steve -- >> reporter: a 12-year-old girl on her way to junior high school behind that billing over there at about 7:30 this morning, she was hit by a nissan. she did not make it. the impact was devastating, just to take a look at the car involved. police say at this point there, is no criminality. the speed limit here 30 miles per hour. and the driver got out of the car to try to help but according to police, there was nothing that could be done. >> the impact was extreme. okay. and that is unfortunately why the 12-year-old sub comed to her injure -- died of her injuries.

counselors at the junior high where the 12-year-old girl was headed to school. uber drivers are taking to the streets without their the cars to protest the recent fare cuts. we are live with reaction to this. >> reporter: mary, we are here at uber's headquarters where more than a hundred drivers are on strike and they are urging all uber drivers to do the same. they say the company continues to cut into their earnings and they now say uber either needs to raise the fare, low its commission or ideally both. uber recruits drivers with the promise of good money, a flexible schedule and the freedom to be your own boss but after the company cut fares by 15% on friday, drivers say uber is taking them for a ride. >> uber used to charge $3 a mile. there used to be 10% commission. they dropped the price to

and now the commission is increased to 25% and the price is dropped by another 15%. i will ask the american public, if your salary is decreased by 45% in two year, how would they feel? >> reporter: uber requires drivers have cars that are at most five years old. >> now it's easy and affordable to get into the most popular cars on the road. all uber partners are eligible. even those with poor or no credit history. >> reporter: but drivers say some of the plans come with high interest rates and while they seem sensible when drivers were making more money, now they feel trapped. >> i see guys who have paid a car that cost $20,000, pay $60,000. they just sucked in into this for five years. >> reporter: still uber says the new fares benefit drivers by raising demand telling drivers last night, quote, partners spent 39% less time waiting for a trip compared to

our goal was to turn your unpaid time into paid time and we have seen a 20% increase in hourly earnings but drivers say that hasn't been their experience. and the new york taxi workers alines says it will extend beyond uber. >> well, once you have a large player in the industry lower its rate, there's a desperation for everybody to start lowering their rates so what happens to the drivers? how are people expected to survive? >> reporter: now uber wouldn't talk to us today. but they have said in the past f the new prices don't work out, they'll go back to the old ones. but the drivers say they're more forced to drive, the more expenses they continue to occur and there's only so much longer they can go on before they're forced to leave the company altogether. diane macedo,. >> thank you. now the first head to head

tonight with the entire country watching and waiting. cbs 4 news marcia kramer has more. >> reporter: well, mary, because it's a caucus and people can change their minds biting time. the first votes of campaign 2016 cast as the latest poll out today gives donald trump a decisive lead. he is now seven points ahead of cruz. and bernie sanders is now beating hillary rodham clinton by three points with iowa voters but it's within the margin of error. and now candidates making their final push in both parties. >> one last thing. >> reporter: an early wake-up call on caucus day. even donald trump is anxious. little bit nervous and you know, i like to win and i want to win for the country. i don't want to win for myself. election night. >> reporter: marco rubio stopped at a des moines cracker barrel with his kids this morning.

>> we can't afford to make a mistake. >> reporter: well, des moines register poll this weekend shows 45% of republican voters in iowa say they could change their minds about who they're going to support tonight but both sides are nervous. for republican, whether trump can convert fans into voters. and on the democratic side whether organization, that's clinton or passion of younger voter tell us, that's sanders will prevail. >> thank you. an update this noon on a death investigation in hoboken. a person found shot can killed inside a home overnight. janelle burrell has more from the scene. >> reporter: this normally quiet block now teeming with police and investigators. the search focused around a single family home on grant street where police say they responded to a shooting around 1:00 this morning one person was injured and died. >> our doorbell started ridging a bunch and i heard the lights

was someone who had a good time on sunday or something. >> reporter: her apartment is next door to the home which neighbors say is occupied by a middle aged couple. neighbors say they saw a body being removed from the home this morning. >> i have never seen anything like this before or heard of anything like this before. >> it's a super safe neighborhood. kids running around. really pleasant. i actually moved here because it's nice and quiet and safer. >> reporter: police say the death is being investigated as a homicide but it's not clear what the motive may have been or whether investigators are still looking for a suspect. reporting from hoboken, janelle burrell, cbs cbs 2 news. >> and police have not released the name of the victim. city officials are using cameras to enforce bus lane rules along harlem's busy 125th street.

