it's 4:30, 73 degrees on this tuesday, august 9th. a warm, sunny day today ahead of some showers that are coming our way tomorrow. good morning, i'm chris wragge. >> and i'm mary calvi. welcome to cbs 2 news this morning. we'll have traffic and weather on the 2s in a moment. but, first, we begin with breaking news. a chaotic scene this morning park section of the bronx. bullets started flying as police struggled with the suspect. >> one man was killed, the suspect wounded, and now that suspect is in police custody. cbs 2's magdalena doris joins us live from bed forepark with more this morning this morning. >>reporter: police say -- sources say this all started inside of bodega here on the corner of east 198th street and valentine avenue, an that's

innocent bystander was killed as a result of this shootout. the police scene now stretching for blocks here on 198th street, evidence markers show the bullet casings left over from this shootout early this morning. sources say the commotion started out in the street and then spread inside the store. they say that someone flagged two police officers down who went into the store and they were approached by a 30-year- old suspect who grabbed one of the officers' guns and began firing. a second officer responding back with shots, and that's once in the torso and that innocent bystander was shot and killed. now, witnesses say they saw the bystander being taken out of the deli. they say he is a 49-year-old man, a store employee, well known in the neighborhood who was just cleaning the shop at the time. >> i was upstairs in my apartment, and i just kept on hearing a whole bunch of shots. it actually didn't even sound like shots, so, you know, after about five or six of them went

rounds went off. frightening to live in a neighborhood all this, you know, violence is occurring. >>reporter: sources say the 30- year-old suspect was shot in the torso. he was take to st. barnabus hospital and is in stable condition. as for the police officers who responded to this scene, they are doing okay. they were just taken to the hospital for an evaluation. we're live in bed forepark section of the bronx, magdalena doris, cbs 2 news. >> magdalena, thank you. . you might recognize this man, john elliot. >> i gotta tell you, chris. >> yeah. >> it is so good to be back. already three hugs, one of them from a total stranger on 11th, but the other two from folks here at cbs, so it's just great. we are going to have another nice day today. it'll be a little warmer. it won't get humid, though, until tonight, and that tees it up for some stormy weather mid week into the weekend, hit and miss showers stick around. but i tell you what, i hope you can stick around today to enjoy. comfortable, high pressure is

police continue to investigate murder of a new york city woman, an employee of google while out jogging. >> janelle burrell join us live from outside google headquarters in chelsea. >>reporter: vanessa marcade had worked here at google for just under 10 years and her coworkers say she was a much loved member of her team, one who had a passion of volunteering and boston sports. and this morning police are still hunting for her killer. she had accomplished so her 27 years, an account manager at google, a limitless future ahead of her, only to end in what investigators describe as a vicious, brutal death. >> please use an abundance of caution. we don't know if this is a random act. we're asking you to be very careful. >>reporter: the small town of princeton, massachusetts, about 55 miles west of boston now swarming with detectives. it's where vanessa marcot was visiting her mother over the weekend. the young woman had gone out for a jog along a tree-lined

return, her mom called police. her bow was found sunday evening -- her body was found sunday evening in the woods off the road about a half mile from her mother's house. there were reports that she was naked and burns on her hands and feet and signs of sexual assault. >> we cannot tell whether or not it was a random act at this point, so we're asking the residents of princeton and the surrounding areas to be vigilant. >>reporter: the murder happening five days after jogger karina vetrano was killed in howard beach. ol for her killer. in a packed community meeting last night, investigators said they don't believe the cases are connected. >> with that said, we are going to continue to share notes and compare evidence as both cases progress. >>reporter: but the similarities have rattled many new yorkers. >> as a young woman, you feel the need to be protected and in the city that you live -- in the city that you live in. it's terrifying. >>reporter: the cause of marcot's death expected to be

geo, january jab, cbs 2 news. >> thank you. new this morning, police are asking for help finding this man caught at the counter of a high-end retailer in shenel as he buys a handbag worth more than $6,600 that's not his. it happened january 30th around 1:00 p.m. at the store in manhattan. police say the victim's name whose on the cord is a 26-year- old long island man. the male model who danced naked in times square is out 2 about his mental illness. it's been five weeks since 21- year-old crit mclean danced on the tkts booth and taunted police. he has since been diagnosed with bipolar disorder. mclean says he was walking home at dawn and became transfixed by the signs in times square. >> the -- it's express yourself. how can i express myself now. and i realized, oh, my god, i need to take off my clothes and

