ground shocking drivers and people walking near this intersection. the mystery now solved. we will explain later this morning. good morning. i'm emily riemer. randy: and i'm randy price with cindy fitzgibbon. looked like a little musical there. cindy: absolutely. we have got a very changeable day coming up weatherwise. so kids at the bus stop this morning are going to want a heavy jacket for this morning. getting off the bus this afternoon there will likely be rain as temperatures come up into the 40's. again a changeable day weatherwise but it is so cold out there this morning. frosty as well. you may need some time to kind of get some of that frost off the windshield. lower 20's up on the north shore. beverly back to lawrence. 29 worcester. 26 plymouth down to the cape. boston right now sitting at 34 degrees. you can see the skies are still mainly clear. but clouds are going to advance on in quickly this morning. look at this as you work towards southwestern connecticut back toward new york city. there is some rain and this is moving in our direction. the concern is as it comes in

part of the state, it may be just cold enough at the onset for some spotty light areas of freezing rain until we can inch those temperatures up over the freezing mark. by the time this rain gets into the boston area, it's going to be after lunch. by then, temperatures should be at or above 40 degrees so just rain in the greater boston area. if you are headed west this morning, do keep the potential for slippery conditions in mind. notice through 8:00 this morning as well it's dry. the morning commute not a big issue. there you see those showers breaking out by lunchtime out in western massachusetts. then they move to the east. we are going to see rain for the evening commute becoming heavier during the overnight hours. so this will impact the evening commute tonight. we've got another round coming in tomorrow. so multiple commutes here are going to be impacted by this rain on the way. so get on out there now. let's see how we're doing on those dry roads, olessa. good morning. olessa: we're start to go see some delays as well as a couple trouble spots. a live outside by the pike.

an accident 24 northbound by route 123. delays building there. route 3 slow into the braintree split on the expressway is about 25-30 braintree to boston. the pike looks good this morning. north of town volume picking up 93 south out of methuen down to andover and again approaching spot pond. trains and buses still running on schedule. randy: thank you. only on 5. a new bedford cab driver seen minutes before his murder. police are looking through this video searching for clues on who killed the grandfather saturday night. emily: erika's here with the new leads in the case. erika? erika: robbery seems to be the motive in the shooting death of donald depina. now sources tell us police are looking for two young men, ages 14 to 18. those sources say police have surveillance video from both inside depina's cab and from the gas station where he picked up his last fare. depina would later be found shot dead next to his car in the parking lot of brooklawn park. the 66-year-old was a vietnam

bedford's veteran's agent. >> my first sergeant in the 483rd engineers. the best man i ever knew in my life. erika: depina leaves behind three kids and six grandkids. a "go fund me" page has been set up to help with funeral expenses. emily: a probable cause hearing will be held today for one of four people accused in a grisly marshfield murder. mark o'brien of south boston has been held without bail since his arraignment. police say he was the driver during the september 16 murder of robert mckenna after he and the others broke into the victim's home. o'brien has pleaded not guilty. randy: the defense gets the case today in the philip chism murder trial. they'll argue the teenager was insane at the time he's accused of killing danvers high school teacher colleen ritzer. the eye's sera congi is live at the courthouse in salem with the comment made after the prosecution rested. sera? sera: well, that comment was about a motive.

heard about one. the prosecutor told the judge that this is a sexually motivated homicide. the prosecution rested its case after the testimony of one of colleen ritzer's close friends. surveillance video shows sarah giaquinta, a fellow teacher, talking to ritzer. that was in the danvers high school hallway. moments later, chism would follow ritzer to the bathroom where prosecutors say he killed giaquinta told the jury they talked about chism briefly. prosecutor: what did colleen say to you just about why the boy was in her classroom? giaquinta: she said i don't know why he's here. sera: also on the final day of the prosecution's case the doctor who performed the autopsy on ritzer who described her gruesome injuries. in all, the prosecution called 36 witnesses. the defense is expected to call family members to testify on a

well as experts who evaluated chism. today a judge will also make a ruling on a rape charge focusing on whether ritzer was alive during the assault. that was in the woods. that could result in a heftier sentence for chism. live in salem, sera congi, wcvb, newscenter 5. emily: breaking news. a new bedford marine has been found guilty of homicide in the death of a transgender woman in the philippines. the verdict coming down overnight. private first class joseph scott pemberton was convicted of strangling the woman and leaving her body in a hotel room last fall. witnesses say the two left together after meeting in a bar. pemberton was sentenced to 6 to 12 years. right now a second person is facing charges in a weapons theft from the worcester armory. and police say cell phone photos helped lead them to the suspect. this is ashley bigsby in a vulgar pose. police say another photo allegedly shows her tattooed hand holding one of the stolen

