a warren county woman is the first to file a lawsuit in the wake of the listeria outbreak linked to salad from the dole plant near dayton. dayton.the lawsuit was filed by a woman who claims her mother became sick after eating tainted salad mix purchased from a kroger store in january.that salad was bagged at the dole plant in springfield.the plant remains shut down because of that listeria outbreak.18 people were hospitalized after eating the salad including someone from michigan who died.dole isn't commenting on the lawsuit. it's being called "super tuesday two" with voters in four states making their picks for president today. voting is underway in hawaii, idaho, michigan and mississippi for republicans.

at stake. the democrats are voting today in michigan and mississippi. more than 1- hundred-60 delegates are up for grabs for the dems. donald trump is looking for a repeat on his dominate super tuesday performance. but a new national poll out today shows the race is changing a bit. trump now has support from 34 percent of voters... followed by ted cruz at 25 percent. that's less of a lead than he held two months ago in a similar poll. support is one thing but like is another. just about half of republicans say they actually like trump as the nominee. that's much less than cruz at 65-percent and rubio at 62-percent. mitt romney is also continuing his push today against trump... sending out robocalls for the other candidates. runs=11"hello. this is mitt romney and i'm calling on behalf of marco rubio for president. i believe these are critical times that demand a serious, thoughtful, commander in chief." chief." romney goes on to say he's convinced trump would lose to hillary clinton.

robo-callers ... and more of today's top consumer stories ... is 9 on your side consumer reporter john matarese. julie....we all hate them, and they never seem to end. robocalls. now lawmakers are calling on phone companies to offer new ways for us to be able to block robocalls. robocalls. they also want the federal trade commission to pressure companies to integrate technology to do that directly into new cell phones. there are more than 3 million complaints to the f-t-c every year about robocalls. new technology is making it easier for robocalls to call more numbers all at once, and making it harder to track them. ironically, the federal government is one of the robocall offenders. federal debt collectors are exempt from robocall restrictions. congress is considering a bill called "the hang-up act" that would change that.

following breaking developments out of hamilton - one man struck by a train and flown to the hospital. 9 on your side's ashley zilka is live at the scene with what we're learning about the victim's condition - ashley. ashley. police have left the scene but you can see inspectors are still looking at the train. when first responders got to the scene- they had to pull the victim out from under the train. the 19 year old man was conscious but it's unclear how serious his injuries are at this time.the accident happened here at the intersection of martin luther king junior boulevard and pershing avenue around 3:15. right now- the northbound train is stopped and some of the intersections are blocked. the man twas taken by ambulance to a hospital. according to police, the incident does not appear to be a suicide attempt. right now- investigators are trying to figure out why the victim was walking near the train tracks and what exactly happened. more breaking news now- a
