children is in the navy deployed overseas. the trooper was rushed to metro health hospital. this is a live look at the line of state highway patrol cars outside the hospital. friends and colleagues coming to mourn their fallen brother. >> right now the investigation into trooper velez's death has the westbound lanes of i-90 shut down with the evening rush being rerouted. we'll have a traffic report for you in just a moment. first we begin with derick waller live on the scene of that crash. derick what have you learned tonight? >> reporter: a terrible tragedy here. i-90 westbound still closed at alger road. earlier we had that black hyundai on the road. that's the car that hit trooper velez. we actually have video of that

at first he was given a field sobriety test by troopers before he was handcuffed and taken away. so they do have someone arrested, somebody in custody for this. but again a state trooper based in cleveland was pulling somebody over, got out of his cruiser when he was hit and killed. a very tragic situation that has i-90 westbound near the cleveland lakewood border closed. it is closed for several miles. traffic is backed up. we have a lot of traffic that is actuly heights boulevard as an alternate. obviously an area that you are going to want to avoid this afternoon. that's the latest from cleveland. derick waller, newschannel5. >> we want to take you to cleveland's air tracker 5 for a look at how this tragedy is tieing up traffic right now. john, tell us what you are seeing. >> reporter: well, frank, you are looking at the ramp from -- to go to 90 westbound just coming across the bridge.

it is causing traffic to backup well past dead man's curve, stretching to about east 55th street. it is moving a little bit but the de tore is going to take you to 71 southbound to i-480 westbound. we just mentioned 7 1, another crash happening in that area has lanes shut down on i-71 northbound. we're told two people were injured on i-71 northbound. you can see a our oh dot our -- a live look from our odot cameras. two people injured in that crash. we're seeing heavy backups on 90, on 490, and on 7 1. 90 closed because of that accident. if you are able to get on 90 after 490 you are going to be diverted off at west 117th street.

to thin out. we also do want to point out we are seeing delays on the shoreway as well. frank, we will keep you updated. for now back to the studio. more breaking news now. an accused serial killer charged with murder. >> we broke the news this afternoon moments after charges were filed against shawn grate. >> reporter: he had a bond hearing that was scheduled for less than 15 but just minutes ago it was postponed until 3:00 tomorrow at the request of the prosecutor. the hearing will take place tomorrow via skype. here is what else we learned today about the charges that were filed against the suspect. just a couple of hours ago prosecutors filed two counts of murder and one count of kidnapping against grate in connection with the horrific crime scene in ashland tuesday morning. the woman who survived and bravely called in a hushed

activity. one of the murder victims was stacey stan sel, a 43-year-old mother who had been missing for days. the second woman found in that home has not been identified and is referred to as a jane doe. many fear it could be another ashland woman who went missing awhile back. on top of that sources say grate led them to a third body, a woman whose remains were found in a wooded area. at the house where grate was living flowers and stuffed it was very emotional for one visitor because her mother was murdered 20 years ago. >> you know, it touches me a lot. i know how it feels. when i found out about it, i was like, oh my gosh, small town ashland. a horrible story. but i just definitely know how it feels, and it hurts. >> reporter: the hearing has

we will carry that live on our newsnet5 app. live in ashland tonight bob jones, newschannel5. tonight new information is emerging about a teen shot and killed by police in columbus in a case reminiscent of tamir rice. the 13-year-old was carrying a realistic looking bb gun at the time. here is what else we know. the shooting happened overnight as police were investigating an armed robbery. they approached a group of three people and two of them ran. that is 13-year-old king pulled a bb gun from his waistband. police say officers thought it was a real gun and opened fire. >> in addition to this appearance, it also had a laser light attached to the right underneath the barrel. our officers carry a gun that looks practically identical to this weapon. >> the officer who shot king is

searching for one of the three sins this case. and today construction crews continue to dismantle the gazebo where 12-year-old tamir rice was shot and killed. his family wanted the gazebo taken down. the family originally wanted it to be demolished but then realized its historical significance. we reached out to the museum learn their plans for the gazebo. they haven't responded to our request. a new poll shows donald trump and hillary clinton are tied nationally. >> the poll found the two locked at 42% among likely voters. >> the candidates set out today with clear messages in mind. hillary clinton's message, i'm back. the democratic presidential candidate returned to the trail

considering voting for hillary clinton. he is catching on. this tells us a lot about, if it doesn't change where this state may go in november. >> chelsea clinton was outside of columbus today. elizabeth warren and bernie sanders will both be in ohio campaigning for clinton this weekend. the cleveland planning commission is getting a look at a new apartment building for the heart of downtown. today committee talked about what will be known as the beacon. that is going to be at 515 euclid avenue. the 19-story building will rise above the existing 10-story parking garage on the site and will feature 200 luxury apartments. how about that. stark enterprises is leading the development, and that will also include 8,000 feet of retail space, lee. greeting our schools. new today the report cards for