yet another shows what appears to be a stolen assault rifle. the f.b.i. says the placemats in the background match those found in bigsby's apartment in the dorchester section of boston. she's due in court on thursday and is charged with lying to the f.b.i. another suspect, james walker morales, is accused of stealing the weapons and trying to sell them. police say he was wearing a g.p.s. bracelet the night he broke into the armory. investigators have now recovered all six stolen assault rifles, but they're still looking for 6 of the 10 stolen pistols. the f.b.i. is offering a $15,000 reward for information leading to those guns. randy: seven minutes after 6:00. this morning chicago's mayor will announce the creation of a new task force on police accountability. the announcement comes as a city police officer, charged with murdering a teenager, is free on bond. jason van dyke is accused in last year's shooting death of laquan mcdonald. the black teenager was shot 16 times while walking away from

hand. emily: dramatic video of a deadly police-involved shooting in atlanta. it happened last night near the aloft hotel. one person was killed. police are calling that person a suspect though it's not clear what he or she was accused of doing. the hotel says none of its guests or employees were involved. randy: new this morning. a top safety leader in boston is concerned about gangs. he says the kids being recruited are getting younger every year. the eye's todd kazakiewich is live with the defense offered by schools. todd? todd: randy, good morning. the city's public safety director says kids as young as 14 years old are getting recruited by gangs. so principals and other school leaders are being told to keep an eye out for some key indicators. daniel mulhern tells "the herald" that includes certain clothes and handshakes. he says gang members in the area also identify themselves through professional sports teams and

mulhern estimates there are 30-40 gangs in boston but says city schools do not have a, quote, "overwhelming problem." the comments come on the heels of a shooting in roxbury that left one student hurt and put three schools on lockdown. police are investigating whether it was gang-related. live in boston, todd kazakiewich, wcvb, newscenter 5. emily: the man accused of a massachusetts native at a planned parenthood clinic in colorado, could face more charges. announcement during 57-year-old robert lewis dear's first court appearance. he's charged with first degree murder in the deaths of three university of colorado police officer and melrose native garrett swasey. this morning there's new video of swasey from his years as a figure skater here in massachusetts. that's swasey performing at m.i.t. back in 1988.

morning it's not going to be dry. the rain is coming on in. enough. you can see the moon out there this morning. it was full last week. and the fact that the skies are clear out there this morning, an indication that the temperatures did drop overnight. it is a cold start indeed. a lot of 20's out the door this morning. there is frost on the windshield , maybe you need some time to wipe that off. outside the city 20's, north shore, south shore, cape, running in the low to mid 20's. 29 in worcester. as you head out to the western part of the state it's in the 20 as well. we may have some stubborn kind of cold air lingering in our valley locations through the morning hours. that's important because we've got that rain moving in. there may be some spots where it hits temperatures that are still running near or below freezing at the surface. there could be some patchy areas of freezing rain out in western most massachusetts around the hartford area as well. that is through the morning hours.

but really the steadier rain comes in after lunchtime today. hours as well. a little break in the action on wednesday morning. and then another round of rain coming in wednesday afternoon and wednesday night. when it's all said and done, it is going to add up. i think we're talking about a widespread half an inch to maybe over an inch of rain in some spots. certainly welcome as we could use the rainfall. got this storm system that is all stretched out. it's bringing snow to the dakotas and minneapolis this morning. rain all the way to the carolina coastline. ahead of it, the first surge of rain bringing showers to the new york city area. 's what we are watching here for the lunchtime hours around here locally today. right now skies are still mainly clear. we may see a little bit of sunshine. sun is up at 6:53 clouding over though by mid morning. temperature around 30 degrees at 8:00 a.m. by noontime, it's only in the upper 30's to around 40 and there could be a few showers out in the western half of the state. but i think it's by 5:00 p.m. that we're in those areas of rain. temperatures coming up into the 40's by your evening commute. so again not worried about the slippery conditions this

