"eyeopener." emily: also on the eye. a bizarre sight in china. vans and cars floating off the ground shocking drivers and people walking near this intersection. the mystery now solved. we will explain. later this morning. good morning. i'm emily riemer. olessa: better stick around for that. cindy: yeah. randy: randy price with cindy fitzgibbon. a cold start to the day. cindy: it is cold and dry but do not leave the house without an umbrella. look at the readings out the door. lots of 20's right now. boston sitting at 32 degrees. it's really the only spot at the freezing mark right now outside of that 20 from the cape to the north shore, southern new hampshire. out in the western part of the state as well. the skies though are still mainly clear. but you can see to the south a few rain drops sneaking in to southwestern connecticut. these are focused back toward new york city. this is the area that is going to be lifting on in this morning. so it's kind of a race to see

this precipitation moves on in. it will take a while to get in here though. we'll come out of the 20's into the 30's this morning. make sneak in a few peeks of sunshine as the sun comes up at 6:53 but by 9:00 this morning, the clouds are thickening up. i think that rain arrives after lunchtime in the boston area. and by then, we should be at or above 40 degrees but it will be a different story west of the worcester area. by late morning as we get a few rain drops in here, they'll be calling into surfaces that are so at or below freezing so it could create slippery krchs. there is a freezing rain advisory up until noontime out today. here you can see not a lot happening this morning besides the clouds thickening up. there are the rain drops in the western part of the state. during the afternoon they move on in to the boston area so your evening commute will likely feature some wet weather. but this is just the beginning. more rain coming in. we'll time that out just ahead. right now we want to get you out to the dry roads. olessa: that construction is picking up. a live look outside the top of the expressway.

and the northbound side. so far nice and quiet for us this morning. let's get over to the maps and check out the rest of that trip as you head into town. construction clearing. the final stages here approaching the zakim on 93 south as well as here on 128 by 95 and the ramps from 95 to 128. roadwork also picking up near great plain avenue. as you travel the pike so far so good this morning. construction clearing here on 128 south, 4 and 225 down to route 2. trains and buses starting the morning on schedule. randy. randy: thank you. only on 5. a new bedford cab driver seen minutes before his murder. police are looking through this video searching for clues on who killed the grandfather saturday night. emily: erika's here with the new leads in the case. erika? erika: robbery seems to be the motive in the shooting death of donald depina. now sources tell us police are looking for two young men, ages 14 to 18. those sources say police have surveillance video from both inside depina's cab and from the

his last fare. depina would later be found shot dead next to his car in the parking lot of brooklawn park. the 66-year-old was a vietnam vet and once served as new bedford's veteran's agent. >> my first sergeant in the 483rd engineers. the best man i ever knew in my life. erika: depina leaves behind three kids and six grandkids. a "go fund me" page has been set up to help with funeral expenses. emily: a probable cause hearing will be held today for one of four people accused in a grisly marshfield murder. mark o'brien of south boston has been held without bail since his arraignment. police say he was the driver during the september 16 murder of robert mckenna after he and the others broke into the victim's home. o'brien has pleaded not guilty. randy: the defense gets the case today in the philip chism murder trial. they'll argue the teenager was insane at the time he's accused of killing danvers high school teacher colleen ritzer.

the courthouse in salem with the comment made after the prosecution rested. sera? sera: well that comment was about a motive. it was the first time we've heard about one. the prosecutor told the judge that this is a sexually motivated homicide. the prosecution rested its case after the testimony of one of surveillance video shows sarah giaquinta, a fellow teacher, talking to ritzer. moments later, chism would follow ritzer to the bathroom where prosecutors say he killed her. giaquinta told the jury they talked about chism briefly. >> what did colleen say to you just about why the boy was in her classroom? >> she said i don't know why he's here. sera: also on the final day of the prosecution's case the doctor who performed the autopsy on ritzer who described her

