emily: good morning, it's wednesday, december 23. i'm emily riemer. randy: i'm randy price. stories we're following on the eyeopener right now. getting back on track after an outbreak in boston. the steps chipotle is taking today to reopen. emily: christmas decorations swiped from a family's home. the specific item thieves are after. and the warning from police. randy: war of words between donald trump and hillary clinton. the comments from which neither is back down.

with cindy. cindy: visibility may run under a quarter of a mile at times this morning. there is a dense fog advisory. look at the temperatures. 40's to the lower 50's once again it is another mild start and it is going to be a dry start. the fog may burn off and the clouds may thin. to the south, you can see there is rain. this is coming in with a warm frontal boundary that is going to push really warm temperatures in our direction overnight into christmas eve. today temperatures mostly in the lower 50's. we sfepped morning, in the 40's here in boston. lower 50's on average for high temperatures today but the temperatures do jump up tonight and that rain is going to hold off. as we get toward the later afternoon, by 3:00, a cple of showers coming up from the south

kevin in for olessa this morning. good morning, kevin. kevin: very light volume as expected this time. overnight work crews. the roads a little bit wet this morning from overnight rain. no sign of freezing or anything. the temperature is up there so you swropet any trouble >> there is. let's go to map. mass pike both directions and route 93, we have work crews picking up in both directions. both directions on the tobin bridge this morning have a couple of lanes shut down. south of town, the expressway not too bad. route 3, work crews over by route 18 and union street. emily, randy, good morning.

getting ready for a big move. emily: the eyeopener's antoinette antonio is live in boston with the steps being taken this morning. >> if everything comes back clean, it could reopen by as early as the end of this week. for the last few weeks, workers have been cleaning and disinfecting the place from top to bottom avenue people suffered from nausea and vomiting after eating at the circle location. the mother of one of those people is the mother of a 16-year-old boy. an employee was sick during a shift at the restaurant and that may have caused the outbreak of noro virus, which is extremely contagious. chipotle issued a statement saying we have been working diligently with health officials to be sure the restaurant is safe to open.

say the entire establishment has been disinfected from top to bottom and the second round of samples for norovirus have come back negative. of course when the store reopens depends on the outcome of today's inspection. randy: other stories we're following right now, an ayer man charged in a deadly hit and run in worcester will be in court today. daniel depew will be arraigned on several charges including drunk driving. police say he hit gina and george burdick as they unloaded groceries from their car in september. emily: police are investigating an armed robbery in brighton. it happened in the 200 block of lake street yesterday. police tell newscenter 5 that one person was robbed and the suspect or suspects got away. no one was hurt. randy: right now, a warning to homeowners, as police try and track down holiday thieves.

a very specific type of decoration. the eyeopener's todd kazakiewich is live in dorchester with the target. todd: randy, good morning. it happened in dorchester. thieves are after the newly popular laser lights. since they're sold out in many stores, crooks are helping themselves. take a look at the video here. the lights shine through a projector, making holiday decorating easier, and less time consuming than hanging lights. quintino centeio caught a grinch on surveillance in dorchester, stealing his pricy laser display. another was captured in lynn, unplugging the lights, and walking away. >> unfortunately you have people out there that they don't have no spirit of christmas. they want to take but they don't want to give. todd:police are warning homeowners to keep their projectors in a safe place. as for centeio, he says he'll

asked, if that projector is emily: right now, the man who marathon bombers is free and apologizing. stephen silva walked was released yesterday for the first time in a year and a half. he admitted to lending his gun later used to murder mit police 22-year-old silva was a close time. silva apologized for his role in the crime. >> i would like to give my deepest condolences. it is sad a close friend chose to do that with his life. emily: silva's cooperation with prosecutors proved key in the marathon bombing trial. his testimony helped undermine the defense case that tsarnaev's older brother tamerlan was the driving force behind the attack. >> we shouldn't let anybody

