construction." mountain snow continues with an 8 day bitter blast. plus i'll show you what causes these mountain wave clouds. good evening i'm jean jadhon. continuing coverage now - of the ashley white trial in pulaski county. right now the court is about to wrap up day two of jury selection - a process that's taking much longer than expected. wdbj7's justin ward is live at the pulaski county courthouse to explain how that's altered the trial schedule. a jury was already supposed to be set at this time today. now the trial is expected to start tomorrow, that is if the lawyers can find a impartial jury. there are 24 people in the jury pool now. lawyers say the court could widen the pool 30 people which will then be narrowed to 12 jurors and two alternates. the commonwealth's attorney had no comment on the jury selection process. in court it seems all parties are annoyed with how slow the

ashley white is in the court room again today crying on several occasions when potential jurors brought up their interactions with noah. she was in tears when one man said his child played basketball with noah and talked to white during those games. he was put in the jury pool even though other potential jurors with similar stories of meeting the five year old were sent home. justin, are lawyers asking the same questions from yesterday, or have they changed? at least two questions that were confusing to the judge or the lawyers were changed today. one about a mother and father's roll in a child's upbringing was reworded after a lengthy debate. prosecutors also blamed her lawyer for asking too detailed follow up questions. the judge reminded them all to stick to the approved questions. next at six i'll

creasy got into a fight in the parking lot of martin's bar and then drove his car into one of the people he was fighting with. warrants say the group then pulled creasy out of his car and began fighting him again before he ran away. creasy's blood alcohol was nearly three times the legal limit. duke energy is being fined more than 7 million dollars. the department of environmental quality says the fine is for violations surrounding the coal ash spill at the company's dan river power plant in eden, north carolina 2 years ago. the agency says the civil penalties could be increased because this fine covers violations duke energy admitted when it pleaded guilty to federal pollution crimes nine months ago. the company previously agreed to pay 102 million dollars in fines and restitution. a follow up tonight: private animal shelters across the state will now see new regulations regarding adoption after it's third reading, the bill passed 53 to 45 today in the virginia general assembly.

firearm. but not everyone is on board. less than a month ago, governor mcauliffe and supporters of everytown for gun safety were standing together. but no longer. with the gun compromise headed for votes on the house floor, the gun control group backed by former new york mayor michael bloomberg purchased a full- page ad in the richmond times- dispatch. it carried the headline: terry mcauliffe is wrong, and it challenged the governor's claim that the compromise legislation will make virginia safer. three bills were up for debate today in the house of delegates. all passed withour debate. and the governor's supporters say they reflect a step forward that will make virginians safer. these are two significant pieces of legislation and i think when the dust settles even our critics will agree that this was a victory. sot that might be wishful thinking on secretary moran's part, but it does appear that the legislation is headed

the senate has already approved the compromise in a bipartisan vote, and a final vote in the house could come as early as tomorrow. joe dashiell wdbj7 the virginia senate has passed legislation which will require a judge's approval for 16- and 17-year-olds to get married. a republican senator from northern virginia says the legislation will help prevent young women from being taken advantage of. current law sets the minimum age to be married at 16, with the consent of a parent or guardian. democratic senator john edwards spoke against the bill, saying parents are in better positions than judges to decide if their children should get married before the age of 18. a disagreement over money is holding up construction of a new bedford county. architects have could cost more than county leaders aren't willing to spend that much. wdbj7's tim saunders is live in our lynchburg bedford newsroom. tim, what's being done to resolve the issue? jean, the school board is trying to cut costs but some

happening at the expense of quality. if current plans move forward, a new middle school will sit on this land off centerville road by 2018. sarah mayhew's children will attend the school and she doesn't want contractors to cut corners. sarah mayhew/parent: "we should be choosing materials that will last 50 or 100 years. not what looks nice or is the cheapest." mayhew is part of an advisory board that's planning for the new school, which will replace the current bedford middle school built in 19-28. a competition gym for liberty high school is also part of the project. contractors have indicated the cost will run between 45 and 51 million dollars, a figure that angers steve arrington. he was serving on the county board of supervisors last year when the group reached a consensus to spend no more than 38-million. steve arrington/former county supervisor: "the $38 million is a number we picked because it's a real number and a good number. the very fact that anyone would look to increase that (amount) just doesn't

school board chairman gary hostutler disagrees. gary hostutler/school board chairman: "we don't think that's feasible without making major cuts in the programs and the quality of the building, because of what the experts are telling us." hostutler says plans for the project are modest and cuts have already been made to the architect's original plan. gary hostutler/school board chairman: "we're trying not to build the school on the cheap, which would cause us to have long-term maintenance and other issues with the school." but arrington, a contractor by trade, holds firm to his position that a quality school can be built for 38 million. arrington: "we know that we can build the middle school for $30 million. we know that the competition gym will not exceed $5 million. that leaves us 3 million for contingencies and anything that we need." the board of supervisors will vote on a funding resolution at their next meeting. and jean based on a discussion that was held at a work session last night, it appears the board is ready to approve 44-million for the
