rejecting a plea from convicted killer gary lee sampson to have evidence excluded from his upcoming trial. sampson had pleading guilty to carjacking and killing two massachusetts men in 2001. however a u.s. district court judge ordered a new sentencing trial after finding out that a juror had lied about her background. the new trial is slated to begin september 14. new at 4:30: another one of the state's most wanted sex offenders has been captured in new jersey. miguel villegas was wanted for failing to register as a sex offender and was listed as a high risk, level three offender. history, including a 2003 conviction for child rape. he's the second most wanted sex offender caught this week. maria: lawyers for the teenager convicted of murdering his danvers high school teacher are trying to prevent a second case from going to trial. 17-year-old philip chism was convicted earlier this year in the 2013 murder of colleen ritzer. while awaiting that trial at a detention center in 2014, chism allegedly attacked a female

next month with prosecutors and a judge, to come up with an agreement before a trial. ben: sky 5 over a deadly crash in franklin. a driver killed after a pickup truck rolled over off the road and into the woods this happened on route 495 north on the bellingham line. it's not clear what went wrong but the crash backed up traffic for miles around 6 this morning. the victim's name hasn't been released. a bill advances to make duck boat tours saf a deadly crash in april. maria: allison warmuth was killed after she was hit by a duck boat while riding her moped. the state senate has now advanced legislation pushed by warmuth's parents to mandate two staff members on each tour. the bill adds new penalties for violations of safety requirements, including having blind-spot cameras and proximity sensors. boston duck tours has already started making changes.

a new threat in the fight against opioid abuse. officials say a drug used to sedate elephants is suspected in several overdoses in several states. ben: authorities say they've found carfentanil mixed with or passed off as much weaker heroin. the drug is said to be 100 times as potent as fentanyl. maria: if you're like many people you sit all day at work. but new research shows even one hour of exercising could improve your health. scientists combed over data from more than 1 million people and found it takes 60 to 75 minutes of moderate intensity exercise to undo the damage of sitting for at least eight hours a day. dangerous as being obese or smoking. ben: using your ez pass for more than just driving along the pike. maria: the report showing that same technology could make life a little easier. and the powerball jackpot going up again.
