south eastern part of the state. we've already surpassed a record high for this day in the providence area. still dealing with some showers. the last gasp of the showers moving through worcester county. heavier downpours now heading up toward andover over to lynnfield and lynne. we have lighter showers moving through boston. south of town, a band of some downpours right now just passed through scituate. now back to marshfield and clint only. this is racing eastward quickly. it will be wet as you're heading outside this morning. all this rain is is coming in with a front. it's the leading edge of dryer air. we'll see the rain end a about 7:00 or 8:00 this morning. the clouds break for some sunshine by 10:00 a.m. but the winds do ramp up. by lunchtime sustained winds around 20 miles per hour gusting 40-50 through the afternoon. so wind advisories up until 6:00 this evening. temperatures though feeling nice on this december day. we'll hover close to 60 during the afternoon. let's get out to the roads. they are wet and still a little fog out there this morning. olessa: that means a few problem

if you're heading south of town. we just cleared an accident on the expressway by neponset circle. another crash now 128 south right at the braintree split so if you're heading that way expect some delays getting into that accident scene. 24 northbound also heading out of brockton. route 3 from weymouth to braintree. it will be 30-35 braintree to boston on the expressway. pike still looks good 15-20, 495 to 128 and then 9 south heavy volume already building out of methuen all the way down to spot pond. more delays approaching the leverett connector. trains and buses running on schedule. erika. erika: thanks so much. breaking overnight. a nightmare commute home on the rails. passengers stranded for hours taking to twitter to beg for help. emily: it is just the latest headache for the "t." the eyeopener's juli mcdonald is live at south station with what we've learned. good morning. juli: good morning, emily and erika. the commuter rail train pulled out of south station last night on time. but then it broke down between braintree and south weymouth leaving passengers stranded.

this is video in overnight as the kingston-bound train finally pulled in to its final destination two hours late. it had to wait on the tracks for another train to essentially push it into a station so passengers could reboard another train. many taking to social media asking for help and answers from the "t." peter posting this photo of the situation on the train on twitter tweeting that it was "dead in its tracks." the commuter rail telling passengers this was a "mechanical failure." but not being more specific. passengers we spoke with last night frustrated but just relieved to finally be home. live in downtown boston this morning, i'm juli mcdonald, wcvb, newscenter 5. emily: right now. commuter rail train is under investigation. the 50-year-old was struck by last night. she was pronounced dead at the shuttle buses were used during rush hour. service was back to normal before the end of the night. deliberations continue this morning in the philip chism

murder trial. the eye's sera congi is live outside court in salem with with the tough questions jurors have to consider. sera? sera: emily, during the trial lawyers already admitted that the danvers teenager killed his high school teacher two years ago. but the question that jurors really have to decide on is the two different versions of why. the prosecution says chism planned the stabbing and assault of colleen ritzer and knew what he was doing. but the defense says chism was hallucinating and having a psychotic episode and did things afterward that a sane person wouldn't do. >> philip chism arrived at danvers high school that morning with everything he needed to do what he wanted to do. >> after leaving ms. ritzer's body in the woods, he enters the school he's covered with blood on his pants. he's barefoot. his face is exposed. it makes no sense. sera: chism faces four charges including first degree murder and aggravated rape.

"5 investigates" is revealing people walking free after using the defense. the new calls to change the law coming up in our next half hour. erika: right now the stage is set for a showdown. two candidates will face a critical test in just hours. here with what is likely to be a heated battle. doug: there will be twelve candidates on the stage in las vegas tonight, but the spotlight will be especially bright on two of them-- donald trump and ted cruz. while trump still holds a commanding lead in many national polls, two recent surveys give cruz an edge in the early caucus state of iowa. last night in nevada, trump acknowledged it will be a challenging night on the cnn

