day. lower 60's in plymouth all the way down to the cape. still have a little bit of fog here cape cod up to cape ann where the visibility running near a mile to two miles in spots. that fog is going to be scoured out with the last of the showers rolling on through. you can see the back edge now pulling out of the berkshires. we're looking at showers out through worcester county closing in on the boston area. these are all moving from west to east. i give them another couple of hours. they are going to be out of here. they're coming in with a frontal boundary much this is the leading edge of dryer air. eventually cooler air as well but that won't bother us today. we will see the clouds break with some sunshine. by mid to late morning bright sunshine. look at the winds. they are ramping up and staying out of the west near 20 miles per hour. could see gusts 40-50 miles per hour today. a wind advisory is up into this evening. we're talking about high temperatures today holding about where they are in the upper 50's to around 60 degrees so it is a warm one coming up for today but the roads turning out a little bit wet. let's get you out there. olessa: good morning.

construction so that's a bit of good news for you. heading over to the maps let's see what's going on right now. so far a quiet start. all the overnight construction knocked out. you're in good shape this morning. no problems getting into boston. south of town everyone geeing by at speed limit. budget in a little extra time because the roads are wet this morning. not the best visibility in some plays. eastbound on the pike, route 9 you're good to go. 93 south also wide open. so far trains and buses starting the morning on schedule. erika: thanks so much. breaking overnight. rails. passengers stranded for hours taking to twitter to beg for help. emily: it is just the latest headache for the "t." the eyeopener's juli mcdonald is live in braintree with what we've learned. good morning, juli. juli: good morning. the commuter rail train pulled out of south station last night on time. but then it broke down between braintree and south weymouth leaving passengers stranded. this is video in overnight as the kingston-bound train finally pulled in to its final destination two hours late. it had to wait on the tracks for

passengers could reboard another train. asking for help and answers from peter posting this photo of the situation on the train on twitter tweeting that it was the commuter rail telling passengers this was a "mechanical failure." but not being more specific. we did speak to some passengers night. frustrated but just relieved to finally be home. live outside south station in downtown boston, juli mcdonald, wcvb, newscenter 5. emily: right now. the death of a woman hit by a commuter rail train is under investigation. the 50-year-old was struck by the train in ashland around 5:00 last night. she was pronounced dead at the scene. shuttle buses were used during rush hour. service was back to normal before the end of the night. deliberations continue this morning in the philip chism murder trial. the eye's sera congi is live

to consider. sera? sera: emily, during the trial, lawyers for the danvers teenager admitted to the jury that he committed a crime, that he killed his high school teacher two years ago. but the jury will have to decide on two different versions of why. the prosecution says chism planned the stabbing and assault of colleen ritzer and knew what he was doing. but the defense says chism was hallucinating and having a psychotic episode and did things afterward that a sane person wouldn't do. >> philip chism arrived at danvers high school that morning with everything he needed to do what he wanted to do. >> after leaving ms. ritzer's body in the woods, he enters the school with probably blood on his pants. he's covered with blood on his pants. he's barefoot.

it makes no sense. sera: chism faces four charges including first degree murder and aggravated rape. at stake-- whether chism goes to a state psychiatric hospital or an adult prison. the jury deliberated for three hours yesterday. they'll start again today at 9:00. live at the salem courthouse, sera congi, wcvb, newscenter 5. emily: so what happens if chism is found insane? this will not like an evening in do we agree? watch-- new jersey governor chris christie. up to the main stage tonight. the first votes will be cast in this presidential race in just six weeks. erika? erika: hard to believe. thanks, doug. on the democratic side, vermont senator bernie sanders says he's in good shape to pull off a major political upset. yesterday sanders admitted to a new hampshire audience that it's difficult to compete with hillary clinton's money and organization. but in a one-on-one interview with newscenter 5's janet wu, sanders said he's tapping into the same voter angst that republican donald trump is. sanders: the fact that people are tired of establishment politics and tired of establishment economics, want real change, want leadership prepared to stand up to the billionaire class, that is going to give us the edge and lead us to victory. erika: the most recent new hampshire poll puts sanders ten points ahead of clinton.

expected to announce a new terror threat alert system tomorrow. the alerts put in place after 9/11 used color codes, but intelligence leaders say the country needs more specific warnings. the new bulletins will reportedly provide a short summary of the threat including the region, infrastructure being targeted, and action being taken. threat potential will also be characterized as "elevated" or "imminent." f.b.i. agents think a maryland man wanted to use isis money to launch an attack in the u.s. mohamed elshinawy lives outside baltimore but was born in egypt. f.b.i. agents say he had extensive contact with isis overseas and received almost $9,000 from them. he claims he was just trying to scam the terror group out of some money, but agents don't believe him. they think he was in the early stages of planning a domestic attack. erika: we're learning more about troubling facebook posts from one of the killers behind the california shooting rampage. f.b.i. agents say tashfeen malik sent at least two private messages pledging her support of islamic jihad. the messages were posted before