>> charges of public lewdness, disorderly conduct and exposure have now been dropped. our dr. max gomez says delusions are associated with severe bipolar disorder. the cause of a raging fire on the lower east side remains under investigation this morning. flames eresulted on the roof of 190 bowery which is near spring street. there were also several explosions. the historic building is best known as the former home of the jamania bank. it was completed in 1899. there were no ur in westchester county thanks to a quick-thinking emergency roadside truck. a car was headed in the eastbound lanes of 97 near the tappen zee bridge just after the morning rush. the driver of the state d.o.t. help truck positioned himself in the car's path getting the driver to slow down. >> i tried to stop the guy because i know he was going to be a disaster.

finally opened the door and grabbed the -- put the car in park and grabbed the key. >> the wrong-way driver suffered a medical emergency and drove for a mile and a half before the car was stopped. new jersey congressman frank palone, jr. is calling on the house to approve immediate funding to fight zika. palone, a democrat has criticized republicans for refusing to approve president obama's request for $1.9 billion. the congressman will address the conference later this morning in edison. meanwhile, officials in florida say gli ka may be heading north. the florida health department is investigating what could be the first case of zika contracted in palm beach county. the patient involved recently traveled south to the miel-dade county area, so it's -- the miami-dade county area, so it's possible the infection took place there. governor rick scott wants students to be taught zika protection measure when is they return to school. delta airlines still

disruptions. delays and cancellations are expected this morning. the airline blames a power outage in atlanta monday night. the fbi says it does not appear to be the result of hacking or other foul play. delta says it canceled about 1,000 flights yesterday, another 2,600 were delayed. >> you show up, you think you're going to be getting your boarding pass and getting on the plane and they're, like, we're grounded. >> delta says passengers traveling today should check the status of their flight online or using the delta app. delta is waiving rebooking fees again today offering $200 travel vouchers to anyone who was delayed by three hours or more or had their flight canceled. it's now 4:39. coming up donald trump's vision for the u.s. economy. the presidential nominee announces his plan to revitalize the economy where he says he could make cuts and how hillary clinton is responding to the plan. and new information on a tragedy at a water park. how a 10-year-old boy died on a water slide is. we find out who's responsible for the safety of water slides

tony sent in. i like this picture too. a little butterfly action and that is a butterfly just before it took off. all right. it's not kind of cool out there, it's comfortable, but we are going to see warmer conditions roll in and take over over the next few days. we're flirting with 90 by the end of the week. 73 with clear conditions in the city, winds are calm around the area. catona nice, 65. kingston, yeah, that's a jacket for you at is the cool spot. sunny skies over the next few hours and humidity values stay in check. so the high of 86 should feel like about 86. but that will change over the next few days. it's by tonight where we see the dewpoints creep up. scanning the skies right now, they're -- there's not a whole lot going on. it's going to be a sunny bright delight today. we are going to see, though, the heat and humidity take over and z and the chance for rain

shower. and then we get into the 10:00 hour, you see even an isolated thunderstorm. and then as we work our way into the afternoon, you got the heat, you got the humidity, you have the lift in the atmosphere, so you see a few more showers pop up, a few isolated thunderstorms, and then thursday into friday this i think a little overstated. it's going to be more in the way of cloud cover. there'll be moisture aloft. there will be those passing showers both days. i think of the next few days, i think wednesday likely will be the busiest as far but then when you have heat and humidity, both days right around 90, you have to leave the possibility of some more stormy weather in the forecast thursday into friday. some of that rain on friday could be heavy. and then we're still sweatin' to the oldies, high of 91 on saturday. so, yeah, today is the day to get out there and enjoy it, and to help you get out there, here's alex. >>reporter: thanks, john. good morning, everyone. if you are traveling in the bronx, some changes for you. two lanes are closed in both directions of the cross bronx. it's near the sheridan expressway. delays are starting to build as you make your way eastbound.

