it's 4:30, 51 degrees on this thursday, april 28th. a cool start tot morning with some rain expected a little bit later on today. good morning, everyone, i'm chris wragge >> i'm mary calvi. welcome to cbs 2 news this morning. weather and traffic on the 2 in just a moment. a noarm jetblue pilot this morning is free on bail. >> the pilot has a very different story. >>reporter: when dennis murphy, jr. came out of brooklyn federal court, cbs 2's alice gaynor demand answers from him that he was drunk while piloting jetblue passengers. were you drinking on the plane? >> no comment. >>reporter: it was april 21st of last year, 151 passengers were on board a flight from orlando to kennedy airport. prosecutors say after it landed safely, murphy was picked for a random alcohol test. the criminal complaint states

which is over the legal limit. court papers also reveal he was tested again 15 minutes later and allegedly blew a.091. according to the complaint, murphy said the results must have been caused by the gum that he was chewing, a likely witness fort prosecution is murphy's copilot for the two flights that day who told investigators both times murphy was drinking an unknown beverage from a cup. murphy, who lives here with his wife in ramsey, new jersey was released on a $50,000 bond. passengers at kennedy airport don't like hearing any of this. >> that's crazy. that's insane. >> very reckless and irresponsiblement >>reporter: jetblue says it has a zero tolerance drug and alcohol policy an confirmed murphy no longer works there, saying he resigned. the federal aviation administration says 225 commercial airline pilots tested above the legal blood alcohol limit since 1995. >> to know that they should not

several new jersey families have been left homeless after a car slams into the side of a building forcing an evacuation. it happened last night in plainfield. now police are investigating what caused the crash. police say about 20 people are now kiss placed because authority -- displaced because authorities believe the building is now structurally unsound. the condition of the driver is unclear at this time. now tot new york city corruption scandal. the investigation into mayor de blasio's fundraising has now reach to city hall. some of his closest allies have been hit with subpoenas. the mayor has not been personally served and we'll have much more on this coming up in our next half hour. new this morning, he construction site but that turned out to be a disguise for a bank robbery. police in queens have released images of a man they say entered a sussex county bank on

they say he showed a gun and demanded cash, but he left the area empty handed, fleeing on foot. police in williamsburg, brooklyn, released surveillance video of a car break-in suspect. they say the man struck at least twice this month, both during daylight hours, on april 9th and on april 15th. both times he broke the side wiis on cars and remove property from inside. in one case on north first street, that included a drone along with a nexus computer tablet. now to campaign 2016. two candidates who were once rivals will campaign together in indiana today. ted cruz has picked carley fiorina as his running mate, even though his own nomination is more uncertain than ever. cbs 2's tony iello reports. >>reporter: cruz' v.p. pick clearly intended to help him in fiorina's home state, california, the biggest prize of the last 10 states. with 502 delegates still to be allocated, donald trump needs 48% of them to win the

long island doctor's office. police say a retired police officer was showing the gun through the podiatrist. police are searching for a brooklyn woman who vanished more than a week ago. 21-year-old destiny dawson left her home in bed-stuy at dinner and never returned. police say thieves are targeting teens in a popular manhattan park and stealing their iphones, but it's what's happened next that has some people especially concerned. cbs 2's allana gold reports. >>reporter: a walk along the water at riverside park and 72nd street turned into a frightening one for ross kennedy and his friend. >> it was pretty scary. >>reporter: kennedy says two teens on a bench started talking to them, then they suddenly showed knives on their waistbands and demanded their wallets and cell phones from their pockets, but the robbery didn't stop here. the criminals stayed in contact with the victims for longer than most holdups. >> the entire time while it was going on, i just -- i was just waiting for it to be over. >>reporter: he tells us the crooks made sure the iphones

