>> he goofs around with everyone. >> if you look closely you quickly see the scars from a frightening attack. >> i saw eight and today there was another one. >> nine different shots the family says someone took at their dog when he wandered down the road last week. >> i just can't see anybody doing that. it looks like somebody was trying to kill him >> 4-year-old noble took off just after 6:00 in the morning and when his family found him at the nearby cemetery nothing seemed wrong initially. >> i petted him and noticed he had blood on his side. i looked at the wounds and said did he get hit by a car, in a fight with another dog? >> parting the chocolate lab's thick fur revealed deep wounds. >> two right in the ear. >> from a pellet or bb gun. >> what? why? >> thankfully after an emergency trip to the vet it looks like noble will recover

the dog is haunting the family. >> he can't speak for himself. hopefully we can get this out and someone will know who has done this. >> you saw the dog is very happy. he is doing well. the family says the bb's or pellets are still lodged under his skin so he potentially still needs costly surgery. live in rochester tonight, john atwater wcvb newscenter 5. >> draft kings is signing a big name on defense. confirming tonight that the boston based site has hired former attorney general martha cokely as ad vicer. she is also newscenter 5's legal analyst but will not be part of any stories about draft king. it appears the site is gearing up for a fight as the state inches closer to slapping new rules on fantasy sports websites. let's get to the state house right now with the breaking developments. >> well, tonight draft king says its own internal investigation clears its

employee of any wrongdoing. legal experts say not so fast. according to draft kings its employee did nothing wrong, did not use insider info to win $350,000 on rival fantasy site fan dual. the company receiving a statement saying because he did not receive the information until 40 minutes after the lineup was locked. good public relations says this law professor michael mccann. >> certainly draft kings hired a preeminent attorney but there is no way an attorney can be completely unbiased. >> there are investigations into possible violations of federal gambling laws. writing, they say though well respected, there is little legal bearing. >> his voice supporting draft

kings certainly helps but isn't >> tonight the massachusetts attorney general released a statement saying there is little question this industry needs to be regulated in order to protect consumers. draft king's own investigation unlikely to put up any legal fires. >> we know draft king hired an attorney. person. it isn't a court or a jury. >> gambling officials in nevada have already ruled draft king and fanduel must obtain licenses to operate there. here the attorney general says she'll announce findings of her own review soon. live outside the state house, newscenter 5. >> also breaking tonight this man charged with injuring three lowell police officers. one of the officers was thrown down the stairs of a home while trying to arrest the man. two more officers who arrived as backup were also hurt fighting with the man who is now in custody. the officers were taken to the

hurt. >> nearly three dozen people are out of their apartments because of fire tonight. flames broke out and two people are being treated at this hour for smoke inhalation. >> it's another chilly night as we look live over boston. 40's in most spots right now. 30's in some. a warmup is on the way. >> absolutely, heather. morning. if you were out you know what i'm talking about. 17 in norwood. other places in the teens. many spots in the 20's. below freezing in boston. look at the readings tonight. for a couple reasons. they're in the 40's but clouds are moving in. the north of boston. that would be about it. also the wind direction now out of the southwest. that means warmer times and the around the islands. a wind advisory in effect tomorrow 7:00 a.m. to 7:00 p.m. for the cape and the islands where there can be many gusts for the rest of us the temperatures will move in the 40's through the overnight and

morning. some of us will see it into the 60's and then we'll be back in a little while to talk about the rest of the week. more ups and downs in that temperature department. >> a not guilty plea from whitey bulger's long-time girlfriend today. katherine greg faces a contempt charge for refusing to say bulger had help evading the law during his 16 years on the lam. prosecutors say greg has ignored a judge's order to testify before a grand jury. the brother of a woman allegedly killed by bulger says greg is doing what she's been paid to do. >> there is a price on everything. she must have got paid a lot of money to keep her mouth shut. >> greg's lawyer calls the contempt charge bordering on harassment. >> the suspect in the death of a little girl who came to be known as baby doe are back in court tomorrow. michael mccarthy is charged with killing 2-year-old bella bon. mccarthy the boyfriend of the girl's mother who is charged as an accessory after the fact. little bella's body was found

over the summer on deer island and identified months later. the philadelphia mom who sparked an amber alert in boston over the weekend is free tonight. the judge setting bail at just $250. tiffany cherry says shoo -- she brought her 2-month-old son to boston for medical treatment after he became severely dehydrated. her lawyers say police over reacted when they triggered the amber alert. >> the whole thing was over blown. she has custody of these children. this is not a case where she took the kids. >> that child tonight is now in state's custody. commitment 2016 right now and all eyes at this moment on joe biden as he decides whether to jump into the presidential race. >> and there are new indications tonight of the impact if he does decide to run. phil? >> we know this. with each passing day the vice president does get closer to making that decision. everything he says now is open