men out there. emily: the latest national poll has trump leading the g.o.p. but six in 10 women voters say they would be embarrassed to have trump as president. emily: christmas decorations tossed from the rooms of homeless families. randy: the battle underway in danvers this morning. a new investigation into concussions. how congress is now getting involved. cindy: we have rain moving up from the south. that is not going to arrive

emily: dozens of families are outraged this morning, after being told to get rid of their christmas trees. those families are homeless, living in temporary housing at this hotel in danvers. state inspectors recently told them they had to get rid of the christmas trees and decorations in their rooms calling them a fire hazard. parents say this won't stop santa but something is still lost. the state department of housing and community says they care deeply about residents' safety, and this is a matter of clutter. randy: a gun policy revoked in virginia.

randy: our holiday gift from cindy. i know there are skiers desperate to get out there on the slopes, but r for the rest of us. cindy: i told my kids, santa brings presents to kids in florida. we have warm conditions this year for sure. more rain on the way today. it is not going to come until the end of the day today. for the evening commute, there will be some light rain around. the downpours are possible overnight. we're talking about a widespread half inch to an inch for most of us. that is great news. we got quarter to half inch yesterday. we're behind more than 10 inches in boston and nine inches in worcester. this morning we're not dealing with rain but we are dealing with fog. it is out there wherever you see

visibility is about a half mile. visible may drop to under a quarter of a mile. there is a dense fog advisory for a good portion of the area. look at these temperatures. we're getting so used to this. usually in december we wake up to morning, in the 20's. in the 40's and lower 50's this morning. a few pockets of 30's, places like bedford and norwood. the temperatures may fall a little bit here this morning and then bounce back into the low 50's this afternoon. once we burn off that fog, there could be just a little bit of sunshine breaking through this morning before the clouds really take over again today. you can see how widespread the clouds are you r-now. what i'm watching is a slug of rain here to the south lifting northward here to the crarns. this is coming in with -- karns. this is coming in with a warm frontal boundary.

the south already in the mid 50's. that is the air mass that is going to surge in overnight at as that front moves on in. by day, mostly in lower 50's as our winds turn to the east. as we go through most of the day, again, it is dry, by about 3:00, a couple of showers may start to come up along the south coast and islands. by 6:00 this evening in the evening commute, some light showers. there are some downpours that could could occur by midnight and tomorrow morning, 6:00, i think the rain is pulling away and we're starting to dry it look at the temperatures, though. the temperatures rise overnight. by 6:00 rpgs 7:00 tomorrow morning sh, it is near 60. 60's. look at your temperatures. 70 degrees the forecast high temperature tomorrow in boston. if we get a little bit more sunshine, i'm thinking that

we're going to smash these records back in 1996. christmas day, we're actually talking about the temperatures coming down a little bit but still around 60 degrees. incredibly mild for christmas eve and christmas day. a chance of a few showers saturday and a few more on sunday and early next week, there is another system coming in. randy: very good. cindy: it didn't snow last year on christmas either but then we had snow. erika: dense fog. some areas a little more dense than others. not too bad here coming over the zakim bridge. workers have picked up.

tobin bridge still picking up pup tobin bridge both directions there, a couple of lanes shut down. also on route 93. 93 northbound workers at south hampton street has cleared away. whatever delays has eased out. 95 south and 128 north looks like those workers have cleared. emily? emily: a new poll of u.s. republicans shows that more than half are in support of the climate deal reached in paris. the reuters/ipsos poll shows that 58% of republicans surveyed say they approve of u.s. steps to curb global warming. a high number, but still in stark contrast to 91% of democrats polled. 40% of republicans, however, say they would support a presidential candidate, willing to work with other countries on the cause. emily: a congressional committee will conduct an investigation into concussions next year.

