we're rolling closer to the new year. here it comes. and rain welcomes us as does mike wankum on this sunday morning. mike: we have rain. it is in the form of rain because check out the temperatures right now. we're in the 40's in most locations. mid 40's. you know what? today will be another mild day out there. we have rain to contend with. here's that batch of rain that is over the top of us right now. most of it is from the north shore around route 2. we're talking about rain, not talking about snow. south shore you're seeing lighter amounts of showers as well as the cape at this point. this rain is going to be moving through here this morning. we're not going to clear a lot this afternoon. here you can see where the rain is right now. notice how we're looking at a warm front lifting its way north ward. that's causing the rain this morning. a cold front to the west will come slipping through here as we get toward late this afternoon but in the meantime, a mild air will be bubbling up from the south. also you may have noticed the visibility down in a few locations, close to a mile in some spots. keep an eye on that as you step out early this morning. here's the timeline. we push the heaviest rain off shore by 7:00.

of cloud cover. you look really carefully there may be a few breaks in this cloud cover late this morning into early afternoon. then we get a new batch of showers that slips through here between 4:00 and 7:00 tonight. not much associated with that one but that threat will be out there. finally we we clear things away as we head to the overnight hours. for today it looks like this. we'll see showers this morning. mostly cloudy this afternoon. we'll finish the day with a few scattered showers. that's that the temperature 56 degrees looking beautiful but i'm tracking this. snow for tuesday morning. we'll talk more about that in a few moments. right now more than a dozen people are homeless after this fire engulfs their home in dorchester. newscenter 5 learning a candle sparked that blaze. frank holland joins us now with the close call for the families. frank? frank: antoinette and doug, ten adults and six kids were able to escape just as flames climbed up their multi-family home, but they lost everything else in the fire. the flames started around 6:00 it quickly spread to four

firefighters able to get the an hour but not before the house was destroyed. just a day after christmas, the family is thankful that everyone made it out safely. >> we have our lives, but we lost everything. everything is gone. it's all gone. >> it's just never going to be the same. i'll never forget this. frank: firefighters say the fire started on the first floor when a flammable liquid got too close to a candle that was burning. they say everyone got out just in time thanks to those who ran upstairs to alert their neighbors. doug? doug: frank, thank you. breaking overnight. this convicted bank robber is now behind bars after turning himself in to police. matthew martin turned himself into vermont state police around 3:00 this morning. he was wanted on several warrants in both vermont and new hampshire. he was supposed to be sentenced last week for three robberies in vermont but never showed up in court. in the past few weeks police

crimes in new hampshire. antoinette: a teenager is recovering after being shot in the leg in dorchester. the 14-year-old boy was struck last night on stratton street. he was taken to the hospital for evaluation but is expected to be okay. k-9's searched the area for a suspect who was seen heading toward blue hill ave. no word on any arrests this morning. right now upton police are trying to piece together a deadly mystery. they say a hunter found human remains in a wooded area off mendon street. the situation is being investigated as an unattended death. the worcester county district attorney office is now involved. the skeletal remains will be taken to the state medical examiners office. doug: this morning, we're learning more about the man and woman found dead inside a milford home. carbon monoxide poisoning blamed for the tragedy. the victims were natives of brazil with strong ties to their homeland and their adopted community.

with the tragedy in milford. she speaks little english. but her profound grief is fluent through her tears. sister (translated): today was the day that i was going to meet him after 13 years. reid: with her daughter translating, sylvania ferreira says today was to be a celebration not only for the holidays but for time lost. sister: see him again. hug him. he was so special. reid: sylvania hadn't seen her brother in 13 years since he moved from brazil for a better life. avair desales died alongside his girlfriend, maria aprecida dasilva, in their milford home. the couple was found in bed christmas morning by a roommate. carbon monoxide poisoning, family members have been told, is the likely cause of death. sister: he was taking care of our mother. reid: between them the couple had three adult children-- none together-- all of whom live in brazil. family here now beginning the tough process of sending them home. sister: the real concern that we