they were recovered by agents looking into whether malik and her husband had contact with foreign terror organizations before killing 14 people in san a new poll shows most americans now think mass shootings are here to stay. "the wall street journal"/nbc news poll shows 71 percent of respondents think such gun violence is a permanent, regular occurrence. another question showed 52 percent fear recent shootings will lead to excessive gun control while 44 percent think the government won't do enough to restrict access to guns. emily: the suspect in a deadly shooting will go before a judge today. brahden hill is accused of gunning down edward andrews in brockton on saturday. the victim was found on haverhill street. state police say they arrested hill at his father's home in dorchester. erika: 5:09 right now. wahlburgers on a mission to beef up business. get it? the plan to expand the local

we are going to push that cooler air out. looking at still lingering fog here through the merrimack valley, the cape ann as well, beverly, right now has visibility of a mile. we've got some fog on cape cod as well. visibility between one and two miles there. also still tracking some showers so it's kind of a damp and muggy start this morning. the dew point temperatures are up near 60 degrees as well. you see showers on the lighter side here through the north shore. a few more moderate downpours here as you get from boston down toward norwood and back into millis. 495 stretching into northern rhode island and just south of the worcester area back toward north bridge. we're looking at a couple of showers. these are racing rapidly toward the east. i suspect they'll be off shore by about 7:00 this morning. they're coming in with this frontal boundary. what is going to happen is an area of low pressure is going to develop. as that strengthens, the winds are really going to pick up this afternoon. they're going to tap in to some of this, yeah, cooler air. 30's, 40's, but it is far to the west.

pretty balmy day as the temperatures hold in the upper 50's, close to 60 degrees here right through the afternoon. today. those winds pick up. gusts 40-50 miles per hour through the afternoon. around 20 miles per hour starting at lunchtime. sunshine. today. notice the winds are gusting 30, 40, maybe even close to 50 miles per hour right on into this evening. it will be overnight before the winds settle down. partly cloudy skies. we'll drop back into the 30's to around 40 degrees by the time you're heading out the door tomorrow morning. tomorrow. the winds will be light. temperatures will be cooler. a break in the action as temperatures come up into the mid 40's with some sunshine. another round of rain coming in on thursday. not in the morning hours but during the afternoon. a system pretty similar to what we're going through right now moves across the area with a good slug of rain. perhaps a half an inch to an inch of rain behind this one, yeah, reality settles in. it is.

man saved a life. doug: your feel-good story of the morning. 17-year-old desmond powell stopped a man from committing suicide. last night powell thought he was leading the pledge of allegiance at a school committee meeting, but he was really getting rewarded for that good deed. he says he was walking home last month when he heard a man on the granite street bridge say he was going to jump. powell says he told him to stop and think about his family. he then brought the man to dunkin donuts, gave him money for food, and called police to give him a ride home. >> just like being a popular person who everybody knows and likes. he works extremely hard. he does not let that go to his head. he's not prideful at all. he is just a wonderful person. >> i want to help anybody who is in trouble. he really needed the guidance. i was just there to help him. doug: powell is on the football team at west high school. he's also a navy junior reserve officer training corps cadet.

great officer. emily: impressive young man. doug, thank you. erika? erika: emily, doug, thanks. 5:18 now. the federal reserve is expected to raise interest rates for the first time in nearly a decade tomorrow. that had asian investors a little jittery, but stocks still ended mostly higher there. u.s. stock futures are up right now. the dow gained 103 points yesterday to close at 17,358. a warning to twitter users over a possible hack. the company reached out to users of what it calls a small number of accounts claiming a group may have stolen personal information. twitter thinks that group might be associated with a government though it's not clear which one. the company claims there's no indication that sensitive data was compromised. this is the first such warning from the social media site. new plans for the popular restaurant wahlburgers. the family-namesake burger joint says it's adding up to 150 new locations in the next five years. wahlburgers currently has its flagship spot in hingham and locations in boston, lynnfield,

we have the last of the showers working on through. got heavier downpours right now in northern worcester county and a downpour that just came through the boston area right now from quincy down towards places like foxborough, walpole looking at these heavier showers rolling on through. these are moving through from west to east pretty quickly. i think they're going to be winding down in next hour-and-a-half or so. by 7:00 i think the bulk of this is pushing off shore. they're coming in with a frontal boundary. this is the leading edge of dryer air. it will eventually bring in cooler air. you'll notice the winds picking up by lunchtime sustained winds up to 20 miles per hour. there could be gusts through the afternoon. 40-50 miles an hour so a wind advisory is in effect. the temperatures hold steady throughout the day. we'll keep it in the 50's to near 60 degree s with sunshiny merging. it's a windy and warm mid-december day on the way. let's get you out to the roads right now though because they are wet. we have the overnight rain. rainfall in a few spots out there. olessa: we're seeing some of the

