by midmorning, it is out of here. after that, we will be looking toward a much brighter afternoon. 33 degrees right now in the city. twenty-six in franklin. as we take the forecast hour by hour, by 9:35 a.m., feeling like 32. noon, 39 and partly sunny. this afternoon, your high is 45 degrees. pretty much on par with where we should be. feeling more like 44. the wind will be calm today. the windchill is not a big factor. coming up, talking about temperatures 25 degrees warmer than today. back to you. new this morning, firefighters battled a huge fire in brooklyn overnight. when flames broke out at a commercial building. this is a picture from the scene in east new york. the fire started at a building on lake street around 1:00 this morning. it is now completely out. fire officials say no one was inside at the time. police say 36-year-old roger luvall has been arrested

explosion in the bronx. investigators say two aerosol cans -- one armed with a detonator, and that -- ignited inside of a car wednesday night. the 24-year-old driver and his passenger were not injured. roger luvall was charged with attempted murder, criminal possession of a weapon. campaign 2016 -- some presidential hopefuls are gaining steam after voters went to the polls in five states on super saturday. donald trump and ted cruz both split wins last night. donald trump still leading the delegate count. on the democratic side, bernie sanders pick up two wins, down craig boswell has more on the washington. >> ted cruz picked up super kansas and maine. >> super tuesday, last week, was a phenomenal my where we won victories all over the country. doing the same thing. >> donald trump took

>> today's -- today they will caucus in maine. john dickinson will talk with hillary clinton and ted cruz on face the nation. at 8:00, we will talk with john about his thoughts on yesterday's race. community members are paying respects to a new jersey child killed in a hit and run. >> a visitation will be held today for 7-year-old shayla pichardo. she died in west new york on her way to school. we're live at the scene of the crash with the details. >> reporter: diane, the death of shayla pichardo has said -- has had such a devastating impact on this community. tonight, people will get a wake. we have watched this memorial drastically grow at the intersection where she was killed. dozens have been stopping by to honor her life and say a prayer for her family. >> 7-year-old shayla pichardo will be laid to rest this week. her loved ones now preparing to >>

>> a grieving father spoke to us with help from a translator sending a message to the driver accused of hitting shayla pichardo monday morning on her way to school and leaving the scene. him. step into my shoes. >> surveillance cameras captured this black suv right before it hit her and her mother crossing this intersection at 61 street. police say seconds later, the driver got out of the vehicle, looked at her lifeless body on the ground, and get them the vehicle and speeds off. we talked to her mother, still recovering from the impact and stunned by the outcome. in spanish, she told us the driver looked at her daughter, said a curse word and left without apologizing. police have identified the driver as 23-year-old fabian rodriguez. they tell us, just hours after the hit and run, his girlfriend reported the suv stolen, trying to cover up the crime. both are now under arrest and appeared in court where they pleaded not guilty.

the 80-year-old was in a honda on friday when state police say the driver of a suzuki crossed the centerline on route six and hit the vehicle. last night, students dedicated their musical production of "cinderella" to her memory. she handstitched many of their costumes. school leaders say the community is devastated. >> sister barbarba heil -- you have to remember, just here at kennedy, was a woman of faith that influenced young people for 50 years. >> sister barbara's funeral will be thursday morning in white plains. police in long island say a burglar armed with a blowtorch was caught on camera breaking into a cell phone store. police say the man spent about one hour trying to burn a hole through the door at the at&t store. the double panel metal prevented him from getting in. but investigators say he then broke into the nail salon next door and tried to burn through the wall. that did not work either.

in the window at the cell phone store. >> this is the most brazen act to get into the store that i have seen so far. the glass doors and the metal doors are not going to hold these guys back. >> police say the burglar made off with cell phones, ipads and a few cases as well. the attorney for the engineer in a deadly train derailment says his client has retired with a disability pension. 48-year-old william rockefeller has not worked since this accident back in 2013, which left four people dead. a tribunal found he is no job. the national transportation safety board concluded that rockefeller suffered from sleep apnea and fell asleep just before taking a 30 mile-per- hour. a father and daughter survived what could have been a >> you see your life flashing before your eyes.

it is tax season. and you have six more weeks to go before the deadline of april 18. if you are still unsure about what you can and cannot deduct, we have tax expert jeff levine back to answer your tax questions. we had one viewer say -- do people that sell items on ebay have to claim those as income? >> a great question. many answers. it depends on how you are doing it. most cases, the answer is no. i saw in the last segment, they were talking about strategies to clean up the house. if you bought a book a few years ago and it was $20 -- and today, you sell it for $5 on ebay, you don't have to report that. it is really a loss. but it is a loss on a personal item. so you don't get to deduct. but you don't claim the income. on the other hand, do you remember the movie "the 40-year- old virgin"? >> yes. she runs a store like that. >> that is her business. if everything she sold is essentially like inventory, she

her business returns as a gross receipt. it depends on the capacity. most people -- does clearing out the house -- and selling something -- years ago would have been a higher price. and then having a garage sale online basically. you don't have to worry about reporting at. >> donating goods -- this is another question i had. you drop things off at salvation army. a lot of times you do it, and you don't deduct them. where does that come into play? >> anything you give to a qualifying charity, you can deduct a fair market value. that is the real question. what is the fair market value? what would someone else pay for it? the dress you bought years ago -- where you are like, this looks amazing on me. and your friend said -- i don't know. no one else would wear that. >> it is the question of -- how much would someone else pay for that item? so there is a method that you would use to determine -- it

some people throw away stuff that is just a tattered garment that nobody would wear. >> you cannot count that. >> if it is in good condition, you could take the value that someone else would pay. obviously -- that is an estimation. you can take an educated guess. it really depends on what the value is. the more value that you are donating in terms of goods, the more strict the irs reporting requirements are. there is also a special form to file. >> key pictures. pictures of what you are donating. then you can say, this is what i donated. this is the quality it was an. >> another one. do i have to report a scholarship my daughter received for college if i claim her as a dependent? >> good news. generally, no. if this person is going to a degree granting institution -- and they are getting this -- just for going there. they are not getting it for working. that is the difference. sometimes the scholarship is

