>> good morning. it is wednesday, september 21. we are following breaking news on the eyeopener right now. a deadly police shooting leads to violent protests in north carolina. the new details into our newsroom. and injuries to officers overnight. a life after being hit by a car in brockton. the tragic crash police say was likely an accident. a gun conviction tossed in boston. the bombshell ruling and what the police commissioner has to say about it. we'll get to those stories. first, i want to check in with cindy and a look at how the day is starting. >> we're starting out on the muggy side and very mild for this time of year. 70 degrees in boston right now. that dew point is still in the mid 60s.

humidity. that is going to be the case for the next two hours. notice the winds out of the west right now and there's drier air that will filter in. fog along the coast and cape. visibility is running about a quarter mile. so heads-up. second morning in a row you may encounter fog. clouds are lingering in southeastern massachusetts, but high pressure -- as the to drop. temperatures holding around 70 through 8:00 a.m., then the 80s this afternoon, 80 and 85 away from the south coast and the cape. >> good morning, everyone. so far the roads are fairly quiet. a live look outside. the pike eastbound heading to the top of the screen. we have overnight road work. the construction picked up nice and early.

ride. construction picking up on the expressway near the o'neil tunnel. route three looks good. 128, construction in place by highland avenue. that should clear up shortly. north of there, more construction on 128 south from route 2. we're expecting trains and buses the start on schedule. >> protests in charlotte, north carolina after the deadly shooting of a black man by police officers. at least 12 police officers have been hurt. the eyeopener's erika tarantal tracking the latest developments. >> randy, good morning. one of the officers was hit in the face with a rock. it was just a short time ago that protesters disbursed from a high. police using tear gas to break up the crowd angry over the

contents of stopped trucks on. police are guarding local stores that were looted. it was around 4:00 in the afternoon yesterday when police shot and killed 43-year-old keith lamont-scott. the officers saw scott get out of the car with a gun, get back in and exit once more. that's when at least one officer fired. >> there is something going on across this nation t throwing of water bottles and destroying city vehicles, i don't condone that by no means. but as far as my child, my nephew, i'm worried about them. something has to be done. >> the officer is on administrative leave. this comes after the fatal police shooting of an unwarmed black man in oklahoma friday.

bombings in new york city and new jersey. the criminal complaint alleges that ahmad khan rahami had been planning it for months. the 28-year-old allegedly wrote in his journal, you continue your slaughter against the mujahidean in afghanistan, iraq, syria, palestine. police say rahami has been purchasing bomb-making materials onlinein devices in new york and in new jersey. >> right now boston police are investigating a deadly shooting. the eyeopener's sera congi is at boston police headquarters with questions surrounding the case this morning. >> emily, we don't have a lot of details or information at this moment. but here is what we know. the shooting happened around 8:00 last night on downer avenue in dorchester. residents there reported hearing

was shot and taken to boston medical center and is reportedly being considered a homicide. investigators remained on scene until about 9:30 last night. at this point, we're waiting for an update on whether any arrests have been made or exactly what the circumstances were around that shooting. once we get more information, we will pass it along. live at boston police headquarters, sera congi, wcvb newscenter 5. >> a toddler is fighting for his life after he was struck by a the eye's antoinette antonio is there this morning. antoinette had new information on his condition. >> it was a tragic scene, what's being called a tragic and horrible accident. that 2-year-old boy suffering from critical injuries after he was bit a car. the boy's name is neyden tavares. he's being treated at mass general. investigators telling our partners at the enterprise that he likely suffered a brain hemorrhage. it happened around 7:00 last night when the toddler was

his family's house on market street. his frantic parents rushing to his side as witnesses stood in shock. >> screaming at first. then ran back, you see the dad coming -- i don't know if it was the dad. she had her hand on his head. >> looking at the baby, seeing if it was ok. at point? >> neighbors say the driver was clearly distraught. police talked with him and they looked through his cell phone. they say there's no evidence that he was texting while he was driving. he tells police that he never saw the toddler, that he only heard the accident happen. antoinette antonio, wcvb newscenter 5. >> boston's police commissioner is responding to a bombshell ruling from the state's highest

racial profiling. the case began in 2011 as police searched for a break-in suspect. they attempted to stop jimmy warren based on a vague description when warren ran off. he was arrested after police found an unlicensed gun. now the court rules that running from police does not necessarily make someone a suspect. the police commissioner says the justices used what he calls a biased aclu report in their decision. >> i'm a little disant report that didn't take into context who was stopped and why. >> police say they do not use racial profiling, but target what are statistically problem neighborhoods. the suffolk county plans to request a rehearing. excessive force claims tossed for a boston police officer. >> video and witnesses, police say, clears him of wrongdoing.