36 witnesses. the defense is expected to call family members to testify on a history of mental illness as well as experts who evaluated chism. today a judge will also make a ruling on a rape charge focusing on whether ritzer was alive during the assault. that was in the woods. that could result in a heftier sentence for chism, if convicted. live in salem, sera congi, wcvb, newscenter 5. emily: a new bedford marine has been found guilty in the death of a transgender woman in the philippines. that verdict coming down overnight. he was convicted of strangling the woman and leaving her body in a hotel room last fall. witnesses say the two left together after meeting in a bar. pemberton was sentenced to 6-12 years. right now a second person is facing charges in a weapons theft from the worcester armory. and police say cell phone photos helped lead them to the suspect. vulgar pose. police say another photo

handguns. yet another shows what appears to be a stolen assault rifle. the f.b.i. says the placemats in the background match those found in bigsby's apartment in the dorchester section of boston. she's due in court on thursday and is charged with lying to the f.b.i. another suspect, james walker morales, is accused of stealing the weapons and trying to sell them. police say he was wearing a g.p.s. bracelet the night he broke into the armory. investigators have now recovered all six stolen assault rifles, but they're still looking for 6 of the 10 stolen pistols. the f.b.i. is offering a $15,000 reward for information leading to those guns. randy: seven minutes after 5:00 and this morning chicago's mayor will announce the creation of a new task force on police accountability. the announcement comes as a city police officer, charged with murdering a teenager, is free on bond. jason van dyke is accused in last year's shooting death of laquan mcdonald. the black teenager was shot 16 times while walking away from

hand. a 21-year-old man is in custody this morning accused of threatening to kill students and staff at the university of chicago. we've learned jabari dean made that threat in an attempt to avenge laquan mcdonald's death. the university closed the campus yesterday after the online threat surfaced. dean allegedly posted that he planned to kill 16 white male students or staff the same number of times mcdonald was shot. emily: dramatic video of a deadly police-involved shooting in atlanta. it happened last night near the aloft hotel. one person was killed. police are calling that person a suspect though it's not clear what he or she was accused of doing. the hotel says none of its guests or employees were involved. randy: new this morning. a top safety leader in boston is concerned about gangs. he says the kids being recruited are getting younger every year. the eye's todd kazakiewich is

schools. todd? todd: randy, good morning. the city's public safety director says kids as young as 14 years old are getting recruited by gangs. so principals and other school leaders are being told to keep an eye out for some key indicators. daniel mulhern tells "the herald" that includes certain clothes and handshakes. he says gang members in the area professional sports teams and baseball caps. mulhern estimates there are 30-40 gangs in boston but says city schools do not have a, quote, "overwhelming problem." the comments come on the heels of a shooting in roxbury that left one student hurt and put three schools on lockdown. police are investigating whether it was gang-related. live in boston, todd kazakiewich, wcvb, newscenter 5. emily: todd, thank you. the man accused of killing three people, including a massachusetts native at a planned parenthood clinic in colorado, could face more charges. prosecutors made that

appearance. he is he's charged with first degree murder in the deaths of three people last friday including university of colorado police officer and melrose native garrett swasey. this morning there's new video of swasey from his years as a figure skater here in massachusetts. that's swasey performing at m.i.t. back in 1988. he was a prominent competitive skater and sometimes trained with nancy kerrigan. randy: the u.s. is considering deploying more special ops troops to syria. the pentagon first wants to see if a pilot program to combat isis militants gains progress. if it works, more troops could be sent over. last month, the pentagon announced it would send 50 commandos to northern syria to advise forces battling isis. a hearing will be held today on the u.s. counter-isis strategy. emily: a warning after hackers target a popular kids toy.

"holiday lights" is live this thursday at 7:00 p.m. always a great show. cindy: it sure feels suddenly like winter. perfect timing because it is december 1. although it's a cold start this morning, we're going to warm it up today. that is a good thing. look at the temperatures right now. we are starting out at freezing in boston. otherwise, it is mainly in the 20's right now from the north shore to the south shore. look at plymouth just 24. 29 in worcester. 21 in orange. so there is some concern that we have some precipitation moving on in. from worcester on westward, it may take a while before those temperatures come up. it's kind of a race to see how quickly we warm it up before the rain moves in. and there may be some patchy areas where it's just not quite warm enough that we get some freezing rain at the onset with this precipitation so that is a concern this morning in the

otherwise, the steady rain begins after noontime. temperatures should be up close to 40 by then. there's going to be a little bit of a lull in the action by tomorrow morning and then another round of rain is coming in tomorrow afternoon. this is a spread-out rain event over the next couple of days. by tomorrow night, we're talking about a widespread half an inch to about an inch of rainfall across the area. that's a good thing because we do need it. the storm is pretty complex, but the coldest air associated with it is on the backside of this area of low pressure. it's producing snow through the dakotas and the minneapolis area. that is going to our west so overall this is putting us on the milder side of this system. first batch of rain is down around new york city now and this is what i'm tracking here. as we get into the morning hours. you can see right now the skies are still mainly clear so we may actually see a little bit of sunshine for a while this morning. the sunrise officially at 6:53. temperatures will be in the 30's through mid to late morning as we cloud over. notice in the boston area, it's going to be at about 1:00 i think before any shower activity moves on in. during the afternoon, as those

