randy: it's 6:00 a.m. also on the eye this morning, mistakes that could derail your fitness resolutions. the bad move you could be making right when you wake up. good morning. thank you for joining us. i'm randy price. emily: and i'm emily riemer with cindy fitzgibbon. it is cold, cold, cold. cindy: um-hum. coldest in a good long while. i thought we would get around 10. we've superseded that. we're down to eight in boston. the coldest we've been since the 24th of february. it's been a good long time since we've been this cold. kids are going to want the heavy coats at the bus stop this morning. the hats, the gloves, the mittens, the whole deal. the wind chills will be running still around 5 below zero at many bus stops with temperatures in the single digits. this afternoon wind chills teens. do bundlal up. there's that eight-degree temperature in boston. look at worcester at three. six in beverly. there are some 20's on the cape. but this is also where we've got some snow happening this morning.

are running sub zero. worcester. the wind chill is going to hover below zero i think through at morning. up. by noontime it still feels like it's barely ten degrees. the wind chills will get no higher than the teens this afternoon. at least we'll have the sunshine boston north and west. this afternoon. once you head down toward this. we have snow flying this morning. these are ocean-effect snow bands. they're very localized. they've been happening since yesterday. right now the steadiest snow is just south of plymouth down towards sandwich, bourne, mashpee, falmouth. this band extends beyond hyannis now. to parts of truro and up to provincetown. wellfleet as well. these bands will be with us through late morning. once we get into the afternoon they'll taper off but a winter weather advisory up this way for the slipper erodes through about 10:00 this morning. speaking of the roads, we've got trouble there also on the trains, olessa, this morning. olessa: following breaking news in andover.

train has derailed there. that is impacting service on the haverill line. service was suspended between haverill and andover, lawrence and andover rather and buses were being provided from there. you can catch a train from there to get into boston. keep in mind delays about 30 to 40 minutes. we'll keep you posted on that. here are some live pictures in the andover station where that train derailed early this morning. again, we'll bring you the latest as we get the information. as far as the roadways go this morning, accident free. construction free. that's good news. 93 in somerville you can see some of that volume on the southbound side. let's check the rest of your ride. as you travel south 24 building those delays out of avon. expressway doesn't look too bad just yet. it's about 20 braintree to boston. and then eastbound on the pike, 15 minutes 495 to 128. 93 south slow out of andover as you travel down toward dascomb road. more delays approaching spot pond. and once again those delays on the haverill line 30 to 40 minutes because of that early morning derailed train but everything else is on schedule. emily, randy.

preparing to take new action on gun control. randy: and boston's mayor will be front and center for this controversial announcement. the eyeopener's erika tarantal is here with what we can expect to hear today. erika: randy, emily, good morning, again. boston's mayor will be in president announces that executive action aimed at curbing gun violence. that includes expanding background checks to deal with the so-called gun show loophole with more checks at shows and online. the f.b.i. would hire more than 200 examiners to process those checks. the white house also plans to ask congress for $500 million to improve mental health care. boston mayor marty walsh, frustrated by the scars gun violence has left on the city, tweeted the country cannot wait for congress to act. anticipation of this announcement is already fueling gun sales. this north attleboro gun shop owner says gun control is a delicate balance of freedom and safety. >> it's an infringement on our freedom, yes, but in this day and age things are really

terrorism stuff. erika: meantime, many republicans are already attacking what they call dangerous executive overreach. the president's announcement is at 11:40 this morning. you can watch it right here on newscenter 5 and streaming live on wcvb.com and our mobile news apps. randy: right now there is some cleaning up to do after a water main break in south boston. this is video in overnight from the area of "h" and east 5th streets. the water is off, but you can see there was definitely damage done to the roadway. emily: right now the mbta is considering two options to spike fares for everyone who rides the rails. one as high as 10%. the eyeopener's doug meehan is live in at the jfk-umass station to break down what we know this morning. doug? doug: good morning, emily. no matter how you slice it, people are going to pay more to take the "t" to and from work this year. the question is how much more. let's break it down for you. here are the numbers. one proposal calls for a system-wide hike on average of

average of 9.8 percent. but the big story here is the price of monthly passes. under the first option, bus and subway passes would spike $7.50. the more severe option means a $9.50 jump. all of this is designed to reduce the mbta's projected $242 million operating deficit. reduce -- not close. the proposed fare hikes come as many who take the "t" every day continue to complain about service interruptions. the state's transportation secretary says the goal here is to improve service, and they're looking at other options in addition to fare hikes. the next step for the proposals is a series of public hearings. the fare hikes would take effect in july. we're live at j.f.k.-u-mass station. doug meehan, wcvb, newscenter 5. emily: right now police are investigating after a man was hit by a car in malden.

