i'm chris wragge. voting day here in new york. >> with the latest on the campaign 2016, cbs 2 news' janelle burrell joins us live from the upper west side. >> reporter: the poll workers say they have had a good turnout so far today. as for the voter, they tell us they are excited. for the first time in decade, new york could be a turning point during this primary season and right now, it's the new yorkers who are the favorites to win. the lines to vote this morning telling of what a contentious fight the battle for the empire state has become. >> it's been an extraordinary election. and we're very excited to be voting.

that new yorkers votes are pivotal in a presidential primary and these people want to make sure theirs count. >> we have so many important issues here in the city. >> reporter: the new york candidates casting their votes as well. hillary rodham clinton with the former inspect tow. clinton knows she needs to win here in new york and win big in order to win the democratic nomination. >> i hope everybody gets out to vote. >> i think right now she's the only person on the political scene who is qualified to take over from mr. obama. >> reporter: bernie sanders counting on a big turnout as well, still lagging about 10 points behind clinton in the most recent cbs polls. sanders held his finally rally in long island last night. >> this is a movement getting establishment very, very nervous. [ applause ] >> reporter: he's banking on

like this 34-year-old. if he stands a chance of pulling off an upset. >> i followed him since i was 13 years old in mock congress. loved the man then. told my president, he's got to be president. >> reporter: in the gop race, donald trump still well ahead of ted cruz and john kasich as he voted in midtown this morning. careful not to assume victory. >> i think i'm going to do well. we'll see. who knows? it's politics. you know that better than i do but i think we will do well. >> this is trump world. yeah, donald is going to be fabulously. >> reporter: both cruz and kasich moving on to the next states. new yorker voters now eagerly a waiting the outcome and how their input may shift the course of both races. >> i guess that's a nice thing for new york. doesn't happen that often. >> reporter: and a lot of delegates up for grabs in this new york primary. 95 on the republican side. 247 for the democrats. hillary rodham clinton and

right here in the city tonight to watch as the returns come in. reporting live this afternoon from the upper west side, janelle burrell, cbs 2 news. >> all right, thank you. voters on long island are also casting ballots today to fill a vacant senate seat. in the election, they are running to replace the disgraced senate majority leader that was convicted of corruption. this is one of four special legislative elections taking place today. polls are now open across the state and will be until 9:00 p.m. tonight. that includes the five boroughs and long island. we ask that you stay with cbs 2 news and cbsnewyork.com for continuing coverage of the new york primary and tune in tonight at 11:00 for live coverage and the latest of all the results. it is sentencing day for the former nypd police officer in the 2014 shooting death of an unarmed man. cbs 2 news' magdalena doris joins us live in downtown brooklyn outside the

>> reporter: mary, the decision between prison and probation judge. both supporters are planning to be here in court. officers are standing by which barricades are up. brooklyn supreme court is prepared for crowd reaction as the former police officer is death. at send temperaturessing, the judge has the option to send him to jail for a maximum of 15 the brooklyn district attorney is proposing house arrest and probation. the family is concerned that they may not find the justice they seek, speaking directly to the district attorney. >> you hoodwinked us. >> that's right. >> people of color, your kind. >> reporter: conversely, there have been protests in the chinese community, claiming he is being punished as a scapegoat for the sins of other bad cops in recent times. in november 2014, he fatally

during a patrol of a dimly lit stairwell of the pink houses. supporters say it was a tragedy. >> so many police officers have committed all kinds of brutal violence against civilians but his was indeed an accident. >> reporter: sentencing was postponed earlier this month after a juror on the panel which convicted him omitted the fact his own father was convicted of a similar crime. while his lawyers filed a motion for a new trial, the judge ruled that he did not intentionally lie to the court and the verdict -- >> verdict. >> reporter: would stand. throughout the trial process, the family of the victim and those who support the police officer have been vocal and divided. the two parties will once again meet in court today. both the defense and prosecution will be arriving here shortly to hear the judge's decision.

supreme court house, mag, cbs 2 news -- house, magdalena doris, cbs 2 news. a school bus driver has been selling heroin. he was caught selling the drug on the street monday night. he is charged with possession of a control substances. one person was hurt after a van jumped the curb and crashed into a bagel store in new jersey. chopper 2 flew over the scene this morning. the accident happened just after 8:00 a.m. a pedestrian was struck by the vehicle. the extent of the injury is unknown. a man is under arrest in connection with the campus scare that led to a lockdown at suny purchase in westchester. investigators say it started at a student event sunday night. students were told to stay in place as police flooded the campus looking for a possible armed man. charges are penning against the 24-year-old. at least 28 people are dead, more than 300 injured after a deadly attack in afghanistan's capitol city.

broke out at a government security compound after a suicide bomber blew up a truck full of explosives. police say an armed militant stormed the agency after the blast and the taliban claimed responsibility for the coordinated assault. the police chief said, the suicide bomber tried to get into the building but our officers shot and killed him. afghan security forces say they gunned down the second attacker after a two-hour battle. more than three dozen people, mostly civilian, died in the injured. he says he tried to run but was hit in the leg and couldn't stop the bleeding. the attack happened just a mile from the u.s. embassy at the height of morning rush hour. the assault on the government agency similar to the u.s. secret service comes just days after taliban insurgents announced the start of their spring offensive. cbs 2 news.