we'll actually come up into the mid and even upper 40's down on the cape today but north and west of town it does hold pretty close to 40 degrees through the afternoon. so let's time things out for you. here are the clouds thickening up this morning. no worries for your morning commute. once we get towards lunchtime there is that rain breaking out in the western part of the state where there may be a few areas still near the freezing mark so that is concern really le morning out this way. as we get into the afternoon lighter showers. have the umbrella with you. it's overnight that the rain gets heavier. that heavier rain is going to be wiefnedding down for tomorrow morning's commute. there's that lull i was mentioning. so temperatures tomorrow morning 30's to around 40 degrees. no icing concerns tomorrow morning. and tomorrow afternoon we actually sneak up pretty close to 50 degrees. as the next round of rain moves in, as this area of low pressure pushes into the area. once that goes by on thursday morning, colder winds are going to take over. there can actually be a little bit of snow flying across far northern maine here on thursday morning.

the trains and buses also running on schedule. emily: thank you. a man from brockton is the first in the region to undergo a knee surgery at brigham and women's that could change the lives of thousands of people. the surgery involves this device-- the "nusurface meniscus implant." it's the focus of an f.d.a. trial. in people ages 30 to 50, the meniscus can wear down and tear. rob price of brockton hurt his knee playing basketball. he's too young and active for a total knee replacement. he had surgery to remove the damaged meniscus, but he's left with bone-on-bone pain. dr. andreas gomoll from brigham and women's says there's never been a good treatment option for that until now. doctor: this one is a small incision if it doesn't work, you just take it out. that is what is exciting about this. >> i play basketball, maybe do maybe some kind of running again. definitely resolve to play

emily: rob had his surgery last week. the implant simply pops in between the bones creating a new cushion. no screws are necessary. while its under a trial here in the u.s., the implant has been used successfully in europe. randy: recovering from a bad night's sleep can be tough. but there are ways to do it without downing coffee. as we do hear on the "eyeopener." first get in the light. experts say you should expose yourself to bright light for 30 minutes as soon as possible after getting up. that will help reset your circadian clock to get you back on the right track. avoid ups and downs. don't guzzle caffeine or energy drinks because the temporary fix will only lead to another crash. finally, breathe briskly. experts say inhaling and exhaling quickly through the nose-- for 15 seconds at a time-- can boost your energy. economic news this morning. retailers were expecting record sales during yesterday's cyber monday deals, and target's website just couldn't keep up

the site kept shutting down asking customers to "hold tight." target had to set up a virtual line giving customers access to the site gradually in order to control the traffic. emily: if your kids have a v-tech gadget in your home, then identity thieves may now have your personal data in their hands. hackers forced their way into v-tech's servers stealing records of 4 million adults and 280,000 children. the stolen data includes email addresses, passwords, and headshots. the company says credit card information was not taken. asian stocks were mostly higher today after improved manufacturing in japan. right now, stock futures are up on wall street after the dow plummeted 78 points at the close of cyber monday. randy: the city of new bedford once again launching its holiday parking program hoping to boost sales at local shops and restaurants. everyone gets up to two hours of free parking per day downtown or along acushnet avenue in the north end.

the 20's this morning to the low 40's this afternoon with rain moving in so you may want some rain gear for the kids this afternoon as well. look at the temperatures this morning. lots of 20's showing up. north shore, south shore, cape out in worcester as well. boston really the only spot that is around the freezing mark. we still have mainly clear skies but very quickly off to the south, you can see the clouds thicken up. right around new york city. that will be moving on in. the concern that i have is out in the western part of the state the temperatures may not be in the upper 30's to around 40 when that rain moves in like it will be in the boston area around lunchtime. that's about when the rain is going to move in in the boston area. out in the western part of the state, patchy areas of lightning could freeze on contact with surfaces near the freezing mark. through about noontime today as we watch that first batch of shower activity move on in. really it will be after lunchtime into the afternoon that we get into some steadier showers and a heavier rain here develops through the overnight hours tonight with temperatures

