emily: it's friday, october 9. good morning. i'm emily riemer. erika: thanks for starting your day right here. i'm erika tarantal. here are the stories we're following on the eyeopener right now. uber in trouble this morning over passenger safety. the incidents that have two women taking the company to court. emily: new fallout.from the fantasy sports scandal. the accusations sparking a federal lawsuit against draftkings and fanduel. emily: new trouble for uber this morning over passenger safety. the eye's antoinette antonio is live in boston with the lawsuit the ride share company is now cindy: we're starting out this morning dry but have an umbrella with you as you're getting ready to head out the door.

there is some work on the expressway by the south bay mall. still come work on the entrance ramp to the pike. trains and buses expected to start the day on schedule. emily: thank you. new trouble for uber over passenger safety. rorp >> reporter: this morning two women are taking on the company, accusing uber of neglect and fraud after they were allegedly sexually assaulted by drivers. the lawsuit focuses on two separate incidents: one in boston back in february where driver abderahim dakiri was charged with indecent assault after allegedly took a woman off her route and attacked her. the other incident happened in south carolina with similar allegations. the lawsuit calls on uber to create full-service customer support centers. mandate tamper-proof video

cameras in cars. give customers the option of choosing a female driver. and mandate fingerprint based background checks. uber, which is currently facing a regulation debate here in massachusetts, released a statement saying the company's thoughts are with the victims in these cases. we are live in boston. wcvb news center five. >> other stories we're following right now. investigators are trying to figure out what caused the fire that heavily damaged a popular brockton business. the flames broke out at the sunset cafe around 7:00 last night. one firefighter was injured in a fall during the fire, but he's expected to be ok. local leaders, including the mayor, said the cafe had done a lot to revitalize that brockton neighborhood. >> police are looking for a man and woman seen leaving the scene of a stabbing on boston common. one pulled out a knife and the fight turned bloody.

wounds described as nonlife threatening. >> investigators say this fast-moving fire at an oxford lumber yard was an accident. the fire chief says wednesday night's flames started near a make-shift kiln used to dry lumber. the telegram reports that kiln was built out of an old oil tank, which was not maintained and left unattended. the business owner says his son noticed the smoke, was on scene all night helping deal with the fire and its aftermath. >> right now there is new legal trouble at the trial of a teenager accused of killing his teacher. a father from danvers could be charged with contempt after violating a judge's orders and speaking to fellow potential jurors about why he wouldn't be picked. the man identified as "juror 39" admitted that he went on a rant about the fact that his son attends danvers high, the same school where philip chism allegedly raped and murdered math teacher colleen ritzer. the judge will meet with the trial teams this morning to decide if any other jurors were tainted by his comments. >> right now investigators are trying to figure out what caused

this raging marina fire in quincy. they're still waiting to raise the boat where the flames actually started. for some people, those boats were also homes. we brought this to you as breaking news yesterday morning. the fire started in a boat called the dry anchor with what witnesses describe as two big explosions. an abington woman on board barely escaped with her life. >> she came out of her bedroom and smelled and saw smoke. so she yelled to my dad and that point the smoke got worse. he yelled at her to get off the boat. she was scared to go from one side to the other because of what would happen. he went back and held her hand and pulled her back through. >> there were 11 boats involved in all. this morning former crew members are raising new concerns about the cargo ship lost at sea during hurricane joaquin. they say the el faro some rooms were constantly leaking. and that the drainage didn't work on the ship. the company that operated the ship denies those claims saying the vessel was

meanwhile, a new mission will be launched in finding the ship. the u,s, navy will send special equipment in hopes of locating el faro and its data recorder. that recorder may explain what happened as the ship went under. house speaker robert deleo knew winthrop native keith griffin, who went down with that ship. >> he would be the type who would just go through a wall, you know, to get something done. and my first reaction was i could just picture keith out in the ocean. you know, saying i'm going to save this one. i can do this. >> two other massachusetts natives were also aboard. investigators believe the ship is located close to three miles below the ocean's surface. >> right now a class action lawsuit spellling new trouble for the fantasy sports business. that includes allegations of insider-trading, fraud and false advertising by boston-based draftkings and rival site fan duel.