this. also the manhattan-bound tube of the queens midtown tunnel is closed for construction. the queens-bound tube is taking that two-way traffic for you. we also have construction in the brooklyn-bound tube of the battery tunnel. again, road work under way there. the manhattan-bound tube is taking that two-way traffic for you. alternate side parking, it is in effect city wide. do be safe, don't text and drive. chris, over to you >> alex, thank you. if you're just waking up, here's a quick look at your morning update. police in princeton, massachusetts, say a new york city woman who disappeared been found murdered. 27-year-old vanessa marcot worked in manhattan. she was in massachusetts visiting her mother. surveillance video released of two robbery suspects in the bronx. they're accused of beating a man on the grand concourse in fordham heights last month. police say they stole $1,300 in cash, a cell phone and a tablet computer. donald trump has announced an economic plan which he says will revitalize the u.s. economy by cutting taxes for workers and businesses. hillary clinton responded by saying trump's plan would

to create jobs or boost the economy. the kansas city water park where a 10-year-old boy was killed is scheduled to reopen tomorrow, though the ride where the accident happened will remain closed. police say caleb schwab broke his neck while riding down the verruckt water slide. he was in a raft with two women who were unrelated to him. they suffered minor facial injuries. the water park says the rides are inspected daily. >> we honestly don't know investigation -- a full investigation is necessary. all our rides are inspected everyday, and our rides are inspected by an outside party before the season starts. >> the 17-story water slide sends riders plummeting at speeds up to 70 miles per hour before opening in 2014 the slide faced multiple delays. tests with sandbags showed rafts literally flying off the slide. the ride was also limited to children over 14, but that

concerns about local water slides in our area. cbs 2's emily smith has more from suffolk county. >>reporter: at splish splash on long island, there are 35 water slides, some high in the sky with 80-foot drops. >> i get scared going on, but i feel fine once i'm going down. >>reporter: but with sunday's death of a 10-year-old boy at the water park in kansas city, some parents here are now concerned about water slides. >> it could happen to anyone, so, you know, but i try not to live my life coming today. that's why i'm here with my friends. we didn't want to let the kids come by themselves. >>reporter: long island splish splash doesn't have anything like the park in kansas city, but this is the most daring. it drops eight stories in three seconds. it's half the size of kansas city's. it's called cliff diver which, like all water slides at splish splash come with a height and weight requirement. height and age limits may have been a factor in kansas city. caleb was 10, the ride requires

mike bankston says he can't speak for other parks, but here managers ride every slide every morning and lifeguards are audited by an unannounced risk management team to be sure they are watching height and weight requirements. >> every year at the beginning of the summer the department of labor comes in and walks all of our slides, the fiber glass, the towers, everything and checks to make sure is everything is okay. >>reporter: while the park in kansas city hasn't released many details about how the boy died, parents here have >> i don't know what went wrong to have it happen, and ironically today my son was telling me how we had to go on cliff diver together which we haven't done yet. >>reporter: and that's the biggest one here. >> yeah. >>reporter: many parents say when it's awe august and humid say it's hard to tell your kids no when it's all a risk. emily smith, twuz. >> just gotta be careful on these things and the lifeguards have to make sure the kids are tall enough, heavy enough, old enough, whatever.

a charter school showdown in new jersey parents in mont claire say they want one. >> they claim the proposed charter school could ruin the town's award-winning public stop the charter school they say will go away from a unique system the town has worked hard to build. >> mont claire prides itself on our diverse public schools. kids are not assigned to schools based on where they live, but rather based on what their interests are. >> the charter was proposed based on the idea that the schools are failing, and that's just not the case. >> an application for the full bright academy charter school