from around the world are now in ecuador trying to find survivors from this weekend's devastating earthquake. more than 400 people were killed and the number is expected to rise. cbs 2 news reports. >> reporter: from beneath the rubble, a sign of life, this hand belongs to a man trapped under a flattened shopping center in ecuador. firefighters pulled him out alive along with two other women on monday. they were wedged between a floor and a roof for more than 32 hours following the devastating 7.8 magnitude earthquake. i felt that she was alive said the husband of one of the survivors. here, rescuers worked to free a man trapped under a collapsed hotel. as news of another survivor spread, dozens of people rushed to the scene. we spotted this woman, she looked helpless. it was her husband who was stuck. he had called her on his cellphone from under neither the rubble. he's alive but trapped, she

>> reporter: moments later, firefighters pulled him out. a total of eight bodies were removed from the hotel. he was the only one found alive. here in the city, families are sleeping outside tonight. mother, father, their two children, there is nothing left to go home to. their homes are leveled. and this is where they feel safe. tremors continue. there have been more than 250 aftershocks since the earthquake saturday night. cbs 2 news, ecuador. the red cross has 5,000 people might need temporary housing because their homes were destroyed. still much more ahead here on cbs 2 news at noon. supermarket crooks targeting women shoppers. caught on camera, what a thief ran off with that had a store worker chasing him. and remembering doris roberts, the emmy-winning raymond.

a thief pulls a fast one at a brooklyn burger joint. it's all caught on camera. crook for several blocks. he took off with a tip jar. police say the suspect asked to use the restroom at action burger and then on the way out, he grabbed the jar of money turned. the 22-year-old chased him for nearly four blocks. she says she never gave it a second thought. money. i had money from the previous day so there was a decent amount. i was like, if i catch him, going to fight him. i was so -- i was just ready for it. >> there have been so many tip jar thefts in this part of brooklyn, many businesses have decided to put the jars behind the counter where they are harder to reach. fans and friends are remembering veteran actress doris roberts who died in los angeles over the weekend. she is best known from the hit cbs sitcom "everybody loves raymond."

tramp by. >> i think they were being kind. >> roberts won four emmy a wards during the show's nine- year run. she was a broadway actress in the '50s before heading to hollywood. her family says she passed away many her sleep on sunday. last night, ray said in part, doris roberts had an energy and spirit that amazed me. she never stopped. i will miss her dearly. she was 90 years old. >> always made us laugh. >> yeah, a real funny woman in hollywood. >> truly missed. the water is still rising in texas after rains. many people in areas that normally don't flood were caught off guard. and how long will our beautiful weather last? our john elliott has the

and a little story. the houston area is struggling with deadly widespread flooding and more is on the way. >> an estimated 1.5 feet of rain flooded homes and killed at least five people. >> reporter: overnight, first responders rescued more stranded residents in houston following monday's historic rainfall. some carried pets as they made

i mean, we have a 2-week-old. if the water keeps rising and it was unsafe for him. and it's terrifying. especially if you can't swim. >> reporter: on monday, rescue crews worked around the clock in boats and even jet ski, saving children and seniors. people escaped to safety anyway they could, on air mattresses, empty container bins, even inside refrigerators. >> haven't seen anything like this before? >> last time it got like this in this area was allison. the water line came up to here. >> reporter: this is the largest flood event to hit the houston area since tropical storm allison in 2001 where 23 were killed in texas alone. a woman drowned while flood waters overtook her inside her car. her husband says his heart is broken. >> cancer, i understand. but this, driving through high water in the middle of the city

be done, it's a terrible loss. >> reporter: and more rain is in the forecast, texas and nearby states face possible flash blooding through thursday. cbs 2 news, houston. >> most schools in the houston area are closed today. 10,000 residents remain without power. >> devastating there. >> yeah. our weather, so different here. and you really don't want to take this for granted. another nice day. >> yeah, got to count our blessings. and our big area of high pressure is blocking those storms so they can't break through. first off, let's show you, look here, i know what it is, it's time for weather watchers. it's interesting as you look around the area, in and around the city, we have cracked the 72-degree mark but to the north and west, still cooler. those gusty winds. barbara has 63. and she is counting her blessings, a glorious day but we need the rain. there is some in the forecast on friday, barbara, we will look at that in a second.

and her dog is getting ready to go for a sail. i just love that. happy trails. and i like these pictures too because beautiful flowers from eva. richard said, oh, this weather is for the weeds. but the flip side of that, this lovely chick which you are from charlie. i'm going to leave these pictures to charlie. these are some busy bees and you can see the pollen too. it is springtime, pollen count is high. that in a second. and you may hear an occasional sneeze during the course of this weather cast too. yeah, a lot of folks suffering. wind out of north at 23 miles per hour. there's the variety, 73 in belmar. 63 in white plains. these numbers compared to yesterday, on average about eight degrees colder. four degrees colder in the city. but the wind makes it feel cooler. gusty winds out of the north, northwest at 35 miles per hour in the hudson valley.

that's why the national weather service reminding you, yeah, this is red flag fire weather. we worry about any kind of fire that starts would spread quickly with the lorel hiv humidity values and the windy conditions so be -- with the low relative humidity values and the windy conditions so be extra safe. 10degrees colder than yesterday. the normal is 63. sun sets at 7:40. pollen count, yeah, it's high. it's way up there. today, tomorrow, some relief thursday into friday. nice and dry right now. you get a sense of our big area of high pressure. and good news for houston, up to dallas, we could see pop-up storms later. no rain for us though over the next few days. and for the month of april, we're running a deficit of 1.65 for. for the season, we're 4:00 p.m. 84 be -- 4.84 below normal. and the only rain in the forecast is coming in on friday.
