sergeant is dead and his partner wounded after being shot in the bronx. good evening, i'm ed harding. maria: i'm maria stephanos. investigators say the gunman was also killed in the gunfire. newscenter 5's ben simmoneau has the breaking details, ben? ben: the men were shot as they responded to a reported armed home invasion. as the police arrived, the suspect drove off but was tracked down a few blocks away. one sergeant approached the car and that is when we are told the suspect got out and began firing , killing sergeant paul tuzzollo, a 41-year-old married father of two. >> a man who committed his life to protecting all of us. ben the second sergeant

hit several times in the leg and is said to be in serious condition this evening. ed: breaking news involving a special forces soldier from new hampshire. staff sargent david whitcher was taking part in a diving drill off the coast of key west, florida when he was killed. whitcher was 30-years-old and a native of bradford, new hampshire. maria: breaking from new jersey, a suspect is in custody, after three people were stabbed at rutgers university. the school was on lockdown after the attack this afternoon at the university's business school. a rutgers spokesperson says 3 people including the suspect are being treated for their injuries. no word on how serious those injuries are. ed commitment 2016: the final : weekend before the election is here. both donald trump and hillary clinton making last-minute pitches focusing in on new hampshire. maria and here in massachusetts : thousands lined up as early voting comes to an end. we have team coverage for you tonight.

mary? mary: the final voters are trickling out of city hall but you saw that video earlier. what a success early voting was. it was like that, long lines all day, all week here at city hall. people wanted to vote before election day even if it meant standing in long lines because they could choose when they could fit that into their busy schedules. absolutely about convenience. i have lived in other states where you had early voting so it is great massachusetts had to -- did it this year. >> the differences people are voting. it was an impressive turnout. mary: over one million voted early. the secretary of state said in most cases in cities and towns

ed a falmouth man is facing : attempted murder charges after allegedly throwing heroin in the faces of two police officers. russell pena was arrested on drug charges this morning, and became combative when brought to the police station. the chief says he removed a bag believed to be heroin from his pants, tore it open an threw it -- and he threw it toward the officers' faces. tonight both officers are ok. pena was arraigned in falmouth district court and is being held on $25,000 cash bail. avoid 128 in needham this weekend. if you can. crews will be tearing down the rest of the old highland avenue bridge over the highway and there could be big delays. starting tonight at 8pm through 2pm tomorrow northbound drivers will get off at highland ave and be detoured back onto the highway. then from around 1 pm saturday until sunday afternoon, southbound drivers will have to face similar detours. highland ave itself will be completely closed over route 128. it's expected to be completed by monday

: devices, meant to monitor the state's environmental police while on the job are no longer in patrol trucks. that's raising more concerns, after our 5 month investigation which found some officers at home, but on the clock. here's kathy curran. kathy: environmental police officer pat robert loads up a handful of fishing poles and is finally ready to respond for duty after staying at home on the clock for the first six hours of his shift. it's a troubling pattern 5 investigates discovered in our undercover investigation. some environmental cops at home on the taxpayer's dime, their take home state trucks parked outside. others out on patrol but not doing much work at all. >> everybody does whatever they want to do. kathy: this person who's identity we're protecting is familiar with how the department works. >> there's no accountability.

each police truck was equipped with a gps tracking device called geotabs, which allowed supervisors to see where their officers trucks were at any given time. but last year, the agency decided to remove the gps devices from all its vehicles. i'm not sure why they would >>i'm not sure why they would install at taxpayer expense gps devices to these take-home vehicles and then deactivate them. i mean that's a solid management tool. kathy tom nolan is a criminal : justex boston police lieutenant. >> i would question what the reason was, what the justification was for deactivating those devices. kathy governor baker's former : campaign driver, james mcginn, is the man in charge. >> these to have gps and the trucks but that was taken out less summer. why was that taken out? >> he was taken out for cost-saving measure. we can't use those gps like, you're talking about ups, how

: investigates show the police officer's union filed a complaint with the state department of labor relations in 2013, just days after management first installed the gps devices. a year later the two sides signed an agreement which allowed the department to keep the monitoring devices in the trucks for fleet management, dispatching. and patrol analysis, but prohibited trolling or going on a fishing expedition in the gps database looking for violations. a spokesman for the department says last year the union again requested the removal of the gps system after mcginn had been appointed director and that request was approved. >> it was more of a hands-off approach where there was less accountability, less supervision. and you know what they say, when the cat's away the mice will play. kathy the department has a 10 : million dollar budget and the gps system wasn't breaking the bank. the costs for all the devices was $11,000 and then 2$700 each

and seeing the intent and this is incredibly important to analyze it quickly. mike: they have to be counted by hand. but not with clear ballot. what if you wrote in david ortiz? >> they can go through and give the votes to the right candidate and do a transparently and show the results at the end of the day that say david ortiz correctly got those votes. mike: the system has options for people with headphones for those who need from at the keypad with braille. >> it allows the voter to mark the ballot, a touch screen ballot. what it does is it prints out a paper ballot. a marked paper ballot. mike: six dates are using clear ballot to get the company is expecting federal certification and the next year, opening them up to bigger possibilities.

it will not be bright and sunny all day. on sunday, the wind becomes a little more north-northeast and the air mass will be chillier. after we see a day of mixture, sun and clouds on saturday, the slightest chance for spread through the morning but i doubt it. some clouds and sunday more so along the coastline for easter massachusetts and further inland. there is the chilly wind off the water. election day. it looks terrific. it looks a highs will be in the low 60's and parts of the area. with sunshine and dry air. nationally it looks pretty good. i do not see any egg storms across the country, a little moisture around the gulf of mexico. a reminder about this weekend. turn the book -- turn the clocks back one hour. the sunsets at 431 on sunday. tomorrow is the latest sunrise of the year.