trump: i would say it won't be an easy-- this will not be like an evening in paradise for me. doug: another candidate to watch-- new jersey governor chris christie. his poll numbers have him bumped up to the main stage tonight. this presidential race in just six weeks. erika? erika: thank you, doug. on the democratic side, vermont senator bernie sanders says he's major political upset. yesterday sanders admitted to a new hampshire audience that it's hillary clinton's money and but in a one-on-one interview with newscenter 5's janet wu, sanders said he's tapping into the same voter angst that republican donald trump is. sanders: the fact that people are tired of establishment politics and tired of establishment economics, want real change, want leadership prepared to stand up to the billionaire class, that is going to give us the edge and lead us to victory. erika: the most recent new hampshire poll puts sanders ten points ahead of clinton. expected to announce a new

terror threat alert system tomorrow. the alerts put in place after 9/11 used color codes, but intelligence leaders say the country needs more specific warnings. the new bulletins will reportedly provide a short summary of the threat including the region, infrastructure being targeted, and action being taken. threat potential will also be characterized as "elevated" or "imminent." f.b.i. agents think a maryland man wanted to use isis money to launch an attack in the u.s. mohamed elshinawy lives outside baltimore but was born in egypt. f.b.i. agents say he had extensive contact with isis overseas and received almost $9,000 from them. he claims he was just trying to scam the terror group out of some money, but agents don't believe him. they think he was in the early stages of planning a domestic attack. erika: we're learning more about troubling facebook posts from one of the killers behind the california shooting rampage. f.b.i. agents say tashfeen malik sent at least two private messages pledging her support of islamic jihad.

the messages were posted before malik came to the united states. they were recovered by agents looking into whether malik and her husband had contact with foreign terror organizations before killing 14 people in san bernardino. a new poll shows most americans now think mass shootings are here to stay. "the wall street journal"/nbc news poll shows 71 percent of respondents think such gun violence is a permanent, regular occurrence. another question showed 52 percent fear recent shootings will lead to excessive gun control while 44 percent think the government won't do enough to restrict access to guns. emily: a brockton man is facing murder charges today in the shooting death of this man. police say brahden hill is accused of gunning down edward andrews in brockton on saturday. the victim was found on haverhill street. state police say they arrested hill at his father's home in dorchester. erika: wahlburgers on a mission to beef up business.

sleeping. we actually set a record high in providence already in the lower 60's. still holding at 61 there. 61 in plymouth. near 60 on the cape. north and west of town, upper 40's to around 50 degrees. we've settled back to around 50 in worcester and into boston as well. still looking at a couple of showers but this is the last gasp of the showers. beneficial rain in the past 24 hours. a lot of spots up over a half an inch. close to three quarters of an inch of rain. we're still looking at lighter showers around the worcester area up into southern new hampshire. you get into a couple of more moderate downpours here crossing through the north shore from boxford down to peabody heading over to manchester-by-the-sea. we're looking at the fast-moving downpour. another one of those lined up from plymouth back toward wareham. everything moving very, very quickly. i suspect the back edge of these will be shifting off shore between 7:00 and 8:00 this morning. only another hour-and-a-half or so. they're all associated with the frontal boundary. this is the leading edge of dryer air. eventually cooler air will spill in behind it.

that doesn't happen today. throughout the day. morning. gone. we still have lingering clouds but clouds break for sunshine. by lunchtime we're still looking at mid to upper 50's but the winds start to pick up. that wind will make it feel cooler than these readings but holding near 60 through afternoon. per hour. that's why we have a wind advisory up until 6:00 this evening. even into the evening hours, strong winds. i think it takes through the overnight hours for those winds to step down gradually but they will. skies overnight partly cloudy. temperatures dropping back into the 30's to around 40 degrees. so a much different feel out the door tomorrow morning but tomorrow high pressure noses in. should be our brightest day this week. we'll get a little sunshine light wind mid 40's. seasonal for this time of year. another round of rain though coming in on thursday. not in the morning hours. the morning should be dry. it looks like during the afternoon and evening another area of low pressure moves right over southern new england. what that will do is bring in

