>> still a sink feeling, somebody has my phone. >> reporter: she got a new iphone and went on with her life until about 10 days when she got an e-mail from randall murray in lufkin, texas. after seeing this ad on ebay, randall bought the phone for $270. but when he got it, it was i cloud locked. it did have missy's e-mail on it. >> he lost his money, he can't use the phone, and he can't get a refund. >> reporter: randall told me he talked to ebay and infolder them the phone was lost and stolen only to be told by ebay saying the phone was locked. >> ebay tells me there wasn't anything they could do. >> reporter: i tracked down the supposed return address on the iphone package that was sent to randa. it's a house in maple heights. but no one answered. who knows if that's the real address of the seller. criminals have been known to

rice's death. last week the grand jury declined to indict the two police officers involved in the 12-year-old's death. only a judge can release the transcript but the naacp letter asks mcginty to join with them to make that request from a judge. cleveland police arrested three men in connection with a overnight. tonight investigators are connected. police say christopher freeman and gerald williams and another man drove a van aid. all three were captured after they took off from the scene. cuyahoga falls police are looking for this man caught on at gunpoint. it happened at that time seven monday morning. police say the man walked into the store, pointed a gun at the employee, then ordered them into a back ram and got cash. if you recognize this guy call cuyahoga falls police.

father will spend the next eight years behind bars for killing his three-month-old daughter. matthew scott was convicted of murder after his baby girl died of head injuries. scott has said he accidentally dropped the child and she hit her head on the floor. cleveland paramedics are take something else along on the job. they are now required to wear bulletproof vests on every call. the change just went into effect, and we wanted to know why. so derrick waller worked very hard today to find out. derrick, what did you learn? >> reporter: danita, our ems director tells us this is not in response to any specific threat but she says she's seen issues with ems workers getting hirnt other major cities so she wanted to take this precaution so that her employees that come out of fire stations like this remain say. nicole carlton said she reviewed her policy after seeing paramedics get hurt elsewhere including an incident in detroit. two paramedics were stabbed on

i spoke with carlton as 15 new paramedics were sworn in today. they will be required to wear those ballistic vests on every call. vests used to be only required on certain calls. a mother of one of those cadets tells me it's a sign of the times. >> it's just to save his life as well as anybody else's. it's a dangerous world out there and people are shot every day, innocent bystanders, little babies. so anything to protect his life, i'm all fort. >> reporter: according to a memo that we obtained this change actually took effect on december 21st, but the vests are still not required in every situation, like going to the hospital, court, or training. live in cleveland, derrick waller, newschannel5. jute could be a few more days before chester avenue in cleveland reopens to traffic. we just checked with the stey's water department, and crews are still working to repair a massive water main break under the road. chester remains closed between east 36th street and east 55th street.

court judge who was accused of retiring. the ohio supreme court agreed to dismiss complaints if angela stokes agreed to never run for reelection. governor john kasich will pick her replacement. a major blow to a popular mexican restaurant chain. chipotle is now facing criminal investigation fooling norovirus outbreak in california. and lee, the company received a subpoena from a federal grand jury? >> danita, chipotle is required to produce a broad range of documents related to a restaurant where nearly 200 customers contracted norovirus. chipotle released a statement saying it does not discuss pending litigation but the company intends to cooperate fully with the investigation. the number of people getting sick after eating at chipotle has been growing for months. a norovirus outbreak in boston last month sickened more than

least three northeast ohio chipotle restaurants have been linked to an e. coli outbreak. this isn't the only problem chipotle is dealing with. the mexican chain's stock fell to its lowest level in two years and is now down 40% in the last three months. a grocery klain is being sued for allegedly underfilling its cans of tuna. the class action complaint claims trader joe's 5-occupies tuna cans only contain three ounces of tuna. a government lab found nearly every can tested was underfilled. trader joe's which has locations in westlake has not commented. now to a news alert just in. macy's has announced it's closing 40 stores including two in northeast ohio. macy's at chapel hill mall in akron and in elyria.

we've got lower 30s cleveland, a southerly breeze on the light side at 7 miles per hour. a dew point at 18. so we're going to see temperatures falling back with those low dew points within about four or five degrees of the dew point. so we're talk probably low to mid-20s for most of you except right along the lakeshore for tomorrow morning. our high 39, five clicks above the average. 16 the morning start. that was cold. another night in the teens. tonight i think we will avoid teens, for a lot of you anyway. let's talk snowfall. take a look at these stats. so far for this snowfall season we've had 1.4 inches of snow in cleveland. that is 21 inches below normal. compare that through january 6th of last year and the year before. almost -- well, almost 22 inches of snow, and over 30 inches of snow back in the 2013-14 sea sown through january 6th.

this is a huge difference, thanks to el nio. remember during el nio winters, greater cleveland averages less than half of their normal snowfall. we might even set records for least amounts of snow. but we are going to get a little bit. now, not this stuff. it is sliding that way. we've got some moisture coming in from the south and west for friday. snow is going to stay to our north. this is where they're going get the snow. we're going to see the lows travel to our west. when that happens we're on the warm side of it. notice where the snow. we stay snow-free at least until late in the weekend. so rain for friday, rain for saturday, and then some scattered snow for sunday. 33 at 6:00, 31, 30, there's 29 right around midnight for greater cleveland. so a chilly night. lows near 26, a few clouds, dry and cold. tomorrow a little milder. 4 2, above normal by about eight degrees. cloud/sun mix, staying mild,

the browns interviews for the next head coach officially began today with what could be the top choice, adam gase. the browns wanted to hire him two years ago but he declined the interview to focus on the super bowl with the denver broncos. he is in demand. he interviewed with the eagles and is expected to meet with the team this weekend and is scheduled to interview with the giants and dolphins. now the team is also scheduled to interview lyons defensive coordinator charles lawson. that was set up for today. austin is also in line for