forecast for today. but, first, city bike is rolling into another manhattan neighborhood and some in the area are outraged. >> many people on the block include the disabled or families with children. they say the bikes pose a problem. cbs 2 is demanding answers. >>reporter: metal bike racks line the stretch of 91st street between second and third avenue. closed to vehicle traffic for 40 years, this street is also home to many elderly and disabled residents, and people like maria laguna i'm very unstable on my feet. if i see a bunch of bikes coming to me, what's going to happen? >>reporter: the debate is nothing new, but the people who live here say this time it's different. it blocks the only handicap entrance to the park. now when people try to go out, they run into this row of bikes. tony lives on this street. he's blind and relies on his dog baby to help him around. but baby couldn't figure out a way around the metal racks. >> i think it's an absolute

cross the street here. i'll fall and break my neck. >>reporter: but not everyone thinks the 39 new bikes are a bad idea. >> i think it's a great thing for the neighborhood. i have a store right here on second and it's wonderful for the neighborhood. it brings more people to second avenue. >>reporter: councilman ben callos says his office sent a letter to the d.o.t. last year when the plans were first proposed, asking them not 0 to put a city bike station in a dedicated play street >> city bike is fine, it just shouldn't be on a closed play s put it over there 10 feet away. >>reporter: the d.o.t. says they didn't know about the issue on 91st street until cbs 2 brought it to their attention. >> it is always a balancing act with city bike and i'm happy to say sometimes when people complain a lot when a station first comes in, as soon as they get used to it, they often grow to love it. we're obviously going to go take a look at this one. >> so this raises the question of how much communication goes on between d.o.t. and the communities where these bike stakeses are being installed.

eight people inside of the deli when those shots rang out and they were at close range, within two to three feet. one person is dead this morning, an innocent bystander. the suspect was shot and is now in police custody. now, sources say this is what happened. it all started at a deli on the corner over here. you can't see it because there is a massive police scene going on right now. the suspect got into an altercation with a clerk at this deli, then he walked across the street to on the corner. that clerk followed him in to warn the store owners and customers that this man was coming inside. the police were called, and when they came to grab the suspect and take him out of the store, the suspect grabbed one of the officers' guns from their holster and began firing, almost emptying the clip, 15 shots rang out in that close proximity. and the store clerk from the original deli was shot and

>>reporter: but the similarities have rattled many new yorkers. >> as a young woman, you feel the need to be protected in the city that you live in. so it's terrifying. >>reporter: well, vanessa mercot's family asking for privacy this morning, but her colleagues here at google say that she was a beloved member of their team. we're awaiting autopsy results which are expected to be released later today. reporting live this morning in chelsea, janelle burrell, hospital after gunfire breaks out in the bronx. the shooting happened around 6:30 at 179th and grand concourse in the mount hope section. police say it appears the wounded victim is a 20-year-old woman and a 63-year-old man, they were unattended targets. none suffered life-threatening injuries. so far no arrests have been made. police are also investigating a slashing on the upper west side. it happened last night at mama's famous pizza and burgers on broadway near west 86th street. employees tell us a man in his

a fight broke out and the worker was slashed in the back. he was treated for nonlife- threatening injuries. the slasher ran off. to campaign 2016, hillary clinton campaigns in miami today, donald trump has two rallies in north carolina. last night maine senator susan collins joined the list of republicans who said they will not vote for trump. she cited concern over trump's temperment, self-discipline and judgment. earlier in the day in detroit, trump announced a new economic and tax plan. the tax plan would reduce e to three. top earners would pay 33%, down from the current 39%, and at the other end, people would pay nothing at all. trump also wants to allow families to deduct their child care expenses. >> our current tax code is so burdensome and so complex that we waste9 billion hours a year in tax code compliance. >> trump also wants to reduce

completely. chris and mary. >> all right, alex, thank you. more breaking news now out of the bronx. a chaotic scene this morning in bedford park. bullets fly inside a crowded bodega as police struggle with a suspect who allegedly grabbed an officer's gun >> a deli worker was killed, the suspect wounded and now in police custody. cbs 2's magdalena doris joins us live from bedford park with more. magdalena. >>reporter: we just got updates from the bronx borough commander here moments ago. police have been investigating since 1:00 this morning when they say t identified by police as efrem guzman. he is 30 years old. he was shot in the torso by officers and a 49-year-old man, a deli worker was killed during this gunfire exchange. now, police say this all happened at a deli that is now being blocked by this white truck. the 49-year-old store clerk and efrem guzman got into an altercation there. guzman then cross the street and then headed to this deli,

