emily: good morning. it is tuesday, october 25th. i'm emily riemer. randy: and i'm randy price. now 4:30. we're following breaking news on the eyeopener. a teenage fugitive has been captured overnight. where he was picked up and the charges he's going to be facing in court today. >> i was supposed to have emily: heartbreak after five people are killed in a wrong-way crash. the new details about those victims. randy: a push to investigate possible civil rights violation on the t's commuter rail. the decision that's facing extra scrutiny this morning. emily: we'll get to those stories. first checking in with cindy. a cool start today and cool the rest of the week. cindy: yesterday was the warmest day of the week. we're starting in the low 40's. clear skies.

you can see some of our colder suburbs on the north shore running in the upper 30's. worcester down to 35 right now. got 30's around the norwood area and toward the cape, low to mid 40's this morning. mainly clear skies. we've got high pressure nosing in from the west, but a storm hanging around to our north. in between, it is a chilly breeze today. it's going to be tough to warm up despite the fact we will see a good amount of sunshine. temperatur 7:00 a.m. should be around 40 degrees at 8:00 a.m. by lunchtime, it's only in the mid 40's. upper 40's the best we do today boston to the north and west. then we may briefly touch that 50-degree mark on the cape. it's a chilly day with sunshine. a freeze watch for tonight. we'll break down how cold it gets tonight and the rest of the week. olessa: live look outside here. starting things off with a check of the pike by alston-brighton

screen. traffic is nice and light. there's a bit of overnight construction left over. heading into boston, you're in pretty good shape. south of town, 24 looks good. route 3. the expressway is quiet. no issues on 95. 128 construction still in place right near kendrick street. the pike looks good. heading north of town, everybody getting by at the speed limit. expecting trains and buses to start on schedule. emily: breaking overnight, this 16-year-old fugitive is under arrest charged with july shooting in fall river. jayden smith was number one on the city's most wanted list. he's one of two people charged in the plain street murder of jerrod cohen. he was arrested just before midnight in fall river and is expected in court today. randy: right now three people are hurt after this rollover crash in revere. a 17-year-old driver lost control on route 145 just before 8:00 last night.

were taken to the hospital. one passenger with serious injuries. two other people in the s.u.v. were not hurt. >> i was supposed to have a son like him. for 20 years he'd tell me he loves me, dad. he was just a great kid. emily: heartbreak after a horrific crash on 495 in middleborough. four young men and a wrong-way driver all killed and want to know why. randy: doug meehan in middleborough with the search for answers. doug: it's just an awful story out here. state police still trying to figure out how that driver got on the wrong side of the highway, that as we are learning more about the victims. kraig diggs' father identified his son as one of the victims as well as two of the boys as cousins and friends. they were headed to college, back to college in central mass monday morning after visiting

going the wrong way on 495, crashing into the car that those young men were in, and it was head-on. balloons released at a vigil in harwich last night honoring the victims, the cousin of the three paying tribute. >> they were three different unique personalities, and i just feel like they can never be replaced. >> they're going to live with us forever. they're in our hearts. they're in our minds. it's sad. doug: family members have jordan fisher. the names of the others expected to be released officially later on today. we're live in middleborough this morning, doug meehan, wcvb newscenter 5. randy: thank you. right now, the driver charged in a deadly crash at a newton restaurant is facing a new lawsuit from the family of one of the victims. the eye's sera congi is at that restaurant, sweet tomatoes, with the latest developments. sera: randy, the crash happened in march. you can still see the front of the store is boarded up.

and now one of the victims, one of the -- the husband of one of the victims is now filing a wrongful death lawsuit. eleanor miele and gregory morin were both killed when the s.u.v. plowed into sweet tomatoes. seven others were hurt. our media partner wicked local reports miele's husband george is seeking compensation from the driver bradford casler. the lawsuit seeks damages for alleged negligence and compensation for personal loss. years or more to resolve if it is not settled. the driver, bradford casler, is facing criminal charges. he pleaded not guilty to motor vehicle homicide and due back in court in december. emily: sera, thank you. new this morning, congressman michael capuano wants the government to look into whether the company that runs the commuter rail in boston violated civil rights laws. this comes after a decision by

the fairmount line. fairmount runs through hyde park, mattapan, roxbury and dorchester. capuano says intentionally moving the trains to, quote, more affluent communities raises questions of economic and racial injustice. a keolis spokeswoman tells "the globe" they work closely with the mbta to make sure they're complying with civil rights laws. randy: commitment 2016 just two weeks until election day. today a big effort on both campaigns to push thei to voters. erika looks at the day ahead. erika: the campaign focused on battleground states. bill clinton, chelsea kiln, elizabeth warren and vice president joe biden campaigning for hillary clinton today. mike pence has two stops in ohio. eric trump will make several stops in new hampshire. trump and clinton both have rallies this afternoon in florida. trump in florida yesterday

randy: all right. still waiting for a freeze in a lot of communities, which we'll be getting probably tonight. cindy: tonight and tomorrow night into thursday morning.

