representatives from the faa safety risk to passengers is "immediate and urgent" and cited research showing batteries can cause fires capable of destroying a plane. an environmental group is suing the federal government, over how it handles big oil spills. the suit was filed by the national wildlife federation. it says the federal oil pollution act prohibits operators from handling, storing or transporting oil until their spill response plans get federal approval. the group says the department of transportation was ordered to write regulations and review companies' spill response plans 20 years ago but never has. heather: senator harry reid has filed a lawsuit in connection with his treadmill fall on new year' s day. he says he was using an exercise band on new year' s day when it broke or slipped out of his hand and made him fall.

phil: a warning for some gm owners tonight, don' t use your windshield wipers. an electrical short could cause them to catch fire. the recall involves model years 2016 and only 60 400 were sold. the rest will be repaired for free. a hefty settlement involving lumber liquidators. the company has agreed to plead guilty and pay 10 million dollars for making false claims about where the timber used in its hardwood flooring came from. the company also faces allegations that some of its flooring contained toxic chemicals including cancer-causing formaldehyde. more than 100 lawsuits have already been filed. heather: it is not even halloween yet, but this year' s holiday retail forecast is already out and the national retail federation is not expecting a great season.

sales are expected to be up 3%, but that is a slowdown from 4.1% up last year. amazon is getting hands into the handmade crafts business. the company is launching handmade at amazon. it will feature items from all 50 states and other countries handmade is one of several niche market amazon has moved into his past few years. phil: act fast if you' re looking to save on holiday travel. the orbitz holiday insider index says tickets will be cheapest tomorrow. airfare may dip again around november 6 but will peak the week before christmas. you can save the most money, up to 30%, by flying on december 21' st, the monday before christmas or on christmas eve. heather: i cannot think about christmas.

phil: encouraging news for those of you trying to quit smoking. your risk for diabetes appears to drop, over time, once you finally stop. a new study shows the more people smoke, the higher their chances for diabetes. but if they quit, their odds of being diagnosed diminishes even in as little as five years. bottom line the long-term benefits of quitting smoking

risk. heath: it' s mainly known as a women' s disease. but men can be diagnosed with breast cancer, as well. the american cancer society says roughly 2300 new cases of breast cancer will be diagnosed in men this year compared to 23,000 women. men are typically diagnosed at a later stage than women. and while cases those cases are rare, doctors say the number of men with breast cancer is increasing up 26% over the last 25 years. flu season is upon us and we all getting that flu shot. are having fun driving that point home. phil: matter how many times you smile.