couldn't be trace. they force the victims to delete the app called find my iphone and turn off their icloud settings. that way kennedy and his friend couldn't log into their accounts from another device and find the phone's exact location. it's an app people commonly use if their phones are lost or ripped off. kennedy says the thieves also made them hit reset on their phones and wipe them clean for possible resale. they basically got a brand new phone? >> yeah, pretty much. >>reporter: kennedy tells us he used a street phone to call 911 and then canceled the line with his service provider an he had to shell out a few hundred dollars for a new iphone. other iphone users in the area now concerned about their phone getting stolen this way. >> the iphones are ridiculously expensive. i'm also a film student, so i have so much stuff on my phone that i need for school. >>reporter: police tell us this is definitely a new tactic that crooks are using and that they haven't dealt with many of these cases, but they say if this happens to you, don't fight back. >> it feels like a violation. >>reporter: investigators say kennedy an his friend did everything right.

you may never see your phone again, but the device isn't worth risking your life for. on the upper west side, allana goal, cbs 2 news. monch money watch, stock futures lower after a mixed performance on wall street yesterday. the dow rose as the federal reserve left a key interest rate unchanged. the dow up by over 51 points. the s&p 500 rose by 3, but tech stocks were battered by weak earnings reports. the nasdaq composite lost over 25 yesterday. well, newark gives uber the green light to pick up passengers city wide, part of a 10-year deal, $10 million deal. the company must pay the city $3 million up front, provide commercial liability insurance and conduct driver background checks. the mayor says the agreement is about fairness. >> what we're trying to do is just make sure that we have a competitive playing field here that we can begin to help the industry which i think is important for folks to begin to do. >> uber must also pay a fee for operating at newark airport. earlier this year the city

behind by this car here on watchon avenue. police were able to pull the car out with a tow truck here overnight, but you can see all of the glass and debris shattered here across the sidewalk. this happened about 10:00 last night at the intersection of watchong and east second street, witnesses recording some cell phone video showing the car soon after it crashed into the front of this jackson hewitt tax service storefront. again, at this point it's not clear what caused the crash, but witnesses do tell us that the driver was taken away in an ambulance, though it's not clear what injuries that driver may have sustained. we're told about three families lived in the apartments above this big here at 200 watchong, about 20 people were displaced, evacuate because authorities at this point do not know if the building is structural sound is. those people this morning are being helped by the red cross, but, again, at this hour police still investigating the cause of this crash.

now to the new york city corruption scandal, some top aides of mayor de blasio's slap with subpoenas >> it's part of the state and federal probe noose the mayor's fundraising. cbs 2's andrea grymes has more from lower manhattan. an dree a. >>reporter: well, chris and mary, mayor de blasio's spokesperson says everyone involved followed the letter of the law, but clearly prosecutors have some big questions. the alleged corruption scandal swirling around mayor bill de blasio has now directly hit city hall. his attorney mia wiley confirms, quote, city hall has been subpoenaed by the new york county district attorney's office and the u.s. attorney's office for the southern district, and we are fully cooperating with the investigation. the mayor has not been personally served. the investigation focuses on the mayor's fundraising and how he raised money to unseat state senate republicans in order to further his political agenda.

cara and manhattan d.a. sier russ vance want to know if de blasio violated the law by sish couple venting laws and specifically marking money for candidates which is not allowed. they're also looking into whether promises were made in exchange for donations. the mayor has defended his actions, saying everything they've done is legal and appropriate. he said this on monday. >> a lot of very good people are having their names dragged through the mud over these last few weeks. that's not right, that's not fair. >>reporter: cbs 2 has learned members of de blasio's inner circle who were subpoenaed include emma wolf, a top political adviser and the city's director of intergovernmental affairs, top fundraiser ross offinger and the consulting firm berlin rosen which works on the mayor's political campaigns. now, being subpoenaed means these people can be questioned and must preserve documents. de blasio's spokesperson specifically described emma

