nausea and vomit ing after eating at this cleveland circle location. the mother of a 16-year-old boy is now suing chipotle. boston health officials said an employee was sick during a shift at the restaurant. chipotle issued a statement saying "we have been working diligently with health officials to be sure the restaurant is safe to open." and representatives with chipotle told us the entire place has been disinfected and the second round of norovirus testing came back negative. we'll keep you posted on what happens with today's inspection. live in boston this morning, wcvb news center 5. randy: the danvers teenager convicted of raping and killing his high school teacher understood exactly what was going on during his trial. those comments from the judge in

competent to stand trial despite several incidents. chism will be sentenced on january 29 for the murder of colleen ritzer. because he was a juvenile at the time of the murder, chism can't be sentenced to life without parole. emily: right now, police are investigating an armed robbery in brighton. it happened in the 200 block of lake street last night. police tell newscenter 5 that one person was robbed and the suspect or suspects got away. no one was hurt. emily: right now, the man who loaned a gun to the boston marathon bombers is free and apologizing. stephen silva walked free yesterday for the first time in a year and a half. he admitted to lending his gun to dzhokhar tsarnaev which was later used to murder mit police officer sean collier. the 22-year-old silva was a close friend to tsarnaev at the time. after his release yesterday, silva apologized for his role in the crime. >> i would definitely like to give my deepest condolences to the collier family. i don't support any type of

colicchio told us she was using earned time to deal with family health issues but after our investigation the state trial court launched a review. we reached out to both her and her lawyer but did not receive any response. randy: prosecutors say a lakeville mother accused of kidnapping her two children planned to kill them. in court yesterday, prosecutors claimed valerie mcgrath was so distraught over losing custody of her children that she planned to kill them, and then herself. she failed to return them to their father's home on sunday sparking a search that finally ended monday night. mcgrath was ordered held on bail. randy: convicted killer aaron hernandez wants a court hearing to see if one of the jurors who voted guilty was biased against him. hernandez' defense says a juror in the odin lloyd murder case may have known hernandez was implicated in two other murders. information about the double-murder case was excluded from the lloyd trial. hernandez' lawyers want to question the juror. no decision on the request yet from the judge.

charged in a deadly hit and run in worcester is preparing to face a judge. daniel depew will be arraigned on several charges including drunk driving. police say he hit gina and george burdick as they unloaded groceries from their car in september. depew is being held without bail. emily: five on the opioid crisis, more than a dozen people are under arrest this morning charged in a massive heroin bust in maine. we're talking about nearly 18 pounds of this drug worth $3.2 million. these suspects including 34-year-old brian aquino from lynn are facing aggravated trafficking charges. authorities say the bust is the equivalent of 80,000 doses of heroin. randy: dangers on the road for drivers in new hampshire. emily: the objects getting hurled at moving cars. and it's a find recovery crews did not expect to make. the miracle they uncovered, days after a deadly landslide. randy: and new this morning, holiday shopping is winding down, but stores want to lure you back in. the big items getting marked

this is a push of record-setting warmth that is going to be ours for christmas eve. temperatures in the low 50's through the afternoon. we will see rain come in here but not until the end of the day. by 3:00 this afternoon, a couple of showers coming up along the south coast, the island. it is by 6:00 the evening we start to see some light rain. there are some downpours we may get in here. first thing in the morning, 5:00, 6:00, the rain is shifting out. the skies may try to brighten up by christmas eve. the temperatures are in the lower 50's. by tomorrow morning we're waking up to readings near 60. incredible stuff. forecasting a high temperature of 70 degrees in boston tomorrow. that will likely smash the record from 199 of worcester. worcester and boston expecting record highs tomorrow. if you're going to be out and

hampshire. no troubles yet on route 1. much of the same out to west. mass pike ok. 495 all the way into the city. if you're taking the train, all lanes are running on time. emily: incredible video out of china this morning. a 19-year-old is pulled from the rubble of a landslide alive more than 60 hours after being trapped. the migrant worker was conscious, but weak, when he was rescued earlier this morning. he told rescuers he had been trying to get out of his room, when the building collapsed. emily: and take a look at this, a thief caught on camera running from police jumps off an escalator and falls head-first. police in ohio say the man had been switching price tags on coats at macy's. when he got caught he ran. take a look again while he was running down the up escalator he runs into a police officer coming up. the officer tried to catch him by his legs, but couldn't grab on. the suspect was not seriously hurt, but he's now facing