streets. the driver did stay at the scene and has not been charged. no word on his condition at this hour. randy: seven minutes after 6:00. commitment 2016. and it will be very crowded on the campaign trail in new hampshire today. chris christie, marco rubio, donald trump, carly fiorina, john kasich, and jeb bush all stumping for votes in the granite state. the new hampshire primary is now just over a month away. donald trump will hold a rally in claremont tonight after firing up a capacity crowd in lowell. and emotions ran high both inside and outside the tsongas center. outside the event, hundreds demonstrated protesting trump's proposal to ban muslims from entering the united states. inside the arena, trump promised to have mexico pay to build a wall that would stem the flow of illegal immigrants. he also launched attacks against

policies in iran. trump: people are tired and they're sick of the stupidity that we're seeing coming out of washington. randy: even tom brady made it into trump's speech. he raved about the quarterback after he spotted a supporter wearing this t-shirt with trump and brady on it together. emily: hillary clinton is in iowa today. and her husband is preparing to join her on the campaign trail. the former president spoke to a packed house at exeter town hall in new hampshire last night. that came after earlier stops in nashua and manchester, his first on behalf of his wife. clinton says broad-based prosperity is one of the major challenges facing the country and the next president. clinton: if everyone has a job and something to look forward to in the morning, it reduces the tensions and increases the hope in a country. emily: hillary clinton started a two-day "river-to-river" tour of iowa yesterday. randy: right now a worcester man is being held without bail

girlfriend's three-year-old son. the child hurt so badly he needed surgery. police say it happened on december 30 or 31. 23-year-old johnny sanchez will be back in court on friday for a dangerousness hearing. a west bridgewater cemetery that was the target of vandals wants to beef up security. more than 30 headstones were toppled last week at pleasant hill cemetery resulting in thousands of dollars in damage. some of the headstones dated back to the 1700's. our partners at "the brockton enterprise" report the caretaker of the cemetery is launching a fundraising effort to install security cameras around the site. emily: the feds may have to look elsewhere in their mission to track down whitey bulger's missing loot. that's because his longtime girlfriend is pleading guilty to contempt without making a deal to talk. catherine greig has been refusing to tell a federal grand jury whether other people helped bulger during his 16 years on the run. greig is already serving an eight-year sentence for conspiracy to harbor a fugitive

plymouth county and down to cape was flying. look at that flag blowing in the wind. it is the combination of the whipping wind and this bitterly cold air mass enter angting with the warmer ocean waters that makes these ocean-effect snow not seeing the snow. a very localized event with these ocean-effect snow bands setting up through plymouth county and down to the cape through the overnight hours. that is still happening right now. as many as 2.5 inches of snow fell. plymouth just over two. west wareham coming in over an inch. about a half an inch in scituate. and the snow is still flying but notice it is slowly kind of pivoting toward the east just a little bit so the steadiest snow right now is just south of you around the plymouth area stretching down toward bourne and falmouth and this band is shifting eastward a little bit. hyannis looking at visibility around two miles. and these bands are going to continue to pivot toward the outer cape moving toward chatham.

good around the wellfleet area and provincetown and truro as well. as we get into the afternoon, i think the intensity of the snow will gradually taper. as the wind shifts more to the northwest eventually pivot off shore. we do have a winter weather advisory up until 10:00 a.m. for these ocean-effect snow bands reducing the visibility making for slippery travel. i only expect another coating to up to a couple of inches of snow hours. look at these winds. they are strong. sustained 10 to 20 miles per hour across the area. chill this morning. look at these temperatures. single digits right now. it is three worcester to orange. six in beverly. just eight degrees in boston. when you factor in those strong winds, it feels like eight below in the city. and the wind chill as cold as 12 below in worcester so the coldest air we've had since last winter since late last february. these wind chill s are going to hover below zero until 9:00 a.m. but it is a short-lived cold blast. by tomorrow afternoon, we're going to be back up around 40 degrees.