together medical, military and sports professionals, to look at short and long-term effects of head trauma. concussions are often discussed in the context of sports, like but some lawmakers say the problem goes beyond that, and impacts a large portion of the population. randy: a court clerk magistrate is off the job this morning, after 5 investigates tracked her work habits. ann colicchio was one of the highest earning court clerks in the state. sources tell our kathy curran she's been suspended for 30 days without pay as a result of our investigation. 5 investigates tracked the work habits of the concord district court clerk magistrate for 26 days and found the clerk at the courthouse on average only 2 hours and 23 minutes a day. while court was in session in concord, our investigation found the clerk miles away in lowell. colicchio told us she was using earned time to deal with family health issues. but after our investigation, the

review. we reached out to both her and her lawyer but did not receive any response. emily: a check of your economic headlines. asian stocks rallied today in light trading, following gains on wall street yesterday. the dow rose 165 points tuesday, to close at 17,417. right now, stock futures are slightly lower. -- they are up. emily: the government issues an executive order to change marriage licenses . the governor making the announcement yesterday. the new order allows county clerks who oppose same-sex marriage to refrain from adding their name to the marriage license. kim davis garnered international attention after she refused to issue licenses to same-sex couples, with her name on them. randy: a concealed handgun permit pact between 25 states has been revoked in virginia.

emily: just about 4:55. it is time for your early news to go. randy: prosecutors say a lakeville mother, accused of kidnapping her two children, planned to kill them and herself. in court yesterday, prosecutors claimed valerie mcgrath concocted the idea, because she was so distraught over losing custody. she failed to return them to their father's home on sunday causing a search that ended safely monday night. mcgrath was ordered held on bail. emily: lawyers for aaron hernandez want to question a juror who convicted the former patriots star of murder. hernandez' defense says a juror in the odin lloyd murder case may have known hernandez was implicated in two other murders. information about the double-murder case was excluded from the lloyd trial. a judge will decide if lawyers can question the juror. randy: the woman charged with

make her first court appearance today. lakeisha holloway was charged with murder yesterday, hit-and-run and child abuse. drove up onto a sidewalk, car. one person was killed. emily: new york real estate heir and suspected murderer robert durst will head back to los angeles, to face charges. prosecutors say he killed a friend, to stop her from cooperating with an investigation into the 1982 disappearance of durst's wife. durst was arrested months ago in new orleans on weapons charges. emily: one person is seriously hurt after a shooting at a new york mall. the shooting followed an attempted robbery of the rolex counter at the roosevelt field mall. a stray bullet hit an employee in the shoulder. the suspect was taken into custody by a security guard. randy: and a thief makes a daring escape from police falling head-first

police in ohio say the man had been switching price tags on coats at macy's, when he got caught. an officer tried to catch him by his legs before the fall but missed. the suspect was not seriously hurt. he's now facing misdemeanor threat charges. randy: incredible video out of china. a 19-year-old is pulled from the rubble of a landslide alive more than 60 hours after being trapped. the migrant worker was rescued earlier this morning. he told rescuers he had been trying to get out of his room, when the building collapsed. emily: a new york girl badly burned in a fire gets a special holiday card. it is from the president and his family. she asked for christmas cards from all over.

her nice christmas. he started occasionally dancing about three years ago to break the monotony of standing for hours. he realized the collections went up if he put on a show. he is actually this first place for collections in that area. randy: you have to get attention. a few people joined in with him. cindy: get your attention. you're feeling guilty, there you go. it is a wonderful thing there. it is a win-win. look at december. this is just incredible. it will certainly be record-setting. average temperature is 45.7. that is right now currently the warmest on record. the records in boston go back to the late 1,800s. the warmest we have been is 41 degrees.

we have warmer air out there. we're going to see the temperatures spike up to around 70 degrees coming up tomorrow on christmas eve. we're above average as we settle back into the weekend. records will will be set on christmas eve. the record is 61. we'll smash these records. the warm weather is going to come in with rain later on today. now we're starting off in the 40's to around 50. there is some rain along the coastline. it is going to take until the end of the day to get on in here today. 60's from philly to d.c. that is the start of that air mass that is going to surge on in tomorrow. that 70-degree reading in atlanta is going to be our weather. we'll start out dry i think tomorrow with a fair amount of clouds but as the day wears on,