heavier rainfall. quarter of an inch to an inch of rain could fall across the area. that beneficial rain comes in and out friday morning. behind it much cold weather settling in. saturday. we haven't felt that in so long it will feel like december this weekend. but it's brief. another warm-up. olessa: no white christmas. cindy: i think it will be a wet one. olessa: a wet one this morning as well. a couple problem spots we're watching south of town. building on the screen. if you're making your way along route 3, a slow ride from weymouth to braintree. 24 slow from brockton. we're watching a crash 128 south at the braintree split. once you get that's the accident your trip on the expressway 30 minutes braintree to boston. eastbound on the pike you're slow as well. 20-25. 495 out to 128 and then delays there 93 south pretty much out of methuen and out of 495 there as you travel southbound from route 213 all the way down to the leverett connector. so far so good on the trains and the bus s are operating on schedule.

that's a look at your traffic. emily: a manchester, new hampshire, teenager getting surprised with some well-deserved recognition. doug's back with how that young man saved a life. doug: looks like clarence from it's a wonderful life. 17-year-old desmond powell stopped a man from committing suicide. last night powell thought he was leading the pledge of allegiance at a school committee meeting, but he was really getting rewarded for that good deed. he says he was walking home last month when he heard a man on the granite street bridge say he was going to jump. powell says he told him to stop and think about his family. he then brought the man to dunkin donuts, gave him money for food, and called police to give him a ride home. person who everybody knows and likes. he works extremely hard. he does not let that go to his head. he's not prideful at all. he is just a wonderful person. >> i want to help anybody who is in trouble. he really needed the guidance.

i was just there to help him. doug: powell is on the football team at west high school. he's also a navy junior reserve officer training corps cadet. as we said earlier, well on his way to becoming a wonderful officer. emily: humble. impressive. erika: very nice, guys. 6:19 now. the federal reserve is expected to raise interest rates for the first time in nearly a decade tomorrow. that had asian investors a little jittery, but stocks still ended mostly higher there. u.s. stock futures are up right now. the dow gained 103 points yesterday to close at 17,358. a warning to twitter users over a possible hack. the company reached out to users of what it calls a small number of accounts claiming a group may have stolen personal information. twitter thinks that group might be associated with a government though it's not clear which one. the company claims there's no indication that sensitive data was compromised. this is the first such warning from the social media site. new plans for the popular restaurant wahlburgers. the family-namesake burger joint says it's adding up to 150 new

with the wind shift to the west-northwest in boston and in worcester. some 40's right now on the north shore into southern new hampshire. we still have wet weather out there. you are going to need the rain gear for about another hour. these showers will be shifting off shore. they're out there now if you're heading out. we have a band of some downpours here from newton back thruwayland stretching up toward hudson. there are downpours toward the military as well. these extend up toward nashua as well. everything is is racing eastward. i would give it until 7:00 or 8:00 this morning. then we're done with the rain. frontal boundary pressing on in from the west is going to allow those winds to shift to the west and really pick up speed here as we get into the afternoon. so by lunchtime, the sun will be out. but those winds are going to be sustained around 20 miles per hour gusting 40 to perhaps even 50 miles per hour so a wind advisory is up this afternoon but temperatures holding steady. 55 to 60 degrees for most of us here right through the afternoon. so it's going to be a warm day. we will dry out but wet roads have been slowing folks down out there this morning, olessa. olessa: especially south of town we're watching a few problem spots early this morning. if you're travel inning that

direction keep in mind we're still watching a crash. this one just clearing 128 there at braintree split. heavy delays as you approach from braintree to boston here. also on route 3 from weymouth into braintree. there's a disabled truck there. you just saw that blocking one lane. northbound on the expressway 30-5 minutes now braintree to boston. eastbound on the pike, that volume also starting to fill in. almost 35 minutes 495 to 128. and it stays slow until newton corner. more volume 9 southbound from andover all the way down to the leverett connector. stop-and-go ride. we're also watching an accident route 1 south by lynne street. so far the trains and the buses operating on schedule. emily. emily: thank you. we're following breaking news overnight on the eye. the mbta is blaming a mechanical failure after a commuter rail train to kingston got stuck on the tracks. the train from south station finally rolled into the station after midnight two hours late. right now brewster police are searching for the man in this surveillance video. they say he robbed a clerk at the brewster farms market at gunpoint sunday night. and the stage is set for these