but by late morning, there you see those showers out in western massachusetts. then notice how the rain fills in by 5:00 this afternoon. it gets heavier during the overnight hours. and then it moves out so tomorrow morning's commute is likely going to be dry with those areas of rain through the overnight. we're staying above the freezing mark. and tomorrow we may nudge toward 50 degrees as more rain comes in especially in the afternoon as this second area of low pressure rises on into the area. that will keep the rain going through thursday morning before gusty winds bring in some colder temperatures and dry us on out. 50's tomorrow. the day starts dry. so the morning commute really not too much of an impact with rain falling tomorrow but notice how that round comes in in the afternoon. then it gets heavy again wednesday night. thursday morning, we are start to go dry out. you see that snow across new york state? that could move across northern new england and parts of maine, far northern maine could actually get upwards of six inches of snow. skiers like to hear that. around here it looks like we are drying it out.

we could be up around 50 again. olessa: we like to hear that. much better. cindy: something for everyone. olessa: it's a fairly quiet start. we're watching though delays though. there is route 1 in saugus. southbound side move to go the bottom of the screen. let's get over to the maps and check the rest of your ride. as you head south, that volume is picking up on 24 northbound. there is a crash here by route 123. one lane is blocked. we've got pretty heavy delays approaching. the expressway now slow as well. 25 to 30 from braintree to boston. and then some volume building on the pike. 15-20, 495 to 128. so that doesn't look too bad just yet. 93 sowfned. some volume filling in from methuen as you travel to wilmington. once again from concord street all the way down to spot pond. more delays approaching the leverett connector. trains and buses doing okay. emily. emily: thank you. a man from brockton is the first in the region to undergo a knee surgery at brigham and women's that could change the lives of thousands of people. the surgery involves this device-- the "nusurface meniscus implant." it's the focus of an f.d.a. trial.

meniscus can wear down and tear. rob price of brockton hurt his knee playing basketball. he's too young and active for a total knee replacement. he had surgery to remove the damaged meniscus, but he's left with bone-on-bone pain. dr. andreas gomoll from brigham and women's says there's never been a good treatment option for that until now. doctor: this one is a small incision. if it doesn't work, you just take it out. you're not worse off than before. that is what is exciting about this. >> i'll play basketball, maybe do maybe some kind of running again. definitely resolve to play basketball again. emily: rob had his surgery last the implant simply pops in between the bones creating a new cushion. no screws are necessary. the u.s., the implant has been used successfully in europe. randy: recovering from a bad night's sleep can be tough.

of a cab driver. donald depina was shot on saturday night. sources tell us robbery could be the motive. today in the philip chism murder trial. they'll argue the former danvers high school student was insane when teacher colleen ritzer was killed. emily: this woman is the second person arrested in connection to the weapons theft at the worcester armory. police say other cell phone photos show ashley bigsby's hand on one of the stolen guns. randy: right now. lawyers for the marathon bomber are headed back to court in boston. emily: they want a new trial based on a supreme court ruling that they say puts some of his convictions in jeopardy. the eye's todd kazakiewich is live at federal court. todd: emily, randy, that ruling was made in june after dzhokhar tsarnaev's trial. it struck down part of the legal definition of a so-called "crime of violence." tsarnaev's team says that means his convictions on 15 such counts should be thrown out. in all, tsarnaev was convicted of 30 federal charges and

his lawyers think he should get a new trial claiming his death sentence on some of those counts was likely influenced by those "crimes of violence." they carry obviously a stiffer penalty. they'll also argue that tsarnaev should be given a trial in a different location because outrage and publicity in the boston area prevented the jury from being impartial. tsarnaev is being held at the federal supermax in colorado and will not be at the hearing. he was convicted of killing three people and injuring more than 260 others at the marathon finish line. reporting live outside federal court in south boston, todd kazakiewich, wcvb, newscenter 5. >> we know how important it is to us to get him home. emily: right now a new plea for help this morning nearly two years after the murder of this avon man. investigators now turning to hunters for help to solve the disappearance of james robertson. police believe robertson was murdered after he was kidnapped on new year's day in 2014. they think his remains were disposed of in the woods and are