brazil because everybody wants to see him for the last time. reid: the gas leak is believed to have come from the boiler in basement. the unit remains condemned as does the adjoining unit. avair's niece tells us just a day before he was found dead, he was hospitalized complaining of symptoms caused by c.o. poisoning. sister: he felt a lot of headache, a lot of pain. reid: investigators still trying to pinpoint the exact cause of the gas leak. in the meantime, phone calls made to the landlord went unreturned. in milford, i'm reid lamberty, wcvb, newscenter 5. antoinette: an everett man faces a judge tomorrow following a wild standoff that put an entire neighborhood on edge. newscenter 5 cameras were there when 53-year-old mark lavoine finally came out from his summer street home fray. that was after five hours of coaxing by police. right after he was arrested, his home burst into flames. police say lavoine will be charged with discharging a firearm and disorderly conduct. a woman who was struck by a car

57-year-old karen evers-pecci suffered multiple injuries after being hit by the vehicle on washington street wednesday. she was pronounced dead at the umass medical center in worcester. a 53-year-old florida man was behind the wheel. he did stay at the scene. so far, no charges have been filed. doug: remembrances for a fallen woburn police officer killed in the line of duty five years ago. officer jack maguire was shot and killed during a robbery at the kohl's department store on december 26, 2010. more than 100 people gathered yesterday at the spot where maguire lost his life. >> it's important that we recognize our heroes. jack is a hero along with everyone else that is is out here as far as the type of work they do. we believe everyone of these officers here believe in protecting the public. doug: a christmas tree has been lit in maguire's honor every year since his death. a priceless gift she'll never forget. antoinette: a little girl

antoinette: good morning. 5:11. welcome back. public records are being kept from the public far too often. that's the finding from what's believed to be the biggest test of the system ever done here. doug: it was a joint project by "5 investigates," " the boston globe," and northeastern university. here's investigative reporter mike beaudet. ben: my name is ben thompson. i'm a third year student at the northeastern university school of journalism. mike: ben thompson is now a familiar name to every city and town across massachusetts whether they like it or not. he and his classmates mailed hundreds of public records requests to all 351 bay state

using a post office box as thompson's address and a generic email account, they asked for a copy of the annual payroll and a copy of the police department's policy on when officers can use their weapons. state law requires a meaningful response-- ranging from a fee estimate to a denial-- within 10 days. >> that was the number-one thing we were looking at-- would they get back to us? mike: many did including arlington police which handed the policy over free of charge within days. why do you think the public should have access to that policy? >> listen. there's no more important poilcy to be transparent about than our "use of force" policy. mike: but plenty of others didn't follow the law, either by not responding in time or trying to keep the information secret. one town telling us that the providing the payroll would be an "unwarranted invasion of personal privacy." are you surprised by our results? >> well, i'm disappointed to hear these results, but unfortunately i'm really not surprised. mike: state senator jason lewis is trying to reform the public

this audit demonstrates there is a need for changes in the law regarding fees, enforcement, as well as the timeliness of responding to records requests. mike: some communities made unusual demands of the students, and you can read about those demands in today's "boston globe." and coming up tonight at 11:00, my full investigation. watch the reaction from officials when we visit one town that didn't turn over any records. mike beaudet, "5 investigates." doug: all righty, mike. thank you. here's an interesting one. a new hampshire couple looking to undo their divorce is turned down. the new castle couple divorced in 2014 after 24 years of marriage. now they say their divorce was erroneous because they are a couple again. but the state's supreme court says otherwise. an attorney defending the ruling says the couple's divorce couldn't be undone because it would bring into question the finality of all divorces. antoinette: it's been a record-setting warm winter. and that's been both good and bad for businesses drawing