debate stage. donald trump and ted cruz are neck and neck in two recent iowa polls heightening expectations for tonight's showdown. erika: the driver of a runaway red line train is telling his side of the story. david vasquez denying the charges against him. newscenter 5's juli mcdonald is live at south station with the interview you'll see only on 5. juli? juli: david vasquez did not attend his disciplinary hearing yesterday. but newscenter 5 caught up with his attorney. he says the veteran "t" driver did not rig the controls before the train took off last week. investigators have been looking into whether vasquez wrapped a cord around the throttle and forgot to set emergency brakes before leaving the train to manually flip a switch to bypass signal problems. his lawyer points the finger at aging equipment. >> you're talking about a system and tracks that have problems on them and outages and tracks that would require for the train to continue at the particular point

it was at to actually disable safety systems. juli: the train traveled four stops without vasquez last week. vasquez has been off the job since. this morning, there's no word on the outcome of yesterday's hearing. live outside south station, juli mcdonald, wcvb, newscenter 5. erika: the insanity defense in massachusetts in the spotlight as the jury continues deliberating philip chism's fate. the eyeopener's doug meehan is here with some surprising information "5 investigates" uncovered. doug? doug: "5 investigates" is finding people who admit to committing violent crimes are going free. attorneys for chism have already admitted he killed his danvers high school math teacher, so the question for the jury is whether or not to find him not guilty by reason of insanity. but investigative reporter mike beaudet finding some surprising information about those verdicts. ten years of data shows that the majority of people found not guilty by reason of insanity have been released, even some charged with murder. that includes people like angela

vasquez, who was charged in the poisoning deaths of her two children in 2007. suffolk county d.a. dan conley says these kinds of cases have troubled him for more than a decade. conley believes massachusetts should consider adopting a new kind of verdict called guilty but mentally ill. it would require defendants to go back to prison if doctors later determine they're no longer insane. >> eventually some of these folks will get out, and they can quite possibly commit some very, very serious crimes going forward. >> this is very, very disturbing because these defendants have committed some of the most vicious murders, you know, you have ever seen. doug: not everyone agrees. one expert telling "5 investigates" that other states allow the release of those found not guilty by reason of insanity but, unlike massachusetts, require them to be monitored. in any case the insanity defense is rarely used; and when it is, it's usually unsuccesful. emily.

emily: doug, thank you. a little boy left alone in a van that was supposed to bring him to school. now the driver could lose his license and face criminal charges. police say the driver made his morning rounds, then pulled over on prospect street in lawrence, leaving the van locked and unattended. there had been only four kids on the bus, but the driver somehow missed a five-year-old boy, sleeping in the back. a passerby saw the child and called 911. >> by mass law he's supposed to conduct an inspection at the end of his route to make-- to just avoid this circumstance. he obviously did not that the do that. emily: police think the boy was he attends a charter school and is driven there by nunez transport, a company hired by his parents not lawrence public schools. police have no prior complaints against the company. erika: coming up, hotel lobby, and police say it was intentional. driver off. emily: and ahead in news to go, a school with a new idea to

until another train could push them to the next station where they had to get off and reboard a working train. a number of those riders vented their frustrations on social media. peter posted a photo saying the train was dead in its tracks. the mbta says "a mechanical failure" is to blame. but they did not give further details. live outside south station, juli mcdonald, wcvb, newscenter 5. sera: jurors resume deliberations in the trial of a danvers teenager. 16-year-old philip chism is accused of killing his high school teacher colleen ritzer two years ago. his lawyers admit chism committed the crime, but they say he suffers from severe mental illness. the prosecution argues the teenager acted with premeditation and has been faking mental illness symptoms. the jury's verdict would decide whether chism goes to prison or a psychiatric hospital. deliberations ran for three hours yesterday.

