happening now, spraying for zika in our neighborhoods. tonight, a travel warning for new yorkers as we learn of more infections in florida. long lines forced customers to wait outside in line for hours. is this what your next trip to cbs 2 demands answers. but first -- neighbors scream at the sound of a gunshot. a queens history turns into a crime scene after a burglary suspect gets caught on camera, then confronted by cops. good evening, i am kristine johnson.

cbs 2's tracee carrasco is following more. >> reporter: the investigation into the police involved shooting is ongoing of a burglary suspect with a lengthy criminal record. tonight, residents in the normally quiet neighborhood say they have not seen anything like this before. this unidentified woman returned back to her maspeth queens home tonight still shaken by the shooting. cell phone video taken hours earlier around 2 p.m. by a neighbor across the street shows her running into her home, then back out again with seconds later, you hear a single gunshot fired by an nypd officer. you can see the suspect, 37- year-old felix perez, run out of the home on 66th street after being shot in the groin. police tell us they were responding to a call of a burglary in progress. the video does the woman seen on video call 911 after seeing the suspect in her home from a remote surveillance system. she failed to let the suspect inside. >> a struggle ensued, one shot

the officers service weapon. >> reporter: police chase perez and eventually caught up into him. in this cell phone video you can see paramedics treating him as he is reeled away on a stretcher, terrifying for witnesses in the middle. >> i heard a gunshot, boom, like a big boom. i ducked down it was, like, what the hell is going on? i started looking around and saw a guy come out of my neighbors home and run right past my car. is a career criminal who has served prison time at least twice. in 2012 he was convicted of and temp -- attempted burglary, sentenced to five years and released this past june. in 2001 he was convicted of attempted burglary, sentenced to three and half years and released in 2004. police say the burglary may have been part of a break and pattern in the area making residents more uneasy. >> it was frightening, scary. i was very happy that the

were reports of a woman with a head injury. it turned out to be just a coincidence. she fell and injured herself, it had nothing to do with the shooting. sources tell us she suffers from seizures. as for the suspect, he is in stable condition at elm heard high spittle. -- elmhurst hospital. live in maspeth, tracee carrasco, cbs2 news. this video shows two men getting hit by a car when they walked down fulton street in brooklyy investigators believe the driver is a teenage boy. a possible gas leak at a daycare center send four adults and two children to the hospital. chopper 2 was over the apple montessori school in cliffside park around 6:00 tonight after the building was evacuated. we are being told the hospitalization was just a precaution.

new tonight, a judge has reversed a wrongful death judgment against a longtime suspect in the aton pates case. the judge against jose ramos was reversed last week. he was never criminally charged, but he had been held civilly liable for the death of aton pates. in 1979, pates was six years old when he disappeared on his way to a bus stop in soho. the boy's body was never found. he was declared dead in 2001. a second suspect in the case now faces a new trial this fall. federal health officials on the zika virus. the centers for disease control is urging pregnant women to avoid traveling to part of miami. this comes after the number of people in florida believed infected from mosquito bites climbs to 14. all cases stemming from the area. pregnant women are told to avoid the wynwood arts district area of miami-dade county. cdc is urging both men and women to get tested for zika virus if they visited the miami

before trying to conceive a child. there are no reported cases of zika being spread by mosquitoes here in new york, even so, the city is stepping up efforts at the moment to reduce the chance of an outbreak. cbs2's brian coneybeare has more from flushing where right now the city is spring. >> reporter: these trucks where the cities are spraying are the newest battle against mosquitoes that could conceivably carry the zika virus. health department ks , duet, in queens as part of the city's $21 million fight to keep vega -- zika at bay. dylan lives in college point and wears long pants and long sleeves as a precaution. >> if you don't, you will get bit no matter what. >> reporter: college point, whitestone and flushing are being sprayed because they have a large number of asian tiger mosquitoes.

