we have some video in overnight. police say the teen was in a car in front of 25 gavin way just before midnight. that is when the shots rang out. he was hit. we talked to police at the scene, and they're optimistic about his condition. >> he is in surgery. he was shot a few times. according to the doctors, there is a good chance he may survive here. doug: police say the victim was just shy of his 16th birthday. again, no arrests have been made in this case. police are asking anyone who saw anything to please come forward. those tips can be kept anonymous. we'll bring you new information as we get it. doug meehan, wcvb newscenter 5. randy: all right, doug, thank you. right now, state police are investigating the drowning of a man on cape cod. his body was pulled from the joshua pond in osterville around 8:40 last night.

said they couldn't find their father. today, friends and family will say a final farewell to a young woman whose murder rocked a quiet community. the eye's sera congi is in leominster where this morning vanessa marcotte will be mourned and remembered. sera: randy, the 27-year-old woman touched many lives in many communities. her funeral will be held here in leominster where she grew up and hundreds of people turned out for a wake last night, including a bus carrying mourners from new york, where vanessa marcotte worked for google. she was home visiting family out on august 7 when she went out for a jog not far from her mother's house in princeton. sources say marcotte was found naked and burned. police have been pouring over hundreds of tips in the case. and 5 investigates has learned they are testing dna from a possible person of interest.

marcotte's life. the funeral begins at 10:00 a.m, she will be laid to rest in nearby westminster. sera congi, wcvb newscenter 5. >> i was on the ground, and i know they were kicking me in the side, kicking me on the head. emily: right now, police are investigating the brutal beating of an elderly man inside a fall river hotel. he is calling it a vicious witness says that's not the case. 79-year-old al marceau says he came out of his hotel room early sunday morning to ask a group of men to quiet down. he says they pounced on him , kicking and punching. marceau has a bloody black eye, and cuts on his head, face, and leg. >> it was awful, and i said "please, he is 79. he had an operation and while ago. please do not hurt him." they could care less. they were like animals. emily: three men are charged with felony assault and battery.

live in leominster where vanessa marcotte will be laid to rest today. sera? sera: emily and randy, it will be an outpouring of grief and love for 27-year-old vanessa marcotte as her family laser to rest today. police continue to investigate the murder that has shaken her family and her community. marcotte's body was found in the woods in princeton sunday night a short distance from her mother's home. some residents in that community are concerned a townwide alert state police responded last night, saying the town was directed to issue that alert after police assets had been mobilized. but they are trying to reassure residents that the response was swift and significant after the initial missing persons report. they say it included patrols from princeton police and three state police barracks, commanders from troop c headquarters, k-9 units, our air

the situation." both the clinic and the public health department are investigating. mrs. perry is now in the care of a different medical team. emily: 5 investigates with a bombshell in the case of a man who has spent more than 30 years in prison for a crime he says he did not commit. the judge who presided over fred weichel's original trial tells 5 investigates that he should get a new one. weichel was convicted of first-degree murder in 1981 for the shooting death of robert lamonica in braintree. the conviction was largely based on the testimony of a teenager when he says he saw weichel fleeing the murder scene. retired superior court judge robert barton says judges instruct juries differently now on eyewitness identifications. randy>> do you think fred weichl would be found guilty today? >> i do not think so because of the added instructions, the
