2:41 am
and my grandfather kept the two l's. - got it. and did you know that you two were namesakes? erica, erica, or? - yes, i knew from her grandmother. me and her grandmother are really close. - okay, alright, so then tell me ms. phillips, what happened, why are you here suing your cousin today for over $3700? - my cousin here erica, i didn't really know about her until recently. in houston, texas with my boyfriend. things were really good until i actually had gotten pregnant. my boyfriend at the time did not want me to keep the baby. i told him i was going to keep the baby so he actually, he left. i couldn't afford the apartment that we were living in, i couldn't afford to stay in houston, texas in general. i'm not particularly close to like some of my family except for my grandmother

2:46 am
you're watching justice for all with judge cristina perez. justice for all with judge cristina perez is back with the case of erica phillips, she's suing the defendant for $3770, 20 cents. - so then what happened then erica, because you are here suing her exactly for $3770, 20 cents. - four months in things started going south. she started asking for more and more money.
2:47 am
but i still only have so much money. - and who took care of the baby? - so she was taking care of the baby. - was that okay? while she was working you were taking care of the baby? - yes, i didn't mind taking care of the baby while she was working. - but she wanted me to pay her bills essentially. and i was, i was paying her $200, she asked for more, she said she'd contribute more 'cause i'm working more. i was happy to do it, it's fine. - how much did you end up contributing? - it started with 200 but then it start being more like i would never take her whole paycheck. - what was the max she gave you a month, erica? - one time she gave me $400. but for the most part maybe $350. - okay, alright, so what happened then? - i started wanting to be more independent so i moved out. - how did you feel when she moved out? - she conveniently moved out once my daughters money came up missing. $1,000. - what do you mean, your daughters came up, explain that to me. - my daughter graduated from high school
2:48 am
family and friends and we, i put in $250 of my own money and it was about $1,000 and erica conventionally moved out once the money came up missing. - your honor, this is ridiculous. - okay so then you're saying that erica stole $1,000? - yes your honor. - did you have any proof? - there was only me and erica and my daughter in the home. - what did your daughter say happened to the money? - my daughter thought that i had put the money in the bank. - it was cash, yes. - and what did your daughter do with it? - my daughter didn't even know how much money was in the cards. - so where, so all the cards mysteriously were gone? - the cards were there but the money was gone. and erica knows that she took that money. - alright so then you moved out and. - that which leads me to a year later with my roommate.
2:49 am
i'm putting it in my name. so i called the cable company and they let me know that i already have an outstanding balance and if i want to get a new account, i need to take care of that balance before it transfers. they tell me that the address to this account is to an erica phillips and the old place that i was living in. - [cristina] did you open an account when you were living with your cousin? - never had an account, never had credit. never had anything. so i, i tell them that it might be a mistake so i give them my social security number and they tell me that my account number with my social security is linked to this outstanding balance. which made me realize that erica, my cousin erica, used my social security and ran up my credit and essentially stole from me. - okay so then how much was that bill? - i have it right here your honor. - any other bills? - i have the bills
2:50 am
- from everything that she. - so you have that outstanding bill from the. - from the cable company. - okay and what else? - i also have another bill from an electronic store in which erica purchased a tv, was about $900. and then i also have a credit card that she opened up in my name. that's about 2,200. - did you open these accounts? - yeah, she did. - erica owed me money. - [christina] it's a yes or no, it's a yes or no question. - she did. - yes. - did you use her social security number? - yes. - why? - well when she started working more hours your honor, i did ask her to pay money. - and she contributed 350 to $400 a month. - not all the time. - [narrator] judge perez's verdict when justice for all returns.
2:51 am
2:52 am
- no, she hasn't. - no. - how long has it been? - some of those bills have been passed 90 days, like three months. you're gonna have to file a police report and make them understand this was not you. so they understand that there was fraud committed and somebody used your social security number. but you're gonna have to do something about it, you know, at this point family bonds didn't matter to her, they shouldn't matter to you. so i will grant the plaintiff's claim in $3720.