pemberton was sentenced to 12 to years in prison. emily: right now new bedford police are reviewing this surveillance video as they search for clues in the murder of a cab driver. donald depina was shot on saturday night. sources tell us robbery could be the motive. randy: the defense gets the case today in the philip chism murder trial. they'll argue the former danvers high school student was insane when teacher colleen ritzer was killed. emily: this woman is the second person arrested in connection to the weapons theft at the worcester armory. police say other cell phone photos show ashley bigsby's hand on one of the stolen guns. randy: right now. lawyers for the marathon bomber are headed back to court in boston. emily: they want a new trial based on a supreme court ruling that they say puts some of his convictions in jeopardy. the eye's todd kazakiewich is live at federal court. todd? todd: emily, randy, good morning. that ruling was made in june after dzhokhar tsarnaev's trial. it struck down part of the legal definition of a so called "crime of violence." tsarnaev's team says that means his convictions on 15 such

in all, tsarnaev was convicted of 30 federal charges and sentenced to death. his lawyers think he should get a new trial claiming his death sentence on some of those counts was likely influenced by those "crimes of violence." they'll also argue that tsarnaev should be given a trial in a different location because outrage and publicity in the boston area prevented the jury from being impartial. tsarnaev is being held at the federal supermax in colorado and will not be at the hearing. he was convicted of killing three people and injuring more than 260 others at the marathon finish line. reporting live outside federal court in south boston, todd kazakiewich, wcvb, newscenter 5. >> we know how important it is to us. emily: right now a new plea for help this morning nearly two years after the murder of this avon man. investigators now turning to hunters for help to solve the disappearance of james robertson. police believe robertson was murdered after he was kidnapped on new year's day in 2014. they think his remains were

asking hunters taking part in the blue hills deer hunt to be on the lookout. robertson's parents still unable to bury their son. >> the last memory we have of him is going up the street going to his car. that's the last time we saw him. emily: four men have been robertson's disappearance. all four will be back in court later this month. randy: a terrifying robbery near the university of new hampshire. a man came home to what he thought was an empty house only to be held at gunpoint. erika's back with the ordeal. erika? men were already inside his durham apartment when he came home saturday night. he also says they had guns and he says those men started ransacking the house kicking in doors and filling bags with anything they could get their hands on. the gut-wrenching ordeal lasted nearly 40 minutes. >> they started leading me through the house door to door. they would kick in the door. one of them would stand in the

the other two were just ransacking the rooms taking anything expensive, of value. erika: hochberg says the men eventually told him to lie down on his stomach in the living room. they left and he ran to a bar to none of his roommates were home they all say they'll likely move out. randy: a former harvard law school librarian was arrested in colorado charged with attempting to sexually assault an underage girl. the librarian, who used to work at the islamic law center, was caught in a sting operation. police say yahya melhem sent sexually graphic messages to an undercover officer posing as an underage girl. the 47-year-old was arrested as he was driving to meet the officer. emily: a new report says the "t" should have foreseen massive problems with the green line extension. consultants hired to investigate should have known early on that its first estimate of $2 billion was too low.

emily: this was seen yesterday. some parts of the state expected to get nearly a foot of snow by the time it stops snowing today. it is december. cindy: december 1. this is normal. emily: it just seems like such a shock. cindy: we spent a lot of november in the 60's, even 70's the first week. the 8th warmest november on record. now we flip that calendar to december. you can see the snow flying around the minneapolis area and into the dakotas. that whole system is coming at us piecemeal. we'll ob the warmer side of it. the concern this morning though is that as that rain moves toward us, it may be just cold enough out in the western part of the state, out in the hartford-springfield area as well that there could be just a patch or two of freezing rain. it's going to be very light as it happens but it only takes just a little bit to make it very slippery. if you are going to be headed west this morning through noontime, just be advised there is the potential for some slippery conditions out that way. otherwise, we've got steadier

today so dry this morning, have an umbrella with you. that is round one. that will go through tonight. we'll get a break tomorrow morning and then round two comes stretched-out rain here for the next couple of days as this system works in our direction. this first piece of the action right here delivering some showers around new york city and that's the rain that we're targeting for midday today. you can see right now it's cold. temperatures are running in the 20's under mainly clear skies. it's right around freezing in boston. as we go through the morning hours, there might be a few peeks of sunshine but by noontime, it's cloudy. showers in the western part of the state. upper 30's, lower 40's with areas of rain here by 5:00 p.m. so we time things out for you. notice by lunchtime, there are those light showers out in western massachusetts where it could be cold enough for a few pockets of freezing rain. then thereafter rain pushes in to our area during the afternoon hours. it's with us through the evening commute. heavier rain overnight. then we do get a break in the action tomorrow morning. again that was just round one. as that moves out another one to our south moves in in the afternoon.