right now police in londonderry new hampshire are looking for the person who's been throwing full bottles of water at moving cars. one time, it was caught on video by a dash cam. you can hear the thump as 3 bottles hit the car and bounce off. five cars in two days have been hit by full water bottles. police ask anyone with information to give them a call. randy: a check of your economic headlines. asian stocks rallied overnight in light trading, following gains on wall street yesterday. the dow rose 167 points yesterday. right now, stock futures are slightly lower. today investors will be watching for a report on new home sales. as the number of orders amazon fills up, they are looking for ways to cut delivery costs. as of now, u.p.s. delivers most of their packages. but they are looking to take

they are using in some cases, their own trucks and couriers. randy: a new recall this morning from ford. the auto maker is recalling more than 300,000 cars because of headlight issues. that includes crown victorias and mercury marquis. the models were made between 2003 and 2005. ford says a crack in a control module can cause the headlights to suddenly go out. emily: they are a big part of the holiday shopping season. those post holiday deals. electronics expect deep discount on things like tv's and laptops, especially since the new versions are usually unveiled in january. if you need a winter coat, cold weather they need to make way

returned. outraged this morning, after christmas trees. those families are homeless, this hotel in danvers. state inspectors recently told them they had to get rid of the christmas trees and decorations in their rooms calling them a fire hazard. >> they knocked on my door wanting to inspect. i was in the room with my five children. he looked at my tree and said that has to go . my 6-year-old said the tree can't go. santa claus won't come. said are you guys serious? the parents say this will not stop santa, but something is still lost. the state department of housing and community says they care deeply about residents' safety, and this is a matter of clutter. a maine high school teacher will be allowed to keep a pink hello kitty christmas tree in her classroom. bangor high school officials originally ordered catherine gordon to remove the tree saying it had no educational value. but gordon fought back and news

viral. the principal eventually reversed his decision the tree can stay because it highlights the nature of holiday celebration. emily: struggling families in new hampshire will soon have a new place to get help. hundreds of people from non-profit groups around manchester celebrated the grand opening of a new emergency shelter yesterday. more than $2 million went into the project which is the first of its kind to offer a range of family services under one roof. that includes childcare, health services and employment resources. it will officially open in january. randy: spreading holiday cheer to rush hour. emily: the celebration making one commute much more fun. and you might remember this little girl. she asked for christmas cards after being badly burned in a fire. now some very special people have answered the call! randy: and ahead in news to go: more twins than ever are being born in the u.s.

officer sean collier. randy: the woman charged with murder in a las vegas crash will today. lakeisha holloway was charged and child abuse. police say she intentionally drove up onto a sidewalk, plowing into a crowd, all with her young daughters in the car. one person was killed. a woman is dead after she was hospital. police escorted her in handcuffs. she had been discharged and asked to leave by hospital staff. the officers took her back inside after she collapsed but she was pronounced dead. results of her raups expected to be released today. emily: new york real estate heir and suspected murderer robert durst will head back to los angeles, to face charges. prosecutors say he killed a friend, to stop her from

investigation into the 1982 disappearance of durst's wife. durst was arrested months ago in new orleans on weapons charges. randy: twin birth rates hit a new high in the u.s. last year, nearly 4 million babies were born and 135,000 of them were twins. that's about 1 in every 29 babies. in 1980 that ratio was only 1 in 53. experts believe the increase is due in part to the number of women waiting to have children. they say women in their 30's are more likely to have twins than younger women. emily: an animal scare at the airport in myrtle beach. surveillance images capture a coyote, running through the baggage terminal. airport staff say they have no idea how it got in. they wrangled the coyote in the animal had to be euthanized. randy: pro bowl selections have been announced, and 7 patriots players are on the list. tom brady was chosen for the 11th time in his career and rob gronkowski for the 4th. made the cut for the first time in their careers.