weather. in new hampshire, it's bringing crowds to puddle duck pond for some ice skating. but with temperatures in the high 60's on christmas eve, the pond had to shut down. >> when it was really, really warm, it was like a swimming pool. the system that we have under the ice just couldn't keep up with it. antoinette: ski resorts are taking a particularly hard hit. right now, loon mountain has less than half of its terrain open. workers there say they welcome the colder temperatures. and they're hoping for snow. doug: i feel terrible for those folks because their window is so short. mike: they can't even make it up there. this being vacation week, a lot of people would be doing that. i think as we get into the week, it will get cold enough. they'll be making some snow. they have the natural stuff on the way. doug: good. mike: do not cancel your ski reservations just yet. although this morning not much for ski weather. this is where you get to use

anything like that that you got for christmas because we have showers sitting out there. most of it seems to be north of the pike. you can see through leominster and green field down to the south, there's still scattered showers out there. a little pocket around brockton. not much over the cape. what doesn't show up on radar is is probably falling in the form of drizzle right now because it's a gray morning out there. through. however, it's going to get us into this mild air for a while afternoon. high temperatures once again will be into the 50's. do remember the normal high temperature this time of year is 38 degrees. so we are way above normal. we're going to get back to normal behind this cold front. that cold front is going to come through later this afternoon into the evening hours. that will also give us chances of showers as well. hasn't been much rain. orange picking up 21/100ths. that seems to be the most rain i've seen out there. before it's all over with, a quarter inch, maybe one or two spots getting close to a half inchment that's the extent of it. the temperatures are very mild. these are above day-time highs. we're talking about just a little after 5:00 in the morning. it's very warm out there.

rain this morning and not snow. however, on tuesday morning, it's going to be cold enough that we will be talking about snow for your morning commute. it looks like it will be a slow one. 5 degrees right now south-southeastly winds at three miles per hour. here's what's happening. this is the mild air that will bubble up in here today. we had a little bit of rain with that warm front. there's the cold front that will give us some showers as we talk about, say, between 4:00 and 7:00 this afternoon. otherwise, check out the cold temperatures. it will be flowing their way back into our forecast. so what does it look like? this is a storm that will give us the snow. we need a timeline of what will happen. this will be pushing its way in. this is 2:00 in the morning. not tonight. it's monday night into tuesday morning we start to see some snow coming in. also keeping a close eye on that mix line. this is the whole key to the forecast. how much warm air can get wrapped in here? you know, it hasn't snowed for a long time. in fact, notate a all this year. the ground is relatively warm but we haven't treated any of the road surfaces. do be cautious about that. 6:00 a.m. we're in the heart of the snow.

north ward. by 2:00 i think we're talking more about rain mixing in. breaking it down a little bit. it begins after midnight as snow. then the snow-to-sleet mixture around 10:00 in the morning on tuesday morning and then as we head towards noon, it will be raining at the coast but there will be sleet inland. early numbers, here's what i'm thinking. about 1-3 generally but i think where it stays colder, we may get a little bit more out of it. in the 3-6 category. to the south where the mixing comes in faster, we're talking about a coating to an inch. this isn't happening until tuesday morning. a lot of details need to be ironed out. today, check out the temperatures. in the mid to upper 50's today. just a hint of sunshine. really that's nice weather. look at this. we're 20 degrees colder on monday with a high of only 36 degrees. tuesday morning, that's the snow eventually to rain. we clear out for wednesday. thursday. but it does look like it's a chance of rain not snow because it will be warming up then. we'll begin the new year with temperatures in the lower 40's antoinette and doug.

now to some of the stories we're tracking right now on the eye. doug: frank holland is following including new details on a maine. frank? frank: doug and antoinette, investigators say the driver of a car that crashed into that apparently blinded by the sun. seven people were hurt in friday's accident in waterville. one of them seriously. the driver, a 73-year-old man from clinton, maine, slammed into the back of the carriage carrying 15 people. six were treated and released. one woman was airlifted to a hospital and is listed in critical condition. two people are under arrest in new hampshire after an incident at the steeplegate mall. both state and local police responded to an alarm there on christmas day. they discovered part of a glass door shattered at the bon ton department store. the two suspects both juveniles were arrested yesterday. no word on what charges they may face. two people have been killed in an officer-involved shooting in chicago-- one of them by accident.