draftkings employee won $350,000 from fanduel, the same week he inadvertently posted information about the players being picked the most in nfl fantasy lineups. draftkings has denied any wrongdoing, but questions are growing. >> there is a reason to think if you're working for draftkings or fandual, you might be very good at this particular product. that said, maybe there is the possibility they are making this money at least in part because of misuse in information. >> new york's attorney general has the incident, and massachusetts to the two companies about their practices. >> new this morning, boston commuters are demanding changes to make getting around the city less painful. the gobe reports residents would like to see speed limits lowered to 25 miles per hour. more train stations that have

new signs that vice president joe biden may be nearing a decision about entering the race. according to the new yorker, biden aides met with staff from the democratic national committee this week. they reportedly went over details like the primary calendar and filing deadlines. a d.n.c. spokesman would not confirm the meeting took place. meanwhile, a super pac that is urging biden to run now says it will not air a television ad draft biden released a 90-second video online wednesday. titled "redemption," if focuses on the vice president's personal story, recalling the death of his first wife and daughter in 1972. a friend of the vice president told the "l.a. times" yesterday that biden did not want the ad to air. the super pac says they will honor his wishes. right now republicans are still trying to sort out the chaos on

carson was pressed about earlier views he wrote in a book that gun confiscation in nazi germany made the holocaust worse. >> i think the likelihood of hitler being able to accomplish his goals would have been greatly diminished if the people had been armed. >> he suggested if he were in that oregon classroom when a gunman stormed in, he would have urged everyone to confront the shooter. erika: right now republicans are still trying to sort out the chaos on capitol hill. california congressman kevin mccarthy is out, abruptly pulling his name from consideration to replace house speaker john boehner. now there is a growing push to convince former vice presidential nominee paul ryan to throw his hat in the ring. ryan says he doesn't want it, but we're learning boehner and others have now made personal calls to get him to change his mind. a top advisor for the romney-ryan campaign says he understands why.

minute or so. so far the trains and buses expected to start the morning on schedule. erika: governor baker wants more charter schools in massachusetts. baker has filed legislation to add or expand a dozen charter schools each year, beyond the current cap. the bill is similar to a question that will appear on next year's statewide ballot. baker says it's about making a good education available to more children. >> in massachusetts we have 37,000 kids on waiting lists to get into charter schools which is a pretty big statement by a lot of families in underperforming school districts that they would like more options. we would like to give them those options. emily: opponents say raising the number of charter schools would undermine the state's public, non-charter schools. about 80 charter schools currently operate around the state. topping economic headlines this friday -- asian markets jumped overnight over expectations interest rates will stay at a record low here in the u.s. right now stock futures are lower. there were gains across the board thursday. erika: if you're looking to

better before scattering. looking at what's trending this morning. selena gomez is opening up about her health issues. the singer says she was diagnosed with lupus and has undergone chemotherapy. gomez was forced to take a break deal with the autoimmune disease. about one and a half million americans have lupus, most commonly women between ages 15 and 44. emily: it's not a "dislike" button, but facebook is testing out new ways to express emotions. today, facebook users in ireland and spain will be able to use a set of new expressions and animated emojis. they include "love," "wow," and "yay!" along with happy and sad faces. facebook says the new "reactions" feature could become available to users here in the u.s. in a couple of weeks. erika: we know boston traffic can be bad. but just be glad it's nothing like this. that's a 50-lane highway in china. traffic backed up for miles. the jam happening where a new toll booth just opened, reducing the highway from 50 lanes down

a major settlement in south carolina on n the deadly shooting of an unformed black man. they will pay walter scott's family $6.5 million. it shows michael slager firing eight times at scott. he faces 30 years to life if convicted. emily: it is going to start costing a little more to use netflix. they are raising the cost of their standard plan from $9.99 a month to -- 8.99 a month to 9.99. current subscribers won't see their bill go up until next year. they will be able to add more tv shows and movies with that additional money. emily: if you're looking to buy sox tickets next season, you might want to act sooner than later. tickets purchased before december 31.