we find a mosquito. we want to take action now. >> reporter: dr. says the office sent notices to people urging them to take precautions against mosquitoes. use air-conditioner with fence close, pits, toys, outdoor laundry and equipment inside. keep pets indoors. wash your skin and clothes with soap and water if you do come in contact with the insecticides. >> we use a very low volume. even though they are not hazardous to human health. we always want to be cautious about anything we do in the environment. >> reporter: at laguardia airport, people lined up for a flight to miami are worried about the growing outbreak and the new travel warning for pregnant women. others say that is one destination they will try to avoid. >> right now you are not going to miami? >> know. i would not do that. that's dangerous. >> reporter: right now, these trucks are not scheduled to go to any other neighborhood

more mosquitoes throughout the rest of the summer. reporting from the park in flushing queens, brian coneybeare, cbs2 news. campaign 2016, the oracle of omaha is the latest public figure to blast donald trump's treatment of the muslim parents of a falling u.s. soldier. warren buffett made the comment while campaigning for hillary clinton who, by the way, is still haunted by her email scandal. cbs2's now from both campaigns. >> reporter: donald trump hit the campaign trail tonight in pennsylvania as a feud continued between the candidate and the family of a muslim american soldier killed in iraq. >> we want to maintain my family's dignity, my son's dignity and sacrifice. >> reporter: khan criticized trump at the democratic national convention, and trump fired back against his wife this past weekend. >> she had nothing to say, maybe she was not allowed. >> reporter: today, tim kaine and others blasted trump along

>> my family, or my culture never stopped me from saying what i wanted to say. >> reporter: tonight, trump called dr. khan a hero and said what he wanted to say. >> when you and i have what we have discussed in the past, these are great people, great families, frankly. >> reporter: hillary clinton campaigned with warren buffett in nebraska and is enjoying a convention bounce, taking a seven p trying to shake a controversy of her home over emails after telling fox news that the fbi called her answers truthful. >> that's not what i her director comey say, comey he said that my answers were truthful and what i have said is consistent with what i've told the american people. >> reporter: while not exactly true, fbi director james comey

not say she had been truthful to the american people. the washington post fact checker give that answer of failing grade of four pinocchio's. trouble campaign in virginia tomorrow, clinton will had next to colorado. it appears more people are reading the constitution in the wake of the uproar. mr. khan held a pocket version of the document up during his speech. now a similar version was number two on amazon today behind only the new harry potter novel. new video tonight shows the power of flash flooding in maryland over the weekend. you can see cars getting swept away and crashing into each other. the storm dropped 6 inches of rain in just under two hours many homes and businesses in the historic district of ellicott city near baltimore were destroyed. and a group of people risked their lives to form a human chain to rescue a driver stuck in her car during the flooding. the business owner whose shop was destroyed was at the front and was able to pull her to safety.

take a look as a car flips and rolls several times from a parking lot. the store surveillance camera caught this crash yesterday in deland, which is just southwest of daytona beach. when the car stopped rolling, you could see witnesses rush over to help pull the driver out. he is now recovering from the hospital. there is no word yet on what caused the crash. >> cbs2 is demanding answers about excessively long lines in motor vehicle commission offices across new jersey. drivers at several offices including rahway and the heat. in some cases they do not make it inside and leave empty- handed. the motor vehicle commission blames an unusual surge of customers at the end of the month but drivers a long lines happen frequently and on land them days. -- random days. >> how long did you wait? >> 2 1/2 hours. >> i can around the side and it wrapped around the building twice. >> some delays were caused by computer outages, we are told.

for the first time in nearly 30 years, the yankees had a firesale. but it almost did not happen. gm brian cashman did not get the green light to move key players until near midnight saturday night. the result of his work led to carlos beltran walking out of the yankees clubhouse in street clothes. he had been traded to the texas rangers and he leaves as the current team leader in homers, rbi and batting average. even though the trade was not a surprise, it still stings beltran. >> what is your emotion when it became reality? >> it's tough, man. even though you know it is