morning to a domestic disturbance call on the city's west side. police say they were confronted by a, quote, "combative" person and opened fire. a 55-year-old woman was accidentally struck and killed. prompted the call to police was the shooting is under investigation. european authorities are warning of a possible attack between now and new year's. police in vienna are stepping up security but are not canceling any events. a spokesperson says there is no threat to a specific location, but authorities did receive a tip and a list of potential attackers. i'm frank holland. those are the stories we're following right now. >> now sportscenter 5 with bob halloran. bob: rob gronkowski had 108 yards, 11 catches and a touchdown against the jets back in october. that was with amendola and field.

along with mccourty and chunk. the bruins give up five unanswered goals in the final ten minutes to lose to the sabres last night. second period a tip to tie the game 1-1. 76 seconds after that, brad marchand feeds bergeron who nets his 12th of the year. the bruins lead 2-1. they go on to take a 3-1 lead. but a massive comeback. here in the third the sabres scored five times. an empty netter later. bruins lose 6-3. very nearly a similar fate for the celtics in detroit. evan turner with the over the shoulder pass to zoeller. the celtics take a 15-point lead to the fourth quarter. but the lead was down to two in the final minutes. the celtics do 40e8d on to beat the pistons 99-93. the celtics are home against the knicks and the bruins are at ottawa late this afternoon. of course we have the patriots and jets too. mike lynch has all the game action and reaction tonight on sportscenter 5 o.t.

have a great day. doug: a dream come true for a little girl fighting cancer. at gillette stadium. steward, it was like christmas antoinette: the meeting coming just before the patriots traveled to new york for today's game against the jets. our juli mcdonald has the story from foxborough. dad: just to hear him say her that we had heard in a very long time. a christmas gift she'll never forget. she was really good this year after all. she's been brave and strong as she fights b.c.ell leukemia for the second time. her number-one wish was to meet number 12. christmas morning, her best gift wasn't under the tree. it was actually on her computer. tom brady: i heard you had a special christmas wish that you wanted this year. i've got one too. juli: it was christmas morning all over again today. hailey and her parents left their home in bethel, maine, at 5:00 and drove to gillette where they got a special tour and a

dad: what did you think when he said your name? hailey: i'm crazy. juli: hailey swears she's never going to wash that spot on her head where tom gave her a kiss. he also signed her brady jersey and gave her a hat to match his. dad: you have the same hat. when you see him on tv and he has that beanie on, what do you think? hailey: yeah. dad: yeah. juli: after a truly magical christmas at home and in foxborough, hailey has to return to her other "home" at the hospital this week. her dad tells newscenter 5 the generosity of tom brady and the patriots toward his family was a priceless gift they'll never forget. dad: it was just-- i don't know who was more excited, her or me. you know, to see my daughter get her wish was-- is something that i'll forever be grateful for. juli: i asked hailey's dad how they're going to top this christmas. he didn't have to think long. he said their family's best christmas ever is going to be when hailey is healthy at home and the second cancer fight is behind them. at gillette stadium in

mike: well, today is the last day of the warmth because after today the temperatures drop off to 40 degrees. we're not seeing any 50's in the forecast. a lot of 40's and 30's showing up. today we have the rain to contend with. this morning we have basically steady rain going on right now. i think once we get past 8:00 or 9:00 it goes to just a few scattered showers. maybe thinning of that overcast. another batch of showers around

won't be much rain with that second batch but the skies will be clearing away. that cold air will be settling in and setting us up for a chance of seeing some wintery mix as we head towards the tuesday morning commute. doug and antoinette. antoinette: mike, thank you. a strange request from a four-year-old boy for christmas. doug: this is awesome. most children ask for toys, but all a california boy wants is garbage cans. jobiah wells rolls the trash barrels out for his entire neighborhood on garbage day. that's 17 homes. his family says it started two years ago when he became fascinated with the trucks. and since then, he's become a neighborhood staple. >> i pull out the cans and make them happy. >> he loves garbage. he loves all things garbage. the drivers. he can't get enough of the drivers. doug: what do they say? one man's trash. santa did bring jobiah some remote-control dump trucks and toys. but his favorite gift came from the garbage truck drivers who, after their route, delivered