's we're giving you money. but you have to do work. that is an, not regard. in some cases -- if you are just getting a scholarship -- like we will pay for part of your tuition to come to this educational institution, now. >> these are tricky answers. when our transportation expenses deducted? >> good question. again, it depends. transportation expenses can fall into one of a few categories. the most popular one -- business travel. if you work multiple jobs, the commute you have from your first up to your second job -- from home to your first job, that commute is not deductible. if you go from the first job to a second job -- someone like me -- acpa -- if i go into the office and then i travel to a client's place of work -- that could be deductible. absolutely. there is also other travel that is deductible. if you drive to take those closings items to a drop off box for charity, those are charitable miles driven. there is a possible deduction for that.

fraternity at the time. >> very friendly. very loving. very respectful. we will all miss him. >> toxicology results that could answer certain key questions are not back yet. the fraternity has been suspended. counselors will be on hand today at a new jersey high school after the death of a student. sixteen-year-old conor barbero died on friday night after crashing his atv. a small memorial of balloons and flowers has been set up to honor the belvidere high school junior you played basketball and soccer. counselors will be available beginning at 10:00 this morning. police have released surveillance video of the man who they say tried to shoot a crown heights woman while her children were nearby. the nypd says just after 4:00 yesterday afternoon, the woman was walking up the stairs of her apartment building with her two kids when the man approached them from behind and tried to shoot her. police say the gun jammed. the woman and her kids ran into the apartment and locked the

investigators say the man then shot at the door several times before taking off. luckily nobody was hurt. police are searching for a man who pushed a teenage girl on to the subway track in front of an oncoming train. this happened just after 8:30 p.m. last night at the roosevelt avenue and 103 street subway station in queens. investigators say the train operators saw the 17-year-old on the tracks and quickly activated the emergency brake. she was taken to elmhurst hospital where she is expected to be okay. the clock ticking down on a possible transit strike. yesterday, hundreds of workers rally for a new contract. we report on their calls for change. >> after five years without a contract or a raise, new jersey transit rail workers appear to

across from the woodbridge train station saturday as the strike deadline looms, just eight days away. >> when we go on strike, if we go on strike, it will be financial devastation to this area. >> more than 100,000 new jersey people will have to scramble to find another way to work. >> we will not be able to provide the level of service or the capacity that our rail service currently provides to our customers. >> it is a very long time. everything is up at our paychecks. >> there is a highly charged political backdrop to the showdown with a governor who ended his bid for president but now campaigns for donald trump. >> it is absolutely amazing that he continues to refuse to do the work that ordinary new jersey residents expect him to do.

rail workers union that with the national board in washington friday. they are scheduled to negotiate here in new jersey on monday. >> it will be horrible. how will people commute? >> public sympathies toward a strike divided. >> new jersey transit should do the right thing. >> strike train may be about to leave the station. cbs2 news. two presidential labor boards have recommended annual wage increases of 2.6% -- over a 6.5 year contract. new jersey transit says that would force the agency to raise fares. the union says they would not need to raise fares. we reached out to governor chris christie's office yesterday but have not heard back. a new streetlights. it is unlike any others in the cottage in the country. this solar select powered light was installed at jfk marina along the hudson river. it uses a vertical wind turbine

a little windy. camera shaking a bit there. 33 degrees. 7:41 a.m. vanessa says we're in for quite a warm-up. she will explain all about that coming up. new studies on the zika virus show a greater link between the virus and grave outcomes for developing fetuses. researchers in brazil tracked 72 pregnant women who tested positive for the zika virus. they found a virus increases the risk for miscarriages and poorly developed placentas. it creates little or no amniotic fluid. and it raises the risk of blindness and deafness. researchers also linked problems to infections in each trimester of pregnancy. when it comes to easing into your golden years, new york apparently is not the place to be. a new survey says the empire state is the worst place to retire. going to bank rate.com, new york is at the bottom of the list due to factors like cost of living, crime, healthcare and taxes.

where we should be. this evening, sunset is at 5:53 p.m. remember what happens next weekend? we turn the clocks ahead. sunset next sunday will be at 7:01 p.m. losing an hour of sleep is never pleasant. but i do like the fact that it will be later for light in the day. you can see the snow sweeping to the southeast. it is really falling apart as it does so. a few spots with some flakes. midmorning, it is out of here. then skies in the clear. snow this morning, courtesy of an area of low pressure moving to the south. high-pressure building and. not just for this afternoon but for the work week as well. at least the first half. high-pressure migrating off the coast. as that happens, the wind direction switches and becomes southwesterly. temperatures climbing over the next three or four days. each day gets warmer. ten up to 25 degrees above normal is where we will be monday through wednesday.