morning as the wind chills hover down below zero. by noontime wind chills still in the single digits and teens. they will get no higher than the teens this afternoon. even though temperatures do come up into the 20's with mostly sunny skies outside of southeastern massachusetts. tonight not as cold. teens through around 20 degrees. i mention it warms up tomorrow. winds are going to start to shift around to the southwest, and that is going to bring in milder air for both tomorrow afternoon and again on thursday as well. we're going to keep it dry right around 40 degrees through friday but as we head toward the up. we may seattle bit of a light saturday. as warmer air invades with this next system a heavier batch-rain could be coming in on sunday. kind of a messy weekend on tap. let's get you out to the roads right now. following that breakings breakings in up to the north. rail specifically. this is a live look outside. we have issues here for the andover train because of an inbound haverill train that derailed early this morning. it was an out of service train. service is ending at lawrence

to get you into boston and keep in mind also it's about a 30- to 40-minute delay for anyone riding the haverill line this morning. we'll keep you post od that as the morning progresses. we're also watching a problem on rutherford avenue near the hood plant. an accident there shutting down two center lanes causing pretty heavy delays for you as well. north of town we're watching several problems for the trains and the roads. let's get to the maps and see what's happening. if you're traveling north of that camera shot out of methuen 93 south is slow as well. crash on the shoulder 93 south by montvale avenue. a multicar accident blocking a lane route 2 eastbound by main street as you make your way east traveling past 495. more delays on the pike 15 to 20, 495 to 128. heavy as well on the expressway. that ride almost 25 minutes blain brain. emily. emily: thank you, olessa. right now. an urgent warning in massachusetts over this batch of heroin. it's called "hollywood heroin," a potent brand of the drug and police say it's already killed several people.

the worcester district attorney says five people have died from the drug in just two days. as bad as this batch is officials are quick to point out that there's no "good" heroin. >> we attach that it's a bad batch but that would indicate that there's a good batch, right? i've never seen a good batch of heroin. heroin kills. emily: a suspected drug dealer is being held on half-a-million dollars bail in springfield after police there seized 9,000 bags of hollywood heroin. randy: showdown at a california starbucks. an angry mom pulls up to the drive-thru to confront an employee who went on a shopping spree with her credit card info. >> you know what you did, right? >> i'm sorry. randy: the young cashier charged more than $200 in groceries after she used a high-tech new method to forge the woman's credit card. they're called skimmers and they

>> it's very, very difficult to prevent somebody to have one of these magnetic stripe readers which are very small and very portable. randy: that starbucks cashier has been fired. emily: a look at economic headlines. asian markets are muted this morning after plunging yesterday. on wall street stocks had the worst start of the year since 1932. the dow dropped 276 points. the justice department has slapped volkswagen with a lawsuit over its emissions-cheating software. the lawsuit claims v.w. illegally installed the program designed to trick federal emissions tests. nearly 600,000 vehicles were sold in the u.s. with the software. that could lead to billions of dollars in fines against the german automaker for clean air violations. randy: 20 minutes after 6:00. if you want to get fit in the new year, you may want to ditch

through 8:00 or 9:00 this morning. down to eight degrees in boston. that is the coldest morning we've had since february 24. when it was down to two degrees so do make sure the kids are all bundled up at the bus stop this morning. wind chills will be below zero. the sun should be out in most areas. wind chills getting off the bus this afternoon still stuck in the teens. you can see the temperatures right now are running right around three degrees worcester to orange. six in beverly. there's our eight in boston. ten in plymouth. some 20's on the cape but the wind is blowing. that has created ocean-effect snow. you can see those winds sustained 10 to close to 20 miles per hour so that what is knocking back the wind chills. feels like 12 below in worcester right now. wind chill down to eight below in boston so you get the idea that wind chill is going to hover below zero through about 8:00 or 9:00 this morning. thenl only inch up gradually getting no higher than the teens as we get into the afternoon. the actual temperatures will come up into the 20's. still a good ten degrees below average for this time of year. you can see that northerly wind producing very localized bands