don't plan on any more warm days because i think once we start tomorrow morning you're going to notice the temperatures much colder. this morning look at the readings. we're into the 40, 45-degree range. nantucket at 59 degrees. we're talking about rain this morning and not snow. typically a few days after christmas we would be talking about snow. here's where the bands of rain are right now. notice how they're tracking their way along route 2. i see the steadiest showers throughout much of essex county. as you look down towards the middleton area and even out towards lowell pretty good downpour going on right now. if you're traveling in those areas do be cautious about that. the south shore, you do have light rain, some drizzle going on right now. not as extensive but again it's also marching its way off to the east. what's the timeline look like on this? we have to go through a couple of things. one is this warm air is bubbling up. that's creating this band of rain. this cold front will come through late this afternoon and that will give us another batch of rain. but sandwiched in between, actually not a bad day. 7:00 this morning, the heaviest shore.

little hole in that cloud cover afternoon. that will alauer our temperatures on climb into the 50's. that cold front shows up about 4:00 to 7:00 tonight. it gives us another batch of showers. that threat will be out there. eventually the skies clear away. a lot of gray skies today but mild temperatures. coming up on tuesday morning, this will be cold enough for snow. i'll have the timeline of the arrival of that. all that in a few minutes. antoinette and doug. antoinette: mike, thank you. following breaking news overnight. a wanted bank robber turns himself in to police. doug: the eye's frank holland joins us with that, plus the other stories we're following right now. frank? frank: doug and antoinette. police have been looking for the suspect for a week after he failed to show up for his sentencing on three bank robberies. matthew martin turned himself in to vermont state police around 3:00 this morning. he was supposed to be sentenced on three robberies in vermont, but police believe he committed more in new hampshire after he went on the run. he's expected to face more charges. right now 16 people, including

their dorchester home as the triple-decker went up in flames. this happened around 6:00 last night on alpha road. the fire quickly spread to four alarms but was under control in less than an hour once firefighters arrived. they believe a candle sparked the blaze. everybody made it out safely. police are investigating the shooting of a teenager in dorchester. the 14-year-old boy was struck in the leg last night on he is expected to be okay. police and k-9's searched the reportedly took off toward blue hill ave. no word on any arrests. the man at the center of this wild standoff in everett is facing multiple charges. newscenter 5 was there as police arrested mark lavoine who had barricaded himself in his summer street home on friday. minutes after police took him down, his home went up in flames. lavoine will be in court tomorrow charged with discharging a firearm and disorderly conduct. antoinette?

deadly storms striking the country's midsection this morning. at least eight people are dead in texas after a tornado touched down near dallas. flooding is another devastating issue in the latest succession of freakish winter weather across the country. area. at least eight people reportedly killed as police and fire units scramble to do search-and-rescue. though. antoinette: homes destroyed by a storm that menaced communities. in alabama, the day after christmas, this santa's eye view shows the after math of a holiday that will be hard to forget. >> we were in the house having a good time. laughing and joking about memories of our family through the years. antoinette: a quiet christmas at home suddenly became a fight for survival. >> everybody said tornado. get down. and the lights went out. all of us fell to the floor. antoinette: the holiday treacherously pleasant creating ideal conditions for storms and