on schedule. emily: a cabbie murdered in new bedford. randy: newscenter 5's erika tarantal is here with the new clues. investigators are looking at to solve this case. erika: this morning two young men ages 14 to 18 now wanted after the murder of a new bedford cab driver. >> i can't understand why it happened to a good man like donald depina. erika: friends of the vietnam vet who once served as the city's veteran's agent say depina was a tireless advocate for fellow service members. sources say robbery was likely the motive and that police do have surveillance footage from inside and outside depina's cab. the 66-year-old was found shot to death next to his car by brooklawn park. he leaves behind six children and three grandchildren. randy: breaking news. a new bedford marine has been found guilty of homicide in the death of a transgender woman in the philippines. the verdict coming down overnight. private first class joseph scott pemberton was convicted of strangling the woman and leaving her body in a hotel room last fall. witnesses say the two left

consulate. meantime, the democratic frontrunner held a fundraiser in washington, d.c. and a notable face was absent. massachusetts senator elizabeth warren was the only female democratic senator not present at last night's event. warren signed a letter in 2013 urging clinton to run for president but has yet to officially endorse her. emily: republican presidential front-runner donald trump is considering charging cnn for his appearance in the next debate. trump bragged to supporters yesterday that he's been the reason for a boost in television debate ratings. he suggested cnn pay him $5 million for the december 15 debate. trump says he'd give all the money to help veterans. randy: the so-called "lawn on d" will stay at boston's city hall plaza. the project, which is more than $2 million in the red, hosts a variety of events from may through october. organizers expect costs to stay flat for the project through 2019 and hope revenue from events will fill in the gap.

up, right. randy: you know, all night long. emily: i know. it's true. absolutely right. cindy is here. we're just waiting for her to walk on over. cindy: i'm coming. i'm coming. i'm so sorry. been track inning rain that will be moving on in. there is concern this morning out in the western part of the state that there could be some patchy freezing rain. but by far the steadiest rain comes in after noontime today so have the umbrella with you for the afternoon-evening commute. we have another round coming in as we head toward tomorrow afternoon. right now skies are mainly clear over boston. it is cold. we're sitting at the freezing mark with calm winds in town. outside the city though north-south shore you can see on the cape as well we're running in the 20's. that is the case from worcester on westward as w you can see this storm is complicated off to our south and west. there are several areas of low pressure. all of this working in our direction. so this first wave of rain is coming out of new york city this morning. you see that little area of pink showing up here.

initially it is cold enough that this rain may freeze on contact in a few areas especially out in the springfield area, hartford, westward. that is where i am most concerned. right now it's just dry across our area. we are going to see that rain come at us in waves. it's going to be coming at us through tomorrow evening. when it's all said and done a half an inch to an inch of rain is likely which is a good thing because we really do need it. but we're going to watch that come in during the afternoon hours. notice through the morning hours, any sunshine early on, say, by 9:00 a.m. we're in the mid and upper 30's with cloudy skies. i think it will be about 1:00 or 2:00 before that rain starts to make it on in to the boston area but out in the western part of the state again, there is the concern for some freezing rain initially so there's a freezing rain advisory through noontime. temperatures by this afternoon though most spots running in the 40's. even mid 40's down on the cape. you can see here by noontime there are those lighter showers just working on in. it's going to be a steadier rainfall by 5:00 p.m. but it's on the lighter side through your evening commute. it's during the overnight hours

ramps up and that first batch is pulling away tomorrow morning. there is a little lull in the action first thing tomorrow morning. then a second wave of rain develops tomorrow afternoon. on the morning commute i don't think there will be big issues rain coming down. the roads will be wet. notice during the afternoon another round of rain comes in. could be heavier downpours through tomorrow night so it will really be until thursday that we start to dry things out. what is going to bring in the dryer air? gusty winds. winds could gust 20-0 miles per hour as we head towards thursday afternoon. that will eventually bring in chillier readings friday into the start of the weekend. look at all that sunshine for the upcoming weekend. a nice warming trend as well by sunday. we're likely going to be back up around 50 degrees. but in the meantime we're getting on out there to those dry roads for now. olessa: the delays are picking up. a live look at the pike by allston/brighton eastbound move to go the top of the screen. let's get to the maps and check the rest of your ride as you travel south of town. 24 now heavy out of brockton.