the blue hills deer hunt to be on the lookout. robertson's parents still unable to bury their son. >> the last memory we have of him is going up the street going to his car. that's the last time we saw him. emily: four men have been charged in connection with robertson's disappearance. all four will be back in court later this month. randy: a terrifying robbery near the university of new hampshire. a man came home to what he thought was an empty house only to be held at gunpoint. erika's back with the ordeal. erika? erika: brian hochberg says three men were already inside his durham apartment when he came home saturday night. he also says they had guns and were wearing masks. he says those men started ransacking the house kicking in doors and filling bags with anything they could get their hands on. the gut-wrenching ordeal lasted nearly 40 minutes. >> they started leading me through the house door to door. they would kick in the door. one of them would stand in the doorway, put me on the ground as the other two were just

anything expensive, of value. erika: hochberg says the men eventually told him to lie down on his stomach in the living room. that's where he stayed until they left and he ran to a bar to call police. none of his roommates were home at the time. they all say they'll likely move out. randy: a former harvard law school librarian was arrested in colorado charged with attempting to sexually assault an underage girl. the librarian, who used to work at the islamic law center, was caught in a sting operation. police say yahya melhem sent sexually graphic messages to an undercover officer posing as an underage girl. he was driving to meet the officer. emily: a new report says the "t" should have foreseen massive problems with the green line consultants hired to investigate the ballooning cost say the "t" should have known early on that its first estimate of $2 billion was too low. they say the new estimate of $3 billion may also fall short.

around that area. a stretched-out storm e. tending rain into new york city now. that's what's on our doorstep. so have an umbrella with you today. we've got some rain moving in and initially this morning, out in western massachusetts especially around the springfield area and hartford, there could be a little bit of freezing rain. it should be very light and patchy but the temperatures are out this way. it takes just a tiny bit to make it very slippery so a heads-up if you're traveling far to the west here locally. we're expecting that rain to come in closer to lunchtime or after. by then the temperatures should be warmer. it will be steady rain then. heavier overnight. we'll get a break tomorrow morning and then round 2 coming at us tomorrow especially during the afternoon. this is a stretched-out event in terms of the rain. we have wet weather on the way. right now it is all to our south. clouds are moving on in so we've had a glimpse of the sunshine for the next hour or two. the clouds do take over. look at these temperatures though. mid 20's on the cape.

34 boston. 29 in worcester. and notice out here in western massachusetts, we're running in the 20's as well. that's why we are a little concerned with that icing out that way. cold and dry here locally in the greater boston area through 8:00 a.m. temperature comes up to about 30 and then by noontime, upper 30's, a few showers off to the west. that steadier rain with low 40's here by 5:00 this afternoon. there you see those lighter showers moving in around lunchtime. and then as we get toward the evening commute, the rain coming in especially from the pike on south ward overnight that rain is heavier for a time and then there's a break in the action with just very light showers tomorrow morning. second area of low pressure though lifts north ward tomorrow afternoon and evening. that's going to fill that rain back on in. on the backside of this system, look at that through ski country. yes, there is going to be some snow across parts of northern new england as we head towards thursday. around here we're drying it out thursday. 50's tomorrow. with a gusty wind. let's get you back out to the roads this morning. getting busy out there, olessa. olessa: you can see the delays.

vet who once served as the city's veteran's agent say depina was a tireless advocate for fellow service members. sources say robbery was likely the motive and that police do have surveillance footage from inside and outside depina's cab. the 66-year-old was found shot to death next to his car by brooklawn park. he leaves behind three children and six grandchildren. randy: breaking news. a new bedford marine has been found guilty of homicide in the death of a transgender woman in the philippines. the verdict coming down overnight. private first class joseph scott pemberton was convicted of her body in a hotel room last fall. witnesses say the two left together after meeting in a bar. pemberton faces up to 6-12 years. investigators say the pilots' response to a rudder problem is to blame for an airasia crash in indonesia. says the malfunction happened repeatedly during and before the flight. the pilots involved in last year's crash were overwhelmed

the arrest this woman a second suspect in the worcester armory theft. police say photos show ashley bigsby holding one of the stolen handguns. the f.b.i. says placemats in the background match those found in bigsby's apartment in dorchester. she's due in court on thursday, charged with lying to the f.b.i. the newly-elected mayor of alaska's capital has been found dead. juneau mayor stephen "greg" fisk was found dead at his home monday afternoon. police are investigating but would not comment on the manner of death or if it appeared suspicious. police are not having any comments at this point. the 70-year-old recently defeated incumbent mayor merrill sanford. emily: the u.s. house is refusing to back president obama on a climate change deal. republican leaders say they will not commit taxpayer money to support an accord reached in paris. the president is urging the private sector to help reach targets set by world governments.