we've been running really warm and sticky the past couple of days. we had an 80-degree temperature over the weekend. we'll see a few more of those the next couple of days. i know it's september and fall begins tomorrow, but we're running above average by more than three degrees for the month. that's going to continue the next couple of days. here's the fog we were mentioning. visibility about half a mile in the cape. you can see elsewhere quarter-mile visibility toward orange and the connecticut river valley as well. once again this morning, we are dealing w temperatures are very warm to start. 70 in boston. upper 60s in the cape, the south shore. north shore, mid 60s. 63 in the worcester area. any fog this morning is going to be burning off fairly quickly. notice it's a blend of sun and clouds through the afternoon, but we're getting into 80-degree temperatures through the afternoon. it's going to be a warm one. you see the clouds thinning out in southeastern massachusetts. we've got moisture to our south

farther away as this front to the west drops in. it is the leading edge of less humid air. the dew points are more comfortable to the west. but it takes time to work in. you're heading out this morning, it is pretty uncomfortable. by 9:00 a.m. you'll notice it sticky. but by lunchtime you'll feel the change as the humidity goes down. temperatures go down with less humidity. 50s to lower 60s. you can tonight. refreshing air coming in. clear to partly cloudy by the time you get to the cape. less humid air with us into tomorrow as well. high pressure sitting right on top of us tomorrow means another sun-filled day. tomorrow we're into the 80s. not what you expect on the first day of fall. it official arrives tomorrow morning at 10:21. if you're headed to the game,

game and then temperatures fall. by friday we're in the upper 70s to near 80 degrees. we'll be tracking the front. this cold front has moisture associated with it. but it loses a lot of it as it drops southward. it's really the risk of a shower or two friday night into early saturday morning. behind this front, wow, look at the drop in temperatures. from the 80s the next couple of days into the 60s this weekend. jet stream is the south. that is going to bring the coolest air. on monday, look at the temperature monday morning in the 30s. maybe the potential of frost across parts of new england, not necessarily here. so big changes on the way. maybe a little bit by monday morning. >> ok. thank you, cindy. so far we're not dealing with that. a live look at the expressway. northbound heading to the top of

a couple of construction projects. construction wrapping up on the expressway by the o'neil tunnel. road work clearing on 128 by highland avenue. as you travel south of route two. trains and buses are expected to start on schedule. host: a boston police officer be force after this confrontation. the officer wearing red was off-duty. the officer is edward barrett. he has knee on top of milton gurin. he chased gurin after he thought gurin broke his windshield with an umbrella. this video shows gurin fall to the ground on his own and it never shows barrett smashing his head or tackling. that's been the claim. gurin was let go after the

was intact. he's represented by the aclu. the commissioner says he will face discipline because he did not contact a supervisor after the confrontation. >> we're five days away from the first presidential debate. hillary clinton will give an economic speech in orlando, florida, this afternoon. donald trump will host a rally in ohio. that's as trump fires back against a report that he used his charitable foundation to settle business trump used more than $120,000 of the foundation's money to settle a dispute over a large flagpole. another case involving one of his golf courses was settled in a similar manner. in a statement trump's campaign says the account is full of errors and the foundation did not make improper payments. >> massachusetts senator elizabeth warren takes on the c.e.o. of wells fargo on capitol

bullet or from falling off the fourth floor of a parking garage. police in connecticut say there was an outstanding warrant for this man. they say when they confronted him at the casino yesterday, he pulled a gun and he was then shot by an officer. >> police are investigating vandalism to a memorial in milton dedicated to a girl who died in the holocaust. fred manasse's baby sister was one and a half when she died on monday, staff noticed that the sculpture was missing. >> today the head of the company that makes epipen is expected to defend the spike in cost for the device. the c.e.o. will give testimony to a house oversight committee.

africa meandering out in the atlantic. this doesn't look like a threat to any land areas. we have tropical depression carl. the winds are down to 35 miles per hour. but this one is drifting northwestward and likely it's going to strengthen. look at bermuda and look where this is going to be during friday night into early saturday. making a close pass and then it will likely strengthen more, perhaps a hurricane, as it goes by bermuda and into the north atlantic. doesn't look like it in the meantime, we've got above average temperatures. 71 is our average high this time of year. next couple of days in the 80s. but a dramatic drop coming as we get into the weekend. cooler temperatures by then. but warm now. still sticky out there, less humid to our west. that is going to filter in slowly as the day wears on. you can see how comfortable it is this way. that will be here by later today. it turns less humid today. temperatures going to about 84.