early morning accident. expressway northbound neponset street is where we have that crash. it's partially blocking one lane. we'll see those delays starting to pick up. right now you're about 10-15 braintree to boston. east bound on the pike not too bad this morning. it's about a 15-minute trip 495 out to 128. so far so good 93 south. a little bit of volume out of methuen and once again as you approach spot pond. trains and buses still running on schedule. emily: thank you. we're following breaking news overnight on the eye. the mbta is blaming a mechanical failure after a commuter rail train to kingston got stuck on the tracks. the train from south station finally rolled into the station after midnight two hours late. right now brewster police are searching for the man in this surveillance video. they say he robbed a clerk at the brewster farms market at gunpoint sunday night. and the stage is set for these men to go head-to-head on the debate stage. donald trump and ted cruz are neck and neck in two recent iowa polls heightening expectations

red line train is telling his side of the story. david vasquez denying the charges against him. newscenter 5's juli mcdonald is live at south station with the interview you'll see only on 5. juli? juli: david vasquez did not yesterday. but newscenter 5 caught up with his attorney. he says the veteran "t" driver did not rig the controls before the train took off last week. investigators have been looking into whether vasquez wrapped a cord around the throttle and forgot to set emergency brakes before leaving the train to manually flip a switch to bypass signal problems. his lawyer points the finger at aging equipment. >> you're talking about a system and tracks that have problems on them and outages and tracks that would require for the train to continue at the particular point it was at to actually disable safety systems. juli: the train traveled four stops without vasquez last week. vasquez has been off the job

the outcome of yesterday's hearing. live in braintree, juli mcdonald, wcvb, newscenter 5. erika: the insanity defense in massachusetts in the spotlight as the jury continues deliberating philip chism's fate. the eyeopener's doug meehan is here with some surprising information "5 investigates" uncovered. doug? doug: erika. "5 investigates" is finding people who admit to committing violent crimes are going free. attorneys for chism have already admitted he killed his danvers high school math teacher, so the question for the jury is whether or not to find him not guilty by reason of insanity. but investigative reporter mike beaudet finding some surprising information about those verdicts. ten years of data shows that the majority of people found not guilty by reason of insanity have been released, even some charged with murder. that includes people like angela vasquez, who was charged in the poisoning deaths of her two children in 2007. suffolk county d.a. dan conley says these kinds of cases have

decade. conley believes massachusetts should consider adopting a new kind of verdict called guilty but mentally ill. it would require defendants to go back to prison if doctors later determine they're no longer insane. >> eventually some of these folks will get out. they can quite possibly commit some very, very serious crimes going forward. >> this is very, very disturbing because these defendants have committed some of the most vicious murders, you know, you have ever seen. doug: not everyone agrees. one expert telling "5 investigates" that other states allow the release of those found not guilty by reason of insanity but, unlike massachusetts, require them to be monitored. in any case the insanity defense is rarely used; and when it is, it's usually unsuccesful. emily. emily: doug, thank you. a little boy left alone in a van that was supposed to bring him to school. now the driver could lose his license and face criminal charges. police say the driver made his

on prospect street in lawrence, leaving the van locked and unattended. there had been only four kids on the bus, but the driver somehow missed a five-year-old boy, sleeping in the back. a passerby saw the child and called 911. >> by mass law he's supposed to conduct an inspection at the end of his route to make-- to just avoid this circumstance. he obviously did that the do that. emily: police think the boy was alone for less than an hour. he attends a charter school and is driven there by nunez his parents not lawrence public police have no prior complaints against the company. erika: new this morning, drivers new surcharge if they don't have an e-z pass. the department of transportation electronic tolling which is already operational on the tobin it's set for the mass pike next october. some state lawmakers say drivers should not be forced to pay

his own sworn deposition testimony-- drove its decision. meantime, cosby is counter-suing seven of those woman who accused him of drugging and raping them. the suit in massachusetts federal court accuses the women of character assassination. emily: the state's first casino will likely make less money than originally anticipated. budget analysts had originally predicted plainridge park casino would make $262 million in total revenue, but that's been revised to $160 million. island, however, is expected to make more money than expected. analysts thought plainridge would hurt its revenue since they're only 11 miles apart. erika: the "t" is putting the brakes on late night service. the control board that oversees the mbta asked staff yesterday to begin the process of eliminating the pilot program. both late night bus and train service would be cut at an estimated savings of up to $14 million. a final vote is expected early next year. emily: a first-of-its-kind bill in seattle.

unanimously to allow uber and lyft drivers to unionize. the outcome of the vote in seattle could influence cities around the country. the companies, however, are not pleased. a spokesman for lyft says unionization would threaten privacy of drivers and impose additional costs on passengers. the measure will likely be challenged in court. erika: there's controversy surrounding a study linking anti-depressants to autism. the study found women who took anti-depressants in the last six months of pregnancy were 87 percent more likely to have a child later diagnosed with autism. but many doctors say there are flaws in the study and fear it emily: today is the last day to sign up for health insurance on obamacare exchanges if you want coverage on january 1. this is the third year people will be able to buy federally subsidized health care on government-sponsored exchange there was an extension last year, but it's not clear if that will be the case this year. emily: a veteran nba referee is
