>> from boston's news leader, this is wcvb newscenter 5 at noon. thanks for joining us. erika: here's a look at some of the big stories making headlines. this brockton toddler fighting for his life after being hit by a car last night just feet from his home. emily: police investigating a fatal shooting in dorchester. the victim is a man in his 20's. erika: the deadly shooting of a black man in north carolina but violent protests in charlotte overnight. police say the man was armed and

emily: ray raimundi is tracking the investigation which started as the search for another man. ray: tensions boiling over through the night on the streets of charlotte. protesters outraged igniting fires. shutting down a major highway and attempting to overturn this police car. even looting stores. over a dozen officers injured. the mayor of charlotte pleading for calm. to please wait until all information is available. ray: police said there were searching for a suspect with outstanding warrants yesterday when they saw 43-year-old keith lamont scott who they were not looking for. authorities say scott got out of his car holding a gun. >> the officers gave allowed, clear, verbal commands to drop the weapon. as the officers continued to yell at him to drop it he

officer bentley breton fire. scott later. at the hospital. scott family gives a different scenario. >> they said hands up. he's got a gun. that's it. he had no gun. ray: the police officer who fired the fatal shot is on paid leave. the chief said the officer who fired the fail shot was not wearing a camera. erika: this brockton toddler is fighting for his life after being hit by a car. antoinette antonio is life austin worship spoke to the boy's grandfather today. antoinette: at last check that little boy was in critical condition. we spoke to his grandfather this morning and he says his grandson

at this point he is still holding on. two-year-old neyden tavares was with his mother when he darted into the middle of market street just steps from the home. brockton police say that is when a silver toyota camry hit him causing life-threatening injuries. familymembers comforting each other last night including the boy's grandfather. avelino da vega says the last he heard the boy suffered swelling to his brain. >> so-so. i don't know. my daughter says he cannot move or nothing. neighbors say the crash boot -- the crash through the boy several feet. >> out of nowhere the car i just hear a thud and look over and there is a baby in the street.

>> i hurry her and that i hear him screaming and crying. antoinette: police look through the man cell phone but there's no evidence he was texting. in fact he told police he never even saw the child. he just heard the moment of impact. all indications at this point are that this was a tragic accident. that driver has not been charged or cited. the investigation emily: breaking news. the fbi is asking for the public's help in finding two men who took important evidence in the new york new jersey bombings. the men were seen removing pressure cooker device from a piece of luggage on a manhattan street and walking off with the luggage. the fbi wants to talk to these men. they want to recover the luggage area more on the investigation in a few minutes.

court heard arguments on the use of a murder victim's personal life during trial. lindsay marriott was raped and killed four years ago. her killer wants use details of her life as grounds for his appeal. those details were ruled inadmissible. the summer the court ruled the rape shield law does not apply to appeals. then after supreme court took the matter under advisem a worker at the acton bucks borough schools main office says it was in the woods behind the main campus on charter road. everyone was brought inside while environmental police in crews arrived on the scene. help for farmers impacted by cold weather earlier this year are eligible for federal assistance. farmers can apply for low interest emergency loans to make up for the losses caused by frost and freezes from february through early may. they have eight months to apply