it's hard to believe. it seems like just last week we were 80 degrees. emily: was it just last week? cindy: it was last week we were 80 degrees on wednesday. what a change now that we are dealing with. you can see there is some cold right now from the great lakes here into new england. chicago 39 this morning. our air is actually coming up from canada. and there is this core of cold air that's been dropping into the northeast. it's going to continue to do that for the next couple of days. temperatures by day are going to be below average. we're not getting out of the 40's the next couple of days. a freeze is likely with low temperatures in the 20's in some spots both tonight and again tomorrow night into thursday morning. the cold here is on the way. we've actually got a freeze watch, freeze warning. i don't know why it's not showing up in the graph. you see those temperatures trending below average. average highs about 59.

north shore. boston 43. we've had wind overnight. the temperatures are not as cold as they could be. the skies are mainly clear. we'll see a lot of sunshine today. this wind is active all day long, very similar to yesterday, sustained 15, 20 miles per hour with some higher gusts, and that wind is tapping into the cold air sitting to our north and west. 43 in boston right now with that wind and very dry air in place. here you see the temperatures coming out of canada where they are quite to be tough to warm up. it's a breezy chilly day. a good amount of sunshine. skies are mainly clear. just a few clouds bubbling up this afternoon. so 43 the best in worcester. upper 40's boston. some lower 50's on the cape today. you can see how the skies stay mainly clear throughout the day and clear skies into tonight as well, and that is going to allow those temperatures to drop. there may be some cloudiness on the outermost cape. that's about it.

tonight. there you see those spots below freezing with 20's back into worcester county. tomorrow we're stuck in the 40's as well. high pressure is right on top of us. less wind overall tomorrow. then we're watching this next system coming from the west with a slug of moisture. as it approaches initially, it may be cold enough that we start in the afternoon with a little bit of a next going over to a cold rain. look at futurecast, no problems for your thursday morning commute. it's just going to be cold look at that. that is snow approaching the berkshires coming up on noontime on thursday. then if we can hang on to cold air, it will change to cold rain thursday night into friday morning before we dry out. we go from 80 last week to 40's and 50's. back in the 50's by the weekend. emily: then you said that four-letter s-word.

live look at the zakim bridge, southbound side heading to the bottom of the screen. let's check out the maps. not a whole lot 93 by the leverett connector, that project picking up as we speak. as you head south, route 3 looks good, 24 as well. no issues on 95. so far the pike looks good swell. 128 construction is clearing. then as you travel north of town, 93 quiet out of methuen down to the leverett connector where that road work is picking up. no issues on route trains and buses we're expecting them to start on schedule. emily: olessa, thank you. a devastating moment in boston here. this morning we're hearing from the man in this photo who tried to save two men trapped in a flooded trench. that picture taken by "the herald" in the south end friday as that man realized nothing could be done. you can see the anguish on steve smith's face, falling to his knees. he tells us he knew two men were trapped, water filling in over their heads.

emily: 4:54. breaking news. randy: a 16-year-old is now under arrest. jayden smith picked up last night in fall river where he's accused in the july shooting death of jerrod cohen. smith is one of two people charged with this murder. he was number one on the fall river most wanted list. police department there. recently added to the state police list. he's expected in court today. four people are dead after a theme park accident on australia's east coast. two men and two women died at dreamworld. it's unclear how the accident happened. investigators say it happened on or near a conveyor belt. that park has been closed for the day. randy: at least 59 police trainees are dead in pakistan after this training center was stormed.

mostly trainees and paramilitary troops. they were asleep when five to six gunmen bombarded this camp. some were taken hostage during the five-hour attack. emily: haiti on the brink of a food crisis on the brink of hurricane matthew. nearly 1.5 million people are in need of food assistance. 800,000 of them are in dire need of immediate aid. that october hurricane destroyed a massive amount of crops country's food supply. assistance programs in place just do not meet the current need. randy: a manhunt is underway in oklahoma for a suspect in a violent crime spree. police say michael vance shot two police officers, killed his aunt and uncle, stole their car. vance has live screened on facebook taunting law enforcement. he has a medical condition he

emily: students going to durfee high school will have to go through metal detectors after this student brought a bb gun to school. police put the school on lockdown and tracked down the student at his house. that 15-year-old was arrested. randy: breaking overnight, a tentative deal between harvard university and its dining hall employees. "the crimson" reports the re this morning. the strike called for higher wages and no changes to their health benefits package. a vote on the deal is scheduled for tomorrow. the employees could be returning to the dining halls by thursday of this week. emily: the world series kicks off tonight and there is a lot of interest. the cleveland indians, who have not won a world series title since 1948, and the chicago cubs, who haven't won it since 1908. game one, it is in cleveland tonight, and that is at 8:00. the governors, of course, making

a few clouds this afternoon. it is breezy once again. chilly once again. we still have a storm spinning to our north at the same time high pressure is nosing on in. in between those winds are going to be active once again. look at these highs. an average high is close to 60 in boston. upper 40's is what we're doing today, more typical of mid to late november instead of mid to late october. barely cracking 60 degrees in d.c. next storm the plains, that's going to make a run at us thursday. high pressure noses in tomorrow with a lot of sunshine but still chilly. here comes that next system loaded with moisture. and as it comes in initially, it may be just cold enough for a little bit of snow from the worcester hills westward. a little bit of a mix that will change to rain. a good soaking cold rain later thursday into friday. computer models indicating 1/2 inch to an inch of rain likely. we'll break it down right now as