>> i don't know what all was flying. we went in our room to try to duck some of that. antoinette: the high winds driving torrential rains that caused flooding across alabama. the surge in currents ripped this boat house from its moorings and sent it bobbing downstream. power crews were on the job saturday trying to restore electricity. a major winter storm is about to strike the central u.s. with the greatest threat of severe weather over parts of texas. by monday morning, ice and freezing rain will cause travel trouble. for now, some storm victims are clinging to the christmas spirit. >> there's always a bright side. the sun is shining now. so maybe this is the beginning of something better. antoinette: rescue crews are out this morning looking for any survivors in the wreckage in texas. authorities believe at least five of the victims were killed in vehicle accidents that happened during the massive storm. doug: boston police nab three break-in suspects who attempted to get into an east boston home on christmas morning. police say the trio from lynn

saratoga street friday. one was armed with a bat; another with a knife. 23-year-old jose ventura, 20-year-old jeremy ventura, and 33-year-old francisco ramirez were arrested and charged with armed home invasion. they'll be in court tomorrow. antoinette: a haverhill mother and daughter who sparked a bizarre and costly hoax on christmas eve will be in front of a judge tomorrow. holly fowler and her 23-year-old daughter kristine are charged with misleading police. officers say they lied about seeing a baby tossed into the merrimack river thursday night. that prompting a massive search late into the night. investigators are now trying to figure out the motive. doug: after nearly three weeks, the boston chipotle a the center of a norovirus outbreak is finally back open. the cleveland circle restaurant quietly opened yesterday after its scheduled opening was delayed a few days because of a water leak. the location was shut down after some 150 people, mostly boston college students, became sick with the norovirus after eating

5. >> now your storm team 5 forecast with meterologist mike wankum. mike: a lot of things happening around us right now. i want to point out a couple things. one is is the warm front. the other the cold front. the warm air is bubbling up. that's creating the rain you're seeing this morning. the cold front will eventually give us some showers this afternoon. here you can see where the rain is right now. a lot of it is just along the leading edge pushing its way through the north shore. really a lot of this is north of the mass pike. south of the pike we're seeing some light showers. we're seeing drizzle as well. there's a bit of fog out there this morning as well. the cold front will come through this afternoon. but it's much weaker. much less rain is going to be falling out of that one. 45 degrees right now. dew point almost matches it with the southeastly wind. you're looking over the city. you can see the haze out there. about. not reduced visibility but it is down just a little bit this morning. as that warm front lifts it way north ward we bet into the mild air.

this cold front comes sweeping tonight. the cold dry air pushing in. tomorrow. today temperatures are into the mid 50's. they'll be in the mid 30's for high temperatures for tomorrow. in fact tomorrow's temperatures all day long. we're starting it out for 30's and we stay in the upper 30's to low 0's as we head through the afternoon. the other thing is that sets us up for this on tuesday. snow coming in for your tuesday morning commute. let's talk about today. look at these readings today. mid 50's. upper 50's. worcester about 55 degrees for a high for a high temperature today. only into the 30's we talk about monday and tuesday. it's went ir. it's coming back. you'll really feel it. so the south we may actually get a few temperatures to pop up near 60 degrees and a little hint of sunshine. not much. if anything at all, you'd be lucky if you see it. that threat will be out there for a little bit of sunshine followed by a few scattered showers as well. let's talk about what is going to happen on tuesday. there's the storm system there. it is is lifting its way north ward. it comes in with snow, mix and rain.

snow come inning here. this will be after midnight tomorrow night. not tonight. tomorrow night. this is happening for your tuesday morning commute. the snow will be moving its way in. the key to this forecast is how much warm air can get mixed in as well. we get the mix coming in. morning. it's snowing but this mix and north ward. they accomplish that during the late morning, early afternoon. so that will change things over. it's how fast does that changeover take place that determines how much snow we get. right now i'm thinking generally about 1-3 inches of snow. more as you look to the north. a little bit less to the south. you know, we haven't had any snow yet this year. the roads are not treated. even though it's fairly warm and a vacation week, i would still plan on giving yourself extra time on tuesday morning. do keep in mind it doesn't take much to get the roads to ice up especially the bridges and overpasses. so here's your seven-day forecast. let me break it down for you. 56 today. 36 tomorrow. that's the big changeover we're talking about. that snow to ice and rain. finally we clear things out on wednesday. 44 degrees.