regarded public servant whose integrity should not be question. reporting live this morning outside city hall in lower manhattan, andrea grymes, cbs 2 news. >> andrea, thank you. a judge is contemplating the fate after a victim and suspect faces off in court. in july of 2014 he allegedly step on the head of jhamele cuffy in bed-stuy. cuffy had allegedly resisted arrest but officer swer's attorney says after trying to subdue the suspect, he brought the boot down on the victim's hand, not his head. >> >> as he kicked me in the head, my head hit the concrete. >> edward's attorney disputed the photos of the suspect's head taken the day after the arrest. they say he showed no such wounds in public in the days that follow. the judge's ruling is expected tomorrow. a young brooklyn mother disappeared more than a week ago now her mother says enough is not being done to find her.

dawson left her bed-stuy home april 20th to go to dinner. her boyfriend reported her missing the next day. dawson's mother says she's angry her daughter's boyfriend isn't doing more to locate her, but her boyfriend says he's been searching on his own. lasheem harris tells cbs 2 he found messages to other men on her instagram account time stamp just hours before she left. dawson's mother is not satisfied. >> it's a week and he is staying calm, calm, like everything's all right. >> i think she's outdoing her. she's out having fun, she's spending time with whoever she knows. >> dawson has two young daughters, ages 2 and 3 years old. well, we're learning more bottom death of superstar prince. sources tell cbs news he had prescription painkillers in his possession and at his home when he died. prince was found unresponsive in an elevator at his compound outside of minneapolis last thursday. it's not clear yet if the medications played a role in prince's death.

results are not expected for weeks. in the meantime, federal drug investigators are looking for the source of those pain medications. former house speaker dennis hastert is heading to prison. he has been sentenced to 15 months behind bars. hastert pled guilty to breaking federal banking rules to funnel hush money to a man he sexually abused decades ago. he also admitted abusing several boys he coach on a high school wrestling team in illinois in the '60s and '70s. the one-time republican leader was not charged with any sex crimes because of the statute of limitations running out. happening tonight, the nfl draft. the event takes place in chicago this year once again and round one begins at 8:00 tonight eastern time. the l.a. rams and philadelphia eagles shook things up last week with a trade to give them the first two picks in the draft. the giants ventilate 10th pick, the jets have the 20th. due to deflate-gate, the new england patriots lost their first round and fourth-round picks for this year's draft. 5:08. still ahead, abandoned bikes becoming an eyesore. what officials say people in

a growing number of complaints in williamsburg about a bicycle grave yard. the bikes are creating an eye sop store on north seventh. the bike with rust frames and fractured frames. cyclists say it's impossible to find a spot on the bike rack near the "l" station. the owners say the people who abandoned the bikes are responsible for removing them. >> there's no way to track the owners and if you clip the wrong bike, people are going to be upset, so it's, like, what can you do? either way you're going to be wrong. >> seems like some of these bikes have been here for years. it's not a great look for the area. >> santation officials say a bike must be crushed, rusted an unusual to be clipped an taken away. a handful of bikes have been tagged for removal within a week >> like that one you just saw right there. ready for removal. an accused will be back in court next week. port authority police stopped oscar sanchez when they noticed his toll went unpaid at the holland tunnel.

prosecutors have some big questions. the alleged corruption scandal swirling around mayor bill de blasio has now directly hit city hall. his attorney mia wiley confirms, quote, city hall has been subpoenaed by the new york county district attorney's office and the u.s. attorney's office for the southern district, and we are fully cooperating with the investigation. the mayor has not been personally served. the investigation focuses on the mayor's fundraising and how he raised money to unseat state senate republicans in order to further his political agenda. u.s. attorney preet verarap dl and d.a. sigh russ vance are trying to figure out if team de blasio violated the law by circumventing and earmarking large donations for specific candidates which is not allowed. probers are also looking into whether promises were made in exchange for donation. the mayor has defended his actions, saying everything they've done is legal and

affected, the people who operate out of this storefront, they are not able to work here obviously this morning as well. just moments ago i spoke with a man who says he runs a shuttle service out of this tax service storefront here on watchong avenue. he, for the first time as he drove up here this morning, realized what happened, that the car plowed into the storefront here around 10:00 last night. witnesses record some cell phone video showing the car soon after it crashed into the storefront at 200 watchong at the intersection of east second street. witnesses telling us that the driver was rushed away in an ambulance, though it's not clear how badly he or she may have been injured. we're told three families lived above this big, so about 20 people were displaced this morning. they are being helped by the red cross, but at this point it's not clear what caused the driver to lose control of the vehicle. at this point all of that under investigation.