another accident causing some problems on 9 south. to crash is near montvale avenue so that back-up back into wilmington. there's that accident on rutherford avenue that we just showed you live. eastbound on route 2. several cars involved in a crash near acton near main street. the pike east right now about 24, 95 to 128. those delays on the expressway almost 30 minutes braintree into boston. emily. emily: thank you. now to the stories we're following right now on the eye. this morning president obama will announce expanded background checks for gun purchases. he'll also ask congress for $500 million in mental health care funding. randy: right now the mbta is considering two options to hike fares. one proposal calls for a system-wide hike on average of 6.7 percent; the other, an average of 9.8 percent. the hike would take effect in july. emily: right now malden police are investigating after a man was hit by a car at the corner of albion and salem streets.

no word on the victim's condition. randy: right now a dangerous mistake under investigation in cambridge. a little boy left alone on an empty school van. this happened yesterday morning outside of the poe booed owe school in cambridge. the driver was running 40 minutes late analogiedly left the van to escort another student to class. the boy's mother tells newscenter 5 somebody saw her son in the van and got help. >> the door was unlocked, and the engine wasn't on. he could have had a severe asthma attack. he's five years old. he doesn't know how to treat his asthma. todd: the school called the boy's mother nearly two hours later when he finally arrived at his school. sources tell newscenter 5 there are a number of safety complaints against dracut and wakefield-based s.p. and r. transportation. our calls to them went unanswered. the school says the district is working with the company to

the boy is expected to be okay. emily: a key piece of evidence in the pamela smart case may soon be released. "the union leader" reports a judge may reconsider whether to return the murder weapon used to kill gregory smart. the four teenage boys convicted in the crime have all been paroled. one of those teens provided the handgun and the getaway car. now his father wants the state to give back the revolver he turned in to seabrook police back in 1990. more than 40 victims have now come forward alleging sexual abuse at a prep school in rhode island. that's according to two attorneys representing the victims. the alleged abuse happened mostly in the 70's and 80's at the st. george's school. some of those victims and the attorneys will hold a press conference today criticizing the school's own investigation, detailed in a report last month. that report only identified 26 victims. randy: it's 6:35. new this morning. even as the mbta prepares to hike fares, new revelations about just how much the agency is spending on overtime. the eye's erika tarantal is here

erika: and the "how much" is just the half of it. "the herald" reports nearly half of the money the mbta spent on overtime went to workers who weren't working full weeks. that's because of a union rule that allows employees to call out sick then pick up overtime shifts later in the week. by the numbers, the "t" paid out nearly $32 million in fiscal 2015 to staffers who worked fewer than 40 hours a week. that's about 43 percent of the agency's overtime spending. the t's chief administrator says they started working on a new leave policy over the summer to address the issue. randy, emily? randy: a bright side to the patriots' game in miami. emily: tom brady's special move off the field. and a couple banned from being foster parents because of how they discipline their kids. the punishment considered too harsh. randy: and we continue to follow breaking news. commuter rail service on the haverhill line will is stopping at lawrence station after an out-of-service train derailed in andover.

siblings. she'll have another procedure today. emily: sunday's pats/dolphins game was a nightmare for most fans; but for one, it was a dream come true. this 13-year-old miami teen battling a rare abdominal cancer got to meet patriots quarterback tom brady before the game. ernesto has been undergoing chemo so this was a big pick-me-up. brady posed for pictures with him and even gave him his hoodie. the teen got some quality time with patriots owner robert kraft. he met other pats and dolphins teammates too. that's stephen gostkowski there, and he spent some time with the dolphins cheerleaders. perhaps the highlight. randy: indeed. president obama taking action against guns. the moves he's making on his own. and a car salesman kidnapped during a test drive. how he was able to escape. plus disaster avoided by inches. the conditions making for a close call.

