degree murder, aggravated rape, and armed robbery. he faces a sentence of life in prison with the possibility of parole after 15 years. now during opening arguments chism lawyers admitted that he killed ritzer. however, they are building an insanity defense. they claim that he is severely mentally ill. live this morning at the salem courthouse, sera congi, wcvb, newscenter 5. erika: right now we are awaiting new developments in the case of a runaway red line train that put passengers at risk. the eyeopener's juli mcdonald is live in boston with what's at stake for the worker involved today. reporter: that's right, emily and erika. the operator who was supposed to be at the controls of that runaway red line train faces a disciplinary hearing today. as "5 investigates" was first to report, the employee involved is this man-- david vazquez. we've also learned he did not follow several safety procedures including setting the brake before stepping out of the operator's cab. the train traveled from braintree to quincy thursday

50 passengers were on board. no one was hurt. we'll be following today's hearing very closely and bring you new information as we get it. live in downtown boston, juli mcdonald, wcvb, newscenter 5. emily: right now. firefighters are trying to figure out what sparked a fire in worcester that killed an elderly brother and sister. the flames broke out around 8:00 last night on burncoat street. neighbors say the siblings lived in the single-family home for decades. firefighters say the fire spread quickly. by the time they arrived on scene, most of the damage had already been done. we're still waiting to learn the names of the victims. right now a 90-year-old man is in the hospital after being hit by a car in revere. it happened on malden street we're told the victim has serious injuries. the scene and was also taken to the hospital. erika: it's now 6:05.

mark a somber anniversary today. it was three years ago that a elementary school killing 20 children and six educators. fresh in everyone's minds, the faces of the lives lost. anniversary has fallen on a school day. newtown's high school and middle school will mark the tragedy with moments of silence. but lower grade schools will just try to keep the day as normal as possible for students giving parents the option of discussing the tragedy with their children. today massachusetts leaders will mark the anniversary by unveiling a new gun-control billboard. it's being sponsored by "stop handgun violence." that's the same group behind attention-grabbing billboards overlooking the mass pike near fenway park. that billboard came down after the parking garage under it s sold. across the from the hynes convention center. emily: commitment 2016. the campaign trail in new hampshire. sanders: it is an insurgency

the east-southeast right now. and that flow of air off the ocean keeping the temperatures up overnight. upper 40's to around 50 for you on the cape. 47 in beverly. out in worcester we're 4 des. over the next 12 hours there will be a slow tick up in the temperatures despite all the cloud cover throughout the day. should be right around 50 degrees at noontime. we'll spend the afternoon in the 50's despite the clouds. the temperatures are going to warm up. now to the north there's actually been a little bit of snow across far northern maine. warmer air though is surging north ward out ahead of this storm system. low pressure here tracking to our west up through the great lakes. that is going to send the warmth in our direction. you can see it's in the upper 50's right now. near 60 in d.c. they're going to hit 70 today. it is already in the upper 60's, close to 70 down in tennessee. this is that warm air mass that will surge north ward ahead of the storm system. even with the clouds, we're only up in the mid even upper 50's late in the day. cooler up near the new hampshire border but throughout the day nothing more than a spot shower or some drizzle.

still off to the west. starts to pivot into worcester county by 8:00 p.m. then overnight midnight to about 5:00 a.m. tomorrow morning, that's when we're going to see the steadiest rain. there could be a rumble of thunder. some downpours and then the rain tomorrow. we'll dry it out throughout the day. i'm expecting half an inch of rain on average. perhaps a little bit less to the overnight those temperatures tick up. 50's overnight but there are day tomorrow. one more day in the 50's with clearing skies in the wake of our storm system and a real gusty wind coming out of the west. that's going to bring in that dryer air but that wind is going to be super active throughout the day tomorrow. notice during the morning hours, we're gusting over 20 miles per hour 689 and then in the afternoon, winds could actually gust over 40 miles per hour. that brings cooler air in for wednesday. and the next storm system coming in on thursday. evening hours. another area of low pressure coming up from the south. so it's mild as that comes through. rain tapers off on friday.

the good news-- no one was seriously hurt when this fire broke out sunday morning. the fire at the rosemeade complex quickly grew to four alarms before firefighters from neighboring communities were able to knock it down. this building was just rebuilt after it was damaged in the june 2011 tornado. new fire alarms were installed. the building was up to code. something firefighters credit with helping avoid tragedy. a firefighter and a resident were taken to the hospital for minor injuries. erika: it is now 6:19. economic headlines this monday morning. asian markets were mostly lower overnight. all eyes will be on the federal reserve which is expected to decide wednesday on whether to raise interest rates for the crisis. right now stock futures are higher. online retail giant amazon is pulling some types of hoverboards after reports of several of them bursting into flames. amazon says it will no longer carry boards made by swagway until safety reviews of the products are complete. the problem may be connected to

"5 investigates" has learned david vazquez ignored several safety procedures. emily: and new this morning, that's not the only trouble for the red line. the eyeopener's juli mcdonald is live in boston with the new numbers that may concern commuters. juli: emily and erika, it won't come as a surprise to people who take the red line that it's ranked as one of the mbta's worst performing subway lines. but new data from the "t" is painting a particularly grim picture. just last week the red line reported delays due to disabled trains on monday, tuesday, and thursday along with delays because of signal problems. the mbta has set an on-time performance goal of 75%. but new data shows the red line has fallen short of that goal nearly half the time during rush hours from september through this month. only the orange line fared the mbta's financial review board meets today. among the topics-- how to improve service on the

"5 investigates" was the first to report that he stepped off the train without setting the brakes, and it kept moving. transportation secretary stephanie pollack says wedging or restricting the position of

prohibited act. if it happened, it would subject the operator to termination. the mbta had to cut power to the third rail to stop that train. none of those passengers on board was hurt. stay with us though as we continue to learn more about this hearing. live in boston, julie mcdonald, wcvb, newscenter 5. emily: investigators are searching for answers after a deadly fire in worcester, the flames broke out around 8:00 last night on burncoat street. fire officials say an elderly man in his sister died in the by the time firefighters got to the house, most of the damage had already been done. we're still waiting to learn the names of the victims. erika: right now a 90-year-old man is in the hospital after being hit by a car in revere. it happened on malden street just after 7:00 last night. we're told the victim has serious injuries. the driver of the car stayed on the scene and was also taken to the hospital. emily: new questions about the screening process that allowed one of the san bernardino shooters into the country.