from plainfield, new jersey, janelle burrell, cbs 2 news. >> thank you. service on metro north is back on schedule this morning after a train collided with a car in westchester county. it happened yesterday afternoon on the harlem line in bedford hills. crews spent several hours removing the car which set off major delays during rush hour. investigators say the car stall on the tracks. the driver and a passenger were able to escape safely. the driver was issued a summons for illegally blocking a railroad crossing. no one was hurt in the crash. new this morning, police released images of a man they say rob a taxi driver at knifepoint in midtown manhattan. it happened sunday, april 3rd around 4:30 in the morning. police say the man was seated in the cab's passenger seat and when the cab stopped at a red light, he put a knife tot driver's hip and demanded money. he got away with around $300 in cash and the driver's iphone. it happened near the corner of fifth avenue and 42nd street. former fugitive heir robert durst has been sentenced to a lengthy prison term on a weapons charge.

ordered him to serve seven years and a month in prison. durst accepted the sentence in february as part of a plea deal. he was also fined $5,000. the real estate heir still faces a murder charge in california where he's accused of killing a female friend in 2000. the durst family runs 1 world trade center. a new jersey community across the bay from long beach island is divided over dredging. cbs 2's meg baker reports. there's concern over environmental impact. >>reporter: these boats may have to stay where they are on dry land for this year's boating season if a dredging project in the small township of eagleswood, new jersey, does not get done >> we've lost ourselves almost 8 slips that are so shallow that we can't even rent them anymore which is a big amount of our income that we count on paying taxes. >>reporter: debra murphy and her husband own d&s marine services located on west kongcrete. these are pictures of the marina at low tide. >> we'd had boats that constantly run aground and have

caused the crash. cbs 2's janelle burrell joins us live from the scene with more. janelle. >>reporter: yeah, chris, multiple families out of their homes this morning, and a lot of people actually showing up for work, people who work in this office building, only to find out they will obviously not be working out of this location here this morning. this all happening around 10:00 last night at the intersection of watchong avenue and east second street. and you can see all of the debris that was left by the car crashing into this building. witnesses reporting some cell phone -- recording some cell phone video where you can actually see the car moments after it crashed into this storefront. at this point, though, police have not released why they believe the driver lost control of the vehicle, but witnesses do say that they saw the driver rushed away in an ambulance, though it's not clear the extent of their injuries. three families we're told lived in the apartments above the crash site here, so about 20 people were displaced. they were evacuated because

scandal and members of mayor de blasio's inner circle slapped with subpoenas >> state and federal probe rs under way into the mayor's fundraising. cbs 2's andrea grimes has more from lower manhattan. andrea. >>reporter: well, chris and mary, the mayor's spokesperson says everyone involved followed the letter of the law, but prosecutors have some big questions. the alleged corruption scandal swirling around mayor bill de blasio has now directly hit city hall. his attorney maya wiley confirms, quote, city hall has been subpoenaed by the new york county district attorney's office and the u.s. attorney's office for the southern district, and we are fully cooperating with the investigation. the mayor has not been personally served. the investigation focuses on the mayor's fundraising and how he raised money to unseat state senate republicans in order to further his political agenda. u.s. attorney preet berara and

