8:00 and 7:00, there's more to come for the overnight. we've got mid-60s over new philly. a lot of 50s out there well. notice the temps just hover. we've got rain and rain and rain on and off through the entire overnight tonight. john rutter out in storm tracker 5 right now trying to navigate these wet roads. john? >> reporter: a little bit about five minutes since we last touched base and things have gotten better. take a look. not as much visibility and not as much water splashing up on the roadway. as you look on the radar, it may be short lived. you can see another band of wet weather that's approaching in a lull between akron and canton right now. it's still pretty gray out there so there could be issues

yourself plenty of time to do plenty of follow-up space and the roads may still be wet even though it may not look that way. we'll of course keep you up to date on what we see here. for now, we'll see things back inside. the contractor responsible for this ditch right here that swallowed several cars in cleveland on tuesday is speaking out. multiple cars drove right into the hole and a video captured a man wearing their uniform buying beer oth >> nobody answered my complaints, and as a result, we had all of the accidents that we had. >> reporter: multiple cars drove right into this construction ditch outside of this convenience store and bait shop on west 130th in cleveland. it's part of a big repaving project. >> nothing wasn't blocked, so i tried going in there, and i ended up in a ditch. >> reporter: one day after, the construction ceo wrote this

on the drivers saying "we installed drums pursuant to all applicable laws and regulations adding to the extent that a driver was not paying attention is unfortunate, however, it was not the result of any ill legality or failure by our company. ." >> what i thought was total bull. it's as simple as taping off an area to avoid an accident, which they knew of before any ac >> reporter: chief engineer mike told me pork is right but added this. >> it is the contractor's responsibility if there was a damage or claim to investigate that. >> reporter: meanwhile, diam shared video that shows one of the employees buying beer at lunchtime. in the statement, he says that man is an 89-year-old family member who just likes to visit. they say the beer he was seen stashing in his work vest was for dinner. diam doesn't buy that, either.

so he wasn't living on minimum wage, but he was working against the interests of ohio. the senator said that i made $400,000. oh, senator, that's a big whopper. i've never made $400,000 in my life. >> okay, here's what we found when we looked into strickland's earnings. after losing re-election, strickland began working for the center for american $200,000 between april 2014 and march 2015. so how did portman come up with that $400,000 figure? well, we looked at all of strickland's income and found strickland headed up a political action fund for that think tank. it listed strickland's other compensation as $13,623,000 for the nine months of 2013. if you do the math, that brings his compensation for . whole

then he disclosed $20,000 in earnings from the bipartisan policy center. he was also paid $25,000 for working as a mediator with a law firm. strickland also collected $36,700 from his state retirement and $25,500 from an i.r.a., plus he's eligible for a congressional pension, which we estimate to be about $33,000 a year. now, all of $357, 489. strickland -- $357,489. if you subtract that total, he earned $295,000. so as a result, we rank portman's statement as half true. we're also looking into statements made by ted strickland. i'm going to break that down in the next half hour.

in wayne county tonight, investigators are handling a horrible accident on a family farm that killed a 32-year-old father. >> the man fell down a silo chute and became trapped. dozens of firefighters tried to save the man during a complicated rescue attempt. >> reporter: the call for help came around 9:45 this morning from this farm in worcester township. what followed was an hour long rescue attempt inside chute. unfortunately, it all ended tragically. investigators estimate this corn silo was about 80 feet high and red acker was doing work on it. he climbed a ladder halfway up when he suddenly fell backwards down a tight silo chute. >> apparently while the man was servicing the silo, he slipped and fell and became wedged, essentially, face up, feet up, and could not free himself. >> reporter: captain doug hunter says the man's father

40 firefighters, including a confined spaces team rushed to the farm. they quickly realized it would be a complicated operation that lasted about an hour. >> it is a very constricted space. first of all, we had an individual go up below the trapped person, and we established contact with him. >> reporter: . worcester township fire chief shook explained the plan was to get a harness around him. during that time, the chute. >> we were able to get him out at that point. we attempted resuscitative measures but they were unsuccessful. >> reporter: tonight, reese cue crews say their thoughts are with his wife and baby daughter. >> it took its toll on several firefighters that were involved in what they hope to be a rescue. >> reporter: in worcester, bob jones, news 5. we continue to follow developments out of louisville,

in a school bus crash. authorities say just after 8:00 this morning, the driver of that suv you see right there did not realize that a school bus had come to a stop ahead of him. the suv veered to the right and up on a sidewalk where the vehicle struck the kids. neighbors scrambled to get everybody from under that suv. >> i saw this little girl was up under the car, so it was about seven or eight of us, i don't know how many the car up. so when we got it up high enough, the police pulled the kid from under the car. boy, i was so thankful that we could get her out. >> those kids were rushed to local hospitals. at last check, two were listed in critical condition, another in serious. the driver is also in the hospital in serious condition. investigators say that driver could be cited for driving without insurance and

injured. rob, a heartbreaking story. a man accused of killing a woman during a road rage incident was this court today. witnesses say they saw christopher taylor tailing whitney gray's car. they say he pulled out a gun and shot the mother who was driving with her 6-month-old and 3-year-old sons in the backseat. >> mortally wounded, controlled the vehicle with her babies on it, got out on her own two feet shot >> the woman pulled her van onto a nearby yard. he still can't see how she managed to make sure her family was safe. taylor was later arrested in south dakota charged with second-degree murder. >> awful story. thousands of people in indiana still without power right now after a serious overnight storm. strong winds, even golf ball sized hail swept through parts of indiana. even parts of northern

breaking right now in the newsroom, the akron man who stabbed a humane society officer earlier this year was just sentenced to six years in prison. the summit county prosecutor's office found that the shooting of mccullen webb by akron police was also justified. webb beat and stabbed officer tim harlin in march while he

there may be more issues for the donald j. trump foundation. >> scripps senior national investigative correspondent discovers how it donated hundreds of thousands in grants that experts say are breaking

>> that's why. see, i understand the tax code better than anybody that's ever run for president. >> reporter: donald trump bragged about his knowledge of tax rules, but we found the donald j. trump foundation run by trump and his family may have repeatedly violated the tax rules for charitable giving. >> i think that's clear. >> reporter: david says, the problem accordg feeling, trump's first foundation contributed to private charities and other private foundations, something the irs strictly forbids unless trump's foundation provides the irs with proof that the money was used for charity. >> it can keep on going to any number of private foundations and never help charity out at all. >> reporter: we reviewed ten years of the foundation's latest publicly available tax returns. our investigation uncovered nearly half a million dollars in contributions to other

required proof of how the money was used. there's a $100,000 grant to the ruben museum of art. a $107,000 gift to the gucci foundation and $158,000 to the martin greenburg foundation. we saw eight separate ones since 2007 totaling $75,000. >> my conclusion is that those were taxable expenditures. >> reporter: marco is a dc- based tax attorney previously lead the irs on exempt organizations. he says a violation could cost the donald j. trump foundation big, potentially leading to a 20% penalty for each contribution. >> those returns show an absent of attention to detail and ignorance of the law, disregard of the law and a pattern over the course of years. >> reporter: when asked for an explanation about potential violations with irs rules. trump's campaign says the