clerk followed him in, warning the customers and the employees that were inside that deli that guzman was coming. officers were eventually called to the scene from the 52nd police precinct, and when they entered into this store, they got into phase cal altercation with 30-year-old guzman. guzman then pulled the gun from an officer's holster with one pull and started shooting. police say he let off 15 rounlds inside of that store. there -- 15 rounds inside of that store. there were multi store at the time. so this was all in a very close range, maybe two to three feet. once guzman started to shoot, officers then pointed their gun towards him, shooting three times. they shot guzman in the torso. he was taken into custody, but while this gunfire was going off, police say guzman's bullets hit that 49-year-old store clerk that he initially got into an argument with. that store clerk died. neighbors heard all of these

it happened last january 30th around 1:00 p.m. at the shenel store in midtown manhattan. police say the victim whose name is on the card is a 26- year-old queens man from long island city. new this morning, police in the bronx are looking for three robbers who stole a 59- year-old man's cell phone and knocked him out. it happened early monday morning on east gun hill road in norwood. the suspect attacked the victim, then a second man when they tried to get the phone back. the man whose phone was stolen being punched and kicked repeatedly. the two victims were treated at jacoby medical center and released. a new court fight in the scandal over the george washington bridge. the law firm hired by governor christie's office to investigate the lane closures in fort lee says it will fight subpoenas to testify at an upcoming trial. former christie aide richard kelly and former port authority executive bill berone go on trial next month. they're accused of closing the lanes in 2013 for political

more this morning. magdalena. >>reporter: chris and mary, we just got an update from police minutes ago from the bronx borough chief who tells us this all happened in very tight quarters inside of this bodega on the corner here of east 198th street and valentine avenue. nearly 20 shots ringing out and people were within two and three feet. two officers trying to shield people inside from those bullets that were ringing out. now a store clerk is dead, a suspect was shot and is now in police custody after grabbing the magazine. police say 30-year-old efrem guzman got into an argument with a 49-year-old store clerk at a deli across the street. he then went into the next deli trying to get into an altercation with those store clerks and customers inside. the initial clerk followed him in to warn the people that he's familiar with about guzman, and that's when the police were called. when police arrived from the

went in and efran guzman grand one of their guns from the holster with one swift yank. he started firing that gun and 15 shots rang out inside of this store. one of them hitting the 49-year- old store clerk. he initially got into an argument with. police laid it all out in a news conference. >> as the officers were escorting mr. guzman out of the store, mr. guzman was able to grab a gun from officers' holsters. the officer struggled with mr. guzman to regain control of his gun when the second officer fired three shots at mr. guzman, striking him twice. mr. guzman fired numerous shots from the officer's gun, one of which we believe fatally struck a 49-year-old male who works in a store across the street. >>reporter: again, the nypd

moment. plus murder in massachusetts, another new york woman killed while out for a run. is there a connection to the murder in howard beach? what police are saying coming up. but, first, breaking news in the bronx. a wild shootout inside a bodega, a suspect grabs a police officer's gun and kills a deli worker. good morning, i'm chris wragge. >> and i'm mary calvi. thanks for waking up with us. and breaking news this morning out of the bronx, a bronx deli clerk is dead, killed after police struggled with a suspect who grabbed an during the scuffle. now he's in police custody. cbs 2's magdalena doris joins us live from bedford park with more this morning. magdalena. >>reporter: good morning, chris and mary. the nypd says the responding officers were lucky that they did not get shot themselves as they were trying to shield the store employees and customers from over a dozen bullets that rang out inside of this deli at around 1:00 this morning.