at the white house even president obama was bombarded with questions about his vice president. for his part biden had nothing to say publicly about 2016 today although at a white house event he did say this. >> i don't consider republicans enemies. they're friends. >> was that a swipe at hillary clinton? this is what she said when asked which enemies she is most proud of. >> well, in addition to the nra, the health insurance companies, the drug companies, probably the republicans. >> how about this? was this a shot at bernie sanders? >> one of these guys, you know, let's go after the rich and the powerful and they're the problem. they're not the problem. >> a source close to biden told abc news the v.p. has not made a decision yet but has been calling potential supporters. over the weekend talking to the head of the influential firefighters union who says he told biden he'd likely get their support if he'd run.

then there is this. some insight into the biden effect. a new boston herald franklin pierce university poll shows vermont senator bernie sanders with 38% of likely democratic biden's 19. if biden does not run, though, sanders' lead over clinton jumps to 10 points. if the vice president does decide to run even his closest advisers a admit he'll be starting from behind getting in late, no money, no campaign organization, and a decision could come as late as next week. >> the school superintendent could face charges for allegedly going inside a student's home uninvited. superintendent brian hyde is accused of entering the home and going through the student's belongings to see if she was a legitimate resident. hyde claims he was invited in. police say they'll late clerk magistrate review the case before filing charges. >> boston university police tonight saying they are checking out several tips after a student was attacked in her dorm room still asking anyone

with information to come forward. the female student was sexually assaulted early sunday morning inside a dorm right next to the arena. police say the suspect broke into the victim's room and then took off after the attack. he may have tried to break into other rooms as well. >> trying to get into my room at 2:40 a.m. it was kind of terrifying to know that sort of thing happened. i try to sleep at night. >> police met today with students to discuss the investigation and remind them that resources including crisis counselors are available on campus. >> this teenager is facing life in prison convicted of killing another teen in new hampshire. jurors found the 19-year-old of rochester guilty in the june, 2014 stabbing of aaron wilkinson. prosecutors say he and two others drove to the victim's home to steal money and drugs. against him. >> no bail for jason flores the man accused of murdering a woman last year.

he was scheduled for a bail hearing today but at the last minute his lawyer pulled the request. he is charged with killing jamie mendez last november. the 25-year-old single mother's body was found on the beach two months after she disappeared. >> olympic runner oscar pistorius is out of jail tonight but under house arrest in south africa. he was convicted of manslaughter for fatally shooting his girlfriend. he has served one year of his five-year sentence and has been transferred to house arrest for the remainder of his sentence. prosecutors are still hoping to murder. new at 11:00 former nba star lamar odom is reportedly moving to a los angeles hospital. he has been treated in vegas since he was found unconscious week. the owner of the brothel said odom had asked all of the workers to sign confidentiality agreements. tonight his family says he is improving. >> next on newscenter 5.

>> new at 11:00 dozens of animals found living in filthy conditions in a home in derry, new hampshire. >> dogs, cats, birds, a guinea pig. obviously a horse and an iguana, all of them rescued. their cages were covered with animal waste. many of the animals had no food. nearly all of them were living inside the homeowner became unable to take care of all the animals and is now cooperating with authorities. >> for the investigation we determined that she had fallen on hard times.

she was unable to care for the animals. luckily, she voluntarily gave them up. >> so far no charges have been filed. >> the driver of the car involved in this motorcycle crash is under arrest tonight. look at him pull out and bang. there he goes. and he rolls over. the texas man is charged with hitting that bike on purpose. the video shows the motorcycle tried to pass the white car. as you saw it veered over the center line and into the other lane. you can see him move right over causing the motorcycle to crash, sending two people onboard flying. now listen to the driver of that car when a witness confronts him. >> i don't care. >> you hear that? i don't care. the man and girlfriend on the motorcycle had bad cuts and broken bones but not serious injuries. the car's driver faces two counts of assault with a deadly weapon and he will be in jail until a court hearing which will happen tomorrow. >> is that hard to watch.

bombing survivor is moving forward with a new mission. >> it felt great when it was done for me and it's really somebody else. >> heather abbott is determined to help others who know her struggles all too well. newscenter 5 has a very special guest. >> when heather abbott had her leg amputated after the marathon bombing she discovered how expensive prosthetic limbs are so decided to start a foundation to help cover the cost for others in need. your first pair of high heels is a right -- a rite of passage for young women, one that hillary coen waited 26 years for. >> my first time ever wearing high heels. very exciting feeling. i feel very tall and confident. >> ready to take on the world. >> coen has a medical condition which in her case caused tumors to grow in her foot. even before she had her right leg amputated two years ago