the state department of education he all of waits schools and districts in 16 different categories. i looked at the grades for all of them. i can tell you it is not good news for cleveland. the cleveland municipal schools received straight f's across the board. the only other ohio district to get all f's is warrenfield heights schools. here is how five of the largest districts performed. in two of the categories, the performance index is a composite of indicate overall test performance. an f for cleveland, d's for parma, akron, and canton, and a c for willoughby-east lake schools. grades for four-year graduation rates, f for cleveland, akron, and canton. c for parma. grades across the state dropped again this year as schools are adjusting to higher test score

got an a on the performance index. one of those, solon city schools. in november voters in cleveland will be asked to renew a tax increase passed in 2012. a sell made more difficult now because of this report card. medical marijuana may be legal in advocates raised concerns about the delay in drafting rules for prescribing medical pot. ohio's medical board met for the first time this week after the law took effect to try and figure out how doctors can recommend medical marijuana to patients. now, the board has until september of next year to come one rules for doctors. but ohioans for medical marijuana says that's just too long. well, there have been a lot of conspiracy theories about hillary clinton's health. >> especially since she

that interchange with 77. i will zoom in quickly here. along 90 you can see slow traffic as well on 77 after you get off of 90. there is another accidents on 71 northbound that has traffic backed up, and in that area we're told two people were injured that in crash. odot is saying if you are coming north on 71 before you get to 480 you are going to want to take 480 eastbound to we will continue to keep you updated on these incidents. heavy, heavy traffic. we will continue to keep you updated from air tracker 5. today marks one year since a tragedy that shook our community. >> a three-year-old boy was shot to death in a drive-by. little major howard died last

car. after that shooting there was a manhunt for this man right here. after eight months of searching lindsay was arrested in georgia. he has pleaded not guilty in this particular case j. a man wanted for murdering two people arrested in michigan. police here in cleveland have been looking for james johnson since an armed robbery inside the archer on west 9th street left two people dead in january. johnson muskegon. he is being held on $20,000 bond awaiting extradition back to ohio. today the family of sandra bland settled its wrongful death lawsuit with a texas police department accepting $1.9 million. a texas officer arrested bland last year during a traffic stop that was recorded on dash cam in waller county. she was stopped for changing lanes without a signal, ordered out of the car and forced to

cell. the bland family attorney announced several changes will also be made to waller county jail procedure including having a 24-hour nurse on staff. a news alert now on 5. we just learned that the consumer product safety commission has officially recalled the samsung galaxy note 7. >> this comes after several reports that a battery defect has caused the smartphones to explode, and there's more problems. >> reporter: a major announcement from samsung about the dwal lacks' note 7. an official recall -- about the galaxy note 7. an official recall. >> because this product presents such a serious fire hazard i am urging all consumers, all consumers, to take advantage of this recall right away. >> reporter: but just today new problems surfacing for the company. this smoky scene in a cafe from

overheating and exploding according to its owner. an arizona state university student also claiming he heard siflg and smelled burning only to discover it was the samsung phone in his pocket. >> i thought it was my computer at first but then a second after, it just like -- the intense burning sensation kind of hit my thigh. >> reporter: these are not the galaxy note 7 which we have seen explode in dozens of instances blamed on the battery. these new reports involve other models like the galaxy s-6 and s-7. the consumer product safety commission says it is looking into those incidents. does the company have a broader battery problem? samsung says no. a spokesperson telling abc recent reports suggesting that samsung's battery issue goes beyond the galaxy note 7 are not true, the problem is isolated to one battery manufacturer for one specific model. people with the recalled galaxy

back with new video of a frantic race body cam footage captured the action as first responders rescued a man. a truck collided with a school bus and burst into flames. the driver pinned, first responders tried to put out the flames with a fire extinguisher. that did not work so three bystanders grabbed a chain from their car, latching it onto the

we continue to follow breaking news tonight at 5:00. a state trooper hit and killed during traffic enforcement on the interstate. fellow law enforcement officers across the state now in mourning. and right now drivers in cleveland still sitting in traffic this afternoon. >> i-90 westbound near warren road you see right there still shut down while police continue to investigate that crash that took trooper kenneth velez's life. derick wall ser live on 5 near the scene of that crash with an update. >> reporter: i can till now there are actually -- they are actually about to reopen this road, according to a lakewood police officer who just told me they are going to do what's called a slow roll where they kind of have officers on motorcycles slowly guide the traffic so that this road does remain -- does get back up and