got into a physical altercation inside of the deli on the corner of east 189th and valentine avenue, and when cops tried to take guzman out of the store, with one pull, he was able to grab the cop's gun and empty the magazine inside that store, hitting and killing a 49- year-old store clerk whom he'd argued with just minutes earlier. police returned fire, hitting the suspect twice, as they tried to protect the people inside. >> escorting mr. guzman out of the store, mr. guzman was able to grab a gun from one of the officers' holsters. the officers struggled with mr. guzman to regain control of his gun when the second officer fired three shots at mr. guzman, striking him twice. mr. guzman fired numerous shots from the officer's gun, one of

swarming with detectives. it's where vanessa mercot was visiting her mother over the weekend. the young woman had gone out for a jog along a tree-lined route, and when she didn't return, her mom called police. her body was found sunday evening in woods off of the road about a half mile from her mother's house. there are reports that she was naked and there were burns on her hands and feet and signs of sexual assault. >> we cannot tell whether or not it was a random act at this point, so we're asking the residents of princeton and the vigilant. >>reporter: mercot's murder happening just five days after 30-year-old jogger karina vetrano was killed in howard beach. police in queens still hunting for her killer. in a packed community meeting last night investigators said they don't believe the cases are connected. >> with that said, we are going to continue to share notes and compare evidence as both cases progress. >>reporter: but the similarities have rattled many new yorkers. >> as a young woman, you feel the need to be protected in the

so it's terrifying. >>reporter: now, authorities in massachusetts are expected to release mercot's cause of death sometime later today. reporting live this morning from chelsea, janelle burrell, cbs 2 news. major crime is down overall in new york city, but in city parks it's way up, that's according to nyc park advocates, a watchdog group that analyzes nypd data. the number of rapes, robberies and assaults rose 23% in the nine months through march compared to the preou the figures do not include central park which has its own police precinct. the nypd says the parks are among the safest places with less than 1% of all crime reported in the city. new this morning, police in the bronx are looking for three robbers who stole a 59- year-old man's cell phone and knocked him out. it happened early monday morning on east gun hill road in norwood. the suspects attacked the victim and a second man when they tried to get the phone back. the man whose phone was stolen was left unconscious after being punched and kicked repeatedly.

released. the cause of a raging fire on the lower east side remains under investigation this morning. flames eresulted on the roof of 190 bowery which is near spring street. there were also several explosions. the historic building is best known as the former home of a germania bank. tweas completed in 1899. there were no injuries. new information this morning, a brooklyn rapper caught on video firing shots back stage during a t.i. concert at irving plaza is now suing the venue. troy ave seen here on crutc says poor security at irving plaza allowed a, quote, third party to bring in the gun that was used to kill ronald mcfader. the rapper whose real name is rolin collins was wounded during the incident along with two others. back in may collins said he wrestled the gun away from another man. collins is now facing attempted murder charges. a new court fight in the scandal of the george washington bridge. the law firm hired by governor christie's office to investigate the lane closures in fort lee says it will fight

worked hard to build. >> montclaire prides itself on our diverse public schools. kids are not assigned to schools based on where they live, but rather based on what their interests are. >> the charter was proposed based on the idea that the schools are failing, and that's just not the case. >>reporter: despite opposition by some parents, along with the board of education, the mayor and town council, an application for the full bright academy charter school of montclaire has moved to a the charter proposal is for a school of 250 students, kindergarten to fourth grade that will have a dual french/english curriculum with spanish as a core subject. it would take $3 million away from public schools the first year. an the naacp says it may segregate students. >> we have a very diverse, high- performing school system, and we believe that a charter school would dplinnish that.

systems across the nation with school options for science and technology, gifted and talented, s.t.e.m., a montessori magnet and more. this is the proposed location of the charter school off forest avenue near chestnut. parents i spoke to say it's just not necessary >> if a charter comes in, we will lose some of the amazing things that we can offer our children. my children are studying mandarin. >> my school has a lot of creative and amazing arts. >>reporter: but ste education referred me to the founder of the chapter, darrell bogen. she confirmed she is a parent in town, but would not comment on the application. we spoke to about 20 residents who were well aware of the controversy but found no supporters for the charter schools. in montclaire, new jersey, meg baker, cbs 2 news. >> the final decision is expected on september 30th. if approved, the school could open next year. city bike is rolling into another neighborhood and some who live there are complaining.