>> even in high school when the girls were shopping for prom shoes, she couldn't. she had to go with flat. >> which made this moment as emotional for mom as for hillary. >> to see her so happy and so smiley and just so glowing. >> this type of prosthetic limb can cost upwards of $25,000 and insurance doesn't cover it deeming it nonessential. the marathon bombing survivor heather abbott stepped in to make it happen. >> it feels great. i mean, it felt great when it was done for me and it's really nice now to be able to do it for somebody else. >> this is the first prosthetic leg to be donated by abbott foundation. next step, providing the custom fit. don't tell these women having a leg that looks like your own isn't essential. >> they want it back and they want it to look as much like it as it possibly can. >> it feels great. >> it looks remarkable. >> isn't it? hillary says she never has minded people sort of staring

questions but it is hard to differentiate the new one from her real leg. she said she won't mind in the mornings getting on the train and blending in for a change just to have that privacy. >> can you imagine putting heels on? if you want that enjoyment and now she has it. >> right. and to be able to dress up to go out with her girlfriends. >> good for her. >> or a date. >> to look down and see what looks like skin and have it look so authentic. >> well done all of you who have stepped forward. >> beautiful. >> take a live look at the city 11:18. the construction lights are indicating the building is going on but it's still not too bad. not too bad. >> the nice thing is the temperatures in most areas have stopped falling which means tomorrow a much higher morning. it was not a record in boston. 28. still stays in the books from 1922. it was record tying 24 in worcester and the last time we were below freezing in october

in 1979, october 10 had a temperature that was freezing in boston and it actually snowed on that day as well. the average date is november 8 for the first freeze in boston. there is another look at boston tonight. notice the city starting to shake. that's good news and bad news. a little uncomfortable when it gets windy. this is going to be a milder wind coming from a warmer weather wind direction south-southwest. we're 45 now but pretty much part in boston. and look what's happened farther to the south where the south to southwest wind is gusting. it's jumped up into the low 50's so all of this indicates a milder day tomorrow. except it will be windy most especially on the cape where there is a wind advisory in effect. notice it is milder right now. middle of the country. still in the 60's in detroit and chicago. so there is really no choice but for the air to warm up compared to today. these low temperatures may not

so i think the readings you face in the morning will be in the 40's to around 50 degrees. think about that. this past morning most of us were in the teens and 20's. we shoot up into the 60's tomorrow. we won't have the benefit of full sun. there will be clouds around certainly at times. in fact the first wave of cloudiness coming in now. even a couple sprinkles trying to form across new hampshire but again just the chance of a sprinkle. i don't see much happening with that. now here's what happens. we turn significantly milder tomorrow. then a very weak front accompanied by some clouds but not much more than that crosses the region barely tomorrow night and wednesday. so it turns a little cooler wednesday compared to tomorrow but not nearly as chilly as what we had early this morning. and then thursday we're going to bounce right back into the warm air before a front from the west comes through along about thursday night and turns it noticeably chillier for friday. there are a lot of ups and downs in the temperature department. but no major storms. even though we have clouds around and then some breaks and

still more clouds around at times tuesday night, and wednesday, don't see much in the way of rainfall. couldn't rule out a brief sprinkle and maybe a shower or two thursday night or so when the next front comes through and then it does turn noticeably cooler. all right. check it out as we check out the next seven days for you. tomorrow breezy. windy on the cape. milder though. reaching the 60's. then on wednesday it's a little bit cooler and then thursday it's a little bit warmer. but the main idea over the next few days is the jet stream lifting up and allowing the mild air back in. by friday we're turning chillier again and then on the weekend looks like a great start on saturday. an increase in clouds on sunday depending on the timing of the next front. there could be a spot shower or two either sunday afternoon or night. but again, i don't see anything big with that. then it's back to colder weather monday but right now my early estimation is the temperature could be around 60 degrees or so for the start of

look at this. full speed. home run derby tonight. started off with troy tulowitzki. josh donaldson. then going, going, gone. third homer of the night. up 10-4 they hang on and win 11-8 the final. game four tomorrow afternoon. at the garden, one of the newly acquired celtics had 15 tonight. kelly olynyk had 14. terry rosier a rookie out the last couple games with a knee injury helped win it and they're now 4-1 in the preseason. finally tonight congratulations to coach donahue and her watertown field hockey team. tonight in wilmington they won. they now have gone 153 straight games without a loss. that ties the national record. they can break it wednesday afternoon at home against melrose. this is a picture.