the new partnership comes as the west steps up its war against isis. emily: former congresswoman gabby giffords will be in new hampshire today to discuss ways to reduce gun violence. giffords was shot in the head in 2011 during an event in arizona. she will be joined by her husband, mark kelly, and granite state leaders to announce a new bipartisan state coalition to keep guns out of the hands of dangerous people. erika: all staff at boston public school buildings will now undergo active-shooter training. the school system announcing it's expanding training to include teachers, custodians, and cafeteria workers. the district launched active-shooter training under the guidance of boston police last year to help schools be better prepared during a crisis. emily: a school district in indiana is considering arming some teachers. the proposal is to arm one trained teacher in each school in west clark. some members of the school board are arguing that giving a well trained teacher access to a safeguarded weapon on campus

indiana allows school boards to make decisions about guns. erika: a holyoke public school that specializes in caring for special ed students is now accused of abusing them. the local d.a. is opening an investigation of the peck full services community school. last week we told you about an independent report claiming students were restrained and physically abused there. parents of peck students are being asked to come forward with any information. emily: this accused child sex predator is on the run. police say john munroe cut off his ankle bracelet and fled. the 75-year-old is from fall river. his car was found in hull. munroe is charged with raping a girl under the age of ten. anyone with information is asked to call police. erika: boston university is revoking its honorary degree to bill cosby. the college says sexual assault allegations against cosby--and his own sworn deposition testimony-- drove its decision. meantime, cosby is counter-suing seven of those woman who accused him of drugging and raping them. the suit in massachusetts

federal court accuses the women of character assassination. will likely make less money than originally anticipated. budget analysts had originally predicted plainridge park casino would make $262 million in total revenue, but that's been revised to $160 million. twin rivers casino in rhode island, however, is expected to make more money than expected. analysts thought plainridge would hurt its revenue since they're only 11 miles apart. erika: there's controversy surrounding a study linking anti-depressants to autism. the study found women who took anti-depressants in the last six months of pregnancy were 87 percent more likely to have a child later diagnosed with autism. but many doctors say there are flaws in the study and fear it could cause unnecessary panic. emily: today is the last day to sign up for health insurance on obamacare exchanges if you want coverage on january 1. this is the third year people will be able to buy federally subsidized health care on government-sponsored exchange

websites. there was an extension last year, but it's not clear if that will be the case this year. the customer says this started when he asked the employee to toss out hits old coffee. he refused but did try to hand him a fresh cup. as he drove off, that male employee attacked. the customer did come back to continue the argument. he says that employee was irate. emily: a veteran nba referee is coming out as gay after a confrontation with rajon rondo. bill kennedy told yahoo sports he's proud of his job and his sexuality. the comments came after the former celtic directed a gay slur at him during a game. rondo has since tweeted an apology, saying, "my actions during the game were out of frustration and emotion, period! they absolutely do not reflect my feelings toward the lgbt community.

good for our morning commute. cindy: bad timing too because it's almost out of here. you can see it's another murky start in boston. we have clouds and fog the past couple of days but it will like completely different in a few hours as we'll get this rain out of here. 50 degrees in boston. the wind beginning that shift to the west-northwest at 10 miles per hour so it's already bringing in dryer air. dew points are down in the mid 40's. they were up around 60 overnight. we're cooling it off, drying it out worcester on west down to 49 in pittsfield. still near 60 on the the cape. we've already set a record high temperature for the date in providence. still have some showers so you can see brockton down to new bedford to plymouth and scituate as well. you can follow that line up here. it's lining up inside 128 right now. we've still got showers around the boston area. these extend north ward billerica to nashua, manchester up to concord, new hampshire but they're all shifting eastward pretty steadily. by 8:00 this morning, in about an hour, i think they'll be shifting off shore. they're coming in with the frontal boundary. this is the leading edge of that dryer air.