commuter rail line right now. emily: we do have a crew there. we'll bring you information as we get it. todd will be live in just a few moments. first though cindy with the forecast. cindy: temperatures in the single digits. wind chill below zero and very little change until 8:00 or 9:00 this morning. bundle up. while we're dealing with the cold everywhere, look at this. snowing still from plymouth down to the cape. this is an area that has seen snow since yesterday. these are ocean-effect snow bands. they're going to continue for the next few hours. we do have a winter weather advisory up through 10:00 this morning here. watch for reduced visibility and some of those heavier snow bands and slipper erodes. i'm expecting an additional coating to maybe an inch or two fallen. that is now over two-and-a-half inches in kingston. on the vineyard 2.5. plymouth over two inches and falmouth now coming in with an inch of fresh snow from these ocean-effect snow bands. you can see them kind of lining up from plymouth all the way down to the vineyard. they extend toward the mid and

not really reaching into chatham and nantucket. they do so as these northerly winds will persist. this is 9:00 this morning. still going on. it will take until after lunchtime before the winds relax and begin to shift to the northwest. that snow will be diminishing. look at the winds sustained 10 to around 20 miles per hour. that's what's causing the ocean-effect snow. and also knocking back these wind chills. yes, sub zero. it feels like 12 below in worcester. it feels like eight below in boston. that wind chill is going to hover below zero through 8:00 or 9:00 this morning and get no higher than the teens through the afternoon. but as you see the sunshine there. the skies are clear. north and west of boston right now. three degrees worcester. it is just six in nashua. temperatures come up into the 20's this afternoon. but you wouldn't know with that wind blowing it will feel quite a bit colder. cold is with us through tomorrow morning. by the afternoon the winds begin to shift around to the south and west. so just like that, we are back up over 40 degrees. lower 40's wednesday. sunshine still in the 40's on thursday. emily and randy. randy: cindy, thank you.

following at this hour. a train derailment follow service. emily: and todd with what we todd: good morning. this is causing major problems (no audio). olessa: here's the information you need to know. there was an early morning train out of service that derailed. because of that derailment there is now service suspension inbound haverill ending at lawrence. from there you can pick up a bus between lawrence and andover. from there you can catch a train into boston. keep in mind that is causing delays of about 30 to 40 minutes we're going to keep you posted on that throughout the morning. we're also watching some minor northbound delays because of an earlier disabled train. everything else is running on schedule. right now the zakim bridge is getting heavy. also the leverett connector, you can see that volume picking up as you travel into boston. let's go to the maps and see the rest of your ride as you travel north of town. watching a crash involving an overturned car. this is 495 southbound by route

south. heavy from wilmington all the way down to right around spot pond. there's an accident on the shoulder by montvale avenue and then we're watching a crash that is still taking out a lane on plant. accident, several cars involved in an accident blocking one lane and heavy delays back to 495. 128. and then you've got that volume on the expressway with the disabled car northbound by savin hill. braintree to boston is almost a half-hour. randy: today, president obama makes a major speech announcing new actions on gun control. emily: the eyeopener's erika tarantal is here with executive moves the president is expected to make. erika: president obama is taking executive action in an effort to curb gun violence. he's set to announce the details today. expect expanded background checks at gun shows and online. some 200 f.b.i. examiners would be hired to process the checks. the president also plans to ask congress to approve $500 million to improve mental health care.

we're live at j.f.k.-u mass station. doug meehan, wcvb, newscenter 5. randy: doug, thank you. a cambridge mother is demanding answers after her five-year-old son was left alone in a school van outside the peabody school. mother: i think it was a mother that saw him. that's what he's telling me. that a mother saw him in the car crying and went into the school and got a teacher to come out and get him. randy: the boy was left for an undetermined amount of time monday morning while the driver, who was running 40 minutes late, escorted another student into the school. the boy's mother got a call nearly two hours later when he finally arrived at his school, maria baldwin elementary. s.p. and r. transportation, went unanswered. emily: a man is suffering serious injuries after being hit police tell us the victim was hit at the corner of albion and

the driver did stay at the scene and has not been charged. no word on the victim's condition at this hour. randy: "the boston globe" is considering new steps to solve a delivery disaster. thousands of subscribers haven't received a newspaper in over a week. "the globe" is reportedly thinking of bringing in a second company to help the new west coast distributor it hired to take over home delivery. over the weekend reporters and editors volunteered to deliver the sunday paper themselves. emily: police are warning homeowners in marblehead about overnight break-ins. two homes were broken into on londonderry road saturday night into sunday morning. the people inside were asleep at the time. nobody was hurt, but the homeowners reported several items missing the next day, including electronics and prescription medications. the state's highest court has ruled in support of d.c.f.'s decision to stop a couple from becoming foster parents because they spanked their children. gregory and melanie magazu say they use corporal punishment on their biological children but would not spank any foster