if de blasio violated the law by circumventing laws and big if de blasio violated the law by circumventing laws and big donations for candidates which is not allowed. probers are also reportedly looking into whether promises were made in exchange for donations. the mayor has defended his actions, saying everything they've done is legal and appropriate. he said this on monday. >> a lot of very good people are having their names dragged through the mud over these last few weeks. that's not right, that's not fair. >>reporter: cbs 2 has learned members of de blasio's inner circle who were subpoenaed include emma wolf, a top political adviser and the city's director of intergovernmental affairs, top fundraiser ross offinger and the consulting firm berlin rosen which works on the mayor's political campaigns. >>reporter: being subpoenaed means they can be questioned and must preserve documents. the mayor's spokesperson specifically said is of emma wolf that she is, quote, a highly-regarded public servant whose integrity should not be question. reporting live outside city hall this morning, in manhattan, andrea grimes, cbs 2 news >> an dree, a thank you. ancht crime caught on camera, a fast-acting thief grabs a man's wallet right out of his hands. check out this surveillance video from an "n" subway station on west 34th street. a 61-year-old passenger was swiping his metro card when the man on the right grabbed his wallet. the wallet contained credit and debit cards. it happened april 12th around 8:00 at night and police are trying to identify the man in the video. a judge is deciding the fate of a police officer accused of stomping on a man's head after the cop and his alleged victim face off in court. officer joel edward faces assault charges. in july of 2014, he allegedly stepped on the head of jameal cuffy in bed-stuy. cuffy had allegedly resipsed the officer, but officer edward's attorney said after trying to subdue the suspect he brought his boot down on the victim's hand, not his head.

murphy faces up to 15 years in prison if convicted. well, the attorney for a long island man accused of threatening employee employees with a cross bow says his employees never intended to follow through. harold geretsky has been fighting with neighbors and local officials since last summer when he said he couldn't afford to park his plane at the airport. investigators say this week he threatened the town of hempsted employees for dismantling his plane while he was away. his attorney says he's harmless. >> he's an angry old man. he called up, he made a threat. he's not going to carry it out. >> gretsky's attorney said he wouldn't say if his client even owns a cross bow. he now faces charges of aggravated harassment. 6:38. a brooklyn mother missing, but now we are learning new information. why love ones are at odds over where the 21-year-old is or what she's doing. and teenagers threatened

angry her daughter's boyfriend isn't doing more to locate her, but her boyfriend says he's been searching on his own. lasheem harris tells cbs 2 he found messages to other men on her instagram account, time stamp just hours before she left. dawson's mother is not satisfy. >> it's a week, and he is calm. calm. like everything's all right. >> i think she's outdoing her, she's out having fun, she's spending time with whoever she knows >> dawson has two young daughters, ages 2 and 3 years old. now to a consumer alert. new york state officials are sounding the alarm about a new e-mail scam targeting people who don't have chip cards. the fraudulent e-mails contain a link to sign up for your new card, but clicking on it could install malware on your computer. the software gives scammers access to all of your personal information, leaving you open to identity fraud. well, police say thieves are targeting teens at a popular manhattan park and

it's what happens next that has some people especially concerned. cbs 2's allana gold reports. >>reporter: a walk along the water at riverside park and 72nd street turned into a frightening one for ross kennedy an his friend. >> it was pretty scary. >>reporter: kennedy says two teens on a bench started talking to them, then they suddenly showed knives on their waistbands and demanded their wallets and cell phones from their pockets. but the robbery didn't stop here. the criminals stayed in contact with the victims for longer than most holdups. >> the entire time it was going on, i was just waiting for it to be over. >>reporter: he tells us the crooks made sure the iphones they were about to steal couldn't be traced. they forced the victims to delete the app called find my iphone and turn off their icloud settings. that way kennedy and his friend couldn't log into their accounts from another device and find the phone's exact location. it's an app people commonly use if their phones are lost or ripped off. kennedy says the thieves also made them hit reset on their phones and wipe them clean for possible resale. so they basically got a bran new phone? >> yeah, pretty much.
