trial. many procedural but others reveal details not released during the trial. >> one of the motions just released, defense is arguing that tsarnaev's statements from the hospital bed should be admissible saying he was severely injured and was interviewed on and off by the 36 hours. some of his statements were taken out of context. we do not know yet because controversial documents are still under seal exactly what he said during that interview. reporter: the defense argued that lawyers were turned away by f.b.i. agents who refused to accept a leader to mr. tsarnaev notifying him of counsel's availability. he repeatedly asked if my brother is alive. i know you said he is. is he alive? the defense took issue with the f.b.i.'s decision not to record audio

no notes have been released but the defense said agents questioned tsarnaev about how and where the bombs were made. his beliefs about islam and u.s. foreign policy as well as his sports activities, future career goals and school history. the newly released documents also include search warrants of tsarnaev's dorm room. police officers collected these items including a sample of a reddish brown powder in the presence of the f.b.i. whom they had invited into the room. items included a pizza box, a notebook, a book called muslims in the west, articles of clothing, a book called soldiers of god, personal documents and school records. in one of the documents, the defense's ongoing concerns about publicity in this case is revealed. they talk about asking for a delay or a mistrial in the penalty phase because of all the publicity surrounding the second anniversary of the boston marathon bombing. live at the federal courthouse, wcvb, newscenter 5. >> the final chapter in the

and west and the air is chillier to the north and west. i do expect it will be cooling down some. if you're going to be out later on it could already be in the 20's in some of the northern and western suburbs. still above freezing in boston. starting out your day tomorrow in the 20's, so it will be a little colder than the past few. the afternoon, the 30's to around 40 degrees. but here's the thing. there is a storm that's trying to develop over the southeast. the question is how close does it come to us? most of it stays offshore but it could be a close call and could get interesting by friday. we'll talk about that in a little while. >> two suspects arrested after dangerous encounter with norwood police. an officer is recovering after getting knocked to the ground by a fleeing pickup truck. sarah has details right now, the incident that sent the officer to the hospital. >> shredded rubber litters the roadway after state police used sticks to puncture the tires of fleeing suspect's vehicle. the driver, 29-year-old steven grant of norwood wanted for several

charges after an overnight encounter with police. >> we know they were doing drugs. >> officers stopped he and his three passengers around 2:00 a.m. but he wouldn't get out of the pickup truck and that spshgd a struggle. >> he was able to reach in and put the truck in drive and accelerate it while the officer was still engaged. >> as he turned out in an attempt to get away he was city engaged. >> a high-speed chase followed into several surrounding communities. the chase ended when grant's pickup with deflated tires crashed into a pole. he and one of his passengers, 53-year-old kelly, suffered minor injuries. she, too, was arrested on outstanding warrants. >> people resisting the police is a dangerous combination. people need to submit when being arrested. we're lucky that he didn't roll under the truck and the truck didn't go over him. >> the patrolman who was injured has not been identified. he suffered minor injuries and did go to the hospital but he told the chief that he's going

>> in norwood, sarah, wcvb, newscenter 5. >> major settlement awarded to a fall river man arrested for videotaping a police officer repeatedly swearing while on the job. george thompson has been awarded more than $72,000. he warded a fall river police officer loudly and repeatedly cursing on his cell phone while working traffic detail in front of his home. the officer threatened him, arrested him and then took his cell phone and deleted the contents. charges were later dropped and thompson filed a civil suit. the system ettlement was reached just yesterday. >> law enforcement representatives took their fight against opioid addiction to washington. they spoke in favor of the comprehensive addiction and recovery act which is currently being considered by congress. it would sight opioid addiction by clearly stating the dangers of overprescribing drugs and it would start with america's

>> we've got to get into the schools. we've got to get the prevention focused on opioids, prescription drugs, and also heroin. >> the bill before congress also expands the availability of narcan to first responders and law enforcement. state police have arrested two people for heroin trafficking in auburn. this picture is seen from the evidence room. troopers made the bust last week. they pulled over a car for speeding and discovered 75 grams of what's believed to be heroin. the driver and passenger were arrested and are being held on bail. >> the man known for being outspoken thinks drug dealers should be beheaded in public. speaking on a local radio show, he said he thinks the state has gone soft on drug dleerls and supports bringing back the guillotine. the execution should be done in public. he's the second republican that says a new proposal to give dealers a minimum of four years in jail is not enough. people who sell drugs should pay

lives. four massachusetts state senator james has admitted to violating his probation. a probation ordered after he pled guilty to sexually harassing women. he'll pay $1,000 in court costs after traveling to thailand for 11 days without permission. the money will be donated. his lawyer says that his client was volunteering at a school in burma when he traveled to thailand for medical treatment, treatment that was not available in burma. >> a strong year for home sales in the bay state. the warren group releasing new numbers showing sales up more than 10% last year compared to the year before. that's roughly 53,000 single-family homes sold. medium prices were up almost 5% december to december. >> next on newscenter 5 at 5:00, a beloved principal killed while trying to save the lives of her students. >> the investigation, freak bus accident that took her life. >> 5:30, we have new information on the apparent murder suicide, relationship between the victim and her killer.

>> also had at least a 2.5-mile path. more. reports that have come in related to it. you. there are a couple. let's give you an example. this is one of several reports that came in. power lines down in an industrial park, so that's what was going on there. also, there was vehicle damage. we know of at least one injury. there is still active weather the most active is actually on the west side of florida around fort myers at that particular time. as storms moving eastward, across the state. 42 degrees in boston. not too tough to take for late january. westerly wind, a little gusty. 30's around worcester and it's topped below freezing. these winds are importing

west so you will feel the difference if you're out day tomorrow. a little chillier than the last but still nothing unusual. in fact, if anything, still a trifle bit above average for this time of year. the winds will be down by morning somewhat. those are your high temperatures to expect tomorrow. not that different than the now, we've been talking all along that we knew this moisture that's caused a severe weather down in the southeast would spawn a storm and it would become an ocean storm. the question has always been how close to us will this storm track? the bulk of the storm, as you can see, stays out to sea but this system back here represents a very strong disturbance at high levels of the atmosphere and even though the main storm stays away the two can interact in such a way to allow a period of precipitation to move into our region along about friday. it's possible. it may just be snow flurries, borderline temperatures, rain showers, but i can't rule out there could actually be a steady

that's what we'll be following for friday as the moisture tries to brushes the cape with rain overnight tomorrow night and then possibly in eastern mass, some snow showers or rain showers for a portion of friday. after that, it will be chilly for overnight friday into saturday but that chilly weather is not going to last that long. now what happens is, we do turn, as i mentioned, a little bit colder into saturday but look what happens. it turns milder again for sunday and beyond. so mild, that i'm actually forecasting high temperatures to be 50 or higher, possibly for a four day stretch that could begin on sunday. how about that? sunday, monday, tuesday, wednesday, that not only would qualify as a january thaw but that would take us actually into the start of february. so it does look like january will end warm. february will start warm, but i do see signs a bit down the road that it will turn colder before too long in the month of february. >> i hope those are stop signs that you see down the road to