the magazu's said d.c.f.'s decision infringed on their constitutional religious rights. but the supreme judicial court ruled for d.c.f. saying the couples' rights are outweighed by the need to protect foster children. randy: a state representative in new hampshire is trying to lower the drinking age to 18. the seabrook rep. filed a bill that would allow 18- to 20-year-olds to drink anywhere as long as they were accompani by someone over the age of 21, but they could not consumer hard liquor. he says the bill would help prevent underage kids from drinking irresponsibly. >> do you think i chose to be gay? ben carson: that's a long conversation. randy: republican presidential candidate ben carson gets confronted after a town hall in new york. a young attendee asked him about his stance on homosexuality. after his response, the attendee told carson off using an expletive. emily: the mother of the so-called "affluenza" teenager is expected in court today. tonya couch is charged with hindering apprehension of a felon-- her son, ethan. officials are expected to

texas. ethan couch remains in custody in mexico after fleeing there from charges he violated the probation he was granted after killing four people in a drunk driving crash. randy: a car salesman gets kidnapped on a test drive. two men took a dodge challenger for the test run in houston yesterday and stuffed the salesman in the trunk. he was able to get out using an emergency latch and was attacked by the men who had a gun. police say he wrestled the gun away and the suspects took off in the car. the salesman was picked up on the highway. emily: a close call for those living in this apartment complex in oregon. a tractor-trailer lost control on an icy road and nearly slid into the building. it slipped down a hill a few hundred yards just missing a window on the first floor. nobody was hurt. the celtics snap out of a two-game losing streak against the nets in brooklyn. the c's leading by 15 after the first period last night. the celtics had five in double figures.

points. isaiah thomas added 19 and 7 assists. the celtics win 103-94. randy: a special homecoming for some baby girls from texas. identical triplets addison, kinsley, and savannah harris were born on december 1. they'd been in the neo-natal unit since and finally got to go home yesterday. the odds of having identical female triplets can range from one in 60,000 to one in two million. emily: pretty incredible. pretty special. randy: everybody looks happy there. emily: a pretty big nightmare for the commuter rail this morning. randy: let's check in with olessa stepanova. olessa: we're watching those problems continue for the haverill line. inbound service right now is ending at lawrence where buses are being provided from lawrence into andover. that's because of an early morning train that derailed. it was an out of service train so no one was on it. that derailment causing some problems. from andover you can get a train into boston but they are running

schedule. heading outside a live look outside from sky 5 where we have pictures of that commuter rail station right now where no trains are going in and out but buses are being provided. folks are waiting on the lat forms. as far as the roadways go we're watching problems as well. 495 south at 125 in haverill. overturned car blocking at least one lane. heavy delays on 93 south from right around andover all the way down to montvale avenue where an accident is on the shoulder. still watching this crash here at rutherford avenue on the hood plant. a multicar accident is blocking several lanes. it is a cold day to be stuck on the platforms. cindy: the sun is up at 7:13. look at the temperatures though down to eight degrees right now. the coldest we have been since february 24. and it's not just the temperature. that wind out of the northwest sustained around 13 miles per hour. knocking back the wind chills so it does feel like eight below zero. feels like 12 below out in the worcester area and actual temperatures are running had the single digits.

there are some 20's on the cape this morning. but that's where we have some snow flying as well. but sunshine in boston pretty much all day long. by noontime, it's only 20. wind chills get no higher than the teens this afternoon. even the high temperature gets up to about 25. we'll see some lower 20's out through worcester county today. so we've got sunshine in most areas. the exception is right here in southeastern massachusetts where we have ocean-effect snow. you can see bands stretch from plymouth down toward the vineyard across the cape as well. these have been at times persistent. and now they're starting to shift west again back into plymouth county. so we are going to be watching these bands of snow for the next several hours anyway. i think once we get about noontime notice how things start to taper off. as the winds shift more to the northwest this afternoon, this will wind down. do watch for slipper erodes, reduced visibility. winter weather advisories up to at least 10:00 this morning down this way. another coat to go a couple of inches possible. sunshine, we're back into the 40's tomorrow afternoon. and things may get a little bit messy this weekend as we have a system approaching from the
