to bring marijuana to our state and lawmakers are only backing one of them. anxious moments for some hi schools including many here in northeast ohio after four month delay district received the annual report card and several top performing schools did not perform well. >> some superintendents intend to appeal because of the unclear reflections on the students. and meggen hickey joins us live. she investigated a complaint in menner. what are they telling you? >> reporter: a spokesman says they acknowledged that some of the numbers could be wrong but they are going off the data that schools report themselves. beach wood and menner have a serious problem and the department of education's most recent report card and according to doe data so do nearly 80 other schools. >> that is a lot of appeals.

district act school data is wrong. >> i think our community knows when they see zero percent of our kids scored without remediation that is not true. >> there is an appeal and the department of education says the corrected numbers did not come out in time for the first round report cards out this week. >> for those that wanted to appeal they are appealing their data. so it was possible to appeal if you wanted to appeal that information. >> reporter: but here is the problem. the appeals window is closed which means it is too late for beach wood city schools. in a letter to parents harden says the test data was quote wiley off base. the report shows not a single student took the test. in reality, he says students took more than 450 tests this may and more than 350 passed to receive college credit. the board of education says that many schools did file

be reflected in the final report card that came out on january 25th. meggen hickey, newschannel 5. the head of the state school board suggested there may be too many cooks in the kitchen deciding education policy in ohio. those in charge of the policy include the governor, legislature and state school board. now the board president wants to see fewer seats on the board. and and a second board to handle the policy. if you have been to the airport you have noticed the construction zones have shifted again and there is more changes on the way. we are live inside the airport. derrick. what is new? >> reporter: i just learned that one of the most congested parts of the airport is about to open up to passengers on monday. right down here, that area that's blocked off right now near the main bank here is going to open on monday.

locked up on 5 million-dollar bond. he is facing charges including aggravated burglary and assaulting or harassing a police dog. he answered to a judge for the first day sitting feet away from another police canine after spending a week in the hospital. police say canine jethro and his handler with responding to an alarm when the man shot the dog to death. he was later shot in the leg and due back in court in a week. bond set at one hundred thousand dollars for the man accused of pistol whipping a priest in little italy. the man is charged with several felonies. in court phillips waved his right to a preliminary hearing and his case was bound over to a grand jury. the group pushing the fresh start act is backing off. it called for reviewing sentences and expunging criminal records of those with marijuana convictions if the

considered illegal but responsible ohio decided to have the proposed law dropped and won't try to get it before voters after issue three was rejected in november. but none is stopping ohioans to end prohibition for a legalization effort on the ballot and won't wait for legalizing medical cannabis and wants to bring that to ohio. in the meantime in france the health minister says a medication that left one man brain dead during a clinical trial was not based on cannabis as some reports claim. the experimental painkiller left another three volunteers facing possible permanent brain damage and two others hospitalized. right now there is no known treatment for the experimental drug being tested and based on a national brain compound similar to the active ingredient in marijuana. well, happy friday. the weekend is here and what is up in weather department?

happens. number four, nanny or caregiver scam. the so-called client asks for a check to be deposited and you send money to landlord. advertisement. asked to provide money up front before the ad can be placed but it is all a scam. so here are signs of a scam. interviews conducted online or through instant messengers. recruiting claim to be working for a big company. if it seems to be too good to be true it probably isn't. now on five, the largest retailer in the country about to put thousands of people out of work. today walmart announced it is closing 269 stores around the world. the first year ever with the mass closing like this.

northeast ohio as walmart bedford location. some 16,000 employees will lose their jobs when the stores shut down. ten thousand of those workers are in the united states. walmart says more than 95% of the stores closing are in this country within ten minutes of another walmart. and it will try to relocate workers. police found a handicapped assessable van that was stolen from a shaker heights man before christmas. a story that we brought you last month. michael durbin lives with ms and the van was the only way he could get around. thieves made off with it after stealing other things from his home. christmas day we told but a couple that donated their handicapped assessable van to the durbins and now police found his original van. no word on any suspects. the u.s. air force museum in dayton is getting a m

but to others the laughter of others in a disturbance worth suing over. that's the sound that one texas mother said led her next door neighbors to file a lawsuit against her. her four kids ages 2, 4, 7 and 11 are home schooled and they all enjoy spending time outside in their playhouse but their neighbors don't enjoy that. saying it affects their tranquil life. >> i can't imagine kids playing at any stage in my life and thinking that i needed to sue someone. >> it happened and the mom says the neighbors are not quiet and they blast the loud music with swear words.