almost cleaned up this scene where a state trooper was hit and killed during a traffic stop. kenneth velez leaves behind three kids. an awful situation. we have video now of actually a man that police took into custody. they were giving him a field sobriety test before they then put him in handcuffs and took him away. he was driving a black hyundai hatchback which we saw on the side of the road for several hours. they have now cleaned up this road. the breaking news now is that within the next few minutes, hopefully good news for people trying to get home this evening. that's the latest from cleveland, derick waller, newschannel5. more breaking news as interstate 71 also shut down in the northbound lanes near west 150th street. you can see that side of the interstate totally clear with traffic only headed in one direction. two people were hurt in that crash and taken to metro health. we will continue to keep an eye

you. looking ahead now at 5:00 it's a day drivers in our western suburbs have looked forward to for years. later this month the brand-new interbelt bridge will open. >> there will be a ribbon cutting next week butt could take six weeks to notice a big difference. paul kiska is live on the highway. paul, you spoke with odot about what drivers need to know about this new bridge. what's up? >> reporter: well, that's right, frank bridge opens to the public, opens to traffic, but there's still a lot of work to be done. highway closed. detour signs. orange barrels. all a hassle curing the six years it has taken to build a new interbelt bridge. soon it will all be worth it when the entire bridge opens to five lanes in each direction. but not all the lanes will open during next weekend's grand

warren road. all the westbound lanes were shut down for several hours while that crash was being investigated. we will of course have the latest for you next at 6:00. meantime the father stands accused of intentionally killing his child by leaving him in a hot car. >> attorneys are going through the jury selection process for the second time and finding it very difficult impartial jurors. here is abc's amy robach. >> reporter: children being left in hot cars. five-year-old boy found dead inside a hot car. it is the heartbreaking case splashed across national headlines. justin ross harris charged with murdering his 22-month-old son cooper in 2014 accused of intentionally leaving him in a hot car. a judge ruled that jurors from

biased and agreed to move the trial 300 miles away to the other end of the state. >> to say that the juror questionnaires show a pervasive knowledge and extreme opinions that are negative to the defendant is frankly an understatement. >> now this morning for a second time the process of finding 12 iment par sholl jurors who haven't already formed an opinion on this high- profile case is underway. today lawyers are closely questioning three panels of 36 potential jurors asking them case. social media habits, and even if they're familiar with the hyundai tucson, the type of suv harris owned when his son died inside it. the 35-year-old pleaded not guilty saying this is a tragic accident. witnesses say he seemed genuinely upset when he discovered the child. >> he kept saying what have i done, what have i done. >> his ex-wife who filed for divorce says harris is not a

yesterday because some stupid idiot decided to sell drugs, run from the police, and throw them. >> this whole heroin problem around here is ridiculous. >> luckily charlie survived but police say the suspect was selling drugs when they spotted him. and get this. they say he even tried to swallow five bag geese himself. lawmakers are nearing a compromise on a piece of legislation that will help fight the zika virus and keep the down. republicans now suggesting they would allow that zika fighting money to go to planned parenthood clinics. an earlier version was blocked by senate democrats because it made sure planned parenthood wouldn't receive any funding. republicans traditionally disapprove of the nonprofit because some of its clinics offer abortions. you think you can couldn't like this for awhile? >> maybe one more day.

degrees. hour by hour, we'll lose the sunshine in the 7:00 hour. you are going to start feeling the 60s. starry overnight. i do think akron-canton, will you drop to 56 while cleveland will stay at sick. for tomorrow the 80s are back. all right, before you think friday is wet, it is not. we start to see rainfall moving in from the west, headed east. does it not a complete washout. i do think morning, noon, afternoon, evening, we're going to see those showers and thunderstorms come in and out. new philadelphia, around 5:00. again, this is an estimate we're a little bit out. most of that rainfall will start to shift south and east so hopefully game time no issues. tailgaters, i do think you are going to get wet off the top. about an inch on average but

and within the last 20 minutes that road reopened. >> derick wall hear been following this story all afternoon. derick, what are you learning about trooper velez and how he died? >> reporter: a tragic situation right now. as you mentioned i-90 westbound near the cleveland lakewood border is back open, traffic flowing very nicely. but this is obviously a horrible afternoon for the law enforcement community. trooper kenneth velez, a trooper based in cleveland died after he stopped someone in traffic on i-90 and then him with their car. he leaves behind three children one of whom is in the navy. we have video from that scene of a man who was being given a field sobriety test before he was arrested and taken away in handcuffs. we have not identified him yet so that's why we chose to blur his face. but somebody is in custody accused of hitting and killing state trooper kenneth velez on i-90 westbound near the cleveland/lakewood border this