during busy hours will get a ticket. and now to a cbs 2 news exclusive. an amtrak passenger tells us about last night's scare aboard a train headed to new york. a passenger reported hearing a loud boom as it passed through philadelphia and then they saw a window with a large crack. >> one of the people looked and said, oh my god, something hit the train. and immediately everybody looked and said, it's a gun. so. >> a gunshot has not yet been confirmed. for now, amtrak says several objects hit the train. no one was hurt. and amtrak and philadelphia police and the ntsb are investigating this. officials with the world health organization are holding an emergency meeting today to discuss ways to combat the zika virus outbreak. carried by mosquito, the virus has been linked to a rare birth defect in thousands of baby, mostly in south america. they warn there could be as many as 4 million new infections this year. there is no treatment for it.

the hunt is on in new jersey for gunman police say killed a man and young mother inside an apartment with her children just feet away. police say 23-year-old ashley jones and a 28-year-old were shot to death saturday night in newark. her three children were home but not hurt. one neighbor who did not want to be identified said she got into an argument with an ex- boyfriend just last week. and police have not released suspect. her children are now being cared for by family. a string of city subway slashings has commuters on edge.

man they say attacked a 27-year- old man at central park north subway station on 110th street station yesterday morning. police are discussing the possibility of banning career criminals from the subway system but many riders question if it's legal or enforceable. >> that's a good idea but if they're like -- like, if they can do it but i don't know if they're capable of doing it. >> it's a crazy situation honestly. hopefully they get it under control. >> despite the recent attacks, police commissioner police commissioner bill bratton says -- attacks, police commissioner bill bratton says the subways are safe. a driver turns the the tables on a police officer who she says was speeding recklessly. she gave him a piece of her mind. >> there's an officer in front of me that i've been following since miller. >> reporter: she did something out of sudden anger, she pulled over a miami-dade police

>> the cop passed me so fast, my car shook side to side. and that's when i said, you know, [ bleep ] it, this is -- what is the energy and i got upset. -- what is the emergency? and i got upset. i started speeding up and i stopped when i hit 80. >> reporter: she put her cellphone on the dash stand and recorded the pursuit narrating along the way. >> driving recklessly. and he was going about 100 miles per hour because i was hitting 80 and i could not catch up to him. >> reporter: she followed him on the 826 and then on the 83 and have eventually catching up to him approaching i-95 where she got his attention. and suddenly the familiar stern questions at the car window only the officer wasn't the one asking. >> the reason i pulled you over today, i wanted to know what's the energy. >> i don't know how fast i was going but i'm on the way to work right now. i don't believe i was speeding. but like i said, you're

breaking news in brooklyn, an nypd lieutenant has been slashed in the arm. jim smith is in chopper 2 over the scene with the latest. jim -- >> reporter: yeah, mary, still enroute to the area. this happened along east 18th street, just a few block blocks south of prospect park. he was slashed in the arm. the initial word on the officer's condition is that they were in good shape, not exactly known the extent of the injuries but again, a slashing to the arm. we are told he is in good

west, mild readings all the way up into monticello where it's 46. and look at babylon, wow, wow, 63 already. these numbers compared to yesterday, no shock here, two to 16 degrees warmer. shooting for 58. it's only a degree away. and i think we can do it. almost 20 degrees above normal. sun sets at 5:13, wet weather and a few showers. all the green on the screen is not hitting the ground yet. through essex, seeing light rain. and again, there's snow on the curb so it's going to be a little messy. the real concern is going to come in on wednesday when we see some more significant rain. this line of showers pushes through, cold air waiting for your tuesday. and timing it outing for. a few more showers into and through the early evening hours and then tuesday afternoon looks like that. and then wednesday, tell you what, starting the middle part of the day, periods of heavy
